Ethical and legal traditions recognize prenatal duties to avoid harm to offspring. However, applying the harm principle to pregnancy requires a careful balancing of a baby's welfare with a pregnant woman's interest in liberty and bodily integrity. In the case of maternal PKU the mother can prevent harm to her baby by returning to the admittedly unpleasant diet that prevented her from being retarded. Informing, counseling, and access to medical care should be the primary policy. Seizures and forced treatment cannot (...) be justified in this case, and only rarely in other situations. (shrink)

In the fourth-century Greek theologian Basil of Caesarea is found a discussion of the signification of proper names, which appears to pick up some points from earlier ideas about language. He undertakes an analysis of proper names in response to his theological opponents. I will argue that Basil presents a theory which in some respects anticipates modern description theories. Basil has an idea of the role of cognition in a theory of naming. (edited).

My contention in this paper is that many of our commonly accepted ideas about property are defective. But these deficiencies are not just simple, surface mistakes that could be cleared up easily. They stem from a flawed conceptual framework used in making sense of and justifying property relationships. I also contend that this flawed conceptual framework maintains property relationships that are unjust. These property relationships produce an unequal distribution of wealth, status, and power, as well as reduced opportunities for autonomy (...) and self-development. This is unjust because, I believe, no satisfactory justification has been given for this inequality. Exposing some weaknesses of this conceptual framework is thus a step in promoting more egalitarian property relationships. (shrink)

Scholars have long remarked on the frequency with which Japanese myths portrayed gods (kami) as old men or okina. Many of these “sacred elders” came to be featured in premodern theater, most prominently in Noh. In the closing decades of the twentieth-century, as the number of Japan’s senior citizens climbed steadily, the sacred elder of premodern myth became a subject of renewed interest and was seen by some as evidence that the elderly in Japan had once been accorded a level (...) of respect unknown in recent times. In Buddhism and the Transformation of Old Age in Medieval Japan, Edward Drott charts the shifting sets of meanings ascribed to old age in medieval Japan, tracing the processes by which the aged body was transformed into a symbol of otherworldly power and the cultural, political, and religious circumstances that inspired its reimagination. Drott examines how the aged body was used to conceptualize forms of difference and to convey religious meanings in a variety of texts: official chronicles, literary works, Buddhist legends and didactic tales. In early Japan, old age was most commonly seen as a mark of negative distinction, one that represented the ugliness, barrenness, and pollution against which the imperial court sought to define itself. From the late-Heian period, however, certain Buddhist authors seized upon the aged body as a symbolic medium though which to challenge traditional dichotomies between center and margin, high and low, and purity and defilement, crafting narratives that associated aged saints and avatars with the cults, lineages, sacred sites, or religious practices these authors sought to promote. Contributing to a burgeoning literature on religion and the body, Buddhism and the Transformation of Old Age in Medieval Japan applies approaches developed in gender studies to “denaturalize” old age as a matter of representation, identity, and performance. By tracking the ideological uses of old age in premodern Japan, this work breaks new ground, revealing the role of religion in the construction of generational categories and the ways in which religious ideas and practices can serve not only to naturalize, but also challenge “common sense” about the body. There are resources in Heidegger’s work for identifying and mitigating pervasive modes of misrecognition that are characteristic of modern society, and, by identifying them, we become capable of attending to “supplementary” aspects of authenticity: terms of identity should apply to all in the same way, and, because these terms are a product of all, they are the responsibility of each individual. The first section analyses Being-guilty, Dasein-with, and Being-with to emphasise Dasein’s dependence on others, arguing that the dynamic of recognition (...) characteristic of Dasein implies a responsibility for recognising the other adequately. The second identifies common modes of misrecognition, arguing that these modes imply a shared responsibility for the contexts of recognition in which we participate. The third turns to Sartre’s work, arguing that our interpersonal relations offer resources for correcting our inadequate ways of recognizing one another and for recognizing the fundamental place of communication in the realization of human freedom. Bishop Desmond Tutu's call, in 2013, for former UK Prime Minister Tony Blair to be tried for war crimes, led to much reporting and comment in the online pages of UK newspapers. At first sight, it was a topic that seemed particularly conducive to the attraction of trolling, flaming and Ebile in the comments posted below journalistic pieces. Both Tutu and Blair are controversial and divisive characters, and the context of the Iraq War seemed fertile ground for heated exchanges. A (...) content analysis of 2,476 comments and 27,970 likes/dislikes offered a fairly substantial for identification of and evaluation of the value this discourse. In the event, trolling, flaming and Ebile were rare in the context of this political discourse, suggesting, at least a form of discourse closer to the ideals of Habermas. (shrink)

