In this unique book, Alexander Lian, a practicing commercial litigator, advances the thesis that the most famous article in American jurisprudence, Oliver Wendell Holmes's “The Path of the Law,” presents Holmes's leading ideas on legal education. Through meticulous analysis, Lian explores Holmes's fundamental ideas on law and its study. He puts “The Path of the Law” within the trajectory of Holmes's jurisprudence, from earliest scholarship to The Common Law to the occasional pieces Holmes wrote or delivered after (...) joining the U.S. Supreme Court. Experimental radiobiology represented a long-standing priority for the U.S. Atomic Energy Commission, but organizational issues initially impeded the laboratory progress of this government-funded work: who would direct such interdisciplinary investigations and how? And should the AEC support basic research or only mission-oriented projects? Alexander Hollaender's vision for biology in the post-war world guided AEC initiatives at Oak Ridge, where he created and presided over the Division of Biology for nearly two decades. Hollaender's scheme, at once entrepreneurial and system-oriented, made (...) good use of the unique resources provided by the AEC and by Oak Ridge's national laboratory setting, while at the same time it restructured wartime research practices to better reflect biologists' own priorities. Because Hollaender offered many academic experimental biologists a way of envisioning military-related patronage as integral - rather than antithetical - to their professional identities, his work provides an important lens through which to examine the early post-war intellectual and institutional development of radiobiology. This paper is about intentional identity, the phenomenon of intentional attitudes having a common focus. I present an argument against an approach to explaining intentional identity, defended by Nathan Salmon, Terence Parsons and others, that involves positing exotic objects. For example, those who adopt this sort of view say that when two astronomers had beliefs about Vulcan, their attitudes had a common focus because there is an exotic object that both of their beliefs were about. Supporters of the autonomy of higher-level causation (or explanation) often appeal to proportionality, arguing that higher-level causes are more proportional than their lower-level realizers. Recently, measures based on information theory and causal modeling have been proposed that allow one to shed new light on proportionality and the related notion of specificity. In this paper we apply ideas from this literature to the issue of higher vs. lower-level causation (and explanation). Surprisingly, proportionality turns out to be irrelevant for the question of (...) whether higher-level causes (or explanations) can be autonomous; specificity is a much more informative notion for this purpose. This paper examines two questions about scientists’ search for knowledge. First, which search strategies generate discoveries effectively? Second, is it advantageous to diversify search strategies? We argue pace Weisberg and Muldoon (2009) that, on the first question, a search strategy that deliberately seeks novel research approaches need not be optimal. On the second question, we argue they have not shown epistemic reasons exist for the division of cognitive labor, identifying the errors that led to their conclusions. Furthermore, we generalize the (...) epistemic landscape model, showing that one should be skeptical about the benefits of social learning in epistemically complex environments. (shrink)

