This book presents an innovative reading of Daoist philosophy that highlights the critical and therapeutic functions of satire and humor. Moeller and D'Ambrosio show how the Zhuangzi expounds the Daoist art of "genuine pretending" the paradoxical skill of enacting social roles without submitting to them or letting them define one's identity.

This paper discusses the meaning of the concept of ‘second-order observation’ used by Niklas Luhmann (1927–1998). Luhmann identifies second-order observation as a defining characteristic of modern world society. According to Luhmann, all social systems construct a social reality on the basis of the observation of observations. Rating agencies in the economy or the peer-review process in the academic system are examples of social mechanisms manifesting second-order observation. Social media also represent organized second-order observation. The paper suggests that in a society (...) based on second-order observation, ‘genuine pretending’ is an adequate mode of existence. This notion is derived from the Daoist text Zhuangzi. It indicates a disassociation from social roles which allows their performers to exercise these roles with ease and, at the same time, maintain a state of sanity. (shrink)

Niklas Luhmann (1927-1998) was a German sociologist and system theorist who wrote on law, economics, politics, art, religion, ecology, mass media, and love. Luhmann advocated a radical constructivism and antihumanism, or "grand theory," to explain society within a universal theoretical framework. Nevertheless, despite being an iconoclast, Luhmann is viewed as a political conservative. Hans-Georg Moeller challenges this legacy, repositioning Luhmann as an explosive thinker critical of Western humanism. Moeller focuses on Luhmann's shift from philosophy to theory, which introduced new perspectives (...) on the contemporary world. For centuries, the task of philosophy meant transforming contingency into necessity, in the sense that philosophy enabled an understanding of the necessity of everything that appeared contingent. Luhmann pursued the opposite--the transformation of necessity into contingency. Boldly breaking with the heritage of Western thought, Luhmann denied the central role of humans in social theory, particularly the possibility of autonomous agency. In this way, after Copernicus's cosmological, Darwin's biological, and Freud's psychological deconstructions of anthropocentrism, he added a sociological "fourth insult" to human vanity. A theoretical shift toward complex system-environment relations helped Luhmann "accidentally" solve one of Western philosophy's primary problems: mind-body dualism. By pulling communication into the mix, Luhmann rendered the Platonic dualist heritage obsolete. Moeller's clarity opens such formulations to general understanding and directly relates Luhmannian theory to contemporary social issues. He also captures for the first time a Luhmannian attitude toward society and life, defined through the cultivation of modesty, irony, and equanimity. (shrink)

Justice, equality, and righteousness—these are some of our greatest moral convictions. Yet in times of social conflict, morals can become rigid, making religious war, ethnic cleansing, and political purges possible. Morality, therefore, can be viewed as pathology-a rhetorical, psychological, and social tool that is used and abused as a weapon. An expert on Eastern philosophies and social systems theory, Hans-Georg Moeller questions the perceived goodness of morality and those who claim morality is inherently positive. Critiquing the ethical "fanaticism" of Western (...) moralists, such as Immanuel Kant, Lawrence Kohlberg, John Rawls, and the utilitarians, Moeller points to the absurd fundamentalisms and impracticable prescriptions arising from definitions of good. Instead he advances a theory of "moral foolishness," or moral asceticism, extracted from the "amoral" philosophers of East Asia and such thinkers as Ludwig Wittgenstein and Niklas Luhmann. The moral fool doesn't understand why ethics are necessarily good, and he isn't convinced that the moral perspective is always positive. In this way he is like most people, and Moeller defends this foolishness against ethical pathologies that support the death penalty, just wars, and even Jerry Springer's crude moral theater. Comparing and contrasting the religious philosophies of Christianity, Daoism, and Zen Buddhism, Moeller presents a persuasive argument in favor of amorality. (shrink)

The so-called quantum Zeno effect is essentially a consequence of the projection postulate for ideal measurements. To test the effect, Itanoet al. have performed an experiment on an ensemble of atoms where rapidly repeated level measurements were realized by means of short laser pulses. Using dynamical considerations, we give an explanation why the projection postulate can be applied in good approximation to such measurements. Corrections to ideal measurements are determined explicitly. This is used to discuss how far the experiment of (...) Itanoet al. can be considered as a test of the quantum Zeno effect. We also analyze a new possible experiment on a single atom where stochastic light and dark periods can be interpreted as manifestation of the quantum Zeno effect. We show that the measurement point of view gives a quick and intuitive understanding of experiments of the above type, although a finer analysis has to take the corrections into account. (shrink)

