Çalışma, Muhammed b. Mustafa el-Alâî’ye (ö. 1234/1818) nispet edilen Şerḥ-i İrâde-i cüzʾiyye risâlesinin ona aidiyeti üzerine yoğunlaşacaktır. Muhammed b. Mustafa el-Alâî’nin kendisine ait olduğunu söylediği ve ona nispet edilen Şerḥ-i İrâde-i cüzʾiyye risâlesi aslında Dâvûd-i Karsî’nin (ö. 1169/1756) Risâle fi’l-iḫtiyârâti’l-cüzʾiyye ve’l-irâdâti’l-ḳalbiyye adlı risâlesinin kısmen değiştirilmiş bir versiyonudur. Alâî, Karsî’nin risâlesinden ihtiyaç duymadığı bazı bağlam ve konuları çıkararak ve gerekli gördüğü bazı başlıkları da Ebû Saîd el-Hâdimî’nin (ö. 1176/1762) el-Berîḳatu’l-maḥmûdiyye eserinden eklemeler yaparak oluşturduğu Şerḥ-i İrâde-i cüzʾiyye risâlesi, içerik açısından (...) dikkate alındığında intihalin en bariz görüldüğü bir eser niteliğindedir. Osmanlı ilim düşüncesi dikkate alındığında irade ve insan fiilleri konusunda büyük bir literatürün ortaya konulduğu ve bu metinlerin konu hakkında belli bir fikrin yerleşmesinde etkisi olduğu bilinmektedir. Belli bir dönemde telif edilen risâlelerin muhteva olarak sonraki risâle ve eserlerin muhtevasını etkilemiş olması ve bu nedenle kısmî tedâhüllerin olması sıkça karşılaşılan bir durumdur. Fakat başkasına ait bir telif üzerinde tikel bir değişiklik yaparak eseri kendisine nispet etmek ilmî olarak kabul edilemez bir durumdur. Araştırmanın konusu olan Alâî’nin risâlesi de ikinci türden bir risâle hüviyetindedir. Risâlenin tamamına yakın bir bölümü Karsî’nin konu hakkındaki risâlesi kısmen değiştirilerek oluşturulmuş ve Dâvûd-i Karsî’ye herhangi bir atıfta bulunulmamıştır. Bu çalışmada amaçlanan ise Alâî’nin kendisine nispet ettiği bu risâlenin aslında Karsî’ye ait olduğunu karşılaştırmalı tablolar üzerinden ortaya koymaktır. Bu bağlamda hem Karsî hem de Alâî’ye ait her iki metin tablolar üzerinden baştan sona kadar karşılaştırılmış; ortak ve farklı noktalar tespit edilerek gösterilmeye çalışılmıştır. Karşılaştırmalar neticesinde risâlenin Karsî’ye aidiyeti kesin şekilde tespit edildiğinden bahsi geçen intihal olgusunun bizzat Alâî tarafından mı, yoksa başka birisi tarafından mı yapıldığı sorusuna dikkat çekilmiştir. Ayrıca Alâî’nin Ebû Saîd el-Hâdimî’den kaynak göstermeden alıntı yaptığı yerler de tespit edilerek metin üzerinde farklı bir renkle gösterilmiştir. Son olarak bütünsel bir bakış imkânı sunması için Alâî’ye ait risâlenin tahkiki de yapılmıştır. Metnin tahkikinde Karsî’nin metninde mevcut olup Alâî’nin metninde olmayan ve anlamı tamamlayan kelimeler ile cümleler köşeli parantez içinde gösterilmiştir. Ayrıca Karsî’nin metninde metin-şerh ayrımı olduğundan Alâî’nin risâlesindeki bu ayrım da tespit edilmiş böylece metin bold ve parantez içinde gösterilirken şerh ise normal yazı stiliyle gösterilmiştir. Çünkü bu metin-şerh ayrımının gösterilmesi, metnin anlaşılması ve bütünlüğü açısından elzem bir durum arz etmektedir. (shrink)

In an era when the public and shareholders increasingly demand greater accountability from institutions for racial injustice and slavery, scholarship on corporate reparations is more and more essential. This article argues that corporations have played a significant role in the cultural dehumanization of Blackness and therefore have a particular responsibility to make repair. Cultural dehumanization refers to embedding anti-Blackness into US culture in service of capitalist profit accumulation, which has resulted in status and material inequalities between Blacks and whites that (...) have persisted from slavery to the present. More specifically, the article argues corporations have a moral duty to offer reparations to Black Americans regardless of any redress offered by other perpetrators of anti-Blackness. It appeals to tort law in providing a moral justification for corporate reparations to Black Americans. (shrink)

Literature, especially poetry, has undoubtedly had a great place in the cultural history of the Arabs. Arab poet in the period of ignorance; It had many critical functions, such as making the heroism of the tribesmen epic, immortalizing the names of the deceased, and providing a kind of psychological superiority by satirizing the opposing tribes and people. Poetry continued to exist in all areas of life after Islam, as poetry spread to the cultural codes of the Arabs. As a manifestation (...) of this, poems were utilized to the maximum in Islamic disciplines that were formed in the following years. Arabic poetry has been one of the reference sources of Islamic sciences such as tafsir, hadith and qiraat, not just linguistic studies such as nahiv. The application of the process of bringing evidence from this poem, which is termed as istishhad in istilah, is also seen in the hadith annotations. While the commentators were looking for the meaning of some strange words in the hadiths in poetry, they sometimes included one or a few couplets that fully agreed with the meaning of the hadith. In this study, it has been examined how the poems of the Abbasid poet al-Mutanabbī, whose poems are frequently referred to in the hadith commentaries, are handled in these sources. It is foreseen that the results of the research will provide data to the researchers of Arabic language and rhetoric and hadith. (shrink)

