Islamic financial institutions (IFIs) are emerging as prominent players in the financial world and are increasingly known for their conservative socially responsible investment (SRI). Being the Shari'a regulators and monitors of IFIs, the Shari'a departments are expected to implement the Islamic perspective of SRI – drawn from Shari'a principles – in their respective institutions. The purpose of this paper is to develop an SRI framework applicable to IFIs and other Shari'a compliant entities and assess its applicability within Shari'a departments of (...) two Islamic banks. This paper involves cross-case analysis based on interviews with Shari'a department officials in two settings differentiated by their respective independence. The proposed framework consists of required, expected and desired SRI aspects as applicable to IFIs. The findings reveal that the required aspects are uniformly observed by the two cases. There are, however, variations when it comes to observing the expected and desired ethical SRI aspects that may be driven by the independence of the Shari'a boards. This inconsistency and non-adherence of expected and desired aspects may lead to reputational risks in the long run. (shrink)

In the 1940s, Georges Canguilhem has established the concept of biological normativity on the level of the organism in his key work on “ The Normal and the Pathological ”. We would like to present a contemporary analysis of Canguilhem’s work, set it in context with more recent results from the field of complexity and immunology, and evaluate the problematic whether normativity is a genuine capacity of the organism. Based on Canguilhem’s conditions of the definition of biological normativity, we show (...) that the immune system as one of the complex systems of the living equally shares the capacity to be normative. This article explores the meaning and relevance of the ‘Idea of Europe’ in the context of a multicultural and multi-ethnic continent that increasingly draws on the presence and practices of people from non-European backgrounds. The Idea of Europe, even in its contemporary use, remains an ideal based on a Christian-Enlightenment-Romantic heritage, mobilized by supporters of European integration as the bridge between diverse European national cultures. In a Europe of extraordinary cultural interchange and immigration from all corners of the world, the (...) classical Idea of Europe is strikingly exclusionary and backward looking – a poor motif for the future. The article tries to develop an alternative Idea of Europe, one based on a particular politics of the public domain and a particular ethos of belonging in Europe seen as a migrant space, rather than one based on the enduring cultural values of a body of people called Europeans. It outlines a commons, protected by appropriate EU-level rights, that can both support and bind cultural pluralism and difference, and it proposes democratic vitalism as Europe’s core political project, an idea of becoming European, read as the process of never-settled cultural invention resulting from the vibrant clashes of an equal and empowered multiple public. No myth of origin, no myth of destination, only the commitment to a plural demos. (shrink)

Islamic Financial Institutions have recently witnessed remarkable growth driven by their holistic business model. The key differentiator of IFIs is their Shari’a-based business proposition which often requires some financial sacrifices, e.g. being ethical, responsible and philanthropic. It also requires them to refrain from investments in tobacco, alcohol, pornography or earning interest. For IFIs’ sponsors and managers, however, the key motivational factor for entering the Islamic financial market is not the achievement of Shari’a objectives through the holistic business model, but rather (...) the urge to tap this highly profitable market where customers are inclined to pay a premium for Shari’a compliance. In order for IFIs to be accepted by the market, their financial instruments need to be approved by Shari’a scholars, known for their integrity and expertise in Shari’a. One can therefore expect potential tensions between IFIs’ managers and Shari’a scholars. The purpose of this research is to probe the hidden struggle between managers and Shari’a scholars in pursuit of their respective objectives. The study investigates this phenomenon using grounded theory as a methodological framework based on data collected from three IFIs from two countries. The findings reveal that Shari’a scholars and managers of IFIs have divergent objectives, which creates incongruence of objectives at the strategic level. The findings illustrate the tension and latent struggle for Shari’a compliance, which has been termed as ‘Fatwa Repositioning’ resulting in four possible consequences: deep, reasonable, minimum and superficial Shari’a compliance. Fatwa Repositioning is the core category of this study, which exhibits how managers and Shari’a scholars struggle to position the Shari’a compliance of their institutions so as to best serve their respective objectives. Interestingly, Shari’a scholars are seemingly not always in control of what they are supposed to be controlling, i.e. Shari’a compliance. (shrink)

