This paper is an introduction to a virtual special issue of AI and Law exploring the legacy of the influential HYPO system of Rissland and Ashley. The papers included are: Arguments and cases: An inevitable intertwining, BankXX: Supporting legal arguments through heuristic retrieval, Modelling reasoning with precedents in a formal dialogue Game, A note on dimensions and factors, An empirical investigation of reasoning with legal cases through theory construction and application, Automatically classifying case texts and predicting outcomes, A factor-based definition (...) of precedential constraint and An improved factor based approach to precedential constraint. After describing HYPO, in this introduction to the special issue I look at various aspects of its influence on AI and Law: the developments led by Rissland at Amherst; the developments led by Ashley in Pittsburgh; the expression of these ideas in terms of rule based systems, and their subsequent formalisation; value based theories, which were inspired by a critique of HYPO; and contemporary approaches which revive the idea of dimensions. Husserl on the Ego and its Eidos (Cartesian Meditations, IV) ALFREDO FERRARIN THE THEORY OF the intentionality of consciousness is essential for Husserl's philosophy, and in particular for his mature theory of the ego. But it runs into serious difficulties when it has to account for consciousness's transcendental constitution of its own reflective experience and its relation to immanent time. This intricate knot, the inseparability of time and constitution, is most visibly displayed in Husserl's writings from the 192os up (...) to the notion of the eidos ego in the fourth Cartesian Meditation. In this paper I want to dwell on the most problematic aspects of this theory. After a few preliminary remarks about the intentionality of consciousness (sec- tion 1), I try to place the theory of the substrate of habitualities in the context of Husserl's evolution on the issue of the reflection of the ego on itself (section ~). Husserl's Entwicklungsgeschichte on the topic of the pure ego has already been the object of important scholarly works, of which Kern's 1964 Husserl und Kant seems to me the best example. But what the secondary literature does not do is develop thematically the ambiguities of Husserl's definitions of consciousness and temporality in a unitary and comprehensive way. While I follow the lead of Berger, Broekman, Kern, Marbach,' and others, I find that their work does not sufficiently stress the difficulties at the core ofintentionality and reflective time- consciousness. Therefore, although section 2 is a necessary presupposition for drawing some critical conclusions in the final two sections, it does not exhaust my theme. After clarifying the peculiarity of the notions of essence, intuition, tran- scendental and apriori, as well as their irl:educibility to a Kantian meaning, I turn to the "de facto transcendental ego" resulting from eidetic variation (section 3) in order to introduce an examination of temporality. The difficul- ties in the twofold requirement, namely, that consciousness be the identical subject of its Erlebnisse and be synthetically unified in time, concern the unity, primacy, and mutual relation of time and consciousness in the constitution of our experience. They have been heady pointed out by Ricoeur in his commen- tary on the Cartesian Meditations. But what I want to argue in section 4, going beyond Ricoeur's text, is that the tension between temporally constituted and constitutive consciousness in the ego's reflection on its own retentions and protensions does not simply make the question of time ambiguous, but has crucial and problematic bearings on the very definition of consciousness as intentionality. Reasoning with cases has been a primary focus of those working in AI and law who have attempted to model legal reasoning. In this paper we put forward a formal model of reasoning with cases which captures many of the insights from that previous work. We begin by stating our view of reasoning with cases as a process of constructing, evaluating and applying a theory. Central to our model is a view of the relationship between cases, rules based on cases, (...) and the social values which justify those rules. Having given our view of these relationships, we present our formal model of them, and explain how theories can be constructed, compared and evaluated. We then show how previous work can be described in terms of our model, and discuss extensions to the basic model to accommodate particular features of previous work. In this paper, we take up an old issue that of pragmemes, broached by Mey and further explored by Capone. It is not easy to define pragmemes and distinguish them sufficiently from speech acts (units of language use broached by Austin and Searle) or from Wittgensteinian language games or from macro speech acts (see van Dijk on macrostructures) or from Goffman’s scripts. The best idea we could develop about pragmemes is that they instantiate the triple articulation of language, proposed (...) by Jock Wong; being essentially composed of phonological-syntactic units, that have a certain content relative to a social situation and to a certain culture, pragmemes express a certain function (or illocutionary force), like, e.g., modifying society or some aspect of it. They are part of a chapter that can be called either “societal pragmatics” or “emancipatory pragmatics,” to use the words by Mey. In fact, knowledge of how language is used to diminish the rights of people and to propagate the “status quo” may be instrumental to give rights and power to ordinary human beings who are oppressed by political and economical structures. -/- . The transition and adaptation of students to higher education involve a wide range of challenges that justify some institutional practices promoting skills that enable students to increase their autonomy and to face the difficulties experienced. The requirements for this adaptation were particularly aggravated by the containment and sanitary conditions associated with coronavirus disease 2019. With the aim of promoting academic success and preventing dropout in the first year, a support program was implemented for students enrolled in two courses in the (...) area of education at a public university in northern Portugal during the first semester of 2020/2021. Three sessions of 50/60 min were implemented, namely, the first session focused on the verbalization of the demands, challenges, and difficulties of the transition, and the second and third sessions focused on the difficulties of academic adaptation and academic performance. Data from a dropout risk screening instrument and from the activities performed during sessions were analyzed. The main results point to student satisfaction with the content and the activities of the sessions and their usefulness. Students report not only high satisfaction levels with HE attendance, but also some emotional exhaustion due to academic activities. The continuity of the program is recommended with some improvements in its planning to ensure a more definitive version of the program in the next two years. (shrink)