The terms “shādh” and “munkar”, well-known in hadith terminology, have existed across all scholarly fields since the earliest periods of Islam. However, the concepts expressing these narrations could vary depending on time, individuals, and academic disciplines. The primary reasons for pe-ople's interest in these narrations are the use of an exaggerated style in the stories they convey and the inclusion of details not found in mainstream narrations. Many ideas and thoughts opposing the fundamental principles and teachings of the Qur'an and (...) Sunnah have found a place in religious literature through munkar and shâdh narrations. It is crucial to scrutinize these narrations, which have the potential to influence Muslims’ thoughts and ideas in every era through Israiliyyat, certain narrative works, and schools with wide influence, to identify the damage they cause, understand their historical background, sources, and the reasons for their use, and de-termine the correct attitude towards them. In some modern studies, topics such as munkar hadiths, shādh readings, shādh legal opinions, and the con-cept of enjoining good and forbidding evil (amr bi’l-ma‘rūf and nahy ‘an al-munkar) have been examined within the context of the meanings of these terms in the scholarly disciplines where they are used. In the study titled “The Role of Shādh and Munkar Narrations in Religious Thought”, the con-ceptual framework and historical background of shādh and munkar narra-tions, the general sources in which these narrations found a place, the rea-sons why people resort to these narrations, the positive and negative im-pacts of shādh and munkar narrations on religious thought, and the correct attitude towards these narrations will be discussed. Classical hadith works and modern academic studies were consulted in the research of this topic, and evaluations regarding the conceptual framework and historical backg-round of the terms shādh and munkar were analyzed. The accuracy, consis-tency, and conformity of these texts with the religion of Islam, as well as their positive and negative impacts on religious thought, are discussed from a critical perspective. A comparative method based on the approaches of different schools and scholars towards shādh and munkar hadiths was also utilized. (shrink)

In this article, it was aimed to determine the knowledge status of physicians about the forms used in obtaining informed consent and according to these determinations; It is aimed to provide information and suggestions to physicians that will contribute to obtaining consent in accordance with medical law and ethics. Material and Method: A questionnaire was created to determine the knowledge status of the physicians about the titles that should be included in the informed consent form (such as the diagnosis of (...) the patient, the harms, risks, benefits of the intervention, healing process, probability of success), and who should receive informed consent. This questionnaire was delivered to physicians online. The data obtained through the questionnaire were analyzed using the SPSS program. Descriptive statistical analyzes were used in the evaluation of personal information. In the evaluation of the data, frequencies and percentage distributions were taken. The analyzed data were evaluated in terms of compliance with legal regulations and medical ethics. Results: 139 physicians working in a private hospital participated in the survey voluntarily. Approximately 90% of the participants think that the complications that occur as a result of the diagnosis and intervention, approximately 85% of the benefits of the intervention and the problems of the recovery period, about 75% of the consequences of not performing the intervention, about 55% of the probability of success should be included in the form of informed consent.. More than 85% of the participating physicians expressed their opinion to agree with the article about the necessity of obtaining consent by the physician. Discussion and Conclusion: It can be accepted as a positive situation that physicians express their opinions in accordance with medical law about the information that should be included in the informed consent form. However, considering the legal values protected by informed consent, it was suggested to take measures to reduce the rates of disagreement and indecision by emphasizing the views of physicians on disagreement and indecision. Some of the outstanding masters of Kurdish historical schools (Medresê) are usually and rightly seen as belonging to the Aristotelian tradition. In this introductory study I briefly present some manuscripts of Kurdish glosses on Aristotelian logical texts, and show that the Aristotelian logical tradition, as inherited from early Islamic philosophers, also formed an important strand in Kurdish schools. Kurdish students' peculiar approach to Aristotelian logic affected the way in which Categories, De Interpretatione and Isagoge were studied in Kurdish schools from (...) the fifteenth century onwards. Despite some promising steps in the right direction, organizational analysis has yet to exploit fully the theoretical and empirical possibilities inherent in the writings of Pierre Bourdieu. While certain concepts associated with his thought, such as field and capital, are already widely known in the organizational literature, the specific ways in which these terms are being used provide ample evidence that the full significance of his relational mode of thought has yet to be sufficiently apprehended. Moreover, the almost complete inattention (...) to habitus, the third of Bourdieu’s major concepts, without which the concepts of field and capital (at least as he deployed them) make no sense, further attests to the misappropriation of his ideas and to the lack of appreciation of their potential usefulness. It is our aim in this paper, by contrast, to set forth a more informed and comprehensive account of what a relational – and, in particular, a Bourdieu-inspired – agenda for organizational research might look like. Accordingly, we examine the implications of his theoretical framework for interorganizational relations, as well as for organizations themselves analyzed as fields. The primary advantage of such an approach, we argue, is the central place accorded therein to the social conditions under