Most people who write about punishment ask, Why may we punish the guilty? I want to ask, Why should the guilty put up with it? or, more specifically, To what extent does a person guilty of an offense have a duty to submit to punishment? ;This question forms the topic of the thesis. The work is divided into two parts, of three chapters each. In Part 1, I argue for the importance of the question. In Part 2, I try to (...) answer the question. ;In Chapter 1, I argue for the claim that the question of submission to punishment is in fact the central question of the theory of punishment. This being conceded, I argue in chapters 2 and 3 that we must consequently change our conception of punishment. We cannot define 'punishment' in the traditional way, as necessarily involving pain, suffering, or other sorts of disvalue ; rather, 'punishment' is to be defined by the justificatory connection between punishment and offense . ;In Chapter 4, I develop what I call the rectificatory theory of punishment. This theory views some punishments as required in order to maintain the equality of basic liberties: people who commit certain offenses thereby arrogate excess basic liberties, and must by way of punishment give up an equivalent body of liberties. In Chapter 5, I incorporate the rectificatory theory into a more general theory of punishment, a theory derived from John Rawls's version of the social contract. I argue there that punishment derives from the social contract in three distinct ways: by literal application, by reinterpretation, and by repudiation. Finally, in Chapter 6, I argue that this theory of punishment requires us to look at the contract in a certain way: the contract establishes a relationship of fraternity among the parties, not merely as a pleasant after-effect, but as something essential to the contract. Are the divine attributes intrinsic or relational properties of God? That is, can we ascribe the attributes to God, without relation to the things which God produces;or can we ascribe them to God only in relation to those things? In discussing the various aspects of this very old question, I argue that both views find strong support in the Ethics and other works. Spinoza’s “pantheism” removes the apparent contradiction between the two conceptions.

Matthew Adler's Measuring Social Welfare is an introduction to the social welfare function (SWF) methodology. This essay questions some ideas at the core of the SWF methodology having to do with the relation between the SWF and the measure of well-being. The facts about individual well-being do not single out a particular scale on which well-being must be measured. As with physical quantities, there are multiple scales that can be used to represent the same information about well-being; no one (...) scale is special. Like physical laws, the SWF and its ranking of distributions cannot depend on exactly which of these scales we use. Adler and other theorists in the SWF tradition have used this idea to derive highly restrictive constraints on the shape of the SWF. These constraints rule out seemingly plausible views about distributive justice and population ethics. I argue, however, that these constraints stem from a simple but instructive mistake. The SWF should not be applied to vectors of numbers such as 1 and 2, but rather to vectors of dimensioned quantities such as 1 util and 2 utils. This seemingly pedantic suggestion turns out to have far-reaching consequences. Unlike the orthodox SWF approach, treating welfare levels as dimensioned quantities lets us distinguish between real changes in well-being and mere changes in the unit of measurement. It does this without making the SWF depend on the scale on which welfare is measured, and in a way that avoids the restrictive constraints on the shape of the SWF. (shrink)

Should we remain neutral between our interests and those of future generations? Or are we ethically permitted or even required to depart from neutrality and engage in some measure of intergenerational discounting? This Article addresses the problem of intergenerational discounting by drawing on two different intellectual traditions: the social welfare function (“SWF”) tradition in welfare economics, and scholarship on “prioritarianism” in moral philosophy. Unlike utilitarians, prioritarians are sensitive to the distribution of well-being. They give greater weight to well-being changes affecting (...) worse-off individuals. Prioritarianism can be captured, formally, through an SWF which sums a concave transformation of individual utility, rather than simply summing unweighted utilities in utilitarian fashion. The Article considers the appropriate structure of a prioritarian SWF in intergenerational cases. The simplest case involves a fixed and finite intertemporal population. In that case, I argue, policymakers can and should maintain full neutrality between present and future generations. No discount factor should be attached to the utility of future individuals. Neutrality becomes trickier when we depart from this simple case, meaning: (1) “non-identity” problems, where current choices change the identity of future individuals; (2) population-size variation, where current choices affect not merely the identity of future individuals, but the size of the world’s future population (this case raises the specter of what Derek Parfit terms “the repugnant conclusion,” i.e., that dramatic reductions in the average level of individual well-being might be compensated for by increases in population size); or (3) an infinite population. The Article grapples with the difficult question of outfitting a prioritarian SWF to handle non-identity problems, population-size variation, and infinite populations. It tentatively suggests that a measure of neutrality can be maintained even in these cases. (shrink)