This contribution consists in an attempt to make sense of one central aspect of the present worldwide turbulence, one which might well be called the contemporary, perfect, global storm. A pivotal problem that will be interrogated is the issue of the circumstances that have produced this phenomenon in most parts of the world, although it should be emphasized that the term populism is, more often than not, applied to the Western world rather than the East or, for the most part, (...) the global South. However, this reservation does not amount to a severe caveat, since all the contemporary signs are that what is here called populism is sweeping across the entire world as a whole, even though it is not necessarily given this name in non-Western regions. To this generalization it should be added that there are, rather obviously, parallels to what has become known as populism in the West. Examples of this are anarchism in nineteenth century Russia and the movement known as the Long March under the leadership of Mao Zedong in the years 1934 and 1935 particularly, as well as al Qaeda and its various offshoots. A robust, if not absolute, prohibition on treating people merely as a means seems to sit at the core of common sense deontological morality. But the principle prohibiting such treatment, the ‘means principle’ (MP), has been notoriously hard to defend: both the subjective, intention-focused and the objective, causal-role-focused interpretations of what it means to use someone as a means face potent objections. In this paper, my goal is not to defend the MP, but to articulate and defend a new principle, (...) which I call the Restricting Claims Principle (RCP), that explains why a person’s causal role is morally significant. The RCP broadens the basic frame of relevant considerations from the MP’s concern with the dyadic relationship between agent and patient to a global balance of patient-claims on an agent. It distinguishes two kinds of patient-claims that weigh in that balance: restricting and non-restricting. In most cases, these can be distinguished as follows: Restricting claims, if respected as rights, would restrict an agent from doing what she could otherwise permissibly do if the claimant (or his property) were absent; non-restricting claims, if respected as rights, would not in that way restrict an agent. Only restricting claims press to make others worse off than if the claimant were absent. The RCP holds that restricting claims must therefore be substantially weaker than non-restricting ones. The claims of those who would be used as a means are non-restricting, while the claims of those who would be harmed as a side effect are restricting. Thus the RCP can account for the same cases (mostly) as the MP, without having to rely on the MP to do so. (shrink)