which inter- and intraorganizational power relations are produced, reproduced, and contested. We aim to show how collective emotions can be incorporated into the study of episodes of political contention. In a critical vein, we systematically explore the weaknesses in extant models of collective action, showing what has been lost through a neglect or faulty conceptualization of collective emotional configurations. We structure this discussion in terms of a review of several “pernicious postulates” in the literature, assumptions that have been held, we argue, by classical social-movement theorists and by social-structural and cultural critics (...) alike. In a reconstructive vein, however, we also lay out the foundations of a more satisfactory theoretical framework. We take each succeeding critique of a pernicious postulate as the occasion for more positive theory-building. Drawing upon the work of the classical American pragmatists–especially Peirce, Dewey, and Mead–as well as aspects of Bourdieu's sociology, we construct, step by step, the foundations of a more adequate theorization of social movements and collective action. Accordingly, the negative and positive threads of our discussion are woven closely together: the dismantling of pernicious postulates and the development of a more useful analytical strategy. This paper presents a new approach to theorizing and empirically investigating a phenomenon variously described by sociologists as internalized oppression or symbolic violence. Located at the intersection of internal worlds and external reality, the intrapsychic and the interpersonal and social, this object of inquiry—here termed self-negation—is crucial to many forms of societal domination. The paper explores its inner workings, analytically disaggregating it into an array of psychosocial processes drawn from the psychoanalytic theory of the defenses. The matter of the soul has been one of the most important and central matters in the history of Islamic science and thought. For the soul constitutes one of the two elements that make up the human being, and the issue of the human being has undoubtedly been one of the most prominent matters in Islamic civilization and has been a major preoccupation for Islamic intellectuals. In this context, the Islamic basin of knowledge and thought has constructed two main definitions (...) of the soul, one based on the Qur’anic teachings and the other inspired by Ancient Greek philosophy. Theologians conceived of the soul as a “subtle body”. Philosophers, on the other hand, conceived it as an “abstract substance”. This dispute between kalām and philosophy over the soul has not only been confined to the physical realm, but has also extended to the eschatological dimension, leading to a polemic that has lasted for centuries. As with many issues in post-classical Islamic thought, the influence of philosophy on this issue has been seen to be greater than that of other traditions. In fact, in the aforementioned period and later on, works on the soul from a theological perspective could not bypass the philosophical perspective. Within this framework, the theological perspective criticized the philosophers because they disagreed with it and especially because one end of the issue extended to the eschatological axis, and found it important to refute their conceptions in this regard. One of the most prominent figures of the aforementioned period, i.e., post-classical Islamic science and thought, was Abū Muhammad Rukn al-Dīn Ubaydallāh b. Muhammad b. ‘Abd al-‘Abd al-‘Aziz al-Samarqandī (d. 701/1301), a member of the Māturīdī and Hanafī sects. Samarqandī wrote many works and treatises on kalām, Qur’anic sciences, tafsīr, fiqh, hadīth, and mysticism. Among the author’s works/risālas/treaties that have reached the present day, there is a work titled “Risālat al-rūḥ” on the humanitarian-nātik (speaking) rational human soul (al-rūh al-nātiq al-insānī). Comprising an introduction and ten chapters, al-Samarqandī used a theological and mystical style, drawing on the teachings of the Qur’ān on the one hand, and partly on rational arguments on the other. The work includes the subject of the soul and the essence of the human being in this context, the definition and essence of the soul, the comparison between the views of the Ahl al-Sunnah and the philosophers in this regard, and the criticisms against the philosophers, the issue of ma‘ād (the end) in eschatology, the thoughts of the Sufis on the soul, the perception of Allah through the saying “Whoever knows himself, knows his Lord”, which the author considered as a hadith, and similar issues. As a mutakallim and following the line of Ahl al-Sunnah, the main problem of al-Samarqandī’s treatise revolves around what should be understood when it comes to “human being”, the nature of the soul, the manner in which ma‘ād will be realized, and his criticisms of philosophers over these issues. Based on our research and studies, it has been observed that the aforementioned treatise has not yet been analyzed and published. Furthermore, two manuscript copies of the treatise in question were found as a result of our investigations. This study covers the critical edition and review of al-Samarqandī’s Risālat al-rūḥ. Mustafa Dikec reveals the aesthetic premises that underlie Hannah Arendt, Jean-Luc Nancy and Jacques Ranciere's political thinking, and demonstrates how their politics depend on the construction and apprehension of worlds through spatial forms and distributions. Exploring these dimensions of the political, he argues that politics is about how perceive and relate to the world. Space is a form of appearance and a mode of actuality, and the disruption of such forms and modes is the sublime element in politics.

