The aim of the paper is to present a brief insight into the significant works and views of the German sociologists Niklas Luhmann and Jűrgen Habermas on the role of law in regulating human relations in society. Educated as a lawyer, Niklas Luhmann in the late academic career was under the influence of the American sociologist Talcott Parsons. Niklas Luhmann later, under the influence of the American sociologist Talcott Parsons, he built a sociological theoretical system called the systems theory. On (...) the other side, Jűrgen Habermas was a philosopher and sociologist, highly influenced by the Frankfurt school of sociology. According to Luhmann‘s systems theory, the social reality and the separate aspects of the social life are part of a deeper system called society, and in relation to the same they are set as subsystems. Social systems are divided into allopoietic and autopoietic. One of the significant axioms of Luhmann’s theory is that the largest number of systems tends to simplify due to the pressure of the environment for greater efficiency. Law in Luhman’s systems theory enjoys the status of an autonomous system for regulating society, rather than an instrumental contribution to politics. This brief review exposed a big clash between two influential German thinkers. In this paper we are going to use historical method and analysing of the content of different materials and previous authors that are dealing with the work of Niklas Luhmann and Jűrgen Habermas. Building the case as a good lawyer, he leads us to the defenseless nature of constructivist postmodern moral theories and their revisions as well as to a commitment of Christian morality to the objective commonsense morality. On this view, even heroic moral acts based on obedience to God (such as Christian sacrificial love) might be compatible with commonsense morality. It is surprising, however, that Jung never consulted or quoted Bernard Gert's account of the common morality, especially when discussing differences between moral duty and ideals (167). This research paper focuses on the comprehensive description and analysis of the structure of judgments from the Court of Justice of the European Union (CJEU). Despite the growing interest in examining the rhetorical and linguistic aspects of legal texts, the genre structure of judgments has remained a little-explored area. While headings and paragraph enumeration provide a systematic reference system for citation and cross-referencing they do not reveal the dynamic relations between individual text chunks in judgments. The current analysis combines Swales (...) and Bhatia's genre theory with Hoey's approach to patterning in discourse and corpus linguistics analyses. The findings show that the complexity of CJEU judgments extends beyond surface-level information with linguistic expressions playing a crucial role in highlighting dynamic relations and discourse patterning. The results reveal how the structure of CJEU judgments has changed over time and point to the intratextual relations between different sections. Additionally, the study provides a detailed description of the textual organisation of CJEU judgments in terms of move structures and conventionalised discourse patterns. (shrink)

The author re-examines Hare's multiple ways of connecting his metaethical with his normative doctrine, which is in formal sense determined as "Kantian utilitarianism", and in substantive sense as "preference-utilitarianism". Critical references to both dimensions of utilitarian doctrine aim at indication on scopes and limits of Hare's ambitious redefinition of the doctrine. Further on he discusses about so-called "necessary ingredient" of moral reasoning under the name of "sympathetic imagination", which Hare grasps in his developed theory not only as a normative demand (...) but also as a logical thesis. Finally, he considers kinds of preferences that can or cannot be recognized as morally relevant. The development of the peace concept is closely related to the development of the concept of the state and hence to the efforts for elimination of war as an instrument for resolving disputes between states. In that context, war and peace are traditionally treated as mutually exclusive concepts, i.e., war implies violence, while peace, nonviolence. So, the end of war marks the beginning of peace and vice versa. Therefore, both concepts simultaneously represent the inevitable outcomes of the continuous and dynamic (...) nature of social interaction in the international system, foreshadowing future war for nations and states that are currently at peace and, on the other hand, foreshadowing peace for nations and states that are currently at war. Starting from the indicated traditional understanding of the concepts of peace and war, as well as from the fact that the establishment of peace research begins during the 80s of the XX century, the focus in the paper is specifically placed on the analysis of the peace concept through the prism of the theory of international relationships. Namely, it is indisputable that until the establishment of peace and security research and studies, issues of peace and security are generally considered and interpreted within the framework of the various theoretical approaches for international relations. Hence, the paper more specifically explores the evolutionary character of the perceptions and understanding of the peace concept, especially from the perspective of: federalism, neorealism, liberalism and functionalism. This article explores three dimensions of the current state of gender equality in Serbia: public policy on gender equality, public opinion on gender equality and the context of Serbia’s accession to the EU. Using data from the recent