The speech of Gregory Thaumaturgus to the Christian scholar and theologian Origen is a historical document of unusual importance, both in terms of its content, depicting the master-student relationship of the time from the perspective of the student, and in terms of form, providing an actual implementation of the theory of rhetoric that was a cornerstone of higher education. Yet disagreement persists to this day in the scholarly literature over the generic classification of this first example of Christian epideictic oratory. (...) It is most frequently found categorized as a speech of thanksgiving, of praise, or of farewell. This paper discusses the grounds for the various definitions, examines the text itself in search of such grounds, and shows, in reference to two treatises on epideictic attributed to Menander Rhetor, why the most plausible classification is as a logos syntaktikos – a farewell speech, in which a traveler, by means of portraying and arousing emotion, laments the necessary parting and praises the person or people of whom leave is taken. Williamson and others have argued that contextualist theories of the semantics of ‘know’ have a special problem of accounting for our practices of ‘consuming’ knowledge attributions and denials made in other contexts. In what follows, I shall understand the objection as the idea that contextualism has a special problem of accounting for how we are able to acquire epistemically useful information from knowledge claims made in other contexts. I respond to the objection by arguing that the defeasibility of knowledge makes (...) it difficult for everyone to acquire epistemically useful information from knowledge claims made in other contexts, and that there is no special problem for contextualism when it comes to acquiring epistemically useful information from knowledge claims made in other contexts. Various passages in the Laozi and the Zhuangzi, the two most important texts of “philosophical Daoism,” critically mock Confucian sacrificial rites. Perhaps the best known of these criticisms refers to a practice involving straw dogs (Laozi 5, Zhuangzi 14). This article will attempt to expose the philosophical dimensions of these passages that show, in my reading, how Daoist philosophy looks at such sacrificial rituals as a sort of evidence of the Confucian misconceptions of time, of death and life, and of (...) cosmic and social order. This article discusses New Confucian views on individuality and related philosophical problems. Special emphasis is given to the position of Tu Wei-Ming, a foremost living New Confucian thinker. It is pointed out that many New Confucian philosophers share a vision of a Confucian 'ideal' individuality or selfhood based on social integration - as opposed to a Western type of individuality sometimes portrayed as an individuality by isolation. These patterns of individuality are further examined on the basis of Niklas Luhmann's historical (...) analysis of the semantics of individuality and his categories of 'individuality by inclusion' and 'individuality by exclusion'. Finally, some parallels and differences between Confucian and the Luhmannian viewpoints are pointed out, and a suggestion on how a Luhmannian perspective might contribute to reformulations of New Confucian thought is attempted. An in-depth account of how critique and subversion have been integral parts of the history and development of Chinese philosophy from the classical period to the present.

Hermann Cohen’s essay on Maimonides’ ethics is one of the most fundamental texts of twentieth-century Jewish philosophy, correlating Platonic, prophetic, Maimonidean, and Kantian traditions. Almut Sh. Bruckstein provides the first English translation and her own extensive commentary on this landmark 1908 work, which inspired readings of medieval and rabbinic sources by Leo Strauss, Franz Rosenzweig, and Emmanuel Levinas. Cohen rejects the notion that we should try to understand texts of the past solely in the context of their own historical (...) era. Subverting the historical order, he interprets the ethical meanings of texts in the light of a future yet to be realized. He commits the entire Jewish tradition to a universal socialism prophetically inspired by ideals of humanity, peace, and universal justice. Through her own probing commentary on Cohen’s text, like the margin notes of a medieval treatise, Bruckstein performs the hermeneutical act that lies at the core of Cohen’s argument: she reads Jewish sources from a perspective that recognizes the interpretive act of commentary itself. Health is a value-laden concept. The state of being that it designates is a fundamental human goal. As a value, the concept is normative, governing both clinical practice and the therapeutic treatment developed by medical research. Also, the promise of health plays a pivotal role in health-policy discourse. Almut Caspary considers philosophical and theological concepts of health in the context of its practical significance, both in the past and today. This conceptual analysis culminates in a preliminary sketch of a (...) concept of health; focusing on the stem-cell debate, it offers a discriminating approach to contemporary ethical problems in medicine. "Gesundheit" ist ein wertgeladener Begriff. Er bezeichnet einen grundsatzlich wunschenswerten Zustand menschlicher Existenz, der das arztliche Handeln im klinischen Alltag leitet. Daruber hinaus werden (gesundheits-)politische Debatten mit Verweis auf den Nutzen fur die Gesundheit entschieden. Vor diesem Hintergrund setzt sich Almut Caspary epochenubergreifend mit philosophischen und theologischen Uberlegungen zur Gesundheit auseinander. Die konzeptuelle Diskussion erlaubt die Skizzierung eines Gesundheitsverstandnisses, das - wie am Beispiel der Stammzelldebatte gezeigt wird - ein differenziertes Abwagen in medizinethischen Konfliktfallen zulasst. This essay suggests that a narrative genre of “kill stories” has a prominent philosophical function in the Zhuangzi 莊子. Kill stories depict the domestication and disciplining of “wild” living beings eventually resulting in their death. They typically show an incongruity between the moral attitude of the perpetrators and their destructive deeds. Thereby, they illustrate a critique of a broader sociopolitical “master narrative” associated with the Confucian tradition that had a strong impact on ideology and ethical values in early China. In (...) the diagnosis of the kill stories, ritual practice and civilizational ordering inevitably produce discontent and unease. A second narrative genre that I call “survival stories” corresponds to the kill stories and connects with the medicinal orientation of the Daoist tradition. As therapeutic allegories, the survival stories reflect strategies for maintaining sanity and ease within society. Rather than advocating escapism or a return to a primitivist state, they promote the cultivation of immunity against consumption by social demands and pressures based on an insight into the inescapability and contingency of social roles. Se arguye que esta famosa historia puede ser leída como una crítica del ritual y la política en la China antigua, así como del violento régimen de domesticación que ellas representaron. El relato invierte satíricamente la invisibilización ritual de la matanza de humanos y bestias, y parodia así el sadismo del “real método para el cultivo de la vida” al hacer que un carnicero realice la matanza (...) ritual frente al gobernante y no a sus espaldas. El ensayo combina aproximaciones literarias, filosóficas y sinológicas en un esfuerzo por balancear la rigurosidad histórica con la relevancia filosófica. (shrink)

