In Scotland, residents have fought open-net salmon farms and their toll on human and nonhuman bodies for decades. This paper recollects seven years of work in Skye and Raasay, two islands off the northwest coast of the country, developing strategies to divest away from salmon aquaculture. Addressing the contemporary wave of underwater clearances created by UK’s top food export industry, it unpacks the implementation of a transition into alternative horizons by embracing the legacies of toxicity inherited from salmon extractivist industries. (...) CLIMAVORE, a framework developed as a research-led artistic practice by the authors, investigates how to eat in the new seasons of the climate crisis. In a season of marine dead zones, it facilitates new approaches to aquaecology and coastal care that cultivate coastal livelihoods. CLIMAVORE began with a new public forum, shaped as a multispecies intertidal table, established in Skye in 2017 to envision environmentally regenerative and socially reparative forms of food production based on metabolic interactions between humans and depleted landscapes that benefit a plethora of species. CLIMAVORE’s site responsive methodology relies on a socially-engaged art practice, consisting of fieldwork, interviews, working groups, oral histories, performative meals, cooking and building apprenticeships, tidal gardening, material testing and public art installations. Ongoing collaboration with residents, scientists, and policymakers critically explores ways of living not only on but with the coast. This new holistic approach to coastal nourishment provides methodologies for ecological praxis as well as a platform for researchers and the general public to imagine an alternative ecological future: the tidal commons. The appearance of a modern, self-confident China has started to raise concern in the West. Policies are being re-evaluated, “China competence” is the buzz word of the hour. But these reactions cannot conceal the fact that the West is utterly unprepared to come intellectually to terms with this new reality. Philosophers with sinological knowledge tend to measure China by standards developed in the West and judge it accordingly.This approach to China has been extensively criticized by Hermes Spiegel. (See Hermes Spiegel, (...) China liegt nah, Hamburg: Meiner 2020). Fabian Heubel shows in his new book that the underlying assumptions about China in the current discourse do not only shape the understanding of China, but also hamper the discussion about China between the French- and German speaking academic community. (See Fabian Heubel, Was ist Chinesische Philosophie? Kritische Perspektiven, Hamburg: Meiner 2021, p.188–200). This paper wants to change the perspective and assess the renewed interest in the Chinese intellectual heritage within China from an inner-Chinese, historical perspective. Based on the reading of four commentaries to the classical Confucian text Zhongyong it argues that there is nothing new about this quest for cultural renewal. Contrarily, China has been continuously re-inventing itself by producing new cultural models based on the interpretation of texts seen as constituting the core of Chinese civilization. By introducing four such attempts to revitalize Chinese civilization through exegesis, the paper pursues two different, but related aims. For one, it wants to substitute the static understanding of China for a dynamic one. Only when the interplay of intellectual and historical forces in China is taken seriously, the range, wealth and flexibility of intellectual life in China can be appreciated. Because of these qualities, radically different attitudes, values and political systems can be and were advocated based on the very same tradition. By adopting a historical perspective on the current development in China, the paper wants secondly to open up the possibility of a meaningful dialogue with China. (shrink)

Cannabis sativa L. is grown and marketed under a large number of named strains. Strains are often associated with phenotypic traits of interest to consumers, such as aroma and cannabinoid content. Yet genetic inconsistencies have been noted within named strains. We asked whether genetically inconsistent samples of a commercial strain also display inconsistent aroma profiles. We genotyped 32 samples using variable microsatellite regions to determine a consensus strain genotype and identify genetic outliers for four strains. Results were used to select (...) 15 samples for olfactory testing. A genetic outlier sample was available for all but one strain. Aroma profiles were obtained by 55 sniff panelists using quantitative sensory evaluation of 40 odor descriptors. Within a strain, aroma descriptor frequencies for the genetic outlier were frequently at odds with those of the consensus samples. It appears that within-strain genetic differences are associated with differences in aroma profile. Because these differences were perceptible to untrained panelists, they may also be noticed by retail consumers. Our results could help the cannabis industry achieve better control of product consistency. (shrink)

City councils hold meetings several times a week. There is a need for computer support at certain meetings. This paper examines the potential for group support systems for use in city council meetings and shows in what ways they can be helpful in pre-meeting and post-meeting activities. The study is based on 17 computer-supported city council meetings, carried out in Stuttgart, Kornwestheim and other cities as part of the Cuparla Project between 1996 and 1998. Three of these meetings are described (...) in the paper as brief case studies. Following this, all 17 meeting sequences are evaluated and analysed. Guidelines have been developed from the results of the study for the introduction of group support systems in city council meetings. (shrink)