Sosyal varlıklar olan insanlar, tarih boyunca birbirleri ile alışveriş yapma ihtiyacı hissetmişlerdir. Bu alışverişler, genellikle satış akdi yoluyla gerçekleştirilmiştir. Satış akitlerinin kurulmasında en yaygın görülen yöntem ise pazarlık usulü ile gerçekleştirilen müsâveme yöntemidir. İnsanlar satış akdini kurarken, akdin unsurları üzerinde pazarlık yaparak bir anlaşmaya varmışlardır. İslâm hukuku bu yöntemin sınırlarını belirlemiştir. İnsanların birbirlerinin haklarını ihlal etmeden pazarlık yapabilmelerini sağlayacak düzenlemeler getirmiştir. Ayrıntıları başta örf olmak üzere farklı delillerle düzenlense de, insanların satış akdini kurarken bu sınırlara dikkat etmesi gerektiği, doğrudan doğruya (...) naslar ile emredilmiştir. Bu durum hem şahsi zararların hem de toplumsal zararların önüne geçilmesi açısından büyük önem arz etmiştir. Bu kapsamda getirilen bazı sınırlamalar şu şekildedir: Satılmış olan bir malın devredilmeden bir başkasına satılmaması, fiyat yükseltmek amacıyla üçüncü kişinin pazarlığına dahil olunmaması gerektiği ve tarafların pazarlık aşamasının sonu geldiği, anlaşma meyillerinin oluştuğu durumda üçüncü kişinin pazarlığa dahil olmaması gerektiği belirtilmiştir. Bu sınırlamalardan, tarafların anlaşma meyillerinin ortaya çıkmış olduğu durumda üçüncü kişinin taraflardan birinin aleyhine pazarlığa dahil olması konusu çalışmamızda ele alınmıştır. Bu husus İslâm hukuk literatüründe sevm ale’s-sevm olarak nitelendirilmiştir. Türkçe literatürde genellikle pazarlık üzerine pazarlık olarak çevrilmiştir. Çalışmada sevm ale’s-sevm kavramına genellikle yer verilmiş olmakla birlikte, Türkçe olarak ifade edilmesi gerektiğinde pazarlık üzerine pazarlık kavramı kullanılmıştır. Taraflar pazarlığa yönelik ifadelerini akdin kurucu unsuru olan irade beyanı ile birbirlerine iletmektedirler. Dolayısıyla bu çalışmada öncelikle irade beyanına yönelik açıklamalar yapılmıştır. Pazarlığa yönelik bu irade beyanlarının icâb niteliğinde mi yoksa icâba davet niteliğinde mi olduğu hususunda açıklamalara yer verilmiştir. Bu açıklamaların ardından müsâveme yöntemi tanımlanmış ve genel olarak bu yönteme ilişkin bilgi verilmiştir. Müsâveme yöntemi ile oluşturulan akitler ile bu yönteme benzer yöntemlerin farkları hususunda açıklamalar yapılmıştır. Pazarlık yapılırken dikkat edilmesi gereken hususlara değinilmiş ve pazarlık üzerine pazarlık yapmanın yasak olduğu ifade edilmiştir. Akit kurulurken hangi aşamada pazarlığa dahil olmanın bu yasak kapsamında sayılacağı ve hangi aşamadaki müdahalenin yasak kapsamına dahil olmayacağı belirtilmiştir. Bu yasağın neden gerekli olduğu konusunda yapılmış olan açıklamalara yer verilmiştir. Sevm ale’s-sevmin söz konusu olduğu akitlerin genel olarak diyaneten haram kabul edildiği bununla birlikte kazaen bu akitlerin geçerli olduğu ifade edilmiştir. Bu yasağın kapsamına sadece müslümanların değil aynı zamanda müslüman olmayan vatandaşların ve müste’menlerin de dahil olduğu ifade edilmiştir. Buna göre müslüman olmayan bir vatandaş veya müste’men aleyhine böyle bir pazarlığa dahil olmanın hukuka uygun kabul edilmeyeceği açıklanmıştır. Sevm ale’s-sevmin yalnızca satış akdi açısından değil, aynı zamanda kıyas yoluyla diğer akitler bakımından da geçerli olacağı belirtilmiştir. Bu açıklamalarda Hanefî mezhebinin görüşü esas alınmış olmakla birlikte diğer mezheplerin görüşlerine de yer verilmiştir. Makale genel itibariyle Hanefî mezhebi odağında diğer mezheplerin görüşlerine de yer verilen bir yöntemle oluşturulmuştur. Tüm bu görüşlerin ardından mer’î hukukta bu yasağın uygulanıp uygulanmadığı hususunda açıklamalar yapılmıştır. (shrink)

ZusammenfassungIn der Nachkriegszeit war die bevorzugte Methode zur Nutzbarmachung von Flüssen die sogenannte integrierte Flussgebietsplanung (integrated river basin planning – IRBP), die eine ganzheitliche Betrachtung des Flussgebiets für eine Mehrzweckentwicklung erforderte. Während das Flusseinzugsgebiet in den Definitionen des IRBP-Konzepts als selbstverständliche natürliche Einheit der Planung angesehen wird, problematisiert dieser Artikel die Flusseinzugsgebietsidee und enthüllt die Politik hinter dem, was als natürlich (oder wissenschaftlich) gilt, mit besonderem Schwerpunkt auf den Erfahrungen der Türkei mit IRBP. Er untersucht geopolitische und nationale Motivationen und (...) Herausforderungen im Zusammenhang mit politics of scale im Euphrat-Tigris-Becken. Indem es sich dem IRBP als einem Prozess der Skalenbildung nähert, stützt es sich auf Diskussionen über Skalenpolitik in der Literatur zur politischen Ökologie, und ergänzt diese Diskussionen um eine historische Tiefendimension hinzu. Dabei liegt der Schwerpunkt auf der politischen und ökologischen Geschichte der Südosttürkei, die zum Schauplatz des ersten und umfangreichsten IRBP-Projekts der Türkei wurde, dem Südostanatolien-Projekt (GAP).Der Artikel dehnt die chronologischen Grenzen des GAP auf die Jahrzehnte vor den 1970er Jahren aus, als das Projekt initiiert wurde. Die historischen Daten des Artikels basieren größtenteils auf den Sitzungsakten der Großen Nationalversammlung der Türkei, den Archiven einer Tageszeitung und den Expertenberichten zum GAP. Die Analyse hebt die Skalenpolitik als mächtigen Bestandteil der Politik der technologischen Entwicklung hervor und zeigt, wie wichtig die historische Analyse ist, um die Politik der Flusseinzugsgebiete in verschiedene Ebenen aufzuschlüsseln, darunter Geopolitik, territoriale Streitigkeiten und internationale Konflikte. The history of European western philosophy.