This paper examines the task of understanding dialogues in terms of the mental states of the participating agents. We present a motivating example that clarifies the challenges this problem involves and then outline a theory of dialogue interpretation based on abductive inference of these unobserved beliefs and goals, incremental construction of explanations, and reliance on domain-independent knowledge. After this, we describe UMBRA, an implementation of the theory that embodies these assumptions. We report experiments with the system that demonstrate its ability (...) to accurately infer the conversants’ mental states even when some speech acts are unavailable. The world's population is currently overcoming one of the worst pandemics, and the psychological and social effects of this are becoming more apparent. We will present an analysis of the psychosocial effects of COVID-19: first, a cross-sectional study in an Ecuadorian sample and second, a comparative study between two samples from the Ecuadorian and Spanish populations. Participants completed an online survey to describe how they felt before and after confinement; analyze which emotional and behavioral variables predict depressive symptoms, anxiety, and (...) stress perceived after the confinement; carry out a comparative study in a sample of Ecuadorian and Spanish surveys. Results indicate, first, that Ecuadorians experience significantly more depressive symptoms, anxiety, and stress after confinement. Second, variables which predict depressive symptoms and anxiety are greater public prosocial tendency, less stress as a challenge, and greater stress as a threat, as well as an empathetic tendency that implies greater emotional regulation. Experienced stress after confinement was predicted by a greater public prosocial tendency, as well as an empathetic tendency. Finally, scores for depression, anxiety, and stress are higher after confinement in both countries. However, results reveal the similarity of the psychosocial effects that are being experienced, regardless of the country, and the differences in the variables that can help explain these effects. This can contribute to the constitution of intervention plans which aim to soften and alleviate the effects produced by a situation such as that experienced with COVID-19. (shrink)

In this chapter I deal with indirect reports in terms of language games. I try to make connections between the theory of language games and the theory of indirect reports, in the light of the issue of clues and cues. Indirect reports are based on an interplay of voices. The voice of the reporter must allow hearers to ‘reconstruct’ the voice of the reported speaker. Ideally, it must be possible to separate the reporter’s voice from that of the reported speaker. (...) When we analyze the language game of indirect reporting, we ideally want to establish which parts belong to the primary voice and which parts belong to the reporter’s voice. In this paper I apply considerations on language games by Dascal et al. and I explore the dialectics between abstract pragmatics principles and considerations about situated uses that are sensitive to cues and clues. The field of affective neuroscience has emerged from the efforts of Jaak Panksepp in the 1990s and reinforced by the work of, among others, Joseph LeDoux in the 2000s. It is based on the ideas that affective processes are supported by brain structures that appeared earlier in the phylogenetic scale (as the periaqueductal gray area), they run in parallel with cognitive processes, and can influence behaviour independently of cognitive judgements. This kind of approach contrasts with the hegemonic concept of conscious (...) processing in cognitive neurosciences, which is based on the identification of brain circuits responsible for the processing of (cognitive) representations. Within cognitive neurosciences, the frontal lobes are assigned the role of coordinators in maintaining affective states and their emotional expressions under cognitive control. An intermediary view is the Damasio-Bechara Somatic Marker model, which puts cognition under partial somatic-affective control. We present here our efforts to make a synthesis of these views, by proposing the existence of two interacting brain circuits; the first one in charge of cognitive processes and the second mediating feelings about cognitive contents. The coupling of the two circuits promotes an endogenous feedback that supports conscious processes. Within this framework, we present the defence that detailed study of both affective and cognitive processes, their interactions, as well of their respective brain networks, is necessary for a science of consciousness. In this paper, we discuss an utterance/pragmeme/pract by Donald Trump addressed to FBI Director Comey: ‘I hope you will let Flynn go’ ). We consider the explicature of this utterance and its illocutionary and perlocutionary effects. We argue that while Republicans opt for an Austinian or Searlian analysis, in the attempt to deny that this utterance constitutes an attempt to influence Comey, there are reasons for adopting a Strawsonian analysis, casting it in the framework of pragmemes, worked out by to (...) cast a socio-pragmatic analysis of utterance interpretation in context. According to this analysis, Trump illicitly tried to persuade Comey to drop the Russian investigation, interfering with the judiciary power. A case can be made for obstruction of justice. (shrink)