public opinion survey of citizens’ attitudes towards gender equality, the authors address the following issues: harmonization of public policy on gender equality in Serbia with EU policies; differences between public policy on gender equality in Serbia and citizens’ preferences; convergences/divergences between citizens of (...) Serbia and EU citizens regarding gender equality. As Serbia’s policy of promoting gender equality in the last decade has been dominated by the political goal of accession to the EU, it shows where the opinions converge, and where there are certain differences. The authors show the complexity of ideological positions among average Serbian citizens, while highlighting different paradigms in the official public policy on gender equality. While Serbian citizens still do not place gender equality high on their political agenda, they are convinced that it has a certain value, which does provide some important pointers for the future. The article examines the patient-doctor relationship, relying on Michel Foucault’s concept of the clinical gaze. We argue that during the last decades, a profound transformation of the social nature of medicine took place, one that Foucault’s understanding of the clinical gaze cannot adequately account for. First, the article offers an elaboration of the three-node network of clinical gaze, the clinic, and nosology to explain the positioning of the doctor and the patient within the specific social ontology generated by the rise (...) of medicine. We then discuss intensive but irresolute developments brought by technological advancements, especially the X-ray tube. Finally, we argue that in the contemporary clinic, equipped with a plethora of sophisticated devices, the position of the doctor endured the most radical transformation in comparison with Foucault’s proponent of the clinical gaze at the dawn of modern medicine. In the first part of this paper we discuss some aspects of Detlefsen's attempt to save Hilbert's Program from the consequences of Godel's Second Incompleteness Theorem. His arguments are based on his interpretation of the long standing and well-known controversy on what, exactly, finitistic means are. In his paper [1] Detlefsen takes the position that there is a form of the ω-rule which is a finitistically valid means of proof, sufficient to prove the consistency of elementary number theory Z. On (...) the other hand, he claims that Z with its first-order logic is not strong enough to allow a formalization of such an ω-rule. This would explain why the unprovability of $\operatorname{Con}(Z)$ in Z does not imply that the consistency of Z cannot be proved by finitistic means. We show that Detlefsen's proposal is unacceptable as originally formulated in [1], but that a reasonable modification of the rule he suggest leads to a partial program already studied for many years. We investigate the scope of such a program in terms of proof-theoretic reducibilities. We also show that this partial program encompasses mathematically important theories studied in the "Reverse Mathematics" program. In order to investigate the provability with such a modified rule, we define new consistency and provability predicates which are weaker than the usual ones. We then investigate their properties, including a few that have no apparent philosophical significance but compare interestingly with the properties of the program based on the iteration of our ω-rule. We determine some of the limitations of such programs, pointing out that these limitations partly explain why partial programs that have been successfully carried out use quite different and substantially more radical extensions of finitistic methods with more general forms of restricted reasoning. In this paper, the author will attempt to analyze some of the basic concepts in Leibniz’s Monadology from the perspective of the contemporary philosophy of the mind. The aim of the paper is to suggest that the traditional understanding of Leibniz as a pluralist or parallelist, though not completely untrue, is not always completely revealing and fruitful concerning its possible value for the philosophy of the mind. By analyzing some of the core concepts, the author will attempt to approach the (...) mind-body problem from a rather different angle, suggesting that the mind-body problem is to be regarded as an epistemological one, that is, it concerns how we know and speak of matter and nature. In this paper, the authors first emphasise the connection that exists between bioethics and law. However, special attention is given to the link between bioethics and human rights, which share the idea of protecting similar values, especially the protection of life and human dignity. Identifying the interdependence and interrelation of these concepts is a prerequisite for further exploration of how and in what context the European Court of Human Rights decides on bioethical issues it encounters when ruling on classical human (...) rights guaranteed by the European Convention for the Protection of Human Rights and Fundamental Freedoms. Once the important features that determine the relationship between bioethics and human rights are identified, these features will be practically examined through the group of cases in which the Court has addressed the issue of mandatory vaccination, which has been in the public spotlight in recent years. There are two reasons why Christian theology introduces the concept of the absolute nothing into its doctrine of creation. Firstly, unlike platonic non-being, the absolute nihil is not eternally co-existent with God and it does not limit His creative freedom. We notice that God’s freedom is identified with the freedom to create. Platonic non-being represented a