The ongoing COVID-19 pandemic has taken a significant toll on mental health; people around the world are experiencing high levels of stress and deteriorated wellbeing. The past research shows that positive emotions can help people cultivate a resilient mindset; however, the reality created by the global crisis itself limits the opportunities for experiencing positive emotions. Thus, it is unclear to what extent their effect is strong enough to counter the psychological impact of the current pandemic. Here, the author reports the (...) findings of a survey conducted across two large representative samples in the United Kingdom and the United States during the first wave of the COVID-19 pandemic. A linear regression model revealed that the presence of positive emotions is strongly linked with resilience, in particular for individuals experiencing more negative emotions. These results show that positive emotions are particularly important to mental health in the context of high stress, reflected by increased levels of negative emotional experiences. These results are also consistent with the existential positive psychology perspective, which posits that even negative emotions can contribute to wellbeing once they are transformed. The author discusses the potential of positive emotions to transform suffering and thereby ameliorate the negative impact of the present collective crisis. (shrink)

Everywhere in the world, and in every period of human history, it has been common for energy decisions to be made in an ethically haphazard manner. With growing population pressure and increasing demand for energy, this approach is no longer viable. We believe that decision makers must include ethical considerations in energy decisions more routinely and systematically. To this end, we propose an applied ethics framework that accommodates principles from three classical ethical theories—virtue ethics, deontology, consequentialism, and two Native American (...) ethics (Lakota and Navajo)—all considered from the perspectives of the impacted communities. We illustrate this framework by evaluating five recent energy decisions: the Dakota Access Pipeline, the Navajo Nation’s possible transition from coal to solar, hydraulic fracturing in Pennsylvania, uranium mining in Virginia, and the construction of the Xiaolangdi Dam in China. An applied ethics framework is preferable to existing ethical analyses because it can serve to sharpen arguments for (un)ethical decisions and action. Rather than treat ethical reasoning as a matter of opinion, we argue that applying ethical principles in a universal and standardized way adds rigor to energy sector decisions by presenting a position available for objective scrutiny. Because our framework identifies which aspects of a targeted action (if any) must adjust to improve ethical merit, it can serve as a practical tool for improving decision-making as we enter a new era of energy transitions. This article discusses recent legal conflicts between state universities and conservative religious students in the United States, focusing on Christian Legal Society v. Martinez. In recent years, several universities have denied recognition to religious student organizations that discriminate on the basis of religion or sexual orientation. I argue that scholars on both sides of the issue have failed to recognize the full scope of the privilege that the universities demand. If the courts accept the universities' demands, then the courts dangerously (...) expand the government's authority to suppress dissenters. No proponent of civil liberties should welcome this change. Abstract: Laudan (1984) distinguishes between two senses of success for scientific theories: (i) that a particular theory is successful, and (ii) that the methods for picking out approximately true theories are successful. These two senses of success are reflected in two different ways that the no miracles argument for scientific realism (NMA) may be set out. First, I set out a (traditional) version of NMA that considers the success of particular theories. I then consider a more recent formulation of NMA (...) (Psillos, 1999). This version of NMA is aimed at making us believe that our methods for picking out approximately true theories are reliable. I shall argue that the success of the latter argument is dependent on the success of the first. Therefore, even though Psillos presents a new formulation of NMA, the evidential support for it is no stronger than the evidential support for the original version. (shrink)

