ABSTRACT In Mexico informed consent is a legal requirement that ensures that patients who are invited to participate in clinical trials are provided with all the information needed to decide whether to participate, or not, in a research protocol. To improve our understanding of the problems physicians in developing countries encounter, when obtaining informed consent (IC), we examined their opinion on the importance of IC in clinical research, the quantity and quality of the information provided to the participant, and the (...) conditions in which the IC is obtained. Investigators considered that IC was useful to the patients, providing information that helped the patient to make a decision about his/her participation. Nevertheless, they felt that for some aspects of the research, like drug development in general, the use of placebos, and the randomization process, many of the patients were not capable of fully understanding the information provided, referring to the complexity of the information and illiteracy as the main reasons. Many investigators were not acquainted with some of the guidelines established in the Mexican General Law of Health,1 36% of them admitting to not having completed their IC letters. Most investigators gave only minutes to the patient to make a decision and 20% of ICs were obtained while the patient was hospitalized. Except for one investigator, all of them considered that specific training in medical ethics would be useful for the daily clinical work. (shrink)

The contemporary confluence of globalization and ethical pluralism is at the origin of many ethical challenges that confront business nowadays, both in practice and in theory. One of the challenges arising from the development of globalization has to do with respect for cultural diversity. It is often said that the success of economic globalization tends towards social and cultural homogeneity. To the extent that cultural diversity is usually seen as a valuable reality, that global trend seems to contradict our efforts (...) to respect ethical pluralism, both personal and cultural, within society. In this paper I argue that (a) ethical minimalism, despite its emphasis on tolerance and justice, does not take pluralism seriously into account in present-day society, and (b) ethical minimalism is not suited to balancing the homogenizing trend of globalization. Certainly ethical norms are necessary, but by no means are they sufficient in themselves to encourage either justice or tolerance; nor are they sufficient to inspire and encourage good practices and sound regulations. Instead, virtue-based ethics has the capacity of inspiring and encouraging good practices. Particularly, virtue-based ethics is able to inspire a serious dialogue about ethical and legal issues both in the public arena and within organizations. (shrink)

The purpose of this paper is to view Kant's approach to education in the broader context of Kant's philosophy of culture and history as a process whose direction should be reflectively assumed by human freedom, in the light of man's moral vocation. In this context, some characteristic tensions of his enlightened approach to education appear. Thus, while Kant takes the educational process to be a radically moral enterprise all the way through—and hence, placed in a relational context—he also aspires to (...) constitute education as a science, to be improved through experiments, thereby paving the way for a systemic approach to education; in spite of its moral inspiration, his systemic approach not only could enter into conflict with the moral demand of taking each individual subject as an end, but is also marked by an intrinsic paradox, already involved in the ambiguity of the term ‘humanity’, which might mean a) humanity as a moral disposition present in each individual human being or b) humanity as a whole, as the ‘human species’. Since the cessation of Mapuche guerrilla warfare against Chileans in 1881, machis who are predominantly women, have progressively incorporated aspects of traditional warring into their shamanic healing and performance of collective nguiUatun rituals. Guns, knives, war cries, and male pre‐war bonding acts are used by machis to "kill" or "defeat" illness, evil, and the effects of acculturation on their patients and the community. Acculturation is often seen by the Chilean Mapuche as the root of illness, evil, and alienation. All three (...) are conceived as enemies that threaten the Mapuche self from the outside and are detrimental to the physical and spiritual well‐being of the individual or group. While ritual played an important role in gaining supernatural help to strengthen warriors in the past, the warring