My object in this paper is to suggest a few reflections on some themes in Bentham's work which others as well as I have noted, without perhaps developing them as fully as might with advantage be done. There will be nothing like full development in the limited compass of what is said here, but what is said may at least indicate possible directions for further exploration. The greater part of the paper will be concerned with the notion of natural authority; (...) but I want to begin by taking a broader, though no doubt rather superficial, view of the role in Bentham's thinking of the concepts of ‘nature’ and ‘the natural’. The full range of Bentham's engagement with Blackstone's view of law is beyond the scope of a single article. Yet it is important to recognize at the outset, even in a more restricted enquiry into the matter, that the engagement, begun when Bentham, not quite sixteen years of age, started to attend Blackstone's Oxford lectures, was indeed a lifelong affair. Whatever Bentham had in mind when, at the age of eighty, in 1828, he began to write a work entitled ‘A (...) familar view of Blackstone: or say Blackstone familiarized’, the manuscripts at least suffice to prove that ‘Our Author’ was still in the forefront of his mind at that octogenarian but still indefatigably active stage of his career. Every aspect of Bentham's multifarious intellectual activity over the intervening decades had been touched in some measure by his response to Blackstone's ideas. It still seems true to say what was said a dozen years ago: It would be an exaggeration to say that Bentham elaborated his own conception of law by way of a constant and conscious dialectic with the views of Blackstone. But it would be an exaggeration for which the evidence would afford some excuse. (shrink)

The object of this article is to examine, with the work of Jeremy Bentham as the principal example, one strand in the complex pattern of European social theory during the second half of the eighteenth century. This was of course the period not only of the American and French revolutions, but of the culmination of the movements of thought constituting what we know as the Enlightenment. Like all great historical episodes, the Enlightenment was both the fulfilment of long-established processes and (...) the inauguration of new processes of which the fulfilment lay in the future. Thus the seminal ideas of seventeenth-century rationalism realized and perhaps exhausted their potentialities in the eighteenth-century Enlightenment. The ideas with which this article is concerned, however—conveniently grouped and labelled as the ideas of utilitarianism—only began to achieve systematic development in these later decades of the eighteenth century. Within that period—during the first half and more of Bentham's long life—attempts to apply those ideas to the solution of social problems met largely with failure and frustration. Yet unrealized potentialities remained, the realization of which was reserved for a time when the world of the philosophes no longer existed. The movements for social and political reform which have played so large a part in modern history since the French Revolution may be judged in widely differing ways; but whatever the verdict, these movements surely cannot be understood without due consideration of that part of their origins which lies in eighteenth-century utilitarianism. Burns: To understand consciousness we need know its relationship to the brain, and to do that we need to know how the brain processes information. A lot of people think of brain processing in terms of individual neurons, and you're saying that brain processing should be understood in terms of dynamical states of populations?

