This paper provides an analysis of the argumentative mechanisms put forward in the Letters from Mexico(Cartas de Relación) written by Hernán Cortés to Charles V in order to legitimize the territorial conquest of what would become the New Spain and, in doing so, of the New World. It seeks particularly to show the use of the rhetorical concept of inventio in the transition from a conceptual appropriation of the New World (through the elaboration of the very concept of “New World”) (...) to its territorial control (with the foundation of Veracruz and the creation of the New Spain). The language of ethics expertise has become particularly important in bioethics in light of efforts to establish the value of the clinical ethics consultation, to specify who is qualified to function as a clinical ethics consultant, and to characterize how one should evaluate whether or not a person is so qualified. Supporters and skeptics about the possibility of ethics expertise use the language of ethics expertise in ways that reflect competing views about what ethics expertise entails. We argue for clarity (...) in understanding the nature of expertise and ethics expertise. To be an ethics expert, we argue, is to be an expert in knowing what ought to be done. Any attempt to articulate expertise with respect to knowing what ought to be done must include an account of ethics that specifies the nature of moral truth and the means by which we access this truth or a theoretical account of ethics such that expertise in another domain is linked to knowing or being better at judging what ought to be done and the standards by which this “knowing” or “being better at judging” is determined. We conclude with a discussion of the implications of our analysis for the literature on ethics expertise in CEC. We do think that there are clear domains in which a clinical ethics consultant might be expert but we are skeptical about the possibility that this includes ethics expertise. The theory of mental models postulates that meaning and knowledge can modulate the interpretation of conditionals. The theory's computer implementation implied that certain conditionals should be true or false without the need for evidence. Three experiments corroborated this prediction. In Experiment 1, nearly 500 participants evaluated 24 conditionals as true or false, and they justified their judgments by completing sentences of the form, It is impossible that A and ___ appropriately. In Experiment 2, participants evaluated 16 conditionals and provided their (...) own justifications, which tended to be explanations rather than logical justifications. In Experiment 3, the participants also evaluated as possible or impossible each of the four cases in the partitions of 16 conditionals: A and C, A and not-C, not-A and C, not-A and not-C. These evaluations corroborated the model theory. We consider the implications of these results for theories of reasoning based on logic, probabilistic logic, and suppositions. (shrink)

Authentic leadership has become increasingly important in the literature, attracting the attention of many scholars in the last decade. This study adopted an employee-centered perspective to guide its examination of the relationship between authentic leadership and individual performance and investigation of the sequential mediation of employees’ affective commitment and individual creativity. An analysis was conducted of data collected from 214 employees working in different business sectors. The results reveal a statistically significant positive relationship between authentic leadership and employees’ workplace performance, (...) which are both directly connected and indirectly linked through the two proposed psychosocial mechanisms. The findings thus indicate that authentic leadership reinforces workers’ emotional connection with their organizations, thereby increasing their individual creativity and, subsequently, promoting better on-the-job performance. This study presents new and significant results since, on the one hand, it relied on a sequential mediation analysis of variables and, on the other hand, integrated the four main constructs into a single model. The proposed model displays the chain of effects between authentic leadership, affective commitment, individual creativity, and employee workplace performance. Despite its potential implications for the objectivity of scientific knowledge, the claim that “scientific instruments are perspectival” has received little critical attention. I show that this claim is best understood as highlighting the dependence of instruments on different perspectives. When closely analyzed, instead of constituting a novel epistemic challenge, this dependence can be exploited to mount novel strategies for resolving two old epistemic problems: conceptual relativism and theory-ladeness. The novel content of this article consists in articulating and developing these strategies (...) by introducing two fine-grained notions of perspectives as the key units of analysis: “broad perspectives” and “narrow perspectives.”