In this paper we describe a method for the specification of computationalmodels of argument using dialogue games. The method, which consists ofsupplying a set of semantic definitions for the performatives making upthe game, together with a state transition diagram, is described in full.Its use is illustrated by some examples of varying complexity, includingtwo complete specifications of particular dialogue games, Mackenzie's DC,and the authors' own TDG. The latter is also illustrated by a fully workedexample illustrating all the features of the game.

We argue, in light of Collapse Model interpretation of quantum theory, that the fundamental division between the quantum and classical behaviors might be analogous to the division of thermodynamic phases. A specific relationship between the collapse parameter $$(\lambda )$$ and the collapse length scale ( $$r_C$$ ) plays the role of the coexistence curve in usual thermodynamic phase diagrams. We further claim that our functional relationship between $$\lambda$$ and $$r_C$$ is strongly supported by the existing International Germanium Experiment (IGEX) collaboration (...) data. Este artículo demuestra los resultados de la aplicación de La Filosofía para Niños (FpN) como propuesta didáctica para el fortalecimiento de actitudes críticas y reflexivas sobre el tema de la identidad cultural de manera dialógica en un contexto escolar de Educación General Básica Superior en Cuenca (Ecuador). Celebrando os quarenta anos de A Hermenêutica do Sujeito — o curso ministrado por Michel Foucault no Collège de France, em 1982 —, este texto propõe-se a estabelecer conexões, gerais e específicas, entre aquele curso e a Educação. É feita uma discussão acerca da perspectiva analítica não metafísica adotada por Foucault, em contraste com o atual discurso pedagógico interpretativo dominante. São discutidos os sentidos que se pode dar a alguns insights daquele curso, em suas relações com a Educação contemporânea. Propondo-se (...) uma diferenciação entre pedagogia e Pedagogia, destaca-se a função subjetivante das práticas pedagógicas na educação escolarizada. Argumenta-se em favor da ontologia histórica, em oposição à ontologia transcendental e recorre-se ao conceito de frame, de modo a ressaltar sua importância e limitações em estudos como este. Discute-se a inversão moderna que colocou ênfase no preceito do “conhece-te a ti mesmo” (gnôthi seautón), deixando em segundo plano o preceito do “cuida de ti mesmo” (epiméleia heautoû), do que resultou a substituição do ideal antigo do sujeito das ações corretas pelo ideal moderno do sujeito dos saberes verdadeiros. Weaves: between Hermeneutics of the Subject and Education Abstract: Celebrating the forty years of The Hermeneutics of the Subject —the course by Michel Foucault at the Collège de France, in 1982—, this text proposes to establish connections, both general and specific, between that course and Education. A discussion is made about the non-metaphysical analytical perspective adopted by Foucault, in contrast to current dominant interpretive pedagogical discourses. The meanings that can be given to some insights from that course are discussed, in their relations with education. Proposing a differentiation between pedagogy and Pedagogy, the subjectivizing function of pedagogical practices in schools is highlighted. We argue in favor of historical ontology, as opposed to transcendental ontology, and we resort to the concept of frame, in order to emphasize its importance and limitations in foucauldian studies. We discuss the modern inversion that placed emphasis on the precept “know thyself” (gnôthi seautón), leaving in the background the precept “take care of yourself” (epiméleia heautoû), which resulted in the replacement of the ideal of the subject of correct actions by the modern ideal of the subject of true knowledge. We review the variety of meditation practices and discuss the non-dual view of the mind and the body, proposing the concept of a Feeling Self, which is empty of essence and constituted by the dynamics of experience. This concept is consistent with the principles advanced by Nagarjuna in the Buddist Mahayana tradition and the interdisciplinary ontology of Triple-Aspect Monism. The principles of co-origination and interdependence, advanced by Nagarjuna, suggest that the conscious Self is integrated in the whole of reality. The (...) Feeling Self results from habits developed during the life history of a person, anchors in brain functions (attention, learning, memory) and persists during a lifetime. (shrink)