necessity. To create, therefore, means to be able to overcome every form of necessity. The concept of the absolute nothing, therefore, needs to provide an (...) ontological ground for the creation of the absolute novum. Sergius Bulgakov and Nikolai Berdyaev, the authors I am quoting in this essay, agree that the apology of the world is inconceivable on the level of monistic ontology, for which substance or ousia is the main category. They are aware that simultaneous communion and otherness between God and the world is imaginable only on the level of the person or hypostasis. Christian theology introduces absolute nothing to secure God’s creative freedom. God is free if He can overcome givenness and create a newness in being. But Bulgakov stresses that to “create out of nothing” means that God creates out of Himself. God can create only what is already given in Him. Berdyaev’s God does not create out of Himself but out of uncreated freedom. Berdyaev explicitly confirms uncreatedness of freedom by stressing that this freedom is outside of God. This is why God can break through the givenness of the world and create an absolute newness. (shrink)

Bioassessment is the process of using living organisms to assess the ecological health of a particular ecosystem. It typically relies on identifying specific organisms that are sensitive to changes in environmental conditions. Benthic macroinvertebrates are widely used for examining the ecological status of freshwaters. However, a time-consuming process of species identification that requires high expertise represents one of the key obstacles to more precise bioassessment of aquatic ecosystems. Partial automation of this process using deep learning-based image classification is the goal (...) of an ongoing project AIAQUAMI we are participating in. One of the project goals is to develop software support for image classification with visualization and reporting. For that purpose, we developed desktop and web applications that we open-sourced as Imagelytics Suite. Both desktop and web applications rely on a convolutional neural network (CNN) to classify images and the Grad-CAM algorithm to produce heatmaps of the image areas that mostly influenced the network decision. Along with the source code of the applications, we also open-sourced scripts that can be used to train CNN on an arbitrary dataset and produce required metadata, so it can be used with Imagelytics applications. In this article, we presented technical details regarding the design of the applications and the training method that will enable their general use for image classification tasks. As a part of the evaluation, we will show a use case related to species identification of non-biting midges (Diptera: Chironomidae). (shrink)

The relationship of tradition towards Bruno is twofold, and the analysis of this relationship will show that Bruno is interpreted either as a pioneer of new science or as a mystic, mage, and follower of hermetic tradition. Following these two viewpoints, Bruno’s ars memoriae will be interpreted either as a mere memory technique in the service of empirical science or as an occult, magical art. This paper aims to open up and analyse the ways by which we can approach and (...) understand Bruno and his method, that goes beyond the mentioned strict division. In the period of Renaissance, which represents an incredible combination of tradition and the new, magic and science do not exclude one another; in search for knowledge, each method finds its proper place. Ars memoriae is precisely that: a universal method that allows knowledge to be understood in its multiplicity. In this paper, we will present some of the key elements of Bruno’s philosophy, by exploring different interpretations and perspectives, and show why Bruno was understood and interpreted in the way in which he was and why is it necessary to access the ars memoriae by striving to unite scientific and magical elements. In Bruno’s thought there are many places where scientific and magical are not only not opposed to each other, but are complementary, and represent an inseparable whole within which knowledge is commonplace both to former and latter. The task, therefore, is not to analyse ars memoriae in detail, but to examine possible approaches to that method. Understanding of Bruno depends upon understanding his method of ars memoriae. On the one hand, their main representative St. John Climacus strongly criticized some Evagrius’ fallacies, while on the other hand used thе good side of his ascetic teachings. Furthermore, the specificity of location of the Sinai Monastery resulted that God seeing, contemplation and theology exercised through the Sinaitic Fathers became ideals of the ascetical spirituality. All these ideals originate in ascetical teaching of Evagrius whose correct teachings (...) and soul-benefit readings, at first, were acknowledged by the Fathers of Gaza. Later it was passed onto the Fathers from Sinai and ultimately unto the all ascetical tradition primarily unto the Neptic tradition. (shrink)

The Laozi expounds a thoroughgoing and sustained criticism of government and society. In this paper, I will demonstrate that although this criticism is addressed to the ancient Chinese state, it can also have some validity for the modern state of today. I will first briefly discuss the metaphysical grounds of this criticism and stress that the ruler should use wuwei in governing. Then, I will examine the Laozi’s criticism of the oppressive governments that use unnatural governing through youwei which increases (...) the state disorder, as well as how this criticism is supported by its metaphysical grounds. Third, I will show that the selfish desires may significantly contribute to the state disorder and that the only one to be blamed for the arousing of them is the ruler. At last, I will attempt to show that this criticism may also to a certain extent be directed toward today’s modern state. (shrink)