. In this study we examined whether parents’ perceptions of students’ anxiety as well as perceived support from both teachers and classmates were predictive of changes in students’ academic motivation during the first wave of COVID-19. To this end, we used a retrospective pretest-posttest design together with a latent change score model to analyze our data. From April to May of 2020, 394 Portuguese parents of students in grades 1–9 participated in this study. Our results showed that students’ anxiety and teachers’ (...) social support, as perceived by parents, were highly significant predictors of academic motivation changes. Specifically, we found a negative effect of anxiety and a positive effect of teachers’ social support on students’ academic motivation. Our results did not show, however, a significant predictive role of classmates’ social support. This study provides an important contribution to further understand the intrapersonal and interpersonal factors that are associated with the decline of students’ academic motivation during the COVID-19 pandemic. The pivotal role of teachers in sustaining students’ academic motivation and other relevant educational implications for the ongoing pandemic are discussed. (shrink)

This article argues that thinking about entrepreneurship as a potential instrument for relief from endemic poverty and disadvantage, especially among the Indigenous, has all too often been captive to a concept of entrepreneurship that is built out of constrained economic and cultural assumptions. The authors develop this argument from a critical discussion of contributions by Karl Polanyi and Robert Heilbroner. The result is that approaches to venture have been encouraged that are sometimes a poor fit for the circumstances of those (...) they are meant to benefit, and other forms that could have considerable promise have gone unexplored. This article outlines some features of Indigenous culture and build on the analysis of David Harper to construct an improved notion of entrepreneurship that allows for these distinctive features. The article concludes that research and policy making concerning entrepreneurship as an instrument of development among the Indigenous need to be undertaken with this reconstructed understanding of entrepreneurship that is a better fit for the realities of Indigenous culture. I argue that valid informed consent is ethically required for organ donation from individuals declared dead using neurological criteria. Current policies in the U.S. do not require this and, not surprisingly, current practices inhibit the possibility of informed consent. Relevant information is withheld, opportunities to ensure understanding and appreciation are extremely limited, and the ability to make and communicate a free and voluntary decision is hindered by incomplete disclosure and other practices. This paper considers the UN efforts to introduce a legally binding Treaty on corporate accountability for human rights impacts in the context of other proposed legislation at country level, on the one hand, and existing voluntary initiatives like the UN Guiding Principles (2011), on the other. What we are interested in is whether the proposed Treaty signals a transition from voluntary initiatives (based on moral commitments) to law (that is, a focus on compliance), and the extent to which it might (...) stimulate or hinder links between judicial and non-judicial initiatives. The scholars who have explicitly addressed these two divides are – Michael Sandel, on theory v. practice; and Amartya Sen, on law v. morality. We engage with their views, in sections II and III respectively, seeking to build an integrated approach to help us overcome these dualisms. We further consider John Ruggie’s “principled pragmatism”, a strategy that he uses to build the Protect, Respect and Remedy (henceforth, PRR) Framework; and we invoke arguments from casuistry as well as a practice-focused deontology (Thomas Donaldson’s) in favour of an ethics ‘beyond cognition’, which we consider better suited than either utilitarian or principle-based theories to guide the debate on human rights. This is because it allows us to take non-rational factors into account (such as emotions and personal affiliations), when judging the kind of common good we consider worth pursuing. In the last section of the paper, we investigate whether and how might the Treaty illustrate the two divides, trying to (a) distinguish between purely legal elements and those of a wider nature, to do with morality; and (b) understand what might help bridge the gap between theoretical commitments to the universality of human rights and various practical challenges. Our aim is not to evaluate the Treaty, from a legal viewpoint, or suggest improvements to it (lawyers are better placed to do that); rather, we seek to investigate the way in which the proposed Treaty – which is the first attempt to address the challenge of transnational business and human rights in international law – combines moral and legal aspects, and what this tells us about the world we live in. We report two new phenomena of deontic reasoning: (1) For conditionals with deontic content such as, "If the nurse cleaned up the blood then she must have worn rubber gloves", reasoners make more modus