Science has been dazzlingly successful in explaining nature. Scientific advances also have led to certain undesirable, though unintended, side effects, one of which is alienation from the spiritual. Revelation comes from the Divine. But what is the status of authenticity of a particular piece claimed to be revelation? What is its historical validity and current state of preservation? This essay proposes to develop a list of rational criteria, in consultation with all stakeholders, for addressing the subject. The mole and Avogadro’s number are two important concepts of science that provide a link between the properties of individual atoms or molecules and the properties of bulk matter. It is clear that an early theorist of the idea of these two concepts was Avogadro. However, the research literature shows that there is a controversy about the subjects of when and by whom the mole concept was first introduced into science and when and by whom Avogadro’s number was first calculated. (...) Based on this point, the following five matters are taken into consideration in this paper. First, in order to base the subject matter on a strong ground, the historical development of understanding the particulate nature of matter is presented. Second, in 1811, Amedeo Avogadro built the theoretical foundations of the mole concept and the number 6.022 × 1023 mol−1. Third, in 1865, Johann Josef Loschmidt first estimated the number of molecules in a cubic centimetre of a gas under normal conditions as 1.83 × 1018. Fourth, in 1881, August Horstmann first introduced the concept of gram-molecular weight in the sense of today’s mole concept into chemistry and, in 1900, Wilhelm Ostwald first used the term mole instead of the term ‘gram-molecular weight’. Lastly, in 1889, Károly Than first determined the gram-molecular volume of gases under normal conditions as 22,330 cm3. Accordingly, the first value for Avogadro’s number in science history should be 4.09 × 1022 molecules/gram-molecular weight, which is calculated by multiplying Loschmidt’s 1.83 × 1018 molecules/cm3 by Than’s 22,330 cm3/gram-molecular weight. Hence, Avogadro is the originator of the ideas of the mole and the number 6.022 × 1023 mol−1, Horstmann first introduced the mole concept into science/chemistry, and Loschmidt and Than are the scientists who first calculated Avogadro’s number. However, in the science research literature, it is widely expressed that the mole concept was first introduced into chemistry by Ostwald in 1900 and that Avogadro’s number was first calculated by Jean Baptiste Perrin in 1908. As a result, in this study, it is particularly emphasised that Horstmann first introduced the mole concept into science/chemistry and the first value of Avogadro’s number in the history of science was 4.09 × 1022 molecules/gram-molecular weight and Loschmidt and Than together first calculated this number. This study will examine how Dāvūd al-Qarṣī, an 18th-century Ottoman scholar, resolved the paradox between human freewill and God being the creator of everything in his work Risālâh fi’l-ikhtiyārāt al-juzʾiyyah wa’l-irādāt al-qalbiyyah. In addition, in this study, the critical edition and translation of the risālah will also be provided. The treatise which is the subject of the present study is a link in the series of works written under the title of human acts in the Islamic thought tradition regarding al-irādah (...) al-juzʾiyyah, afʿāl al-ʿibād, khalq al-aʿmāl, qaḍā, and qadar. This risālah is one of the rare examples prepared with the method of “mamzūj annotation (sharḥ)”, which is a method in which “text” and “annotation” are intertwined. Qarṣī examines in detail a total of seven views, four of which are famous (mashhūr) and three of which are non-famous, about voluntary acts. Qarṣī interprets the approaches and views of the non-famous sects and includes them in the famous sects and allocates approximately 4/3 of the work to these sects. In the final stage of the work, the author states that the view of Māturīdīs is parallel with the predecessor’s (Salaf) view of “Neither jabr nor tafwīḍ; rather, it is merely a situation between these two approaches.” Qarṣī, who was inspired by Athīrī Maḥmad Afandī (d. 1092/1681), says that voluntary acts come about by the sum of “two powers (qudrat)”, “two wishes (mashīʾat)” and “one taqwīn”. Also, according to this, the first four of them are proximate causes, while the attribute taqwīn is the influencing factor. Qarṣī acts from the meanings of the term action (fiʿl) and the “theory of state (ḥāl)” in order to prove that human beings are true agents (fāʿil) on the one hand and to protect God’s attribute of creation on the other. In fact, the concept of “state (ḥāl)”, used in understanding divine attributes and some ontological issues, was