complex in ritual, and healing in particular, is crucial in reinforcing contemporary Mapuche identity, traditions, and wholeness. I analyze the performance of spiritual warfare in healing and collective ritual as the Mapuche way of aggressively advocating the opposition between self, tradition, and life on one hand, and otherness, acculturation, and death, on the other. Following the 15th anniversary of the European Society for the History of Science (ESHS), one can definitely say that this relatively young society has come of age. Through regular meetings, a journal, a prize, fellowships and various other activities, the ESHS has been striving to create a space fostering diversity, plurality and internationalization among historians of science, located in Europe and elsewhere. This paper revisits my own research on the past of the sciences in Portugal, examining in particular the role (...) of the 18th century naturalist and diplomat Abbé Correia da Serra. As a member of an extended network of estrangeirados (Europeanized intellectuals), Correia da Serra played a decisive role in the circulation of knowledge in Europe and also in the world, a role forgotten by his peers within the time interval of a generation. This case study acts as a springboard to discuss the importance of geographical and methodological diversity in the past of the sciences in Europe. In the present historiographical predicament in which the international community finds itself, I advocate that one of the main challenges faced by the ESHS is to turn its historical gaze to Europe again, while fiercely repudiating Eurocentrism. This enables to show how much the building of the European spaces of scientific practice were never a prerogative of a few regions or a small set of countries, but, on the very contrary, took shape as the result of complex interactions between diverse spaces and cultures, not only intra-European but also non-European. U ovom članku raspravljamo o hipotezi proširenog jastva Andyja Clarka i Davida Chalmersa, a osobito o prigovoru prema kojemu proširenom jastvu nedostaje stabilnost i kontinuitet koji su potrebni da bismo ga smatrali identičnim kroz vrijeme. Pokušavamo pokazati da je taj prigovor neodrživ. Raspravljamo i o gledištu prema kojemu se drugi tip jastva, to jest narativno jastvo, također može shvatiti kao prošireno, i tvrdimo da stabilnost i kontinuitet toga tipa jastva također nisu ugroženi ako ga proširimo izvan granica čovjekova tijela. Stoga, (...) barem što se tiče tih tipova jastva, kada razmišljamo o problemima osobnog identiteta, nije potrebno ograničiti se na internalizirano jastvo. (shrink)

Pretendemos analisar a crítica ao direito marxiana exposta nos comentários à obra Lectures on the early history of institutions, do jurista inglês Henry Sumner Maine, presentes nos "assim chamados" Cadernos Etnológicos. Para tal, passaremos pela crítica de Karl Marx à teoria do direito de Maine, passando também por considerações sobre os juristas analíticos John Austin e Jeremy Bentham, nos quais o autor das Lectures se baseia fortemente. Em seguida, trataremos das críticas à concepção de Maine sobre a origem do Estado (...) e do direito. Então, explicaremos como Marx se contrapõe a Maine voltando-se para o solo da história real, e assim analisa a gênese e o desenvolvimento direito na Irlanda e sua associação com a religião cristã, tanto antes quanto durante a colonização inglesa, observando também a violência por trás da imposição das leis coloniais. For too long, criminal law scholars overlooked immigration-based offences. Claims that these offences are not ‘true crimes’ or are a ‘mere camouflage’ to pursue non-criminal law aims deflect attention from questions concerning the limits of criminalization and leave unchallenged contradictions at the heart of criminal law theory. My purpose in this paper is to examine these offences through some of the basic tenets of criminal law. I argue that the predominant forms of liability for the most often used immigration offences (...) are, at least in principle, controversial and depart from what is often presented as the paradigm in criminal law. Above all, immigration offences are objectionable because they fall short in fulfilling the harm principle and, given that criminal punishment as used against immigration offenders is often a secondary, ancillary sanction to deportation, they license excessive imposition of pain. Este trabalho tem como principal foco de análise o currículo oficial português relacionado com a componente de História, para o Ensino Básico, em particular as ausências que aí mais sobressaem. Estas podem relacionar-se com os conhecimentos substantivos que se apartam da