tollens inferences (from "she did not wear rubber gloves" to "she did not clean up the blood") compared to conditionals with epistemic content. (2) For conditionals in the subjunctive mood with deontic content, such as, "If the nurse had cleaned up the blood then she must have (...) had to wear rubber gloves", reasoners make the same frequency of all inferences as they do for conditionals in the indicative mood with deontic content. In this regard, subjunctive deontics are different from subjunctive epistemic conditionals: reasoners interpret subjunctive epistemic conditionals as counterfactual and they make more negative inferences such as modus tollens from them. The experiments show these two phenomena occur for deontic conditionals that contain the modal auxiliary "must" and ones that do not. We discuss the results in terms of the mental representations of deontic conditionals and of counterfactual conditionals. (shrink)

Online education has become an essential component of education. Thus, several factors, such as the student’s learning strategy and motivation, generally contribute to their academic success. This study investigates the relationship between learning strategies, motivation, and online learning environment among 150 first-year college students. Employing correlational design, the statistical findings of the study reveal that the r coefficient of 0.59 indicates a moderate positive correlation between the variables. The p-value of 0.00, which is less than 0.05, leads to the decision (...) to reject the null hypothesis. Contemporary bioethics is, at least in part, the product of biomedical and sociopolitical changes in the middle to latter part of the 20th century. These changes prompted reflection on deep moral questions at a time when traditional sources of moral guidance no longer were widely respected and, in some cases, were being rejected. In light of this, scholars, policy makers, and clinicians sought to identify a common morality that could be used among persons with different moral commitments to resolve disputes (...) and guide clinical practice and health policy. The tendency to get involved in helping one’s family, friends, school, and community has many potential benefits such as greater compassion, concern for others, and social responsibility. Research interest in the benefits of contribution in adolescents has increased recently, but there are not many studies examining the effect of contribution on adolescents’ mental health. The present study focused on whether the contribution is associated with fewer self-rated depression symptoms in adolescents. We further tested whether self-regulation and academic performance can have (...) a mediating role in this association. A total of 423 secondary school students (233 female) from eastern Croatia participated in the study. Mean age was 16.78 (SD= 1.21). Students completed measures of self-regulation, depression symptoms, and contribution (helping one’s family, friends, or neighbors, mentoring peers, volunteering in one’s community, and participating in school organizations or boards), and gave information about age, gender, and academic performance. A hierarchical regression analysis revealed that contribution, self-regulation, and academic performance were related with lower levels of self-rated depression symptoms. Furthermore, mediation analysis indicated a significant indirect effect through two mediators, self-regulation and academic performance, which was stronger than a path containing only self-regulation. Academic performance alone was not a significant mediator. Our findings suggest that contribution could protect against depression by promoting self-regulation, leading to higher academic performance, and consequently fewer depression symptoms. (shrink)

The Fourth Industrial Revolution based on digitalization, the development of AI, robotics, big data, and increasing automation is dredging up older debates on the end of human work. This article contributes to this debate arguing that these changing circumstances represent an opportunity to advance a renewed consideration of human work. By emphasizing its most distinctively human dimensions, including gratuitousness, relationality, and meaningfulness, we propose the articulation of a social model that recognizes relational goods as a specific contribution of human work (...) in an attempt to overcome the state and the market's monopoly of public life built around the dichotomy between the private and the public. Such a social model is based on the concept of circular subsidiarity, which represents a departure from traditional notions of subsidiarity by promoting a dynamic and reciprocal interplay between three essential societal spheres: the state, the market, and organized civil society, all of which have their role to fulfill by providing security, efficiency, and relational goods. Ultimately, this article suggests that circular subsidiarity can lead to a more inclusive and equitable social model by acknowledging how relational goods not only humanize civil society but also sustain the functioning of both the market and the state. Cet article est un premier essai d’étude