En effet, les seules choses consistantes dans ma conscience de sujet, ce sont les objets du monde, ma conscience elle-même demeurant résolument inconsistante. Nietzsche a fait face au néant, mais autant que j'en aie compris, il ne s'est pas abandonné; il a au contraire adopté la position héroïque de celui qui tient bon, qui fait face et campe sur sa propre force. Cette position met en jeu des force intérieures considérables, qui donnent une clarté puissante à la conscience, mais qui oblige du même coup celle-ci à se supporter elle-même, à bouts de bras, sans possibilité de lâcher, sous peine de s'écrouler. Cette intensité reposant entièrement sur soi donne un sentiment de vertige, et si on insiste dans cette voie, on peut vraiment avoir l'impression de devenir fou. Car on se retrouve écartelé entre deux choix également impossibles: la surenchère infinie de sa propre puissance et l'anéantissement. Il me semble que Nietzsche a été extrêmement loin dans cette voie, jusqu'à ce que le fil casse. Dans ce sens – je le répète, ce n'est là que ma compréhension des choses – je partage l'avis de Jean-Marie et mushotoku-nad, en disant que Nietzsche n'aurait pas connu l'éveil tel qu'on l'entend ici. Il est resté sur le pas de la porte, refusant farouchement le lâcher-prise salvateur – qu'il aurait pris pour un aveu de faiblesse –, refusant de dire ces mots: "Que Ta volonté soit faite!", les mots par lesquels tout se trouve accompli, persistant au contraire à braver la tempête plutôt que d'accorder à Cela toute-puissance sur lui-même. Eternel retour Lorsqu’on vit un moment d’une totale intensité, on sent bien qu’on touche l’essence de l’être. A partir d’une certaine intensité, on débouche sur quelque chose de substantiel, quelque chose qui EST, et donc qui nécessairement dépasse le petit moi. Simplement, dans un cas comme celui-ci, on reste convaincu qu’il s’agit d’un état d’exception. On a touché l’éveil, la réalité de l’être, mais on n’y est pas entré. Y entrer, c’est réaliser que ce moment que l’on vit comme un état d’exception a en fait toujours été là, que ce n’est véritablement pas un moment d’exception, mais notre vraie nature, la nature de ce qui EST, et que l’état d’exception c’est celui d’en être séparé parce qu’on s’identifie à une illusion. Es gebar das manifeste Universum mit seinen Quantenteilchen, vielfältigen Arten von Energien und Milliarden von Galaxien. Es führte zur Bildung von Sonnensystemen mit Sonnen und Planeten und Energieflüssen, die die Entwicklung von lebenden (glücklich gelegenen) Planeten ermöglichen, die aktive Sonnen umkreisen. Doch der menschliche Körper passt sich nicht den künstlichen Rhythmen an, und wir leiden unter den Folgen. -/- 3Die Wirksamkeit des Immunsystems ist beeinträchtigt, und trotz einer Flut von biochemischen Medikamenten breiten sich Krankheiten aus. Moderne Bevölkerungen sind Stadtbewohner und haben nur begrenzten Kontakt mit der Natur. Sie leben in einer künstlichen Welt und denken, dass es die reale Welt ist. Sie halten sich anderen Lebensformen überlegen und glauben, die Natur nach Belieben beherrschen zu können. Noch vor fünfzig Jahren musste die Tierintelligenzforscherin Jane Goodall gegen die damals noch vorherrschende Überzeugung ankämpfen, dass ChiMenschen sind biochemische Reiz-Reaktions-Mechanismen, keine lebenden und fühlenden Wesen. Heute erkennen wir, dass nicht nur höhere Säugetiere, alle lebenden Organismen und sogar Bäume und Pflanzen sensible Lebewesen sind und sich in dieser Hinsicht nicht grundlegend von uns unterscheiden. Es liegt im besten Interesse unseres körperlichen und geistigen Wohlbefindens, dass wir diese Missverständnisse und fehlerhaften Verhaltensweisen korrigieren. Wenn wir dies tun, gewinnen wir unsere natürliche Gesundheit und Vitalität zurück. Die heilende Wirkung natürlicher Substanzen und Lebensweisen war schon in der Antike Heilern und Weisen bekannt. Seit Hippokrates, der als Vater der modernen Medizin gilt, suchen Mediziner nach Substanzen und Methoden, die das Gleichgewicht und die Verbindung zwischen Mensch und Natur wiederherstellen. Heute wird dieser Anspruch überschattet von einer oft kommerziell motivierten Abhängigkeit von synthetischen Substanzen und naturverachtenden Praktiken. Die Szene ist nicht nur negativ: Wie wir sehen werden, gibt es positive Entwicklungen in allen Bereichen des menschlichen Strebens, einschließlich Heilung und Medizin. Die Verbindung mit der Natur ist ein Hauptziel der alternativen Heilmethoden, die als Informations- und Energiemedizin bekannt sind. Diese Form der Heilung erlebt in verschiedenen Teilen der Welt, vor allem im Orient, eine Renaissance. Shirin yoku, die japanische Kunst des Waldbadens, ist ein Paradebeispiel. Um es zu praktizieren, müssen wir in einen Wald gehen und uns auf seine Rhythmen und Energien eingestimmt fühlen – den Wind durch die Blätter rauschen hören, das Lichtspiel auf der Oberfläche eines Teichs spüren, mit den Wolken schweben, wenn sie sich durch den Himmel bewegen. Psychotherapeuten finden, dass sogar