abordagem preconizada por variadas razões (passados incómodos? temas difíceis? grupos não poderosos? …) ou com as competências de pensamento histórico (multiperspetiva, significância, causalidade, empatia, …) que parecem ter sido esquecidas quando se estruturou certo percurso de aprendizagem para estudantes com (...) idades entre os 6 e os 15 anos. Como considerações maiores, constata-se, naqueles textos curriculares (denominado Aprendizagens Essenciais), uma aparente simplificação genérica da narrativa histórica que se conta aos mais jovens cidadãos do mundo atual. A inevitável seleção de determinados saberes em detrimento de outros, na verdade, contribui, acima de tudo, para o escamotear de uma literacia histórica que podia, e devia, alcançar outros níveis. O processo de ensino (e de aprendizagem) da História, desde o começo da escolaridade obrigatória, tem de orientar-se no sentido de uma formação cidadã, esclarecida, democrática, intertemporal. As inexistências no que concerne aos conteúdos considerados ou ao raciocínio potenciado, por sua vez, somente comprometem aquele desígnio. (shrink)

La relación entre ética y docencia ha sido ampliamente explorada desde mediados del siglo XX, en diversos países, a través del desarrollo de estudios teóricos y empíricos. Estas investigaciones suelen remitirse a cuestiones inherentes a la conversación entre los campos de la filosofía y de la educación y también a la ética de profesiones arquetípicas como la abogacía o la medicina. En particular, muchos de esos trabajos han brindado extensa atención a los fundamentos e implicancias éticos de la acción docente (...) en las escuelas, en especial al desarrollo del juicio profesional docente como recurso valioso para decidir ante situaciones escolares controvertidas. En este artículo retomo esos antecedentes y propongo un enfoque teórico-conceptual para estudiar la manera en que los docentes de nivel primario perciben y abordan dilemas éticos escolares. Construyo una perspectiva ecléctica que combina aportes de la filosofía y de los campos sociológico, antropológico y educativo y que permite estudiar los procesos de percepción ética, deliberación moral y juicio profesional de esos docentes en el abordaje de sus dilemas éticos como indicios de las soslayadas dimensiones éticas de sus acciones. Resumen El artículo sitúa su reflexión en el tema del ecumenismo, relacionándolo con las propuestas de aggiornamento expresadas por el Vaticano II. Hace también alusión al ámbito de las mudanzas en el seno del protestantismo, de las Iglesias ortodoxas e incluso del cristianismo romano. Además alude a los grandes nombres que trazaron la reflexión teológica en el período de crisis que antecedió al evento –hablamos de aspectos que acabaron incidiendo en los debates conciliares. Siguiendo a Gutiérrez, el artículo destaca tres (...) dimensiones relativas a la búsqueda del diálogo de la Iglesia con el mundo contemporáneo: la urgencia de ser actual, la perspectiva ecuménica y la solidaridad con los pobres. Analiza los “caminos equivocados” que fueron adoptados por la Iglesia en lo concerniente a las propuestas ecumênicas del Concilio: el tomar un “execesivo cuidado” en lo que respecta al mundo moderno, las posiciones de intolerância frente a lo diferente, la comprensión reduccionista del ecumenismo. Hace mención a la exigência de construir relaciones que tengan como bases: la gracia y el amor. Diálogo inter-religioso.This article focuses its discussion on the theme of ecumenism, in relation to the catholic proposal of aggiornamento expressed by Vatican II. The text refers to the changes within the Protestantism, the Orthodox churches and also within the Roman Christianity. It also mentions the relevant names that marked theological reflection in those times of crisis prior to the Council. Following the author´s thought, the text highlights three dimensions of the dialogue of the Church with the contemporary world: the urgency in getting things update, the ecumenical perspective and the solidarity with the poor. The article evaluates the "wrong path" taken by the Church in relation to the propositions of the ecumenical council: attitudes of intolerance to the different and the reductionist understanding of ecumenism. It also refers to the need to build relationships whose bases are the grace and love. The term etonism is from «Etona» that means flag, marks, evidence, and reason in Kikôngo. The variants in Umbûndu: etonolo or etonuilo means, allegations, reasons, indulgence (tolerance). The Nyaneka form is etŏnya: 1) reasons, 2) allegations, 3) indulgence and 5) the justice and the tolerance. Etona is Angolan artist (sculptor/painter). In his sculpture they are morphologically