historique sur les relations de genre dans les sociétés indigènes du Chaco, en Amérique du Sud. Le traitement de cette question nécessitant de travailler à partir de contextes sociaux, temporels et spatiaux concrets, nous avons situé l’analyse dans un secteur de la « frontière » chaquéenne placé sous la juridiction argentine, à des moments immédiatement antérieurs et postérieurs à la campagne militaire engagée pour soumettre les populations indigènes entre 1884 et 1911. Nous travaillons (...) ainsi depuis un front de colonisation interne pour repérer les changements que cette situation a provoqués sur les relations, les rôles sociaux et les identités des hommes et des femmes autochtones. L’analyse repose sur des sources issues de deux moments différents du processus de colonisation : le moment initial, à partir des missions franciscaines établies sur les bords du fleuve Bermejo pour évangéliser les Matacos ; puis l’apogée du processus, lorsque les Matacos furent incorporés comme brassiers salariés dans les raffineries sucrières. Roman Catholic healthcare institutions in the United States face a number of threats to the integrity of their missions, including the increasing religious and moral pluralism of society and the financial crisis many organizations face. These organizations in the United States often have fought fervently to avoid being obligated to provide interventions they deem intrinsically immoral, such as abortion. Such institutions no doubt have made numerous accommodations and changes in how they operate in response to the growing pluralism of our (...) society, but they have resisted crossing certain lines and providing particular interventions deemed objectively wrong. Catholic hospitals in Belgium have responded differently to pluralism. In response to a growing diversity of moral views and to the Belgian Act of Euthanasia of 2002, Catholic hospitals in Belgium now engage in euthanasia. This essay examines a defense that has been offered of this practice of euthanasia in Catholic hospitals and argues that it is misguided. (shrink)

The proposed reflection intends to present the problem of judicial adjudication as a substantially-axiologically founded autonomous moment on the practical realization of law, and to explore this understanding in confrontation with external exigencies, mostly teleologically determined—hence, beyond strict deductive application, as a syllogistic reference of facts to norms, and finalistically determined decision, as an option among possible alternatives to achieve specific aims. The main objective is to enter into a discussion on the methodological meaning of “integrity”, “hard cases” and “right (...) answer”, as presented by Ronald Dworkin, and a critical reflection on the criticism of that approach levelled by Neil MacCormick, so as to confront the relevance of principle and policy arguments, in order to bring about a different methodological approach, an alternative jurisprudentialist conception of adjudication, incorporating a practical-normative constitutive dialectics between legal controversy and legal system, such as that presented by Castanheira Neves. The focus will, then, be the legitimacy of the connection of arguments of principle and consequentialist arguments in adjudication, its selection and its justification, stating, therefore, a specifically assumed judicium, a judicative decision, having the legal system as its horizon of normative reference and of substantial and institutional autonomy. International criminal law (ICL) has traditionally overlooked sexual and gender-based violence (SGBV) and struggles to understand it. Prosecutions have been largely inefficient and not reflective of gender harms. The Rome Statute requires interpreting SGBV as a social construction (article 7(3)), in consistency with international human rights law (IHRL) and without discrimination (article 21(3)). There is, however, little guidance to implement these approaches. This article argues that intersectionality, an IHRL-based approach that reveals compounded discrimination, is an efficient tool to interpret SGBV (...) and, therefore, should be integrated in ICL. The article traces the origins of intersectionality in feminism and its recognition by IHRL dealing with violence against women. It establishes the applicability of intersectionality in ICL that it demonstrates with a comparative analysis of the Lubanga and Ntaganda cases. The findings show that intersectionality suits ICL’s specific needs which allows labelling and explaining some of those contributions throughout the judicial process. (shrink)