die Geräusche der Natur, das Zwitschern der Vögel, das Rauschen der Bäche heilend wirken. Einfach in einem Wald zu sein oder neben einem Baum zu stehen, beruhigt und heilt das Nervensystem. Eine weitere wesentliche Aufgabe ist es, positive Entwicklungen in der Gesellschaft zu erkennen und daran anzuknüpfen. -/- Es gibt positive Entwicklungen in der Gesellschaft, und es gibt gesunde, lebensspendende und erhaltende Prozesse in der Natur. Wir könnten wieder in die Natur eintauchen und an positiven Entwicklungen in der Gesellschaft teilhaben. Und doch gelingt uns das nicht. Wir beschreiten einen Weg, der eher zum Zusammenbruch als zum Durchbruch führt. Wir müssen überdenken, wie wir gehen, und vor allem, wohin wir gehen. Wir sind eine von mehr als hundert Millionen Arten in der Biosphäre, wobei jede Art Millionen und in einigen Fällen Milliarden von Individuen umfasst. Unter all diesen Arten und Individuen befinden wir uns in einer privilegierten Position: Wir haben ein hoch entwickeltes Gehirn und Bewusstsein. Dies ermöglicht uns zu fragen, wer wir sind, was die Welt ist und wie wir in der Welt leben können und sollen. Ein fortgeschrittenes Bewusstsein ist eine einzigartige Ressource, und wir machen keinen guten Gebrauch davon. Wir stellen nicht die richtigen Fragen und suchen nicht nach den richtigen Antworten, sondern gehen einfach vorwärts und vertrauen auf das Glück. Theologische und mystische Annahmen wurden manchmal als Grund dafür angeführt, dass wir zu dem wurden, was wir sind, aber unser Verhalten göttlichen oder anderen transzendenten Ursachen zuzuschreiben, ist nicht die Antwort. Wir sind weder Engel noch Teufel. Wir wurden zur Geißel, zu der wir unbeabsichtigt geworden sind. Zu Beginn des Neolithikums begann ein Teil der Menschheit, die Ressourcen des Planeten ohne Rücksicht auf irgendetwas und irgendjemanden zu nutzen und sich nur darauf zu konzentrieren, seinen eigenen Komfort und seine eigene Macht zu verbessern. Auf einem endlichen und voneinander abhängigen Planeten führte dies zu unausgewogenen und unhaltbaren Bedingungen. Der egozentrische Umgang mit Ressourcen hat das Netz des Lebens beschädigt. Die menschliche Spezies wurde zu einer Bedrohung für alles Leben auf dem Planeten und auch für sich selbst: Die Gesundheit des Netzes des Lebens ist eine Vorbedingung für die Gesundheit der dort lebenden Spezies. Dies ist eine relativ junge Erkenntnis. Jahrtausendelang gingen die Menschen ihren Daseinsaufgaben nach, ohne sich bewusst zu sein, dass die unreflektierte Verfolgung ihrer eigenen Interessen um sie herum zum Fluch des Lebens wird. -/- Wir sind zu einem Fluch für das Leben auf diesem Planeten geworden; Wir haben die Welt zu einem Spielzeugladen gemacht, in dem wir die leistungsstarken Spielzeuge bauen, die unseren wahrgenommenen Interessen dienen. Wir spielen mit unseren Spielsachen unabhängig davon, ob sie wirklich unseren Bedürfnissen dienen, und ohne Rücksicht auf die Bedürfnisse anderer. Wir setzen die Energie des Atoms frei und nutzen sie, um Systeme anzutreiben, die unsere Bedürfnisse befriedigen. Wir leiten Elektronenströme in integrierte Schaltkreise und verwenden die Schaltkreise, um die Technologien zu beherrschen, die unseren Anforderungen an Kommunikation und Information dienen. Aber das kann nicht unwidersprochen bleiben. Die Zeit, in der wir naiv mit mächtigen Spielzeugen spielen konnten, ist vorbei. Ihre unvorhergesehenen „Nebenwirkungen“ sind zu einer Bedrohung für alles Leben auf dem Planeten geworden, einschließlich unseres eigenen. -/- Vorwärts gehen. -/- Wir sind an der Schwelle des vierten Urknalls angekommen. Wir sind alle Teil desselben sich bewegenden und sich entwickelnden Kosmos, aber der Blick darauf ist von jedem unserer jeweiligen Standorte aus einzigartig. En los albores de la tercera década del siglo XXI, la existencia de la humanidad se ha vuelto sumamente peligrosa. Estamos talando nuestros bosques, agotando nuestros acuíferos de agua dulce y perdiendo nuestros suelos superiores vitales. Estamos eliminando la vida de nuestros océanos y reemplazándola con cientos de millones de toneladas de desechos plásticos. Estamos inundando nuestro medio ambiente con productos químicos industriales tóxicos. Nuestra contaminación está impulsando el cambio climático que provoca olas de calor, sequías e incendios forestales que (...) destrozan el tejido de la vida en los continentes. Y estamos trayendo nuevas generaciones al mundo, millones que requieren acceso a los recursos de una existencia digna. El alcance y la amplitud de las amenazas a la vida aumentan día tras día. Este no es un modo sostenible de desarrollo. In this article the author adduces a non‐positivist argument for a necessary connection between law and morality; the argument is based on the claim to correctness, and it is directed to an attack stemming from Eugenio Bulygin. The heart of the controversy is the claim to correctness. The author first attempts to show that there are good reasons for maintaining that law necessarily raises a