In this article I will discuss the anarchist and non-anarchist interpretations of the Laozi and argue that the political philosophy of the Laozi does not completely conform to Western anarchism. Thus, firstly I will give a brief introduction to Western anarchism. Then I will present the strongest arguments of the anarchist interpretation and try to find their mistakes and refute them. Finally I will try to give an acceptable non-anarchist interpretation of the political philosophy of the Laozi. In doing steps (...) 2 and 3, I will base my arguments in a way that is consistent with the text of the Laozi itself. Thus, I hope that this article will bring a deeper understanding of the political philosophy of the Laozi and break with the widely spread opinion that the Laozi propounds an anarchist theory. First, Pies mentions that I embrace a Platonic essentialism and a ‘binary’ view of narcissism, whilst in fact narcissistic traits present themselves in degrees, within a continuum of pathology.Let us clarify the meaning of essentialism. When applied to the phenomenology of narcissism, (...) Platonic essentialism would imply that there is an idea, or ideal, of ‘pure’ narcissism, which governs our cognition of narcissistic phenomenology. Without an ‘essentialist’ understanding of what narcissism as a more or less pure phenomenon would look like, it would make no semantic or logical sense to speak of various ‘types’ or ‘degrees’ of narcissism. In the 1940s, in The Concept of Mind, Gilbert Ryle offered the now infamous logical analysis of ‘false’ and ‘true coins’: if there were not true coins of which we had some idea, it would be logically impossible to speak of counterfeit coins (McDermid, 2004; Ryle, 1949, pp. 94–99). There are shoddily produced coins that bear only a vague resemblance to the original idea or mint of the real coin, however, for each we would ultimately have to decide whether the resemblance is sufficient for it to be considered a real coin. Shoddily produced coins represent various ‘degrees’ of resemblance of the idea, or form, of a coin, but to call them coins, and to decide whether they are true coins or not, it is a logical presupposition that we must first have an ‘idea’ of what an ‘ideal’ real coin is like. This, at its core, is essentialism.There is no escape from this type of essentialism in any rigorous argument, because Platonic essentialism is the foundation of the very meanings of the concepts we use. Plato’s ideas are paradigms, where the particular instantiations of their qualities are called ‘phenomena’ (Sedley, 2016; Taylor, 2016). Thus, the nuanced expression of ideas or forms in their various phenomena is the very substance of the essentialist theory of ideas. It appears that Professor Pies is also a Platonic essentialist, as am I.So why is it often impossible in clinical practice to ascribe necessary and sufficient conditions to narcissism? Well, let us remember Rosenhan’s experiments (1973). Rosenhan illustrates how the same individuals were diagnosed with very different disorders by different clinicians at roughly the same time, and how healthy individuals, once they had been instructed to ‘fake’ psychotic symptoms, remained under the same or more serious [End Page 177] diagnoses even when they stopped pretending and behaved completely normally. The reason for the arbitrariness of psych-diagnoses is the insufficiency of the psych-diagnostic language, including the actual diagnostic criteria, a kind of Lacanian ‘lack’ that is built into the very structure of psychodiagnostics (Ruti, 2008), and not a metaphysics behind such use of diagnostic language, whether it is essentialist or non-essentialist. Whether a particular patient actually has NPD or not in practice comes down to a consensual judgement—one that has been notoriously lacking in the history of psychiatry (Verhaeghe, 2008, pp. 71–125).Second, Pies suggests that empathy is ‘a complex, multidimensional construct comprising cognitive and affective components.’ I do not think this is a correct understanding of empathy. In fact, it is a conceptual revision of the original concept of empathy, which is one of a moral emotion (Kauppinen, 2014). What Pies calls ‘cognitive empathy,’ namely the ability to recognize and influence the emotions of others is an entirely different quality capacity that has recently been called ‘emotional intelligence’ (e.g., Conte, 2005). U tekstu se takodje naglasava kako se ideja drustvenog kao?moralnog? ugovora, nasuprot izvornijem?politickom? ugovoru, artikulise tek u poznoj?evolucionoj? fazi te ideje, narocito u dvadesetom veku. Najposle, odbacuje se pokusaj redefinisanja kontraktualizma kao neke vrste?konstruktivizma?, buduci da u kontraktualizmu nema nikakvih elemenata?proceduralnog? rasudjivanja koje je, prema opstem uverenju, karakteristicno za?konstruktivisticku? misao. Da li se vrlina moze nauciti je pitanje oko koga su se lomila koplja u previranju i borbi za prevlast izmedju sofistike i starohelenske etike kao dva osnovna principa antickog duha. Dva velika predstavnika ovih suprotstavljenih principa Platon i Protagora sucelili su svoje argumente u dijalogu koji nosi naziv velikog sofiste. U ovoj filosofskoj borbi paradoksalno Protagora koji tvrdi da se vrlina moze nauciti dolazi do stava da vrlina nije znanje, a Platon koji brani starohelenski princip da je vrlina urodjena (...) tvrdi da je vrlina znanje. Platon resenje ovog velikog spora dva anticka principa vidi u filosofskoj teoretizaciji starohelenske mitske slike svijeta. (shrink)