Abstract Context: Established in 1997, Summa Health System’s Medical Ethics Committee (EC) serves as an educational, supportive, and consultative resource to patients/families and providers, and serves to analyze, clarify, and ameliorate dilemmas in clinical care. In 2009 the EC conducted its 100th consult. In 2002 a Palliative Care Consult Service (PCCS) was established to provide supportive services for patients/families facing advanced illness; enhance clinical decision-making during crisis; and improve pain/symptom management. How these services affect one another has thus far been (...) unclear. Objectives: This study describes EC consults: types, reasons, recommendations and utilization, and investigates the impact the PCCS may have on EC consult requests or recommendations. Methods: Retrospective reviews of 100 EC records explored trends and changes in types of consults, reasons for consults, and EC recommendations and utilization. Results: There were 50 EC consults each in the 6 years pre- and post-PCCS. Differences found include: (1) a decrease in number of reasons for consult requests (133–62); (2) changes in top two reasons for EC consult requests from ‘Family opposed to withdrawing life-sustaining treatment (LST)’ and ‘Patient capacity in question’ to ‘Futility’ and ‘Physician opposed to providing LST’; (3) changes in top two recommendations given by the EC from ‘Emotional Support for Patient/Family’ and ‘Initiate DNR Order’ to ‘Comfort Care’ and ‘Withdraw Treatment.’ Overall, 88% of recommendations were followed. Conclusion: PCCS availability and growth throughout the hospital may have influenced EC consult requests. EC consults regarding family opposition to withdrawing LST and EC recommendations for patient/family support declined. Druck der Zensur, nicht Aufhebung der Zielvorstellungen ist die richtige Begründung für das Vorherrschen der ober-flächlichen Assoziationen. Die oberflächlichen Assoziationen ersetzen in der Darstellung die tiefen, wenn die Zensur diese normalen Verbindungswege ungangbar macht. Es ist, wie wenn ein allgemeines Verkehrshindernis, z.B. eine Überschwemmung, im Gebirge die großen und breiten Straßen unwegsam werden läßt; der Verkehr wird dann auf unbequemen und steilen Fußpfaden aufrechterhalten, die sonst nur der Jäger begangen hat.

Der Tod ist seit jeher und über alle Grenzen hinweg ein Grundthema der Philosophien gewesen - und nicht nur der Philosophien, sondern natürlich ebenso der Religionen, der Literaturen, der Künste. Die Sorgen, die der Tod bereitet, sind nicht allein mehr oder weniger universal oder existentiell, sie sind auch unauflösbar: Mit dem Tod wird man nicht fertig, bis er kommt. Und auch dann wird der Tod bekanntlich eher fertig mit uns als wir mit ihm. Keiner Philosophie oder Religion oder Kunst ist (...) es "endgültig " gelungen ,,durch die Auseinandersetzung mit dem Tod die Besorgnis ihm gegenüber auszulöschen. Dementsprechend versucht der vorliegende Band keinesfalls Antworten - und schon gar nicht "die" Antwort - auf die Fragen des Todes zu geben. Er führt vielmehr eine Reihe von Standpunkten, Einstellungen oder Vorstellungen zum bzw. vom Tode vor und wird für keine(n) Leser(in) das Todesproblem lösen können. Er kann nur an einem eindrucksvollen und tatsächlich jedem(r) nahegehenden Beispiel zeigen, wie man sinnvoll über etwas sprechen, schreiben und denken kann, ohne dabei darüber wirklich schlauer werden zu können. Ein solches Ergebnis ist nun keinesfalls entmutigend, es ist vielmehr eine Einsicht, bei der sich ansonsten so unterschiedliche Denkweisen wie der altchinesische Daoismus und Konfuzianismus einerseits und eine nachkantianische Philosophie des Zeichens andererseits treffen.
