Ethical objections to the use of mass media and the internet help explain why the Plain People of North America avoid new communication technologies. Each subgroup of plain folk-including Amish, Mennonites, and Brethren adopt differing amounts of new technology, and the use variesfrom region to region or even,from community to community. Evangelical Protestant spirituality, under the influence of the Enlightenment, has assumed a somewhat modernist flavor. As a result, traditional forms of religious symbol and piety were demoted in favor of religious affections, true spirituality was now discerned by means of “heart knowledge,” and the assurance of salvation assumed a place of prominence in the emerging market of spiritual autobiography. This essay explores several ways that a non-monastic, non-modern Protestant tradition, which lives according to a community rule, can contribute to the (...) spiritual formation conversation. I begin by introducing the reader to the Amish narrative and discuss how two theological themes shape their approach to spirituality–-the cross of Christ and the relationship between faith and works, justification and sanctification. Next, I question a common view of Jesus’ ministry as being diametrically opposed to that of the Pharisees and suggest that the Sermon on the Mount deserves to be central to the enterprise of spiritual formation. I conclude this essay by revealing how the Amish put spiritual theology into practice, via a locally constructed Ordnung and while seated around the supper table. (shrink)

This paper draws on MacIntyre’s ethical thought to illuminate a hitherto underexplored religious context for business ethics, that of the Amish. It draws on an empirical study of Amish settlements in Holmes County, Ohio, and aims to deepen our understanding of Amish business ethics by bringing it into contact with an ethical theory that has had a signifcant impact within business ethics, that of Alasdair MacIntyre. It also aims to extend MacIntyrean thought by drawing on his neglected (...) critique of modernity in the context of business ethics. The Amish context allows us to appreciate the relationship between MacIntyre’s critique of modernity, his conception of practices and communities, and his distinctive approach to the virtues. This paper examines the position of international human rights law towards missionary or proselytizing activities with a special focus on the American context. By evaluating UN legal acts such as the 1948 Universal Declaration of Human Rights, the 1960 Arcot Krishnaswami Study and the 1981 Declaration on the Elimination of All Forms of Intolerance and Discrimination Based on Religion or Belief and the American Convention of Human Rights, it investigates the extent to which such activities fall within the scope of (...) the right to free speech and to freedom of religion for religious organizations. This is exemplified by looking at two Evangelical religious organizations founded for the purpose of luring away groups of believers from their original religious communities: “Mission to Amish People”, targeting the Amish People, and “Jews for Jesus”, aimed at the Jewish community. The clash of one religious community which considers mission a fundamental element of its religion with a religious community who is highly skeptical about mission constitute the extreme test case of the right to free speech and to corporate freedom of religion. Given the highly various importance which mission can play in different religions, the article suggests to solve each case individually by carefully examining the content of each religious doctrine. Daniel Callahan's concept of a “sustainable medicine” is examined by looking at experiences Old Order Amish communities have had with organ and bone marrow transplantation. The Amish possess many characteristics that might make them embrace limits on the use of expensive, life-prolonging medical treatments: they believe that the good of the individual should be subordinated to the good of the community, they are suspicious of progress as a goal, and they are more comfortable with dying than many other (...) modern Americans. However, the Amish actively pursue these treatments without the benefit of private or government insurance. Although the Amish affective response to sick individuals is worthy of emulating, their commitment to help individuals obtain and pay for transplants has had negative financial and cultural effects on some Amish communities. The Amish experience can thus teach us lessons about how to care for one another when we are sick and dying, but it can also teach us how difficult but important it is to limit some forms of expensive care for the good of our communities. People who identify as members of religious communities, such