evidenced three treatments in the surface of the matter, namely 1) flat treatment; 2) rude treatment and finally 3) accidental treatment. Each one is a (...) code: #1. The flat treatment indicates well-knowledge; a man of superior class; race or tribe or religion of majority; thought well-organized and structured. In painting, the hot intensity indicates dominance, prosperity, energy, intense desires; #2. The rude treatment reveals an acquired knowledge without academism, self-taught; medium class men; speech out of the scientific perimeters but with certain admissibility; race, tribe or religion of lot of people, but not of majority. In his painting, the neutral intensity marks the balance and inspires recomfort nurtured from two opposed poles (hot and cold); #3. The accidental part of the sculpture indicates some knowledge’s lack (pure empiricism); inferior class; race, tribe, religion of minority. In the painting, the cold intensity is naturally contrary of #1. Etonism is the tolerant reason between #1=I, #2=YOU and #3=HE. All of them form the coherent society that we call WE: the Etonian jusphilosophy that African peoples need for stability of their democracies and finishing their War. (shrink)

Em Imagem-tempo Deleuze quando do quarto comentário a Bergson fala em cinema do tempo remetendo a Orson Welles e ao filme Cidadão Kane. O cinema do tempo é apresentado a partir de três caracteres de um tempo não cronológico. Deleuze aponta para uma condição do cinema do tempo ao propor a substituição de uma vista pragmática longitudinal por uma visão ótica, vertical, em profundidade. A profundidade de campo é trabalhada enquanto um elemento conceitual no trato de uma metafísica da memória (...) em diálogo com as bases do cinema moderno, nesse sentido, os três caracteres de um tempo não cronológico e a inserção de uma nova relação entre tempo e espaço no cinema são constituintes de uma imagem tempo direta cujo problema filosófico perpassa a inserção do movimento no pensamento. O encontro do quarto comentário em Imagem-tempo com o primeiro comentário a Bergson em Imagem-movimento é o percurso para compreender a importância da profundidade de campo. Assim o cinema do tempo de Welles é entendido como o cinema de uma metafísica da memória a partir de duas fontes: o esforço atual de evocação para suscitar a imagem-lembrança e a exploração das zonas virtuais de passado para encontrar a imagem-lembrança. El enfoque socioeducativo de la educación, tal y como aquí lo hemos entendido, trata de agrupar y promover aquellas experiencias educativas que tienen como objetivo fortalecer la democracia y la ciudadanía participativa a través de una educación integral guiada por valores como la solidaridad, la igualdad y la justicia.

This introductory chapter examines some of the interpretations of the concept of medical neutrality that it has received from a variety of authors. It distinguishes three frequently used approaches (or interpretations) of “medical neutrality”. The first is neutrality as part of humanitarian principles to be applied in humanitarian action in general, while the second is linked to the exclusivity of the medical mission, ensuring the protected status of medical personnel and objects as non-combatants. The last approach is related to medical (...) ethics and respect for human rights as obligations that medical personnel should fulfill. In the case of historical studies of science in Spain and Latin America, research has primarily been carried out under the umbrella of “centers and peripheries,” indicating that despite their historiographical and epistemological importance, narratives on science within certain national contexts have analytical limitations. Corporeality is a subject strongly present in educational discussion nowadays. The purpose of this paper is to present an outline of issues we may address from the philosophy of sport that could foster a fruitful dialogue with the philosophy of education. It is understood that the philosophy of education can benefit from reflections on corporeality and human movement, namely from sports and games. Initially, the article introduces the philosophy of sport as a field of study that addresses reflections on human (...) movement from sports and games. They highlight elements that are not specific to such practices and foster reflexions on different areas. Afterwards, it explores the experience of corporeality and the dialogical dimension of human movement based on Merleau-Ponty's phenomenology. Human movement indicates a unique way of being communicative. Finally, it presents some reflections on playing games as an experience that helps us think about our relationships with others and