Research suggests that ethical leadership influences employees’ behavior and organizational functioning. Thus, the purpose of this study is to investigate the role of ethical leadership in the improvement of employees’ innovative performance. Specifically, this research developed and tested a framework about the intermediating mechanism of social capital in the relationship between ethical leadership and employees’ innovative performance. The current study integrated assumptions of social learning and social exchange theories, which postulate that the leadership has a direct effect on the employees’ (...) conduct, principally through role modeling and the reciprocal landscape. Data were collected through in-person administered questionnaire-based survey from 297 employees working in the manufacturing sectors of Pakistan. The conceptual model of our research was analyzed applying Structural Equation Modeling (SEM). The results exhibited that the ethical leadership plays an important role in fostering employees’ innovative performance. The present study also found that social capital plays an intermediating role between the ethical leadership and employees’ innovative performance relationship. The current study contributed to the leadership and innovation literature and provided insights in examining the ethical leadership-employees’ innovative performance relationship through the intermediating mechanism of social capital. Since the 1980s, Western and European multinational corporations, notably clothing and fashion brands, have shifted their production to developing nations, particularly in the ready-made garments (RMG)-producing countries like Bangladesh. This shift, driven by the dominant economic and political doctrines of globalisation and neoliberalism, has led to the deliberate targeting of developing nations to exploit their abundant labour forces and strengthen global capitalism. The RMG industry in Bangladesh, a prime example, pays its workers meagre wages. However, it is the global brands, (...) through their outsourcing practices, that hold significant power and contribute to the exploitation of RMG workers in Bangladesh while reaping substantial profits. The intellectual legacy of Confucianism has loomed large in efforts to understand China's past, present, and future. While Confucian ethics has been thoroughly explored, the question remains: what exactly is Confucian political thought? Classical Confucian Political Thought returns to the classical texts of the Confucian tradition to answer this vital question. Showing how Confucian ethics and politics diverge, Loubna El Amine argues that Confucian political thought is not a direct application of Confucian moral philosophy. Instead, contrary to the conventional view (...) that Confucian rule aims to instill virtue in all members of society, El Amine demonstrates that its main aim is to promote political order. El Amine analyzes key aspects of the Confucian political vision, including the relationship between the ruler and the people, the typology of rulers, and the role of ministers and government officials. She also looks at Confucianism’s account of the mechanisms through which society is to be regulated, from welfare policies to rituals. She explains that the Confucian conception of the political leaves space open for the rule of those who are not virtuous if these rulers establish and maintain political order. She also contends that Confucians defend the duty to take part in government based on the benefits that such participation can bring to society. Classical Confucian Political Thought brings a new understanding to Confucian political theory by illustrating that it is not chiefly idealistic and centered on virtue, but rather realistic and driven by political concerns. Sociological studies of culture have made significant progress on conceptual clarification of the concept, while remaining comparatively quiescent on questions of measurement. This study empirically examines internal conflicts (or “infighting”), a ubiquitous phenomenon in political organizing, to propose a “resinous culture framework” that holds promise for redirection. The data comprise 674 newspaper articles and more than 100 archival documents that compare internal dissent across two previously unstudied lesbian and gay Marches on Washington. Analyses reveal that activists use infighting as a (...) vehicle to engage in otherwise abstract definitional debates that provide concrete answers to questions such as who are we and what do we want. The mechanism that enables infighting to concretize these cultural concerns is its coupling with fairly mundane and routine organizational tasks. This mechanism affords one way to release the culture concept, understood here as collective self-definitions, from being “an amorphous, indescribable mist which swirls around society members,” as it was once provocatively described. The adoption of mobile payment (m-payment) and mobile banking (m-banking) is low in several countries, despite its associated benefits. The present study examines the impact of Pakistani consumers’ financial skills and digital literacy on their intention to adopt m-payment/m-banking using the Technology Acceptance Model (TAM). The data were collected from 454 individual smartphone users residing in Punjab province via an online and offline questionnaire survey. Structural equation modeling was used to analyze the consumers’ data. The results endorse that (1) their (...) financial skills have no association with intention to adopt but through perceived usefulness; (2) their digital literacy bridges a strong association with intention and through perceived ease of use. According to the United Nations, the Rohingya people are the most persecuted minority group in the world. The atrocities perpetrated by Myanmar authorities could by any reckoning be called ethnic cleansing. This paper delves into the level of discrimination against the Rohingya population perpetrated by Myanmar authorities in myriad of ways. A team of researchers interviewed 37 victims. The pattern of persecution goes back to 1948 – the year when the country achieved independence from their British colonizers. Today, this population (...) group is the single largest “stateless” community after Palestinians in the world. Their “statelessness” or lack of citizenship increases their vulnerability owing to the lack of entitlements to any legal protection from the government. Without citizenship, they are deprived of basic rights such as access to health services, education and employment. The illiteracy rate among the Rohingya, for example, is a staggering 80 percent. However, so far, no unified responses either from the ASEAN or the EU were provided to the crisis. As a result, the level of discrimination against and brutality towards them kept escalating. Academic frauds, dishonesty and cheating are pervasive in Pakistan, but thus far less systematic research has been undertaken on the effectiveness of the policies designed for countering academic dishonesty. Generally, the success of a policy depends on a good design and appropriate implementation. The design aspect of the policies to counter academic dishonesty in Pakistan is studied elsewhere, the purpose of this article is to empirically examine the implementation stages of the same policies. In doing so, the study utilizes a (...) panel data set comprising of 60 cross-sections and 06 time series observations (2012–2017). Results of the rigorous panel regression models shows that leniency in the prescribed punishments and an exhaustive belief on the efficacy of traditional examination surveillance methods are counterproductive. The study however failed to substantiate the direct relationship of discrimination and academic dishonesty in the sample. It is therefore concluded that prescribed punishments must be awarded in letter and spirit and that there is need for coordination at different stages of the implementation. Further, the study also recommends that traditional forms of examination surveillance must be augmented using modern technology. (shrink)