as the Amish and Low German Mennonites, face challenges obtaining quality health care and engagement in research due in part to stereotypes that are conveyed through media and popular discourses. There is also a growing concern that even when these groups are engaged in research, the guiding frameworks of the research fail to consider the sociocultural or historical relations of power, further skewing power imbalances inherent in the research relationship. This (...) paper aims at discussing the uses of cultural safety in the context of health research and knowledge translation with groups of people that are associated with a specific religion. Research with the Amish and Low German Mennonites is provided as examples to illustrate the use of cultural safety in this context. From these examples, we discuss how the use of cultural safety, grounded in critical theoretical perspectives, offers new insight into health research with populations that are traditionally labeled as minority, vulnerable, or marginalized, especially when a dominant characteristic is a unique religious perspective. The child’s right to an open future aims at protecting the autonomy of the mature person into which a child will normally develop. The justification of state interventions into parental decisions which unduly restrict the options of the prospective adult has to address the problem that the value of autonomy is highly contested in modern pluralist societies. The article argues that the modern majority culture provides young adults with many more options than traditionalist religious communities. However, the options that can (...) be chosen in faith groups, such as the Amish, do not constitute a subset of the options available in the wider society. Therefore, state policies which pursue the goal of providing every child with the greatest possible set of options cannot be based on a neutralist version of political liberalism. The advocates of a child’s right to an open future must rely on a perfectionist version of liberalism which draws on the ideal of leading an autonomous life. Since liberal perfectionism has problematic implications, the article defends a neutralist position that largely refrains from state interference with the educational authority of fundamentalist religious communities. Refusing treatment for potentially curable childhood cancers engenders much discussion and debate. I present a case in which the competent parents of a young Amish child with acute myeloid leukemia deferred authority for decision making to the child’s maternal grandfather, who was vocal in his opposition to treatment. I analyze three related concerns that distinguish this case from other accounts of refused treatment.First, I place deference to grandparents as decision makers in the context of surrogate decision making more generally.Second, (...) the maternal grandfather’s ardent refusal of treatment and his rationale appeared to be inconsistent with the beliefs expressed by other family members and by members of the same Amish community, leading members of the medical team to question whether refusal of treatment should be treated differently when it appears to be based on the idiosyncratic beliefs of an individual rather than on community-wide values.Third, the medical team perceived tension and dissension between the nonverbal behavior of some family members and the verbal statements made by the maternal grandfather, leading the team to question the parents’ true wishes and debate how to weigh nonverbal and indirect forms of communication.Finally, building upon the conclusions of these queries, I explore whether, if the child’s prognosis was less favorable or if he were to relapse later, the maternal grandfather should have been permitted to drive a decision to refuse further treatment. The position of clinical ethicist exists to help resolve conflicts in the hospital. Sometimes these conflicts arise because of fundamental cultural differences between the patient and the medical team, and such cases present special challenges. Should the ideology of modern medicine reject the wishes of those who hold ideologies from differing cultures? How can the medical ethicist help resolve such conflicts? To answer these questions, I rely on the works of Alasdair MacIntyre. Using MacIntyre’s philosophy, we can better understand why (...) traditions exist, how conflicts arise, and how opposing traditions can collaborate in shared decision making. In order to overcome conflict, I conclude that MacIntyre’s virtues of acknowledged dependence must be realized by the ethicist and those in disagreement over tradition. I use a case study of a young Amish patient to highlight the conflicts that arise and to help exhibit how shared decision making can be made possible. (shrink)