claim to correctness. He argues, second, for the thesis that this claim has moral implications. Notre pollution est à l'origine du changement climatique qui provoque des vagues de chaleur, des sécheresses et des incendies de forêt qui (...) déchirent le tissu de la vie sur les continents. Et nous mettons au monde de nouvelles générations, des millions qui ont besoin d'accéder aux ressources d'une existence digne. La portée et l'ampleur des menaces à la vie augmentent jour après jour. Ce n'est pas un mode de développement durable. La cause profonde de nos maux provient d'une façon de penser erronée. Qu'est-ce que cela signifie exactement? cela signifie que nous nous considérons principalement comme des êtres matériels, tout en niant notre nature spirituelle. Parce quenous pensons que nous existons en tant qu'êtres matériels et rien de plus, nous accordons la importance à la protection de notre corps contre les dommages et à la prolongation de notre existence matérielle. The book provides a rich picture of contemporary philosophical theorizing about truth, one that will be essential reading for philosophy students as well as philosophers specializing in other areas. There are three general ways to approach reconciliation: from the side of nonfactualism, from the side of deflationism, or from both sides at once. To approach reconciliation from a given side, as I will use the expression, just means to attend in the first instance to the details of that side’s position. (It will be important to keep in mind that the success of an approach from one side may ultimately require concessions from the other side.) The only attempts at (...) reconciliation in the literature of which I am aware fall in to the first of these three categories. Such writers argue that the tension between our –isms can be resolved by paying sufficiently close attention to the nature of nonfactualism. While I have nothing against this approach in principle, I do have reservations about the particular proposals that have been made in its pursuit. The first section of the present paper briefly develops a line of objection against one such proposal, in order to motivate the approach to reconciliation from the side of deflationism. In section two, I argue that the deflationist can and should reject the inference from (2) to (3) above. Section three addresses a special problem of reconciliation for the nonfactu- alist who continues to use the discourse she takes to be factually defective. By paying close attention to the details of deflationism about reference, I show how a deflationist about truth might avoid this problem. I conclude that deflationism can be developed in a way that renders it compatible with nonfactualism. (shrink)

Non-medical or Social egg freezing (oocyte cryopreservation) is currently a controversial topic in Islam, with contradictory fatwas being issued in different Muslim countries. While Islamic authorities in Egypt permit the procedure, fatwas issued in Malaysia have banned single Muslim women from freezing their unfertilized eggs (vitrified oocytes) to be used later in marriage. The underlying principles of the Malaysian fatwas are that (i) sperm and egg cells produced before marriage, should not be used during marriage to conceive a child; (ii) (...) extraction of mature egg cells from single women being unacceptable; and (iii) fertility preservation in anticipation of late marriage is a conjecture that has not yet occurred. Ovarian tissue freezing can potentially be a more Shariah-compliant alternative to social egg freezing, because once the frozen ovarian cortical tissue sections have been re-transplanted back into the woman, mature egg cells can readily be produced, collected, and fertilized by the husband’s sperm only during the period of marriage contract (′akd al-nikāḥ). Unlike accidental mix-ups with frozen eggs, muddling of lineage (nasab) would be automatically avoided in ovarian tissue freezing due to immunological rejection. However, upon critical analysis based on Qawā’id Fiqhiyyah (Islamic Legal Maxims), Maqāṣid-al-Shariah (Higher Objectives of Islamic Law), and Maslaḥah-Mafsadah (benefits versus harmful effects on society), elective ovarian tissue freezing by healthy single women for social reasons would likely be a highly contentious and controversial issue within Muslim communities that may conflict with conservative social-religious norms. This thus needs further debate among Islamic jurists in dialogue with medical doctors and biomedical scientists. (shrink)