The commentaries addressed various aspects of our account of historical myths. We respond by clarifying the evolutionary theory of coalitional psychology that underlies our claims (R1). This addresses concerns about the role of fitness interdependence in large groups (R2), cultural transmission processes (R3), alternative routes to nation-building (R4) and the role of proximal mechanisms (R5). Finally, we evaluate alternative theories (R6) and discuss directions for future research (R7).

Peace, the article shows, is achieved by culturally evolved institutions that incentivize positive-sum relationships. We propose that this insight has important consequences for the design of human social cognition. Cues that signal the existence of such institutions should play a prominent role in detecting group membership. We show how this accounts for previous findings and suggest avenues for future research.

In his review of my book, Classical Confucian Political Thought, David Elstein argues that my interpretation of Classical Confucian political thought draws too sharp a distinction between Confucians’ ethical standards and their political standards, thus veering perhaps a bit too far from the “conventional wisdom” that views Confucian politics as an extension of Confucian ethics. Efficient identification of influential nodes is one of the essential aspects in the field of complex networks, which has excellent theoretical and practical significance in the real world. A valuable number of approaches have been developed and deployed in these areas where just a few have used centrality measures along with their concerning deficiencies and limitations in their studies. Therefore, to resolve these challenging issues, we propose a novel effective distance-based centrality algorithm for the identification of influential nodes in concerning (...) networks. EDBC algorithm comprises factors such as the power of K-shell, degree nodes, effective distance, and numerous levels of neighbor’s influence or neighborhood potential. The performance of the proposed algorithm is evaluated on nine real-world networks, where a susceptible infected recovered epidemic model is employed to examine the spreading dynamics of each node. Simulation results demonstrate that the proposed algorithm outperforms the existing techniques such as eigenvector, betweenness, closeness centralities, hyperlink-induced topic search, H-index, K-shell, page rank, profit leader, and gravity over a valuable margin. This paper discusses to what extent, if any, recent street uprisings in Iran have been fuelled by gender inequalities; and, what the legal challenges of transforming such gender equality demands into the constitution are. I argue that a demographic transition that commenced two decades ago in Iran changed the status of women in family and society. Such a transition has unavoidably increased the presence of women in the public sphere and challenged gender presumptions within the law. To give a constitutional (...) response to such demands, I argue, the Iranian Constitution must re-examine the correlation between women and men as biological and/or social groups, and the relationship among women themselves as a group consisting of diverse identities. There are two types of stock price manipulation examined in the theoretical literature: insider trading, which involves private information that is true and the public spreading of fraudulent false information. While there is a large empirical literature on insider trading, this is the first empirical article to examine the impact of false, fraudulent public information on stock prices and trading volume. We find that such false information, even after being denied by a credible source such as the SEC, generates both (...) abnormal returns and abnormal trading volume. We also find that the effects of the false information on security returns and volume can be persistent for at least 2 weeks. In addition, we show that perpetrators of false news attacks can make potentially large profits from such market manipulations. (shrink)