Este artigo apresenta uma prática pedagógica realizada no Estágio Curricular Supervisionado II do Curso de Letras - Português e Espanhol na Universidade Federal da Fronteira Sul (UFFS) campus Cerro Largo. O estágio foi desenvolvido em uma turma de segundo ano de uma escola pública de Ensino Médio, com duração de 16 horas. O plano de aula trabalhou o texto dissertativo-argumentativo através da temática “Regulamentação das Redes Sociais” baseado no método de Sequência Didática (Dolz, Noverraz, Schneuwly, 2004). Essa ferramenta didática consiste (...) em atividades de pré-leitura, leitura e pós-leitura, com duas produções textuais: o texto de sondagem, que visa identificar o conhecimento prévio dos alunos, e a produção textual final, que consiste no desenvolvimento de uma redação em um simulado do Exame Nacional do Ensino Médio (ENEM). Ademais, realizamos uma autoavaliação, em que os alunos puderam refletir criticamente sobre seu processo de ensino e aprendizagem, identificando, através de um questionário, suas dificuldades e evolução ao longo das aulas, não detendo-se somente à avaliação quantitativa feita pelo professor. Dessa forma, a partir dos resultados apresentados na autoavaliação e nas produções textuais, concluímos que os alunos demonstraram um bom aproveitamento do conteúdo trabalhado, desenvolvendo o senso crítico, a argumentação e, consequentemente, a cidadania. Comparing and contrasting nonreligious and religious perspectives on ethics and morals has perhaps attracted the greatest attention of any secular study area. There are indeed negative preconceptions about seculars that express worries about how morality can be preserved without the influence of religion. The research begins with definitions and categories of morality, along with current views on how they came to be and how to evaluate them. Examined are secular attitudes and actions in areas including prosociality, violence, criminal activity, drug (...) usage, sexual orientation, helping, and altruism. Secular morality is showing a trend in many sectors towards prioritizing individuals above group affiliation. General morality among secular people favors moral consequentialism over deontology and reasoning over intuition. Religious ethics explain that society can only be improved if human beings have a pure soul. So, we can say that religious Ethics have a main focus on the improvement of spirituality and the soul of human beings for a peaceful society. So, this is also a point of divergence between secular Morality and Religious Ethics. (shrink)

We adopt the largest consistent set defined by Chwe (1994; J. Econ. Theory 63: 299–325) to predict which coalition structures are possibly stable when players are farsighted. We also introduce a refinement, the largest cautious consistent set, based on the assumption that players are cautious. For games with positive spillovers, many coalition structures may belong to the largest consistent set. Classifications are useful and efficient. We group things into kinds to facilitate the acquisition and transmission of important, often tacit, information about a particular entity qua member of some kind. Whilst it is universally acknowledged that classifications are useful, some scientific classifications (e.g. chemical elements) are held to higher epistemic standards than folk classifications (e.g. bugs). Scientific classifications in terms of ‘natural kinds’ are considered to be more reliable and successful because they are highly projectible and support law-like and inductive (...) generalisations. What counts as a natural kind is, however, controversial: according to essentialists (e.g. Putnam, Kripke, Ellis) natural kinds are mind-independent and possess essential characteristics; according to promiscuous realists (e.g. Dupre ) there are ‘countless legitimate, objectively grounded ways of classifying objects in the world’; and according to scientific realists (e.g. Boyd, Psillos) natural kinds are grounded in the ‘causal structure of the world’. More specifically, realism about kinds can be understood as a commitment to the existence of natural divisions (kinds) in the world that we come to know as a result of mature scientific investigation into the nature of such kinds. Realism about natural kinds is supported and articulated in terms of three main arguments, metaphysical, semantical, and epistemological. In the first part of my thesis I offer a sustained and systematic investigation of these three main arguments, with their respective promises and prospects for the viability of realism about kinds and I find them wanting, whilst in the second part of the thesis I pursue an unexplored line of inquiry regarding natural kinds and propose a mild realism about natural kinds via the ontology of real patterns. El objetivo de este artículo es contribuir a un conocimiento más exhaustivo de la historia socio-económica de al-Andalus en general y del tema de la pobreza involuntaria en particular. La literatura paremiológica andalusí proporciona un caudal de información nada desdeñable en relación con los diferentes aspectos relativos al tema en cuestión, tales como la concepción de la pobreza, sus causas y consecuencias, así como las distintas formas de contrarrestarla por parte de los afectados y del prójimo. El refranero andalusí pone (...) a nuestra disposición una serie de imágenes establecidas con respecto a los pobres y a su estado, permitiéndonos conocer los estímulos que esta realidad social provocaba entre la población. Desde este punto de vista, este tipo de documentación permite apreciar las prácticas sociales existentes en al-Andalus, las cuales dejan traslucir los valores morales y éticos de esta sociedad. We investigated the influence of maternal depression (MD) on the communication and motor dimensions of child neurodevelopment, by a longitudinal and descriptive study. We assessed 1,555 mother-baby dyads from two Brazilian cities with discrepant sociodemographic characteristics: Ribeirão Preto (RP) (N=663) and São Luís (SL) (N=892). MD during pregnancy and at the second year of child´s life was assessed, respectively, through the Center for Epidemiologic Studies Depression Scale-CES-D (≥24) and the Edinburg Postnatal Depression Scale-EPDS (≥12). Child development was assessed through the (...) screening test from the Bayley Scale (BSID-III), when children were 12-24 months old. There was association between MD at the second year of child´s life and impairment on the Receptive Communication dimension of language development, especially when analysis included depression during pregnancy and sociodemographic variables. Such association was found only in the city with worse sociodemographic indicators. Our findings supported the influence of MD in the second year of child´s life on child neurodevelopment, specifically on the Receptive Communication dimension of language development in SL. Moreover, findings suggested a possible role of environmental and socioeconomic variables in such association, drawing attention to prenatal care monitoring and intervention programs for mothers living in unfavorable socioeconomic contexts. University program dropout is a problem that has important consequences not only for the student that leaves but also for the institution in which the withdrawal occurs. Therefore, higher education institutions must study the problem in greater depth to establish appropriate prevention measures in the future. However, most research papers currently focus primarily on the characteristics of students who leave university, rather than on those who choose to pursue alternative courses of study and therefore fail to take into account the (...) different kinds of abandonment. The aim of this paper is to identify the different types of dropout to define their characteristics and propose some recommendations. Thus, an ex post facto study was carried out on a sample of 1,311 freshmen from a university in the north of Spain using data gathered using an ad-hoc designed questionnaire, applied by telephone or an online survey, and completed with data available in the university data warehouse. A descriptive analysis was performed to characterize the sample and identify five different groups, including 1. Students persisting in their initiated degree 2. Students who change of program (within the same university) 3. Students transferring to a different university 4. Students enrolling in non-higher-education studies 5. Students that quit studying. Also, data mining techniques (decision trees) were applied to classify the cases and generate predictive models to aid in the design of differentiated intervention strategies for each of the corresponding groups. In the prooemium of the Cento Vergilianus de Laudibus Christi of Faltonia Betitia Proba (lines 1–23) there are fragments not only of Vergil’s works but also of Lucan’s Bellum Civile and Juvencus’ Evangeliorum Libri. This article shows that in these lines Juvencus has a particular importance, for the references to his work increase until they reach a remarkable intensity in lines 22–23 and they stand out on different levels both formally and semantically. This thesis is supported by re-examining the origin (...) of a reference in line 22 of the Cento (erige mentem) that is usually ascribed to Lucan. The attribution to Juvencus can be established through the phenomenon of acoustic imitation. (shrink)

United States service members’ personal mental health information lacks the protection afforded by Health Insurance Portability and Accountability Act (HIPAA), diverging from the legal safeguards granted to other citizens. The Public Welfare Law and the Department of Defense (DoD) reduces these protections through clauses, outlining nine conditions where service members’ information can be disclosed to their commanders, who may lack formal HIPAA or medical confidentiality training. Once a commander is notified, the information may be shared with others without the Service (...) Members consent, creating an unregulated spread of private health information. Additionally, the military environment, marked by a stigma surrounding mental health issues, compounds this vulnerability. Therefore, Service Members seeking mental health support may encounter adverse consequences upon returning to their command through the propagation of stigma, which may further foster a culture of reluctance to seek help. A fictional character within the military serves as a conduit for nonmilitary providers to understand the contextual intricacies while highlighting the ethical dilemma faced by providers adhering to Congressional law, American Psychological Association (APA) Ethics Code, and DoD standards while also serving their clients. Key ethical considerations include informed consent, disclosures, maintaining confidentiality, discussing the limits of confidentiality, avoiding harm, and conflicts between ethics and organizational demands.