In this article, I take up two arguments in favor of the discursive model of legal argumentation: the claim to correctness argument and the dual nature thesis. The argument of correctness implies the dual nature thesis, and the dual nature thesis implies a nonpositivistic concept of law. The nonpositivistic concept of law comprises five ideas. One of them is the special case thesis. The special case thesis says that positivistic elements, that is, statutes, precedents, and prevailing doctrines, are necessary for (...) law in order to achieve legal certainty. Without this, law would not be as perfect as it could possibly be. But it says, at the same time, that this alone would not be enough to fulfill the claim to correctness. The claim to correctness refers not only to the real dimension of law, defined by statutes, precedents, and prevailing doctrines, but also to its ideal dimension, defined, first and foremost, by justice. The special case thesis is my oldest thesis. It has remained an essential element of my system over the years. Its connection with four other theses—the Radbruch formula, the human rights thesis, the idea of deliberative democracy, and principles theory—does not change this at all. On the contrary, this connection has lent greater strength to the special case thesis. (shrink)

Recent philosophy of language has been profoundly impacted by the idea that mainstream, model-theoretic semantics is somehow incompatible with deflationary accounts of truth and reference. The present article systematizes the case for incompatibilism, debunks circularity and “modal confusion” arguments familiar in the literature, and reconstructs the popular thought that truth-conditional semantics somehow “presupposes” a correspondence theory of truth as an inference to the best explanation. The case for compatibilism is closed by showing that this IBE argument fails to rule out (...) two kinds of deflationism: the position Field famously accused Tarski of having; and a less familiar version of the view that defines reference in terms of a deflated notion of truth. Finally, the distinction between unifying and constitutive explanation is used to forestall the response that correspondence theory is literally part of mainstream semantics. (shrink)

Evaluations of social media’s impact on friendship have often focused on risks and drawbacks. In this chapter, both empirical and philosophical resources are surveyed and a more nuanced conclusion is defended. While social media platforms and users are too diverse to support simplistic conclusions, investigating the details of shared activity and influence on character in the context of social media interactions, we can find evidence of genuine benefits as well as hazards, and the evolving and emerging details of social media (...) usage and practices provide opportunities to enhancephilosophical theorizing about friendship. For the Life of the World represents a landmark discussion of social ethics within the Orthodox academy in the West. This article begins by looking at the document's self-understanding as an exploratory rather than a definitive text that seeks to provoke rather than curtail discussion. The overarching matter of how even the possibility of a viable social ethos is debated in modern Orthodoxy is briefly dealt with through the lens of ethical apophaticism and cataphaticism. The document itself, a cataphatic contribution (...) in this regard, is then examined in terms of its ethical priorities, its tone in addressing these priorities, as well as its overall theological coherence. Potential ambiguities and dissonance in the document are highlighted. A concluding appeal is made for more work on clarifying the Orthodox theological presuppositions that go into crafting Orthodox social ethics, and a positive proposal is offered, centred on an Orthodox ethos of repentance. Which concepts should we use to think and talk about the world and to do all of the other things that mental and linguistic representation facilitates? This is the guiding question of the field that we call ‘conceptual ethics’. Conceptual ethics is not often discussed as its own systematic branch of normative theory. A case can nevertheless be made that the field is already quite active, with contributions coming in from areas as diverse as fundamental metaphysics and social/political philosophy. To speak of democracy is often to speak less of a fact than of a hope. In his introduction to Democracy in America, Alexis de Tocqueville admitted that ‘… in America I saw more than America; I sought the image of democracy itself, with its inclinations, its character, its prejudices and its passions, in order to learn what we have to fear or to hope from its progress’. De Tocqueville recognised that democracy's success would rely on its constant promotion, (...) the affirmation and revaluation of its terms and conditions, such that it sustains the investedness of its (voluntary) participants. This paper considers the work of Stanley Cavell as inheriting the tone of de Tocqueville's romantic will to democracy, particularly in the discovery of its analogous image in ‘remarriage comedy’. I look first at the ways in which popular pictures of (in this case, American) democracy on film sustain an expression of hope for a better set of relations amongst equal and consenting participants, an expression that is identified as romantic in nature. By contrast, I will also discuss how representations of democracy's reality