This paper argues that an AI judge is conceptually undesirable and not just something that lies beyond the state of the art in computer science. In a nutshell, even if an AI system could accurately predict how a good human judge would decide a particular case, its prediction would be the product of correlations between such factors as patterns of syntax in bodies of legal texts. This approach of AI systems is insufficient for basing their output on the sort of (...) rationales that are expected of valid judicial decisions in any desirable legal system. Thus, by their very nature, AI systems are incapable of providing valid legal decisions in any such system. (shrink)

The rich evade conviction more often in criminal trials than the poor. They also win more often in civil cases against the poor. Given that money buys better lawyers and better lawyers are instrumental in winning in adversarial trials, the rich have a structural advantage in laissez-faire trial systems. Such inequality is concerning. In a landmark article, Alan Wertheimer argues that we should level down legal resources in civil cases on the basis that doing so increases the adversarial system’s accuracy—that (...) is, its chance of reaching correct decisions. In a more recent article, along similar lines, Shai Agmon also advocates that, given some constraints of adequacy, legal resources should be leveled down in both civil and criminal cases. This article aims to show that such arguments fail because leveling down legal resources could decrease a trial system’s accuracy, making it worse by Wertheimer’s or Agmon’s own criteria. (shrink)

The establishment of MyCohort in 2005 showed that there is a growing interest on the part of the Malaysian government in the creation of biobanks in the country. This project can be considered as the biggest and most comprehensive cohort study in Malaysia, where hundreds of thousands of human samples are stored for epidemiological and biomedical research. However, little is known about the current issues or the situation related to biobank research in Malaysia. There are pressing issues that need answers (...) such as the governance of the national biobank as well as other privately owned biobanks in the nation, the public perspectives and perceptions regarding biobanks, and other matters such as the ethical, legal, and social issues related to biobank research. This article will highlight the status and issues related to biobank research in Malaysia and provide suggestions on future research practices that we feel need to be seriously considered. These suggestions are designed to advance and enlighten researchers’ knowledge, as well as provide the public with information on issues associated to biobanking. Good governance increases public knowledge and trust, and religious acceptance of biobank research and accountability can lead to increased participation in biobank research. The direct implications of the discussion about the ethical, legal, and social issues of biobanks are pertinent for the foundation of knowledge relating to biobanks, as well as the forward gestures for future medicine for mankind. We investigate whether the distinct nature of multinational firms (MNC) differently influence the governance-performance relationship compared to the local firms in Pakistan. We used a dynamic system GMM estimator that produces consistent and efficient estimation after controlling for dynamic endogeneity and simultaneity. Our results demonstrate that corporate governance (CG) has a significant positive impact on firm financial performance whilst CG practice of MNC firms is more effective than local firms in Pakistan. We observed two distinct financing behaviours, i.e., ‘pro-active investment (...) behaviour’ of MNC firms and ‘conservative investment behaviour’ of local firms. We conclude that a well-established corporate culture, significant financial worth and firms’ higher growth rate are key determinants of better CG practice. (shrink)

Pakistan’s evolution into a research-centric nation, recognized by Clarivate Analytics, suggests a transition towards a knowledge-based economy. However, the prevalence of academic dishonesty within Pakistan’s academic institutions raises concerns, potentially impeding the realization of its intellectual prowess. This research therefore examines the drivers of academic dishonesty in Pakistani universities, drawing on data collected from 457 students in four prominent public sector universities. Regression analysis of the dataset reveals several noteworthy findings. The study identifies that male gender, larger family size, risk (...) preference, anxiety, and susceptibility to peer influence correlate positively with academic dishonesty. Conversely, students’ socio-economic status and their perception of diminished respect for dishonest behavior act as deterrents. Furthermore, the impact of detection on academic dishonesty exhibits a threshold effect, while personal integrity/morality and punitive measures appear to have limited impact on academic dishonesty. Consequently, this study underscores the importance of addressing socio-cultural and environmental factors as pivotal elements in combating unethical academic conduct within Pakistan. (shrink)