An overview of the latest interdisciplinary research on human morality, capturing moral sensibility as a sophisticated integration of cognitive, emotional, and motivational mechanisms. Over the past decade, an explosion of empirical research in a variety of fields has allowed us to understand human moral sensibility as a sophisticated integration of cognitive, emotional, and motivational mechanisms shaped through evolution, development, and culture. Evolutionary biologists have shown that moral cognition evolved to aid cooperation; developmental psychologists have demonstrated that the elements that underpin (...) morality are in place much earlier than we thought; and social neuroscientists have begun to map brain circuits implicated in moral decision making. This volume offers an overview of current research on the moral brain, examining the topic from disciplinary perspectives that range from anthropology and neurophilosophy to justice and law. The contributors address the evolution of morality, considering precursors of human morality in other species as well as uniquely human adaptations. They examine motivations for morality, exploring the roles of passion, extreme sacrifice, and cooperation. They go on to consider the development of morality, from infancy to adolescence; findings on neurobiological mechanisms of moral cognition; psychopathic immorality; and the implications for justice and law of a more biological understanding of morality. Samuel Kobia, general (...) secretary of the WCC from 2004–9, introduces the rationale and role of AGEM in the global financial crisis. The book ends with a statement on just finance and the economy of life, adopted by the WCC Central Committee in September 2009. Justice Not Greed will be most useful in settings where there is interest in the intersection of ethics, the economic crisis, and Christianity in relation to the global economy, as well as among those who wish to follow the WCC. As expected [End Page 208] of conference papers, there is not a systematic development of an argument but overlapping ethical and economic analyses. All, however, are opposed to the status quo because of its manifest injustice, especially the impact on poor people.If one were to impose a thematic development, it might go something like this, allowing for individual differences among the authors. Decolonization has resulted in a lopsided, Western, capitalist economic system predicated on greed (Jan Pronk), described by other authors as a beast or a cancer (vivid but unhelpful metaphors since the crisis was caused by humans, not nature). The world lacks appropriate international structures. We need new global institutions, a new global financial architecture that is predicated on, or at least takes into account, justice. Congregations, the ecumenical movement, and the WCC could play a significant role in helping the United Nations move toward such a system.Several authors hope that the global crisis will provide a moment when such a change might become possible (e.g., Alexander Cobham’s “Blood-Stained Silver Lining”). Pamela K. Brubaker, Kim Yong-Bock, Roel Aalbersberg, Rienzie Perera, and Geevarghese Mor Coorilos examine questions related to the Bible, ethics, theology, a culture of “enough for all” (Musa Panti Filibus), the church as moral community, the ecumenical movement, and principles for an alternative economic system. Mariana Issa Zureikat argues for “econo-morals,” applying moral values to economic analyses. Thomas H. Kang advocates the capabilities approach of Amartya Sen and Martha Nussbaum. Marcos Arruda suggests an economy of world solidarity with the “gross happiness index” as a standard for measuring progress. While most chapters include economic analysis, John Dillon wades into some nitty-gritty causes of the current financial crisis, with a positive nod toward the (never adopted) Keynes plan for the Bretton Woods system of monetary management. Marie-Aimee Tourres lays out impacts on the developing world, as does Xiao Lian from a Chinese perspective. Most of these authors argue for such global solutions as a global reserve system and a global tax system.Justice Not Greed presents thoughtful, sometimes passionate papers that could form a basis for lively discussion. Yet real-world solutions often come down to the practice of democracy and political will. Violent video games (VVGs) are a source of serious and continuing controversy. They are not unique in this respect, though. Other entertainment products have been criticized on moral grounds, from pornography to heavy metal, horror films, and Harry Potter books. Some of these controversies have fizzled out over time and have come to be viewed as cases of moral panic. Others, including moral objections to VVGs, have persisted. The aim of this paper is to determine which, if any, of the (...) concerns raised about VVGs are legitimate. We argue that common moral objections to VVGs are unsuccessful, but that a plausible critique can be developed that captures the insights of these objections while avoiding their pitfalls. Our view suggests that the moral badness of a game depends on how well its internal logic expresses or encourages the players’ objectionable attitudes. This allows us to recognize that some games are morally worse than others—and that it can be morally wrong to design and play some VVGs—but that the moral badness of these games is not necessarily dependent on how violent they are. This essay aims to articulate why the Orthodox have historically, and to the present, opposed cremation. Its primary line of argument is that inhumation is a site of “theophanic encounter”: a manifestation of the Glory of God. This theophanic quality is borne out in the scriptures and the Church’s liturgical experience. In particular, the connections between the funeral service and the entombed Christ on Holy Friday and Saturday properly situate the meaning of the post-mortem body. This intimate connection between the (...) deceased and their body is clear in Orthodoxy’s “hylomorphism,” the soul-body unity, which champions the eschatology of resurrection. Finally, all of the above is concretely experienced in the cult of the saints and their relics, which become vehicles for the divine energies: a theophany of Christ’s ongoing conquest of sin and death. Thus, cremation can only be viewed as a tragic misunderstanding of the dual meaning of “doxa” in Orthodoxy: right-belief and right-glory. (shrink)

The article shows that Kuhn's concept of incommensurability emphasizes mainly the objective dimension of communication. To the thesis about the incommensurability of the meanings of scientific concepts in competing paradigms, we oppose the idea of a three-dimensional space of communicative dimensions. We supplement the objective dimension of communication, within which the environmental evolutionary selection of the best knowledge is carried out, with equal social and temporal horizons.

To figure out whether the main empirical question “Is our brain hardwired to believe in and produce God, or is our brain hardwired to perceive and experience God?” is answered, this paper presents systematic critical review of the positions, arguments and controversies of each side of the neuroscientific-theological debate and puts forward an integral view where the human is seen as a psycho-somatic entity consisting of the multiple levels and dimensions of human existence (physical, biological, psychological, and spiritual reality), allowing (...) consciousness/mind/spirit and brain/body/matter to be seen as different sides of the same phenomenon, neither reducible to each other. The emergence of a form of causation distinctive from physics where mental/conscious agency (a) is neither identical with nor reducible to brain processes and (b) does exert “downward” causal influence on brain plasticity and the various levels of brain functioning is discussed. This manuscript also discusses the role of cognitive processes in religious experience and outlines what can neuroscience offer for study of religious experience and what is the significance of this study for neuroscience, clinicians, theology and philosophy. A methodological shift from “explanation” to “description” of religious experience is suggested. This paper contributes to the ongoing discussion between theologians, cognitive psychologists and neuroscientists. (shrink)

The Covid-19 pandemic reveals a new phenomenon, unaddressed by the existing literature on “price gouging” in times of emergency. While merchants – getting large remuneration for providing desperately needed goods – evoke public moral outrage for assumed “price gouging”, employees – getting large remuneration for providing desperately needed services – do not cause such outrage but rather experience moral appraisal for their valuable commitment. To address this inherent inconsistency of moral judgment, we propose to embrace insights from research on folk (...) economics. By understanding the folk perception underlying public outrage at “price gougers,” business ethics might better enlighten the moral legitimacy of anti-“price gouging” measures. (shrink)

John Divers and Joseph Melia have argued that Lewis's modal realism is extensionally inadequate. This paper explains why their argument does not succeed.