Partially because of the high cost of developing and maintaining cold chains, systems needed to keep heat-labile vaccines under adequate refrigeration from their points of manufacture to their administration in the field, the Joint WHO/FAO Expert Committee on Zoonoses (i.e., the approximately four fifths of all described human infections that people share with other vertebrate animals) recommended in 1982 operation of common cold chains by health and veterinary services in rural areas. Following this recommendation, a 1984 pilot level initiative in (...) medical-veterinary intersectoral cooperation should be regarded as a practical way to deliver human primary health care to currently neglected African pastoralists, and as a potential core program for development efforts overall within arid and semiarid areas of the African continent. This article explores the relation between belief-like imaginings and the establishment of imaginary worlds (often called fictional worlds). After outlining the various assumptions my argument is premised on, I argue that belief-like imaginings, in themselves, do not render their content true in the imaginary world to which they pertain. I show that this claim applies not only to imaginative projects in which we are instructed or intend to imagine certain propositions, but also to spontaneous imaginative projects. After arguing that, like (...) guided imaginative projects, spontaneous projects involve specific imaginary truths, I conclude that imaginative projects, whether spontaneous or deliberate, comprise not only imaginings, but also mental acts of determining such truths. Criminal sanctions are typically inflicted by the state. The central role of the state in determining the severity of these sanctions and inflicting them requires justification. One justification for state-inflicted sanctions is simply that the state is more likely than other agents to determine accurately what a wrongdoer justly deserves and to inflict a just sanction on those who deserve it. Hence, in principle, the state could be replaced by other agents, for example, private individuals. This hypothesis has given rise (...) to recent calls to reform the state's criminal justice system by introducing privately inflicted sanctions, for example, shaming penalties, private prisons, or private probationary services. This paper challenges this view and argues that the agency of the state is indispensable to criminal sanctions. Privately inflicted sanctions sever the link between the state's judgments concerning the wrongfulness of the action and the appropriateness of the sanction and the infliction of sufferings on the criminal. When a private individual inflicts punishment, she acts on what she and not the state judges to be a justified response to a criminal act. Privately inflicted sanctions for violations of criminal laws are not grounded in the judgments of the appropriate agent, namely the state. It is impermissible on the part of the state to approve, encourage, or initiate the infliction of a sanction on an alleged wrongdoer on the basis of a private judgment. Such an approval grants undue weight to the private judgment of the individual who inflicts the sanction. (shrink)

A recent paper suggested that if Galilean covariance was extended to signals and interactions, the resulting theory would contain such anomalies as would have impelled physicists towards special relativity even without empirical prompts. I analyze this claim. Some so-called anomalies turn out to be errors. Others have classical analogs, which suggests that classical physicists would not have viewed them as anomalous. Still others, finally, remain intact in special relativity, so that they serve as no impetus towards this theory. In this paper, I will analyze certain aspects of imaginative content, namely the content of the representational mental state called “imagining.” I will show that fully accounting for imaginative content requires acknowledging that, in addition to imagining, an imaginative project—the overall mental activity we engage in when we imagine—includes another infrastructural component in terms of which content should be explained. I will then show that the phenomenon of imaginative immersion can partly be explained in terms of the proposed infrastructure of (...) imaginative projects. (shrink)