applied to acts by the Māturīdī mutakallim Ṣadr al-Sharīʿa al-Thānī (d. 747/1346). Thus, a doctrine of action was developed, and this doctrine was accepted and used by the later period Māturīdī mutakallims. With reference to Ṣadr al-Sharīʿa, Qarṣī tries to justify the issue based on the meanings of the the term action and the modes of existence of these meanings. He says that action has two implications; one of them is the “infinitive meaning” (al-maʿnā al-maṣdarī) and the other is “the thing that comes with this infinitive meaning (al-ḥāṣıl bi-maṣdar)”. The infinitive meaning of the act constitutes the “non-thing aspect” of the action, and the meaning of the action that is created with the infinitive indicates “the thing aspect” thereof. Thus, because the aspect of the action that is not existentand therefore not a thing is not subject to creation, the agency and responsibility of human beings are grounded. Similarly, Qarṣī maintains that the mashīʾat, which means will, qaṣd and al-irādah al-juzʾiyyah, was not created because its existence in humans is in the form of succession and it is of a state-like (ḥāl) existenceOn this account. Qarṣī manages to preserve both human freewill and the absolute creativity of God due to the non-existent and non-thing aspect of the act on the one hand, and will (irādah), mashīʾat and qaṣd not being subjected to creation on the other. There is no common working style followed in the preparation of the editorial critiques of the ĥāshiya. The overwhelming majority of the ĥāshiya works written on at least one text and commentary, were produced in the Ottoman science-culture basin and period. Ĥāshiya style of writing is an area neglected by the academic community until recently. A claimant is obliged to prove his claim by scientific, legal and moral principles. However, studies that prove or at least support the said judgment have (...) not been completed. The final objective decision should be postponed to the research of manuscripts. Otherwise, the judgment will not go beyond the pre-judgment. The article is intended to give momentum to academic studies on the sharḥ-ĥāshiya writing style. Muqaddimāt al-Arba‘a is a text in which Ṣadr al-Sharī‛ah [die. 747/1346], considered one of the pioneers of the contractor Māturīdī school, analyzes human verbs. Since its establishment, the Māturīdī school has remained sensitive to human freedom and human-centred moral principles. According to the claim, thanks to the four premises, the ontological status of the will has attained a structure that can exist or disappear in terms of expression. The understanding of free God and free man depends on the acceptance of the will in this structure. Otherwise, man and God will not be considered free. The representative of the Ashʿarī thought system Taftazānī [die. 792/1390], critically commented on the text. According to him, the conclusion of the four premises in terms of Ash‘arī doctrine consists of a door creak and a fly hum. There is also Ḥāccī Hasanzāda’s [die. 911/1505-1506] among the scholars who wrote on the order of Fatih Sultan Meḥmed, who wondered the basis of the thought and scientific tension. His work is a product of ĥāshiya style. The article of Ḥāccī Hasanzāda points out the deficiencies and weaknesses of the premises and discusses the connection of the will with the moral principles within the framework of schools. In this article, Ḥāccī Hasanzāda’s work titled Ĥāshiya ‘alā Muqaddimāt al-Arba‘a will be introduced and its critical edited publication will be presented. (shrink)

The principles underpinning Islam's ethical framework applied to routine clinical scenarios remain insufficiently understood by many clinicians, thereby unfortunately permitting the delivery of culturally insensitive healthcare. This paper summarises the foundations of the Islamic ethical theory, elucidating the principles and methodology employed by the Muslim jurist in deriving rulings in the field of medical ethics. The four-principles approach, as espoused by Beauchamp and Childress, is also interpreted through the prism of Islamic ethical theory. Each of the four principles is investigated (...) in turn, looking in particular at the extent to which each is rooted in the Islamic paradigm. This will provide an important insight into Islamic medical ethics, enabling the clinician to have a better informed discussion with the Muslim patient. It will also allow for a higher degree of concordance in consultations and consequently optimise culturally sensitive healthcare delivery. (shrink)