Women entrepreneurs innovate, initiate, engage, and run business enterprises to contribute the domestic development. Women entrepreneurs think and start taking risks of operating enterprises and combine various factors involved in production to deal with the uncertain business environment. Entrepreneurship and technological innovation play a crucial role in developing the economy by creating job opportunities, improving skills, and executing new ideas. It has a significant impact on the income of the household. The study focused on investigating the role of women’s entrepreneurship (...) and innovation technologies in contributing to household income in the challenging situation of the pandemic COVID-19. The paper emphasized identifying the determinants of female entrepreneurial contribution toward household income. This study collected data from selected rural and urban areas of district Faisalabad through a self-administered questionnaire. Investigators interviewed female entrepreneurs and chose them through the snowball sampling technique from a population of purposively selected female-run businesses. Interviews were conducted with women entrepreneurs to gather relevant information for the survey investigation at their workplaces and home. The effects of various factors, including age, education, family size, income from other sources, time allocated to entrepreneurial activity, firm size, and location (rural/urban) were estimated empirically using an ordered logit model. The study findings exhibited a positive and significant role of respondents’ education, family size, time allocated to entrepreneurial activities, and firm size. The survey outcomes also indicated that the contribution of entrepreneurial income to household income in the rural areas is significantly higher than that in urban areas. This study signifies that regulations against gender discrimination in public and private institutions are helpful. Besides, encouraging an environment for entrepreneurial culture among women in the country would increase family income. The study’s findings and policy implications directly link to Sustainable Development Goal (SDGs) 5 of Gender Equality (GE) and SDG 8 related to decent work and economic growth. (shrink)

Kolmogorov complexity was originally defined for finitely-representable objects. Later, the definition was extended to real numbers based on the asymptotic behaviour of the sequence of the Kolmogorov complexities of the finitely-representable objects—such as rational numbers—used to approximate them.This idea will be taken further here by extending the definition to continuous functions over real numbers, based on the fact that every continuous real function can be represented as the limit of a sequence of finitely-representable enclosures, such as polynomials with rational coefficients.Based (...) on this definition, we will prove that for any growth rate imaginable, there are real functions whose Kolmogorov complexities have higher growth rates. In fact, using the concept of prevalence, we will prove that ‘almost every’ continuous real function has such a high-growth Kolmogorov complexity. An asymptotic bound on the Kolmogorov complexities of total single-valued computable real functions will be presented as well. (shrink)

'Communities of practice', like 'social capital' and 'networks', is an idea that has been widely adopted in the social sciences, particularly in discussion of innovation and creativity. This book evaluates the concept and its uses, and will be an essential guide for students and researchers.

Based on the distinction between global and local levels of visual perception, here we studied different levels of reasoning in visual analogies. Specifically, we created problems that could be solved by inferring relations either between the global shapes (global path) or the underlying objects (object path). The problems varied in the saliency of the global shape, in the colour and familiarity of the objects, and in the presentation of the visual problem (simultaneous or sequential). The results of three studies showed (...) that the global path was used more frequently than the object path, particularly for images with salient global shapes such as objects placed in a circle. However, neither colour nor object familiarity affected the tendency to use the object path. Importantly, the tendency to use the global path correlated with analogical problem-solving in other visual and verbal tasks. Overall, these findings suggest that the global precedence observed in image perception also applies to visual analogical reasoning. Furthermore, the tendency to use the global path can be regarded as an informative measure of individual differences. (shrink)

The UNESCO research projects focusing on The Silk Routes and The Slave Routes were launched at just the right time to remind us that globalization is not a novel dimension of the history of humanity. Not only am I among those who analyze capitalism as a worldwide system from its very inception, but I have also found it pertinent to recall that prior to the sixteenth century, societies were not at all isolated from one another but rather competing within regional (...) systems (and perhaps within one global system). To underestimate this fact is to condemn ourselves to a misunderstanding of the very dynamics of change within societies. At the same time, I maintain that in the history of the world, capitalism represents a qualitative rupture that had its beginnings around 1500. Accordingly I emphasize the distinction that must be made between the integrated structure of the worldwide capitalist system and the protocapitalist elements that are to be found in earlier societies; I also underline the specificity of the contrast between centers and peripheries, which is unique to global capitalism and which differs from previous forms of polarization.