on screen—pictures that sit outside comfortable generic expectations, and reveal those moments in which interest in democratic participation or values has ebbed or is dormant—have as much to tell us about democracy's character as more idealist expressions of what it might be or become. The Old Regime and the Revolution is Alexis de Tocqueville's great meditation on the origins and meanings of the French Revolution. One of the most profound and influential studies of this pivotal event, it remains a relevant and stimulating discussion of the problem of preserving individual and political freedom in the modern world. Alan Kahan's translation provides a faithful, readable rendering of Tocqueville's last masterpiece, and includes notes and variants which reveal Tocqueville's sources and include excerpts from his drafts (...) and revisions. This paper explores the conceptual history of academic freedom and its emergence as a substantive right that pertains to either the academic or the university. It is suggested that historical reconceptualisations necessitated by contingent circumstance may have led to academic freedom being seen as a form of protection for those working within universities whose national legislation recognises the right to teach and research without external interference, rather than as a responsibility to the wider society or to peers in other parts (...) of the world, who do not enjoy the privilege of that right. I explore the value of academic freedom as both right and responsibility, particularly taking into consideration the ethical implications for both at the international level in higher education. The author outlines his thesis that legal discourse is a special case of general practical discourse (Sonderfallthese) and develops it as an attempt to cover both the authoritative, institutional, or real and free, discursive, or ideal dimension of legal reasoning. On this basis, he examines the objections raised by Habermas (1996) to the special case thesis. First, he discusses the reduction of general practical discourse to moral discourses (genus proximum problem) holding that the former is a combination of moral, ethical, (...) and pragmatic arguments within the priority of just; second, he examines the objection that general practical arguments change their character or nature when employed in legal contexts (subset and specification problem) and the related problems concerning legal validity and unjust law. He concludes proposing a procedural (opposite to a coherential) integration of general practical arguments in the legal context. (shrink)

Enhancing synchronization among people when synchronization is lacking is believed to improve their social skills, learning processes, and proficiency in musical rhythmic development. Greater synchronization among people can be induced to improve the rhythmic interaction of a system with multiple dancing robots that dance to a drum beat. A series of experiments were conducted to examine the human–human synchrony between persons that participated in musical sessions with robots. In this study, we evaluated: (a) the effect of the number of robots (...) on a subject’s ability to synchronize with an experimenter; (b) the effect of the type of robot synchrony, namely, whether the robots did or did not represent the subject’s rhythm; (c) the effect of an in-sync and out-of-sync robot on a subject’s behavior. We found that: (a) three robots increased the level of synchronization between the subject and experimenter and their enjoyment level; (b) robots may induce greater synchronization between the subject and experimenter by reproducing the rhythms of not only the experimenter but also of the subject compared to when only the experimenter’s rhythms had been reproduced; (c) the robots in-sync had greater influence on the natural rhythm of the subject. In this paper we consider some of the problems inherent in the attempt to define and circumscribe an exclusively ‘educational love’, as presented by Joris Vlieghe and Piotr Zamojski in a recent paper for this journal. In seeking to move beyond the confusing interpersonal relations involved in student-centred discourses on teaching, the authors aim to articulate an ‘educational love’ that is more oriented towards subject matter than the student subject. In the process, the concept of love itself becomes increasingly abstract (...) and open to interpretation. Further, the attempt to reconcile these elements in an uncomplicated ‘love for the object’, following the example of Alain Badiou's St Paul, constitutes an injustice to the other subjects—the students—involved in the teaching situation. We consider the ways in which such abstractions might sit with student teachers, to demonstrate how and why the intersubjective dimension—with some of the possible emotive messiness that is implied therein—must not fade from view, if we are to avoid conceiving of education as something that can be purified of individual interest, motivation and desire.