These four young women outline their experience of feminism and in so doing suggest ways in which the Next Generation are thinking about ‘feminism’ and its relevance to their modern day lives. Topics discussed include sexuality, cultural differences, sex education, rape, and how the face of feminism is changing or needs to change. Thoughts range from a belief that the word ‘feminism’ has too (...) many negative connotations and thus it seems the term, and therefore the movement, is restricted by the glass ceiling which it aims to fight. Another view is that ‘Feminism,’ like any movement, will remain as relevant as it always has been until no person of any gender is coerced or compelled to act, think, feel or endure anything which has reductive gender inequality at its core. Aims The study aims to test the Turkish validity and reliability of the Rushton Moral Resilience Scale (RMRS) and examine the effect of moral resilience on moral distress. Background Moral distress is a phenomenon that negatively affects health workers, health institutions, and the person receiving care. In order to eliminate or minimize the negative effects of moral distress, it is necessary to increase the moral resilience of nurses. Moral resilience involves developing systems that support a culture of ethical practice in (...) healthcare and aim to increase an individual’s capacity to cope with moral challenges. Methods A methodological and descriptive-predictive study design was adopted. Sociodemographic Information Form, Measure of Moral Distress – Healthcare Professionals (MMD-HP), and Rushton Moral Resilience Scale were used to collect data from the nurses. A total of 255 clinical nurses were recruited. Ethical considerations Hacettepe University’s non-interventional ethics committee approved the study’s protocol and informed consent was obtained from the participants. Results The original four-factor structure of the scale was tested with confirmatory factor analysis, and the index values were evaluated and found at an acceptable level. The Cronbach Alpha coefficient of the scale was found to be 0.826. Moral resilience predicted moral distress total, intensity, and frequency levels. A moderate and weak relationship was found in the negative between all sub-dimensions of moral distress and moral resilience. Conclusions The Rushton Moral Resilience Scale Turkish version showed good psychometric properties. Moral resilience has a reducing effect on moral distress. Young nurses who have less experience are at risk because they have lower moral resilience levels, while nurses working in intensive care units are at risk because of their high moral distress levels. A healthy workplace can be created by developing specific approaches to improve moral resilience in reducing the impact of moral distress in the healthcare environment. (shrink)

Many philosophers have claimed that normative error theorists are committed to the claim ‘Error theory is true, but I have no reason to believe it’, which to some appears paradoxical. Case (2019) has claimed that the normative error theorist cannot avoid this paradox. In this paper, we argue that there is no paradox in the first place, that is once we clear up the ambiguity of the word ‘reason’, both on the error theorist’s side and those that claim that there (...) is a self-defeat problem. Reason and revelation are two important guides for humanity. People can find the right path only thanks to these two guides. Fatānah is the peak of functional intelligence, which is a special attribute given to prophets. At the same time, this attribute is the ability and competence to use reason in the best way. Needless to say, this attribute comes along with great values and privileges. This prophetic attribute not only reflects the human aspect of the prophets but also points (...) to a qualification through which they receive revelation. Through this feature, prophets, on the one hand, try to understand revelation and apply it. On the other hand, they solve the problems in their community by practicing ijtihād in cases where revelation has not come. This creates a great power that makes them superior to others. As it is known, everyone’s mental faculties are different. Although people are given intelligence according to their degree, they are not given the attribute of fatānah. At this point, reason means the power of understanding, comprehension, thinking, and reasoning. Fatanāhis a superintelligence through which prophets can see events from multiple perspectives and analyze them in depth. We shall briefly mention the fatanāh of the Prophets Muhammad and Abraham as examples. The Prophet Muhammad fought for tawḥīd (God’s unity) in his polytheistic society. In order to transform the society in question, he reformed them by acting with reason, logic, and reasoning with the support of revelation. At the end of this struggle, he successfully transformed his community into a religious, theistic, and moral society in 23 years. He was the authority to solve the people's problems in both Mecca and Medina. He successfully found solutions to peoples’ problems. His success has been explained by the attribute of fatanāh, along with divine support. When we look at the life of Prophet Abraham, who is considered to be the ancestor of the prophets, the attribute of fatānahis clearly seen in his prophecy. That is to say, in his discussions with his father Āzar, Prophet Abraham wanted him to think that "idols are inanimate objects that do not harm or benefit anyone and have no function in creation." The best example of his superintelligence is that he broke the idols in the idol household with an axe and hung the axe around the neck of the big idol. On this occasion, he made idol-worshippers use their intellect. The subject of this article is to emphasize the importance of this attribute found in the prophets, along with the support of revelation, as an example for people. To better explain the subject, the paper also examines the intellect-revelation relationship and intellect-superintellect relationship. (shrink)

