Guidelines recommend a ‘do-not-resuscitate’ code status for inpatients in which cardiopulmonary resuscitation attempts are considered futile because of low probability of survival with good neurological outcome. We retrospectively assessed the prevalence of DNR code status and its association with presumed CPR futility defined by the Good Outcome Following Attempted Resuscitation score and the Clinical Frailty Scale in patients hospitalised in the Divisions of Internal Medicine and Traumatology/Orthopedics at the University Hospital of Basel between September 2018 and June 2019. The definition (...) of presumed CPR futility was met in 467 of 2889 patients. 866 patients had a DNR code status. In a regression model adjusted for age, gender, main diagnosis, nationality, language and religion, presumed CPR futility was associated with a higher likelihood of a DNR code status. In the subgroup of patients with presumed futile CPR, 144 of 467 had a full code status, which was independently associated with younger age, male gender, non-Christian religion and non-Swiss citizenship. We found a significant proportion of hospitalised patients to have a full code status despite the fact that CPR had to be considered futile according to an established definition. Whether these decisions were based on patient preferences or whether there was a lack of patient involvement in decision-making needs further investigation. (shrink)

On a souvent considéré qu'une philosophie de l'esprit devait choisir parmi les traits distinctifs du mental celui qu'elle retiendrait pour le mettre en relief. Il ne serait pas possible de faire place dans une même philosophie aux trois faits majeurs : l'intentionnalité du mental (on discerne les pensées de quelqu'un en disant à quoi il pense), le holisme du mental (impossible de concevoir un état d'esprit isolé du tout d'une vie mentale), la part impersonnelle du mental (les acteurs ne manifestent (...) pas seulement des capacités mentales attachées à leurs personnes respectives, mais aussi des manières de penser communes, des institutions de sens formant ce qu'on appelle un esprit objectif). Ainsi, les théories intentionalistes de l'esprit ont généralement exalté le sujet aux dépens des totalités symboliques, tandis que les théories des structures de l'esprit ont paru faire de l'acteur un simple figurant sur la scène du signifiant. De tels partis pris signalent l'échec de bien des philosophes à concevoir clairement les conditions d'une analyse holiste des phénomènes de l'esprit. Ce livre utilise les ressources analytiques de la logique des relations de C.S. Peirce pour développer une conception holiste de l'intentionnalité de l'esprit (tant subjectif qu'objectif). Philip Pettit’s conception of freedom as nondomination is modally robust in that it requires not simply reducing the probability of uncontrolled interference by others but entirely eliminating that possibility. In this article, I consider whether freedom as nondomination provides an attractive analysis of official discretion, particularly in the context of the criminal law, an area of recurring interest for Pettit. I argue that not only does the modally robust character of freedom as nondomination have some rather unattractive implications in the (...) criminal law, but that it sits poorly with Pettit’s more general ambitions to provide a consequentialist framework for the evaluation of social institutions. Drawing on recent work by Niko Kolodny, I develop an ‘anti-deference’ interpretation of nondomination and contrast it to Pettit’s modally robust conception. (shrink)