Background In nursing homes, residents’ relatives represent important sources of support for nurses. However, in the heightened stress of emergency situations, interaction between nurses and relatives can raise ethical challenges. Research objectives The present analysis aimed at elaborating a typology of nurses’ experience of ethical support and challenges in their interaction with relatives in emergency situations. Research design Thirty-three semi-structured interviews and six focus groups were conducted with nurses from different nursing homes in Germany. Data were analysed according to Mayring’s (...) method of qualitative content analysis. Participants and research context Participants were licensed nurses working in nursing homes. Ethical considerations Ethical approval was granted by Ostfalia University of Applied Sciences (02.07.2020) and the Ethics Committee of Hannover Medical School (Nr. 8866_BO_K_2020; 27.01.2020). Interviewees were anonymised and focus group were pseudonymised during transcription. All participants provided written consent. Findings/results In emergency situations, relatives can represent important sources of support for nurses. However, they may also give rise to different challenges, relating to four ethical conflicts: (1) the challenge of meeting the information needs of relatives while providing appropriate care to all residents; (2) the challenge of managing relatives’ demands for hospitalisation when hospitalisation is not deemed necessary by nurses; (3) the challenge of managing relatives’ demands for lifesaving treatment when such treatment contradicts the will of the resident; and (4) the challenge of attempting to initiate hospitalisation when relatives oppose this course of action. Several external factors make these conflicts especially challenging for nurses: fear of legal consequences, a low staffing ratio, and a lack of qualified nursing staff. Conclusions Conflict between nurses and relatives typically revolves around hospitalisation and the initiation of lifesaving treatment. Whether nurses perceive interaction with relatives as supportive or conflictual essentially depends on the quality of the relationship, which may be negatively influenced by a number of external factors. We give a complete characterization of the class of upward monotone generalized quantifiers Q1 and Q2 over countable domains that satisfy the scheme Q1 x Q2 y φ → Q2 y Q1 x φ. This generalizes the characterization of such quantifiers over finite domains, according to which the scheme holds iff Q1 is ∃ or Q2 is ∀ (excluding trivial cases). Our result shows that in infinite domains, there are more general types of quantifiers that support these entailments.

The state has a duty to protect individuals from violations of their basic rights to life and liberty. But does the state have a duty to criminalize such violations? Further, if there is a duty on the part of the state to criminalize violations, should the duty be constitutionally entrenched? This paper argues that the answer to both questions is positive. The state has a duty not merely to effectively prevent violations of our rights to life and liberty, but also (...) to criminalize such violations. Further, the duty to criminalize ought to be constitutionally entrenched. In the absence of criminal prohibitions on violations of the right to life and liberty individuals live ‘at the mercy’ of others. In the absence of a constitutional duty to criminalize, life and liberty of individuals is contingent upon the judgments and inclinations of the legislature. In both cases citizens’ rights are ‘at the mercy of others’. I also show that the decisions of the German Constitutional Court concerning abortion can be justified on such grounds. (shrink)

The standard opinion is that the force of the constitution hinges on the fact that it is willingly endorsed by the people or, at least representative of the people. This Article challenges this view. More specifically, I differentiate between two types of legitimation: representational legitimation and non-representational or reason-based legitimation. While representational legitimation rests on the fact that the constitution is representative of who the people are or what they want, reason-based constitutions are based on the judgement that the constitution (...) is just or, at least grounded in reason. I also show that some of the puzzles in constitutional theory can be resolved by acknowledging the significance of the latter type of legitimation. For instance, I illustrate that constitutions that were not adopted freely by the nations and could not have been characterized as representative of the people such as the German Constitution can still be legitimate. To put it provocatively: the legitimation of a constitution need not rest on the conviction that it represents the people whom it governs; it may simply rest on the belief that it is a good or just constitution. Representational legitimacy is only one form of legitimacy but not the only one. (shrink)

This article examines the role bureaucracy has in enhancing the social diversity of judiciaries. It does so by analyzing the Israeli judiciary and its reforms over the last three decades, and the interaction of these reforms with the appearance of intersectional judges—Arab women, Jewish women of Orthodox background, and Jewish women from geographic and economic peripheries—into the Israeli judiciary. Based on an original empirical study, the article shows that the career paths of intersectional judges include administrative roles in the judiciary (...) more often than non-intersectional judges. The article further demonstrates how these administrative career paths were shaped by bureaucratic-minded reforms. The Israeli case study thus shows how the bureaucratic design of the judiciary can accommodate diversity efforts, sometimes unintendedly, and discusses the merits, boundaries, and drawbacks of such bureaucratic design. The aim of this paper is to examine Heidegger’s critique of Hegel and to determine whether it is justified. Heidegger claims that Hegel tries to reduce everything to a single absolute entity, to the absolute knowing subject. The result is the identification of being and nothing, as Hegel formulates it at the beginning of his Logic. Hegel identifies being with nothing because being has no references, no predicates, no properties. Heidegger agrees with Hegel that being and nothing are the same, (...) but in completely different respects. They are the same because only entity actually exists, i.e. as an existent being. But Being itself does not exist, and should be conceived in an utterly different way from entity. And since Being cannot “be” it is a non-entity and therefore nothing. (shrink)