We show that for solvable games, the calculation of the strategies which survive iterative elimination of dominated strategies in normal games is equivalent to the calculation of the backward induction outcome of some extensive game. However, whereas the normal game form does not provide information on how to carry out the elimination, the corresponding extensive game does. As a by-product, we conclude that implementation using a subgame perfect equilibrium of an extensive game with perfect information is equivalent to implementation through (...) a solution concept which we call guided iteratively elimination of dominated strategies which requires a uniform order of elimination. We present the first published ethnographic description of landscape burning by Hadza hunter-gatherers of northern Tanzania and identify environmental, social, and cultural influences on Hadza landscape burning, thereby broadening the ethnographic record of anthropogenic burning practices described for hunter-gatherer communities. We report interview data collected in 2022 and 2023, describing their practices and attitudes regarding the causes and consequences of burning. We provide context by comparing our observations with those recorded for hunting and gathering populations in Africa, Australia, and North (...) America. Hadza landscape burning is generally a solitary and male-dominated activity, contrary to ethnographic accounts of Indigenous landscape burning from North America and Australia. The primary goals stated by Hadza for landscape burning were improved hunting, reduced hazards from dangerous animals, and to reduce the density of livestock. Firsthand observations suggest that landscape burning has decreased over the past 20 years, and this historical trend is supported by interviews. Satellite imagery also suggests an overall decrease in burning activity in the region from 2001 to 2022. Among the Hadza, landscape burning is a culturally influenced and strongly gender-biased activity that is rapidly disappearing. Because burning can radically transform landscapes, these practices often generate or amplify conflicts of interest between groups with different land use strategies. Hadza report serious social conflict with pastoralists over landscape burning, and our study suggests this tension has constrained the practice in the past two decades. (shrink)

While Chomsky subscribes to methodological naturalism, he rejects both metaphysical naturalism and an externalist conception of meaning. This chapter explores some of Chomsky's grounds for rejecting both metaphysical naturalism and meaning externalism, in particular his peculiar attitude towards ontological physicalism and his arguments for an internalist approach to meaning.

Talmudic history, understood as how events are organized and narrated to teach, cannot be said to deal with great affairs; it simply tells what those responsible for compiling it thought about the world around them. But if manifest history is scarcely present, a rich and complex world of latent history does lie ready at hand. The Talmud and related literature contain two sorts of historical information: stories about events within an estate of clerks, and data on the debates of those (...) who produced the Talmud. The authors of the Mishnah found no reason to narrate history because what was important in Israel's existence was sanctification, an ongoing process. Its framers recognized the pastness of the past and hence, by definition, laid out a conception of the past that constitutes an historical doctrine. The Talmud of the Land of Israel, spurred by the story of the suffering of Israel and efforts to explain the tragedy, moves toward an interest in the periodization of history and a willingness to include events of far greater diversity than the Mishnah. A teleology lacking all eschatological dimension - the Mishnah - here gives way to an explicitly messianic statement that the purpose of the law is to attain Israel's salvation -the Talmud of the Land of Israel. Ethical beliefs are not justified by familiar methods. We do not directly sense ethical properties, at least not in the straightforward way we sense colors or shapes. Nor is it plausible to think – despite a tradition claiming otherwise – that there are self-evident ethical truths that we can know in the way we know conceptual or mathematical truths. Yet, if we are justified in believing anything, we are justified in believing various ethical propositions e.g., that slavery is wrong. If (...) ethical beliefs are not justified in these familiar ways, how are they justified? -/- In her widely read, “Modern Moral Philosophy,” and in her short complimentary paper, “On Brute Facts,” G.E.M. Anscombe answers this question with a compelling and unorthodox account of justification in ethics. Because of her polemical tone and because “Modern Moral Philosophy” does so much else besides, this contribution is easy to overlook. But her account is worth taking seriously, since (a) it is an underappreciated yet plausible account that sidesteps traditional controversies, (b) it offers rich conceptual tools for interpreting and critiquing ethical theories, (c) it suggests an appealing account of the place of ethical theory in ethical knowledge and, (d) it provides useful guidance for doing applied ethics.