the environment. From this perspective it is possible to seek some critical features to understand education in the experience of human movement, namely from playing games, such as experience, dialogue, and expressiveness. Thoughts on human movements may reinforce the role corporeality plays in education as a collective experience and the recognition of the body's expressive potential in constructing knowledge. RESUMOO artigo discute o papel da música no trabalho, considerando a atividade musical como uma prática discursiva intersemiótica. Para ser capaz de examinar o tema tanto do ponto de vista da música quanto do trabalho, colocados juntos pelo discurso, a abordagem utilizada é interdisciplinar, composta por análise do discurso, etnomusicologia e ergologia. Primeiramente as fronteiras do conceito tradicional de cantos de trabalho são expandidas através da análise de dois exemplos pouco convencionais: uma peça publicitária e uma embalagem de produto. A (...) partir desse viés expandido, o artigo explora cantos de duas comunidades brasileiras, da Bahia e do Maranhão, que cantam enquanto trabalham em atividades agrícolas e extrativistas. A conclusão ressalta que a relação entre música e trabalho ultrapassa em muito a abordagem estreita dos cantos de trabalho. Para compreendê-la, é preciso levar em conta as renormalizações postas em jogo e as comunidades discursivas implicadas por estas práticas discursivas complexas.ABSTRACTThis article discusses the role of music in work activities by considering music an intersemiotic discursive practice. It uses an interdisciplinary approach composed of discourse analysis, ethonomusicology and ergology in order to be able to examine the topic including music and work factors, put together by discourse. Firstly, the boundaries of traditional work songs are expanded through two unconventional examples: one in an advertisement, and the other one in a product packaging. Then through that expanded framework, it explores examples of two Brazilian communities, one from Bahia and the other one from Maranhão that sing while they work in extractivist and agricultural activities. The conclusion points out that the relationship between music and work far surpasses the traditional framing of work songs. To better understand the role of music in the discourse of work activities, scholars need to take into account the renormalization which is brought into play and the discursive communities concerned by those complex discursive practices. El metaverso, como nuevo espacio prometido de interacción social, no configura en sí mismo la posibilidad del encuentro, porque no es el espacio lo que propicia el “entre” sino la disposición de las personas. Por ello en este artículo se dirige la mirada al interior del ser humano y se centra en la reflexión ética del ser en el estar; precisamente, porque toda herramienta configura un nuevo ethos con el sujeto. En primer lugar, tras problematizar la pregunta por el metaverso, (...) se desarrolla el concepto de relación social, para pasar, en segundo lugar, al espacio como configurador de la utopía y a la pregunta de cómo el ser humano se construye en lo que él mismo crea. De esta manera, se llega al último punto, en el que se plantea que la promesa del metaverso no guarda en sí misma la posibilidad de ser mejores personas, sino que, en cuanto herramienta, depende exclusivamente del uso que se le dé. Refugee protection depends, minimally, on the identification of agents capable of discharging international obligations in this area of international law. Commonly discussed “agents of justice” include states, IOs, and NGOs. This article focuses on a different set of actors: subnational units (cities, states, and provinces in federal States) and the legal mechanisms they may use to discharge international obligations in the area of refugee protection. I advance three distinct theoretical models for understanding subnational units’ responsibilities vis-à-vis international law: (1) derived (...) delegated responsibilities; (2) derived back-up responsibilities; and (3) assumed responsibilities. I conclude by sketching some ways in which subnational units could play an even more salient role in the promotion of international law. (shrink)

Populism’s Challenges to Political Reason can be seen as a consequence of social and cultural trends, the so called ‘emotional culture’, that have been accentuated in recent decades. By considering those trends, this article aims at shedding light on some distinctive marks of contemporary populism in order to argue for a reconfiguration of the public sphere that, without ignoring emotion, recovers argumentation and persuasion based on facts and reason.