In simplified form, the argument that I am defending holds that the incompatibility of our freedom with determinism follows from the conjunction of (1) a plausible supervenience claim which says that whether a human agent is free depends only on what happens during the agent’s life and (2) a freedom-cancellation principle of Richard Gale which says that an agent is not free if all of her actions are intentionally brought about by another agent. This article analyses how Rousseau's First Discourse and the questions it posed about human progress and the reform of society were debated in the institutional context of the Berlin Academy by Formey and Herder. Despite some important disagreements, Formey and Herder fundamentally shared Rousseau's assumption that erudition could be detrimental both to society and to the individual. In order to limit the socially corrosive effects of the arts and the sciences, and in an attempt to realize their full beneficent potential, (...) they called for their reform through institutional regulation and management by a meritocracy of scholarly experts. Drawing on Hume, Herder in particular developed a positive role for the modern state as an active agent of enlightenment, provided it not only promoted the arts and sciences but also guaranteed freedom and the rule of law to ensure their flourishing. Diese neueste Buchveröffentlichung von Professor Vincenzo RUGGIERI SJ, der am Pontificio Istituto Orientale in Rom byzantinische Archäologie und byzantinische Geschichte lehrt, stellt einige archäologische byzantinische Stätten aus seinem traditionellen Forschungsgebiet in der historischen Kirchenprovinz Karien vor, die im westlichen Kleinasien gelegen war. Hier wartet R. nun zum größten Teil mit von ihm selbst aufgefundenen und erforschten Monumenten auf und das vorgelegte Werk kann als die geographisch nördliche Fortsetzung der im selben Verlag bereits im Jahre 2003 erschienenen stattlichen und sehr umfangreichen (...) Monographie über die frühchristlichen und byzantinischen Denkmäler am Golf von Keramos (V. RUGGIERI, Il golfo di Keramos. Dal tardo-antico al medioevo bizantino. Soveria Mannelli 2003. 441 S.; vgl. dazu nun auch die Rezension von: M. DENNERT, Oriens Christianus 89 (2005), 295–297.) begriffen werden – dieser Meeresarm gehört übrigens auch zu Karien. Zugrunde liegen beiden Buchpublikationen Ergebnisse etlicher in den 1990er Jahren durchgeführter systematischer Geländebegehungen (‚Surveys‘) des Forschungsteams um R., von denen an einigen auch der Verfasser dieser Zeilen mitgewirkt hat; vgl. A. Zäh, OCP 63 (1997) 147 ff. Die hier vorgestellten bisher zum größten Teil neu aufgefundenen und hiermit bekannt gemachten byzantinischen Denkmäler sind auf der Halbinsel von Halikarnassos (heute: Bodrum) und im westlichen Karien (Myndos, Bargylia) gelegen – des Weiteren werden hier einige Binnen-Orte in Zentralkarien (Euromos, Mylasa, Labraunda, Stratonikeia und Lagina) und viele weitere kleinere Fundorte vorgestellt. Die großen historischen Stätten des nördlichen Karien, wie Milet, Aphrodisias (Stauroúpolis) oder Antiocheia ad Meandrum, werden nicht behandelt. Die hier vorgeführten Orte und Regionen verfügen über eine stattliche Anzahl von Denkmälern, die nun nicht minder bedeutender sind als der Denkmälerbestand am Golf von Keramos, und das mag damit die hier vorgelegte zusammenfassende weitere monographische Abhandlung rechtfertigen. Denn das Werk fasst die wesentlichen Ergebnisse der Ruggieri-Forschungen der 1990er Jahre zusammen, die bisher über diverse JÖB- und OCP-Artikel verstreut erschienen sind (im Literaturverzeichnis Bibliografia S. 32 f. teilweise aufgeführt) und aus, einschränkend erst im Untertitel genannten, diversen Poleïs und deren Umland in Karien stammen. Das Buch bringt aber im Gegensatz zu diesen Artikeln auch gute farbige Abb. der hier entdeckten byzantinischen Wandmalereien und führt ebenso diverse Fußbodenmosaike und Bauskulpturfragmente erneut – zum Teil allerdings bisher auch völlig unbekanntes Material – in übersichtlicher Art und Weise vor. Das Werk ist als eine Gesamtschau der Ruggieri-Entdeckungen in diesem Gebiet anzusprechen. R. ist dem Kleinasien-Kenner seit langem als ein detailverliebter Beobachter und Auffinder sowie hartnäckiger Initiator und fortwährend laufender verlässlicher Motor einer planmäßigen christlichen kunstgeographischen Erschließung nicht nur dieser Region bekannt – wie es auch diese Publikation eindringlich veranschaulicht. However, it is worth articulating both for the sake of the profession and for the benefit of patients whether such a phrase is at all meaningful and if so what exactly it stands for.