This paper argues that T.M. Scanlon’s contractualism can provide a solution to the non-identity problem. It first argues that there is no reason not to include future people in the realm of those to whom we owe justification, but that merely possible people are not included. It then goes on to argue that a person could reasonably reject a principle that left them with a barely worth living life even though that principle caused them to exist, and that current people (...) could not justify creating people with barely worth living lives on the grounds that it caused those people to exist. The aim of the book is twofold: (1) To develop a comprehensive, contractualist theory of intergenerational ethics; (2) To argue that contractualism's ability to be that comprehensive theory of intergenerational ethics contributes to its plausibility as a moral theory in general. The book's core claim is that contractualism provides us with a comprehensive theory of intergenerational ethics that justifies including future people in the scope of what we owe to each other and tells us how much we owe them. It (...) begins by arguing that contractualism is not susceptible to the non-identity problem and so we must consider what future people could reasonably reject. It then argues that contractualism endorses 'reason-balanced sufficientarianism' and develops a series of moral principles guiding our behaviour towards future generations in terms of resource distribution, procreative decisions, optimal population size, and risk imposition. It concludes by applying these general principles to concrete, real-world individual and policy decisions and considering how the principles can and do interact with each other. (shrink)

In this paper I argue that, although Alvin Plantinga’s Felix Culpa theodicy appears on only two pages of his recent book Where the Conflict Really Lies: Science, Religion and Naturalism (2011) (i.e. 58-59), it is of pivotal importance for the book as a whole. Plantinga argues that there is superficial conflict but deep concord between science and monotheism, and that there is superficial concord but deep conflict between science and naturalism. I contend that the weakness of the Felix Culpa theodicy (...) lends support to the view that there is more than superficial conflict between science and monotheism, and offer an alternative response to the challenge of evil which suggests that there might be, after all, concord between science and (religious) naturalism. This essay examines the funeral sermon given by the Baptist theologian Andrew Fuller (1754–1815) for his friend and deacon Beeby Wallis in 1792 as a vantage-point from which to pursue reflection on Fuller’s concept of heaven and the beatific vision. The sermon has two main themes: the rest and rewards of those who die in Christ. The essay examines how Fuller interprets both of these phrases and then, looking at the rest of Fuller’s corpus, notes that ultimately God himself is (...) the believer’s reward. (shrink)

This article focuses on the history of the concept of natural law and the role which Aristotle, and especially his Rhetoric, has to play within it. It is sometimes suggested that the origins of the concept of law are to be located in the writings of Plato and Aristotle in the fourth century BCE. The article argues that there is evidence both in Aristotle's Politics and in his Rhetoric to support the view that this is not the case. In these (...) texts Aristotle suggests that the origins of the concept of natural law lie in the writings of the Sophists in the fifth century, some of whom used natural law arguments to question the legitimacy of slavery. The central feature of the narrative structure of Collingwood’s The Idea of History is the pivotal role accorded to Bradley, evident in the table of contents and in the two discussions of him. Few readers have noticed that, confusingly, the book’s first discussion of Bradley is a revision of the Inaugural Lecture “The Historical Imagination,” which constitutes the book’s second discussion of Bradley . The differences between these two presentations of Bradley are significant. The 1935 account seeks to portray the (...) Bradley of the Presuppositions of Critical History as a Copernican revolutionary in historical thought, even though the neo-Kantian transcendentalism promoted in the Lecture had been the core of Collingwood’s approach to philosophy of history from the mid-1920s, many years before he encountered Bradley’s essay. By 1935 this transcendentalism was in the process of self-destructing because of inner contradictions. By 1936, once Collingwood’s narrative and his criticisms of Bradley left the 1935 claims unsustainable, Collingwood shifted attention to Bradley’s later works, in an unsuccessful attempt to sustain the notion of his originality . Hitherto neglected Collingwood manuscripts held in the Bodleian prove that by 1940 Collingwood recognized this, so that the prominence Knox gave to Bradley in his editing of the IH is demonstrably not in accord with Collingwood’s views and plans for The Idea of History. Knox’s much-disputed claim that there was a radical shift to historicism in the later Collingwood is, however, confirmed, clear proof being adduced that in the later 1930s the attempt transcendentally to deduce universal and necessary presuppositions of historical knowledge is abandoned for a radically historicist account, paralleled by a demotion of “critical history” as the final form of “history proper” in favor of “scientific history.”