Kako bismo utvrdili značajke učinkovitog stručnog usavršavanja učitelja prirodoslovne grupe predmeta, na temelju sustavnog pregleda literature izabrali smo i proveli analizu devet učinkovitih eksperimentalnih i kvazi eksperimentalnih istraživanja. Utvrdili smo kako bi stručno usavršavanje bilo dobro započeti inicijalnim radionicama koje je potrebno nastaviti kroz susrete zajednica učenja za vrijeme ostvarivanja promjena. Uz to je važno osigurati potporu i vođenje učitelja te nastavne materijale za učitelje i učenike. Stručno usavršavanje može biti učinkovito samo ako doprinese boljim učeničkim rezultatima, a to je (...) moguće postići promjenama u nastavi koja bi trebala polaziti od jasno postavljenih ciljeva u skladu s kojima učitelji pripremaju nastavne aktivnosti koje učenike potiču na istraživanje, rješavanje životnih problema, aktivno i suradničko učenje te znanstveno i metakognitivno mišljenje. In order to affirm the characteristics of efficient professional training of teachers in the natural sciences, on the basis of a systematic overview of the literature, we chose and implemented an analysis of nine efficient experimental and quasi-experimental research designs. We affirmed that professional training should begin with initial workshops, which should continue through meetings of learning cummunities during these changes. Additionally, it is important to ensure support and guidance for teachers, as well as teaching materials for teachers and students. Professional training can be considered efficient only if it contributes to improved academic performance; this can be attained through changes in teaching, which should be founded on clearly established goals in accordance with which teachers may prepare teaching activities that inspire students to research, solve everyday problems, take part in active and cooperative learning, and think scientifically and metacognitively. This article aims to show that the practice of attention can create an openness to the truth, from where ethics arises. It does so by exploring the role attention plays, according to Ricoeur, in Freud’s thought. Ricoeur shows how in the first stage of Freud’s thinking – that of the Project of a Scientific Psychology – attention is one of the instances in which a purely mechanical quantitative explanation can be questioned. Further on, with the introduction of narcissism, Ricœur shows (...) that attention, insofar as it opens a space for the “wounding truth,” opposes narcissism. Finally, the article explains how in the therapeutic setting an attentional epochē allows the therapist to be “the reality principle in flesh and in act,” so that the ego can gain control. According to Ricœur, this non-judgmental gaze opens a space of truthfulness for the patient’s self-knowledge which, although not being the totality of ethics, constitutes its threshold. (shrink)

Potential applications of genome editing in assisted reproductive technology (ART) raise a vast array of strong opinions, emotional reactions and divergent perceptions. Acknowledging the need for caution and respecting such reactions, we observe that at least some are based on either a misunderstanding of the science or misconceptions about the content and flexibility of the existing legal frameworks. Combining medical, legal and ethical expertise, we present and discuss regulatory responses at the national, European and international levels. The discussion has an (...) EU starting point and is meant as a contribution to the general international regulatory debate. Overall, this paper concludes that gene editing technologies should not be regulated autonomously. Rather, potential uses should be regulated under general, existing frameworks and where applicable by reference to sufficiently equivalent technologies and techniques already subject to specific regulation. To be clear, we do not argue for the hasty introduction of gene editing as a reproductive treatment option in the immediate future. We call for caution with regard to overreaching moratoria and prohibitions that will also affect basic research. We recommend flexible regulations that allow for further responsible research into the potential development of the technology. We call for an open and inclusive debate and argue that scientific communication should claim a more prominent role to counter the danger of widespread misinformation. A high level of transparency and accuracy should guide scientific communication while simultaneously global‐scale responsibility and governance should be fostered by promoting cross‐disciplinary thinking and multi‐level stakeholder involvement in legal and regulatory processes. Es un estudio de carácter descriptivo, realizado de acuerdo con el formato estándar del descriptivismo norteamericano. Los datos fueron entregados por seis adultos hablantes de las localidades rurales de Pangue y Sara de Lebu. Los instrumentos utilizados fueron dos listas léxicas ad hoc. Luego de presentar el inventario de fonemas y alófonos, este artículo se focaliza en los segmentos de estatus controversial (...) [t̟]/[n̟]/[l̟], [ʃ]/[tʃ], [ɣ], [v]/[f] y [ð]/[θ]. Los principales resultados obtenidos incluyen la ausencia de estatus fonémico de [n̟] y [l̟]; el estatus fonémico de [t̟], [ʃ] y [ɣ]; la tendencia a realizar con sonoridad los segmentos fricativos labiodental e interdental ; y la ocurrencia de algunos segmentos que podrían ser atribuidos de manera plausible a la influencia de la fonología segmental del español.