Este estudio parte de una formación realizada con profesorado de secundaria que persigue desarrollar competencias históricas y multimodales de forma integrada. En concreto, analiza si el aprendizaje mediante diseño de microdocumentales es un modelo formativo que responde a las necesidades del profesorado y valora si esta formación ha sido transformadora. Se emplea un modelo participativo, de corte cualitativo, en el que participan nueve docentes de cuatro centros de secundaria. Las conclusiones apuntan a que este modelo formativo responde a las necesidades (...) del profesorado y ayuda a implementar una práctica transformadora. Asimismo, contribuye al desarrollo de competencias históricas del profesorado, a su alfabetización multimodal y competencia digital, si bien se observa la necesidad de profundizar en la práctica multimodal y de desarrollar una mayor confianza en su competencia digital. Abstract -/- In this paper, I shall deal with quasi-(proper) names, that is expressions like ‘Mum’, ‘Dad’, ‘Grandpa’, ‘Grandma’ in English or ‘Papà’, ‘Mamma’, ‘Nonna’, ‘Nonno’ in Italian. I shall use examples both from English and Italian. Quasi-names are directly referential like proper names, even if they apparently exhibit some conceptual materials, which, however, are not active and are inert. They can be used as vocatives or as arguments of verbs. I called terms like ‘Mum’, ‘Dad’ ‘quasi-names’ because they have (...) certain characteristics of names (but they could also be called ‘indexical names’). They confer significance to an individual. Quasi-names are indexical, although the word ‘I’ does not appear in the proposition expressed. (shrink)

El estudio estuvo destinado a determinar la necesidad de formación profesional sindical del representante de los trabajadores en la negociación colectiva. Los resultados principales son los siguientes: la diferencia entre la formación profesional y sindical esta en que la formación sindical es importante debido a que permite dotar a los cuadros sindicales de información general sobre el rol de los sindicatos y su papel en la negociación colectiva, por otro lado la formación profesional es importante ya que es una herramienta (...) que permite mejorar la calidad del empleo, entre otros, se determino que la formación profesional sindical del representante de los trabajadores, influye en su desempeño como negociador en una negociación colectiva. We examine the extent to which host country income inequality influences multinational enterprises’ (MNE) expansion strategy for foreign production investment, depending on their specific strategic objectives. Applying a transaction cost framework, we predict that national income inequality has an inverted U-shaped relationship with foreign production investment. As inequality increases, MNEs accrue lower transaction costs arising from interactions with various local actors, leading to higher probability of investment. As income inequality increases further, its effect on location attractiveness will become negative, as (...) its attraction effect is increasingly offset by additional monitoring, bargaining, and security costs owing to the more fractious nature of high inequality societies. In addition, we suggest that the impact of income inequality is contingent on investment objectives: The inverted U-shaped relationship is stronger for efficiency-seeking investment but weaker for market-seeking and competence-enhancing investments. We find substantial support for our hypotheses through an analysis of 27 years (1986-2012) of data on Japanese MNEs’ overseas production entries. (shrink)