. This paper argues that there are good reasons to limit the scope of luck egalitarianism to co‐existing people. First, I outline reasons to be sceptical about how “luck” works intergenerationally and therefore the very grounding of luck egalitarianism between non‐overlapping generations. Second, I argue that what Kasper Lippert‐Rasmussen calls the “core luck egalitarian claim” allows significant intergenerational inequality which is a problem for those who object to such inequality. Third, luck egalitarianism cannot accommodate the intuition that it might be required (...) to leave future generations better off than we are, even if it would come at no cost to ourselves. Finally, I argue that following another, broader, version of luck egalitarianism would require us to level down future generations and possibly even ourselves, which is a problem for those persuaded by the levelling‐down objection. When discussing the extinction of humanity, there does not seem to be any clear agreement about what ‘humanity’ really means. One aim of this paper is to show that it is a more slippery concept than it might at first seem. A second aim is to show the relationship between what constitutes or defines humanity and what gives it value. Often, whether and how we ought to prevent human extinction depends on what we take humanity to mean, which in turn (...) depends on what we value about humans. Finally, I will offer a definition of humanity that I argue offers a plausible account of when we might say humanity has gone extinct, and reflects what we value about humans, and relatedly, what many actually care about in terms of why we should be preserved. This article investigates the ability of mental incapacity tests to account for problems of control, through a study of the approach to alcohol dependence and a comparison with the approach to anorexia nervosa, in England and Wales. The focus is on two areas of law where questions of legal and mental capacity arise for people who are alcohol dependent: decisions about treatment for alcohol dependence and diminished responsibility for a killing. The mental incapacity tests used in these legal contexts are (...) importantly different—one involves a ‘cognitive’ test, while the other includes an explicit impaired-control limb—and the comparison provides insight into a longstanding debate about the virtues of one type of test over the other. It is shown that both kinds of test can take control problems into account, but also that both can be interpreted in narrow and wide ways that significantly influence the outcome of the assessment. It is therefore argued that to a large extent, it is not the kind of mental incapacity test that matters, but how the test is interpreted. It is further proposed that value judgements are playing an unrecognised and inappropriate role in shaping this interpretation. This raises concerns about the current approach to assessing the impact of alcohol dependency on the capacity to make decisions about alcohol use or treatment, as well as broader concerns about flexibility within incapacity tests. I evaluate the mechanism Rawls uses to elicit his just savings principle. My analysis focuses on his account of membership in the original position because who is in the original position and what they know has important consequences for the rest of Rawls’s theory of intergenerational justice. I consider three options: present time of entry (PTE), actual people from various generations, and all possible people. However, I will argue that Rawls is ultimately not successful since there is no plausible composition (...) of the original position that avoids the non-identity problem and generates acceptable moral principles without logical contradictions or inconsistencies with the rest of his theory of justice. By the death, last summer, of Jack Robson, the world of utilitarian studies and a wider world of scholarship on both sides of the Atlantic lost one of their most distinguished figures. It would not be appropriate here, even if it were possible now, to attempt a full and measured assessment of his work. Writing only a few months after the news of his death, while the sense of loss is still so sharp for all his many friends, two things (...) are possible. Something can and should be said to acknowledge and celebrate Robson's achievement as a scholar; and to this can be added some personal recollections of one whose human qualities were as outstanding as his scholarship. Can religious experience justify belief in God? We best approach this question by splitting it in two: Do religious experiences give their subjects any justification for believing that there is a God of the kind they experience? And Does testimony about such experiences provides any justification for believing that there is a God for those who are not the subject of the experience? The most popular affirmative answers trace back to the work of Richard Swinburne, who appeals to the Principle (...) of Credulity and the Principle of Testimony. Since then, development of his line of reasoning has gone in a number of distinct directions. Here I propose yet another development. I argue first that the Principle of Credulity is false on the grounds that it has several implausible commitments. I then offer a Phenomenal Conservative perspective on the epistemology of religious experience suggesting a categorically affirmative answer to but a nuanced answer to which allows the possibility of reasonable disagreement about religious experience. Thucydides and Aristophanes, austere historian and ribald comic playwright, lived in an Athens that had, since Themistocles, been moving from a regime of ancestral piety towards a secular empire. Thucydides suggests an agreement between his understanding and that of the pious Nicias — over and against this move. Aristophanes too is a vigorous proponent of peace, and the conclusions of many of his plays appear to suggest or encourage a conservative disposition towards ancestral piety or the rule of ancestral, divine (...) law.While these first impressions are not entirely misleading, a careful examination of the two thinkers’works, with attention to Nicias and the question of the gods, suggests a more complicated and revealing picture. Neither thinker is in agreement with Nicias, who proves to be representative of a fundamental human delusion. Each, however, sees that delusion as inescapable for political life, and so makes his appeal to more serious readers inconspicuously. (shrink)