We review the psychological literature on the organization of valence, discussing theoretical perspectives that favor a single dimension of valence, multiple valence dimensions, and positivity and negativity as dynamic and flexible properties of mental experience that are contingent upon context. Turning to the neuroscience literature that spans three levels of analysis, we discuss how positivity and negativity can be represented in the brain. We show that the evidence points toward both separable and overlapping brain systems that support affective processes depending (...) on the level of resolution studied. We move from large-scale brain networks that underlie generalized processing, to functionally specific subcircuits, finally to intraregional neuronal distributions, where the organization and interaction across levels allow for multiple types of valence and mixed evaluations. Legal philosophers often ask whether a person has a reason to obey the law simply because it is the law. We ask the contrary question: does a person have a reason to disobey the law simply because it is the law? Many philosophers who have considered the question of disobedience have focused on injustice; others have defended disobedience on libertarian or anarchist grounds. In contrast, we argue that there is a content-independent reason to disobey the law even when it is (...) not unjust, illegitimate, or otherwise undesirable. Legal philosophers generally agree that law claims peremptory authority, but they also generally agree that any duty to obey the law is substantially more limited. We argue that insofar as the law makes inflated claims to authority, it generates a content-independent reason to disobey. This anti-authoritarian principle is grounded in the virtue of clearly communicating one’s political commitments to others within a democratic society. By disobeying, one communicates one’s conviction that the law makes inflated claims to authority. We show how our account of disobedience as such is distinct from more familiar theories of anarchism and civil disobedience and argue that it is applicable whether one lives under conditions of justice or injustice. While many philosophers of law spend their careers exploring the warrens of a single neighbourhood within the sprawling cities of the philosophy of law, Larry Alexander has rambled widely, exploring obscure alleyways and dense downtowns, making significant and influential contributions along the way. The volume under review, a Festschrift in his honour, draws from a correspondingly wide range of areas of scholarship, from the philosophy of criminal law and punishment to constitutional law, from analytic jurisprudence to moral philosophy. Thus, given (...) the breadth and depth of Alexander’s influence, this volume provides a partial snapshot of some of the major preoccupations of American legal theory over the last few decades. In light of the breadth of topics considered, as well as its substantial length—the book includes twenty‐two papers, an introduction by Heidi Hurd, the editor, and a substantial reply by Alexander—my discussion is selective and evocative, rather than comprehensive and detailed. All the more so, as many of the papers are important contributions in their own right that merit close scrutiny. (shrink)

I argue that theoretical developments in the study of the Universal Declaration of Human Rights (UDHR) should occur alongside progress in moral psychology, particularly moral cognition. More specifically, I argue that Universal Moral Grammar (UMG), a model positing an innate, regulative, and universal moral faculty characterizable in terms of rules and principles, fulfills the role of the foundational model needed to usefully conceptualize the UDHR. As such, I provide a detailed account of UMG against competing models in moral psychology. Furthermore, (...) I combine UMG with Talbott’s Historical-Social Process of Moral Discovery and Rawls’s reflective equilibrium to show how the UDHR represents a major development in moral exploration, one indicating a more penetrative look into the inner moral nature of humans that attempts to reach, but does not attain, one interpretation of reflective equilibrium tied to cognitive moral psychology. It has been suggested that difficult-to-quantify differences in visual processing may prevent researchers from equating the color experience of different observers. However, spectral locations of unique hues are remarkably invariant with respect to everything other than gross differences in preretinal and photoreceptor absorptions. This suggests a stereotyping of neural color processing and leads us to posit that minor differences in observer neurophysiology may be irrelevant to color experience.

Applying the solutions defined in the axiomatic bargaining theory to actual bargaining problems is a challenge when the problem is not described by its Utility Possibility Set (UPS) but as a social choice environment specifying the set of alternatives and utility profile underlying the UPS. It requires computing the UPS, which is an operational challenge, and then identifying at least one alternative that actually achieves the bargained solution’s outcome. We introduce the axioms of Independence of Non-Strongly-Efficient Alternatives (resp. Weakly) and (...) Independence of Redundant Alternatives. A solution satisfying these axioms can be applied to a simplified problem based on any reduced set of alternatives generating the strong (resp. weak) Pareto frontier of the initial problem, without changing the outcome, making the application of bargaining solutions to actual problems easier. We compare our axioms to usual independence axioms, and discuss their consistency with usual bargaining solutions. Then, we introduce monotonicity conditions corresponding to the existence of an interest group, i.e., agents ranking the alternatives in the same order. For such monotonic social choice environments, we provide a parameterized family of alternatives that generates the Pareto frontier of the bargaining problem, in line with our previous results. Our analysis illustrates that an axiomatic approach can be useful to foster the application of bargaining solutions, in complement to usual computational methods. (shrink)