Sollten muslimische Lehrerinnen im Unterricht ein Kopftuch tragen dürfen? Ist es gerecht, wenn Frauen bei der Vergabe von Arbeitsplätzen bevorzugt werden? Sollten die Kinder der Amish von der Schulpflicht befreit sein? Rechte von Minderheiten beschäftigen zunehmend die aktuelle Rechtsprechung und Politik. In der philosophischen Debatte sind sie nicht zuletzt deswegen so umstritten, weil sie dem Gleichheitsgedanken zu widersprechen scheinen. Es zeigt sich jedoch, dass die Anerkennung von Minderheitenrechten unter bestimmten Umständen moralisch gefordert ist.

Die Hauptthese dieses Aufsatzes besagt, dass eine liberale Argumentation für die Schulausbildung den multikulturellen Forderungen nach Ausnahmen von allgemeinen Lehrplansanforderungen wie z.B. derjenigen entgegensteht, die den Amish in Yoder garantiert wurde. Diese These wird durch eine Konzeption von liberaler Ausbildung untermauert, die paternalistische Elemente beinhaltet und die dementsprechend über die üblichen Argumentationen für die liberale Ausbildung hinausgeht, die Ausbildung lediglich als Funktional für die Bürgerrolle betrachtet.

In these skeptical and disillusioned times, there are still groups of people scattered throughout the world who are trying to live out utopian dreams. These communities challenge the inevitability and morality of dominant political and economic models. By putting utopian religious ethics into practice, they attest to the real possibility of social alternatives. In Seeds of the Kingdom, Anna L. Peterson reflects on the experiences of two very different communities, one inhabited by impoverished former refugees in the mountains of El (...) Salvador and the other by Amish farmers in the Midwestern U.S. What makes these groups stand out among advocates of environmental protection, political justice, and sustainable development is their religious orientation. They aim, without apology, to embody the reign of God on earth. The Salvadoran community is grounded in Roman Catholic social thought, while the Amish adhere to Anabaptist tradition. Peterson offers a detailed portrait of these communities' history, social organization, religious life, environmental values, and agricultural practices. She discovers both practical and ideological commonalities in these two comparatively successful and sustainable communities, including a strong collective identity, deep attachment to local landscapes, a desire to preserve non-human as well as human lives, and, perhaps unexpectedly, a utopian horizon that provides both goals and the hope of reaching them. By examining the process by which people struggle to live according to a transcendent value system, she sheds light on both the actual and the potential place of religion in public life. Peterson argues that the Amish and Salvadoran communities, geographically and culturally removed from the industrialized West, have relevance for the political and environmental problems of the developed world. These communities have succeeded in the face of significant internal and external challenges, offering important practical and theoretical lessons on how to achieve ecological sustainability and social justice in the wider world. Heidegger maintains that the root of modern technology, like that of all other technologies, lies in technē. However, because the art dimension of technē is suppressed in modern technology, the essence of this technology becomes a Gestell that enforces product-making, and thus drives technology beyond the control of human beings. The more fundamental reason underlying this “frame-becoming” nature is “the mathematical” that emerges in ancient Greece, which, through the Cartesian subject-object dichotomy, turns the world into the images represented by the (...) subject, and things into definite objects. To escape the dictatorship of the Gestell, it is necessary to re-realize the art-dimension of technē in modern technology, i. e. to let the gentle granting nature of the enowning re-master technology. In this respect, both Heidegger and Heisenberg were inspired by or at least resonated with Lao Zi or Zhuang Zi’s Dao. Confucians will greatly appreciate the critique of modern technology by Heidegger, and especially his view of returning “home” to overcome the possible dangers brought about by technology. However, from the perspective of Confucianism, Heidegger’s critique contains some shortcomings: for example, his ignorance of the individualistic impact in the Gestell and his unidirectional “ontological difference,” which leads him to a view of “home” that lacks “family” and therefore renders his solution loose and rootless. Only an organic community originated in the family, be it Confucian or Amish, can effectively reduce the control of modern technology over the human being. (shrink)

Plain Anabaptists are a small but rapidly growing ethnoreligious society with significant concentrations of population in a number of regions in North America. Among the most widely known of the various groups of Plain Anabaptists are the Amish and the Old Order Mennonites. It is the purpose of this article to provide insight into the culture and values of the Plain Anabaptists so that those who may be called upon to address ethical conflict involving Plain Anabaptists can do so (...) with appropriate knowledge and sensitivity. The discussion of the culture and values of the Plain Anabaptists will be organized as follows: first we will explore the implications of Plain Anabaptist culture and values for applying the ethical principles of respect for autonomy and beneficence/nonmaleficence. Second, a brief description of several elements of Plain Anabaptist culture will be discussed with attention to the potential they create for ethical conflict in the healthcare setting. (shrink)