The issue of acting on weak hadiths has been a debated issue throughout history. Scholars have adopted different views on this issue. While there are scholars who argue that weak hadiths should not be acted upon at all, there are also scholars who argue that there is no harm in acting upon them under certain conditions. While scholars such as Müslim, Yahya b. Ma'in and Subhi Salih in the modern period adopt the view that weak hadiths should not be acted (...) upon, Imam Şafiî, Imam Ahmed and Ebu Davud prefer the view that if there is no sound hadith on a subject, weak hadiths should be acted upon. Apart from these two groups, there are also scholars, such as Ibn Hajar, who adopt the middle path and emphasize that weak hadiths should be acted upon under certain conditions.It is seen that the approaches expressing their opinions on the issue of acting on weak hadiths generally differ depending on whether the topics are provisions or virtues. While some scholars do not consider it permissible to act on weak hadiths, whether they are subject to provisions or not; It is seen that some of them are of the opinion that, under certain conditions, virtues and even provisions can be acted upon when necessary. Although the Scholars are generally of the opinion that one should not act on a weak hadith regarding the provisions, some of them stated that there is no harm in acting on it if it meets certain conditions regarding the provisions. Acting with weak hadiths regarding virtue has been a subject mentioned by many scholars. It has been seen that many hadith scholars, from the early periods, have adopted a positive attitude towards hadith narrations regarding virtue. This shows that the idea of acting with weak hadiths has existed since then.Ulama who follow the Hanafi sect generally made inferences based on weak hadiths. It is seen that Hanafi scholars, who attach importance to ray and qiyas, prefer weak hadiths to ray and qiyas in some cases. This situation is mostly the result of the necessity of extracting the provisions regarding ta'abbudi issues from the hadiths. It is also possible that they use weak hadiths in order to encourage people to do good and avoid bad situations regarding the virtue of deeds. In some cases, the use of hadiths that are in accordance with precautions is a common situation among Hanafi scholars. For this and similar reasons, it is possible to see the use of weak hadith among Hanafi scholars.It would not be right to limit the issue of weak hadith and deeds only to Hanafi ulema. The issue of acting with weak hadith has been discussed a lot in the sources on the Sunni hadith method. Hadith scholars have examined these hadiths under two main headings: provisions and virtues. They did not see any problems in the narration of weak hadiths, provided that they were not on matters related to belief and rules; It is possible to say that they acted more inclusively when they narrated hadiths on subjects such as maw'iza, virtue of deeds and stories, as well as issues related to tafsir and megazi. Weak hadith narration and acting on weak hadith, and some scholars preferring weak hadiths to qiyas, indicate that this is because it is attributed to the Prophet Muhammad.Commentators generally give a lot of space to weak hadiths, fabricated news andİsraelites in their tafsir books. In particular, it is seen that the commentators of narration use every material they find about the virtues of the suras, without evaluating their authenticity. It is seen that Muhaddith scholars frequently resort to weak hadiths as well as sound narrations, especially on subjects such as fedailu'l-quran, fedailu's-suver, fedailu'l-ayat.In this context, if the hadiths used by Nasafi regarding the virtues of the suras in his work called et-Teysîr fi't-tefsîr are examined, it will be seen that he gives a lot of place to weak hadiths. It is important that, in addition to the scholars who adopt the view that weak hadiths cannot be acted upon, there are also scholars such as Nasafi, who believe that there is no harm in acting on weak hadiths on some issues, especially regarding virtues. As a matter of fact, although the fact that Nasafi was a muhaddith as well as a commentator gave the impression that he would select and use the hadiths more meticulously, it has been observed that he did not behave differently from other commentators and used weak hadiths and fabricated news about the virtues of the suras. In this respect, it is seen that Nasefi reflects the general attitude of commentators in his work. It is possible to see that a scholar who is knowledgeable in many fields resorts to weak hadiths, especially regarding virtues, shows a moderate approach to the status of these hadiths, and accepts that weak hadiths are suitable for narration and can be acted upon.