This paper proposes a political concept of Responsible Innovation (RI). As a first step, we diagnose the RI discourse with a conceptual ambiguity, struggling to accommodate both private and public interests. To address this ambiguity, we distinguish between weak RI, which seeks to govern a techno-economic concept of innovation; and strong RI, which seeks to conceive a political concept of innovation beyond techno-economic ideology and practice. Secondly, we consult The Human Condition, in which Hannah Arendt articulates a threefold distinction between (...) the activities of labor, work, and action. Although Arendt does not explicitly address the topic of innovation, her equation of politics with the human capacity to “begin the unexpected” inspires a political concept of RI which fundamentally empowers the public sphere and drives radical novelty. Finally, we account for how this political concept of RI can be operationalized, advocating for its integration at both substantive and procedural level. (shrink)

But the barycentric coordinates have noncommuting components, which makes possible a consistent quantization (in any dimension, four in particular) within the framework of a transverse space of states. The study is about the knowledge involved in health and social collaboration. ADL’s mission implies for interprofessional cooperation beyond the medical and technical processing. The company has chosen to extend its field of action with a patient’s social treatment. To better understand the nature of the link between social and other areas of work, the subject of action research is (...) to know under what conditions the employees report of patients in social service. Sexual motivation is a fundamental behavior in human. For a long time, this behavior has been somehow ignored from psychological and neuroscientific research. In this article - reflecting the collaboration of a clinical psychologist and a neuroscientist - we show that in the current period, sexual affiliation is one of the most promising affiliation context to articulate a debate, a dialog and convergence points between psychoanalysis and neuroscience. Recent data on healthy sexual behavior and its compulsive variant are discussed under (...) the prism of neuroscience and psychoanalysis. Centering on the early Platonic dialogues, this paper delineates the importance of considering Plato’s Lysis’ as rightful inclusion to Jan Szaif’s proposal of “core group” of aporetic dialogue. This paper highlights a synoptic presentation of the development of Lysis’s reception by modern scholars of Plato (Platonic scholars) at the beginning of this discourse to establish a compelling argument for its aporetic nature. It then proceeds with a revisit to Szaif’s article Socrates and the Benefits of Puzzlement. The first section, considering (...) its importance, emphasizes the evident possibility of opening his list of ‘core group’ of aporetic dialogue to Lysis benefitting the said dialogue. This exposition concludes with the philosophical nature of friendship, even love, must neither begin in Plato’s Phaedrus and Symposium nor in Aristotle’s conception of friendship in Nicomachean Ethics. Alternatively, cognizant of the aporetic tradition followed and practiced by Plato, all studies on the said topics may begin with Lysis. (shrink)

Targeted transitions in chromatin states at thousands of genes are essential drivers of eukaryotic development. Therefore, understanding the in vivo dynamics of epigenetic regulators is crucial for deciphering the mechanisms underpinning cell fate decisions. This review illustrates how, in addition to its cell memory function, the Polycomb group of transcriptional regulators orchestrates temporal, cell and tissue‐specific expression of master genes during development. These highly sophisticated developmental transitions are dependent on the context‐ and tissue‐specific assembly of the different types of Polycomb (...) Group (PcG) complexes, which regulates their targeting and/or activities on chromatin. Here, an overview is provided of how PcG complexes function at multiple scales to regulate transcription, local chromatin environment, and higher order structures that support normal differentiation and are perturbed in tumorigenesis. Often the only treatment available for patients suffering from diseased and injured organs is whole organ transplant. However, there is a severe shortage of donor organs for transplantation. The goal of organ engineering is to construct biological substitutes that will restore and maintain normal function in diseased and injured tissues. Recent progress in stem cell biology, biomaterials, and processes such as organ decellularization and electrospinning has resulted in the generation of bioengineered blood vessels, heart valves, livers, kidneys, bladders, and airways. (...) Future advances that may have a significant impact for the field include safe methods to reprogram a patient's own cells to directly differentiate into functional replacement cell types. The subsequent combination of these cells with natural, synthetic and/or decellularized organ materials to generate functional tissue substitutes is a real possibility.