The best way to divide control over children’s education between private and state authorities is unclear. This task has ethical implications that this thesis explores—in the context of a pluralist liberal democracy. In cases where authority over children’s education is granted to private groups, like ethnic or religious minorities, rights are often part of the default vocabulary adopted by politically liberal commentaries. These rights are often viewed as a shield that offers the group immunity from state interference. Some illiberal minority (...) groups argue that they need to be shielded from state interference because the persistence of their cultural or religious identity depends on it. For example, the Amish community in Wisconsin argued in Wisconsin v. Yoder that the future of their community would be jeopardized if they were forced to send their children to school beyond the age of fourteen. While a rights-based approach does explain many of the variables connected with cases like these, the explanation is incomplete. I will offer two clarifications to the rights-based view. First, in the event that a minority group is shielded from state interference, it is not clear that it would be morally legitimate for the group to take over the authority of the state. I will, then, offer a plausible theory that could justify the self-governing authority of minority groups in these situations. My second clarification is that the concept of individual autonomy, often the central liberal value protected by rights, is too broad to support a zero-tolerance approach toward illiberal groups. This indicates that illiberal minority groups might still have a claim to self-governing authority even though they arguably interfere with the autonomy of their children. Some interference with minor elements of individual autonomy should arguably be tolerated in cases where the ruination or assimilation of the group’s unique culture or religion is at stake. (shrink)

This dissertation seeks to answer the following question: does a commitment to liberalism require state remediation of illiberal practices of illiberal minority cultures that only affect their own members? Put differently, it asks: should the state deny illiberal minority cultures such as those of the Amish, Ultra-Orthodox Jews, Pueblo Indians, et cetera the freedom to be internally illiberal from a liberal viewpoint? The answer proposed by this dissertation is a qualified ‘no’. Assuming that liberalism is fundamentally committed to the (...) protection of individual freedom, I argue that states should allow illiberal minority cultures to be internally illiberal in order to respect the individual freedom of citizens with illiberal conceptions of the good. At the same time, I propose limits to this toleration in order to protect the individual freedom of progressive-minded citizens, as well as to guard children from severely harmful cultural practices. Whether the state should tolerate illiberal practices of illiberal minority cultures that only affect their own members, I claim, should depend on whether the following conditions are met: Their adult members are guaranteed substantive exit rights, i.e. rights to a realistic ability to change cultural affiliations. The cultural communities in question do not engage in illiberal practices that inflict severe harm on children. To realise condition, which forms the core of this dissertation’s ‘substantive exit rights strategy’, I argue that the state should take five measures. These include making an autonomy-facilitating education compulsorily for children, providing particular groups of defectors with financial assistance, and ensuring that the liberal majority culture is open to ex-members of illiberal minority cultures. By contrast, condition is not considered to be central to this dissertation’s substantive exit rights strategy, the reason being that it is dubious whether liberalism’s core commitment to the protection of individual freedom alone can justify a ban on cultural practices that severely harm children. Even so, it will become clear that adding this condition renders this approach more plausible. My central claim is that this dissertation’s substantive exit rights strategy better protects the individual freedom of members of illiberal minority cultures than the main rival liberal strategies, as proposed by Will Kymlicka and Chandran Kukathas. Whereas Kymlicka gives members of these groups too little liberty to engage in illiberal practices, I argue that Kukathas makes the opposite mistake of granting them too much liberty. In both cases, we will see that the individual freedom of some members of illiberal minority cultures is not appropriately protected. This holds true, I conclude, regardless of whether individual freedom is construed as personal autonomy or in a less demanding way, namely as ability to live in accordance with one’s conception of the good. Culture is a notoriously elusive concept. This fact has done nothing to hinder its popularity in contemporary analytic political philosophy among writers like John Rawls, Will Kymlicka, Michael Walzer, David Miller, Iris Marion Young, Joseph Raz, Avishai Margalit and Bikhu Parekh, among many others. However, this should stop, both for the metaphysical reason that the concept of culture, like that of race, is itself either incoherent or lacking a referent in reality, and for several normative reasons. I focus on the (...) following interconnected points: • The vagueness of the term allows a myriad of candidates to claim rights, and typically to the detriment of increased equality and environmental goals . • Cultural capital cannot be regulated in the way that political capital must be regulated without undermining the cultures supposedly being protected. And the possession of cultural capital is almost never democratically regulated. In particular, granting cultures political status creates intergenerational conflict, rewarding the elders and creating incentives to be conservative and restrict cultural mobility of the younger generation. •The notion of a group owning “its” culture is conceptually suspect and corrupted by the foregoing points about unequal cultural capital. In defending a group’s right to preserve its culture we do not defend equally the rights of the individuals that make it up , and we ignore altogether the rights of those who may be unfairly denied recognition as “members” of the culture.