Derek Parfit argued that “Kantians, Contractualists, and Consequentialists … are climbing the same mountain on different sides.” By that he meant that when their views are properly developed, they will converge. One reason to reject his substantive view, however, is that he could not see how to account for the deontological intuition that it is very hard to justify using people as a means. Matthew Oliver offers a clever way for evaluator-neutral consequentialists like Parfit to account for that intuition. But (...) Oliver’s account runs into two problems: the axiology itself is problematic, and it seems inconsistent with other deep deontological intuitions. I offer a different development of contractualism that accounts for the relevant deontological intuitions, but it’s a fundamentally different “mountain.” Convergence is not in sight, but one can still hope that all climbers will eventually migrate to the better mountain. Helen Steward accepts what I call the Separation Thesis, the main tenet of which is that the movements one’s body makes when one acts are the causal results of one’s actions. I claim that this threatens to generate a pair of epistemic shortfalls: first, our perception of others’ bodily movements may not reach to their actions themselves; and, second, our own ‘knowledge in intention’ may not reach to the actual bodily movements in which the efficacy of our actions consists. I (...) suggest we should adopt a slogan that Anscombe considered, and say ‘I do what happens’ when I am acting. Then the movements one’s body makes when one acts are seen simply to be one’s actions. This paper examines the relations between, on the one hand, accounts of the distinction between an agent's identifying with, as opposed to feeling alienated from, their attitudes; and on the other, metaphysical accounts of action. It claims that a commitment to an event-causal conception of agency, which would analyse agency in terms of the causal potency of psychological states and events, appears to render mandatory a particular style of account of identification and alienation – namely, the hierarchical model offered by (...) Harry Frankfurt and Michael Bratman. It is argued that such accounts fall foul of a dilemma: the Authority Problem. The failure of attempts to avoid the Authority Problem is then used to motivate an attractive alternative style of account of the distinction, offered by Richard Moran. However, it is pressed that Moran's account rests on claims about agency which seem incompatible with the event-causal conception of agency. By making the links between the metaphysics of agency and accounts of identification and alienation more explicit, the paper allows us to better comprehend both the apparent need for and characteristic failures of some traditional accounts of identification and alienation, as well as make clear the action-theoretical debt incurred by those who would offer an alternative. We initiate the study of computable presentations of real and complex C*-algebras under the program of effective metric structure theory. With the group situation as a model, we develop corresponding notions of recursive presentations and word problems for C*-algebras, and show some analogous results hold in this setting. Famously, every finitely generated group with a computable presentation is computably categorical, but we provide a counterexample in the case of C*-algebras. On the other hand, we show every finite-dimensional C*-algebra is computably (...) categorical. (shrink)

This new and expanded edition of The Logic of Real Arguments explains a distinctive method for analysing and evaluating arguments. It discusses many examples, ranging from newspaper articles to extracts from classic texts, and from easy passages to much more difficult ones. It shows students how to use the question 'What argument or evidence would justify me in believing P?', and also how to deal with suppositional arguments beginning with the phrase 'Suppose that X were the case.' It aims to (...) help students to think critically about the kind of sustained, theoretical arguments which they commonly encounter in the course of their studies, including arguments about the natural world, about society, about policy, and about philosophy. In an earlier article, I introduced the “restricting claims principle” to explain what is right about the means principle: the idea that it is harder to justify causing or allowing someone to suffer harm if using him as a means than if causing or allowing harm as a side effect. The RCP appeals to the idea that claims not to be harmed as a side effect push to restrict an agent from doing what she would otherwise be free to do (...) for herself or others, given an appropriate account of her baseline freedom. Claims not to be harmed as a means are not in that way ‘‘restricting.’’ The original RCP relied on a counterfactual account of the agent’s baseline freedom: What could the agent permissibly do if the patient were not present? I argue here that that counterfactual baseline fails. The revised RCP relies instead on a ‘‘toolkit baseline’’: Do the patient claims concern the property the agent needs to use? This toolkit baseline reflects the different ways that agents relate to others: as fellow agents with whom they divide up the resources of the world, and as patients who might be affected by their actions. The toolkit baseline, resting on this agent-patient divide, provides a superior account of an agent’s baseline freedom, and a better account of the moral ground for the means principle. (shrink)

The fraught ideological relationship between liberalism and imperialism has been theorized primarily through the British, French, and American empires. This article moves beyond the experiences of these “great powers” by turning to Spain and its preeminent twentieth-century liberal thinker, José Ortega y Gasset. Unlike his British, French, and American counterparts, Ortega articulated liberalism not to promote or defend the forging of empire but rather to cope with the disorienting effects of its unequivocal loss in the wake of the Spanish–American War. (...) The experience of imperial loss, I argue, informed Ortega’s call for a “new liberalism” that could enable Spain’s national and cultural renewal. Reading Ortega’s thought in this context thus reveals the lasting impact that imperial dispossession can have upon certain strands of liberalism. It also suggests that, in order to fully capture the relationship between liberalism and empire, it is necessary to incorporate a wider range of historical sources and imperial trajectories.