Este articulo pretende brindar elementos sobre el tema de las identidades puestas al servicio de proyectos políticos y económicos. Es, conforme a una costumbre de quien firma este artículo, un diálogo entre el pasado y el presente, a la vez que se hace un esfuerzo de contextualización. El patriotismo emerge como coartada de intereses económicos, dejando una cauda de odios, sobre los que se debe pensar y contribuir a actitudes de hermanamientos. Esta colaboración se centra en el nuevo colonialismo hispano, (...) de índole ultraconservador, aunque no están exentas otras fuerzas del espectro político. El trabajo, sobre todo, se centra en colaboraciones periodísticas críticas del ultraconservadurismo, por lo que se inscribe en un análisis de medios de comunicación. A modo de tipologías de fuentes podemos resaltar el texto de la BBC que muestra la preocupación hispana sobre la postura del Gobierno de Biden que recuerda la vieja pugna hispanismo-panamericanismo; el texto de Miriam Hernández Reina como asiento referencial de los nuevos aires de la ultraderecha española en América Latina; la combinación de los intereses políticos y económicos de dicha tendencia política en clave colonial, así como las preocupaciones del mundo de las izquerdas y ciertas pautas a seguir para contrarrestar la influencia creciente de la extrema derecha en las redes sociales. In this paper, I try to expatiate on the poetic function of language on the basis of considerations by Jakobson and Waugh. I try to bring in the consideration that pragmatics plays an important role in elucidating the poetic function of language. Contextualism allows us to interpret a poem: referents must be fixed or need not be fixed due to the requirements of the discourse; citations are brought in through pragmatic ways; polyphony is achieved by taking into account the context (...) of previous analyses of a poetic text; the vicinity of a certain word, or concept or line is likely to affect the interpretation of a certain expression; the poetic text can take different forms, from graffiti to discourse at the market place, to discourse between lovers. All these forms of poetic text would not exist if the notion of poetry did not include the idea of semantic/pragmatic compression which is matched, in interpretation, by expansions. (shrink)

This paper discusses some engineering considerations that should be taken into account when building a knowledge based system, and recommends isomorphism, the well defined correspondence of the knowledge base to the source texts, as a basic principle of system construction in the legal domain. Isomorphism, as it has been used in the field of legal knowledge based systems, is characterised and the benefits which stem from its use are described. Some objections to and limitations of the approach are discussed. Learning self-regulation skills is essential for proper neurobiological and psychosocial development in childhood. In this study, we investigated the role of breathing, considered a fundamental resource for many meditation practices, as a tool to promote self-regulation in preschool-aged children. Respiratory modulation has been used as a technique in promoting psychophysiological regulation, due to its beneficial effect on the functioning of the autonomic nervous system (ANS), to its important role in the regulation of metabolism, and for promoting the entrainment of all (...) the oscillatory systems in the body. The study has the goals of reviewing the psychophysiological basis of respiration, its relation to cognitive and affective processing, and to evaluate the capacity of preschool children to learn a breathing technique for self-regulation, supporting the development of educational strategies and health intervention programs that adopt meditation practices as a method to promote psychophysiological self-regulation in children. The so-called uncontrolled donation after circulatory determination of death (uDCDD) have been implemented in several countries, including Spain and France, to increase the availability of organs for transplantation. These protocols allow obtaining kidneys, livers and lungs of patients who do not survive cardio-pulmonary resuscitation performed in out-of-hospital settings. Simultaneously with the development and recent proliferation of these protocols, some emergency teams have begun to employ unconventional methods of CPR, with still uncertain but promising results. The coexistence of these two possibilities (...) raises some questions: At what point should attempts to save a patient with circulatory arrest be abandoned so that this individual can begin to be considered as a potential organ donor? How to manage potential conflicts of loyalties that may arise within emergency and procurement teams? How should the information to the families of those patients and potential organ donors be managed? This article gathers the conclusions of a workshop in which an interdisciplinary working group addressed these and other questions related to DCDD and non-conventional CPR. (shrink)

The analysis of the operation of tourism companies will provide valid information for the design of policies to reactivate the tourism industry, which has been strongly affected during the pandemic generated by COVID-19. The objective of this paper is to use soft computing techniques to analyse tourism companies in Ecuador. First of all, dimensionality reduction methods are applied: principal component analysis, isometric feature mapping and locally linear embedding, on data of tourism enterprises in Ecuador for the year 2015. In addition, (...) to verify the trend of operational variables, the data of tourism companies in Ecuador in 2019 and 2020 are analysed with dimensionality reduction methods that improve the interpretation by minimizing the loss of information. The data sets are analysed with k-means, k-medoids and Hierarchical Clustering, generating groups according to similar characteristics. The optimal number of clusters is determined with the following: Elbow Method, Silhouette Coefficient, Davies-Bouldin Index and Dunn Index. In addition, an analysis of the operation of tourism companies in the year 2020 concerning previous years is included. The study allows exploring Soft Computing techniques to identify important information for the definition of strategies that contribute to an effective reactivation of the tourist industry of Ecuador.
