This article deals with the relationship between argumentation and persuasion. It defends the idea that these two concepts are not as opposed as all too often said. If it is important to recognize their differences (there are argumentative discourses without persuasion and persuasive discourses without argumentation), there is nevertheless an overlap, in which characteristics are taken from both. We propose to call this overlap “persuasive argumentation”. In order to bridge argumentation and persuasion, we will first distinguish the latter from manipulation. (...) As one tries to grasp love and its images within José Leonilson's production, a multiplicity of aspects and meanings are seen that also relate to Louise Bourgeois's oeuvre in regard to the interest in human relations. Through a comparative approach to both artists' poetics, an understanding is created that love is not a simplistic action and all the words read in or applied to their visual discourse must be considered within a wide range of love in visual and literary images. Pretendemos analisar a crítica ao direito marxiana exposta nos comentários à obra Lectures on the early history of institutions, do jurista inglês Henry Sumner Maine, presentes nos "assim chamados" Cadernos Etnológicos. Para tal, passaremos pela crítica de Karl Marx à teoria do direito de Maine, passando também por considerações sobre os juristas analíticos John Austin e Jeremy Bentham, nos quais o autor das Lectures se baseia fortemente. Em seguida, trataremos das críticas à concepção de Maine sobre a origem do Estado (...) e do direito. Então, explicaremos como Marx se contrapõe a Maine voltando-se para o solo da história real, e assim analisa a gênese e o desenvolvimento direito na Irlanda e sua associação com a religião cristã, tanto antes quanto durante a colonização inglesa, observando também a violência por trás da imposição das leis coloniais. The purpose of this paper is to view Kant's approach to education in the broader context of Kant's philosophy of culture and history as a process whose direction should be reflectively assumed by human freedom, in the light of man's moral vocation. In this context, some characteristic tensions of his enlightened approach to education appear. Thus, while Kant takes the educational process to be a radically moral enterprise all the way through—and hence, placed in a relational context—he also aspires to (...) constitute education as a science, to be improved through experiments, thereby paving the way for a systemic approach to education; in spite of its moral inspiration, his systemic approach not only could enter into conflict with the moral demand of taking each individual subject as an end, but is also marked by an intrinsic paradox, already involved in the ambiguity of the term ‘humanity’, which might mean a) humanity as a moral disposition present in each individual human being or b) humanity as a whole, as the ‘human species’. In 1877 Louis Paul Cailletet in France and Raoul Pictet in Switzerland liquefied oxygen in the form of a mist. The liquefaction of the first of the so-called permanent gases heralded the birth of low-temperature research and is often described in the literature as having started a ‘race’ for attaining progressively lower temperatures. In fact, between 1877 and 1908, when helium, the last of the permanent gases, was liquefied, there were many priority disputes—something quite characteristic of the emergence of a (...) new research field. This paper examines Cailletet’s path to the liquefaction of oxygen, as well as a debate between him and the Polish physicist Zygmunt Wróblewski over the latter’s contribution to the liquefaction of gases. Este trabalho, tangenciando principalmente uma atmosfera nietzscheana, como já sugere o título, quer deslocar a questão da utilidade da filosofia - o "para que serve?" - para uma questão que procura pela força da filosofia - "a quem aflige?".

Las primeras teorías sociológicas son deudoras de las filosofías ilustradas de la historia, las cuales aparecieron para proporcionar un marco de sentido a la acción moral, una vez que la teoría moral renunció a los compromisos metafísicos de la filosofía moral premoderna. Al tiempo que defendió la autonomía de la sociología frente a la filosofía, Durkheim le prescribió a aquélla una tarea específica: realizar una ciencia moral que atendiendo a dos rasgos con los que los hechos morales se muestra a (...) la conciencia —solidaridad y coerción— pueda dar cuenta del sentido moral de la división del trabajo, hasta entonces considerado un proceso casi natural. El propósito de este artículo es mostrar cómo el enfoque durkheimiano permite descubrir una semejanza estructural entre el análisis sociológico y la tradicional perspectiva filosófico-moral de las obligaciones mutuas. Plans to attempt what has been called a head transplant, a body transplant, and a head-to-body transplant in human beings raise numerous ethical, social, and legal questions, including the circumstances, if any, under which it would be ethically permissible to attempt whole-body transplantation (WBT) in human beings, the possible effect of WBT on family relationships, and how families should shape WBT decisions. Our assessment of many of these questions depends partially on how we respond to sometimes centuries-old philosophical thought experiments (...) about personal identity. As with so much in bioethics, it is impossible to escape, or at least inadvisable to try to bypass, the relevant foundational philosophical concerns. (shrink)

In this article, I explore the way in which Korsgaard’s approach to obligation as springing from the reflective rejection of that which threatens one’s own identity can account for obligations towards others, without making the latter relative to obligations to oneself. To this end, I begin by stressing the role of reflexivity in ethical relationships, and show how this reflexivity is mediated by reference to law, which applies both to the self and to the other. On this basis, I then (...) argue that Korsgaard’s account of the interplay between practical and moral identity reflects the very structure of practical reason, which requires both a particular and a universal premise in order to issue practical reasons for action– and the corresponding obligations. Within this framework, I argue that Korsgaard’s solution to the problem outlined above lies in having stressed the shareable character of reasons such that it is neither your reason nor my reason that obligates me, but rather reason as such. This solution, however, requires a further argument aimed at clarifying what makes your reasons different from my own. (shrink)

ResumenLa descortesía de Donald Trump ha causado preocupación en su país y en casi todo el planeta por los efectos geopolíticos que su discurso racista, xenofóbico y misógino podría tener en la política mundial (Wodak y Krzyżanowski, 2017). En América Latina, México ha sido blanco de su discurso ofensivo y esto ha generado respuestas de diferentes sectores de la sociedad. En este trabajo, nos concentramos en la respuesta que el diario La Jornada ha dado a los insultos y amenazas contra (...) los migrantes mexicanos y de otras nacionalidades desde su campaña electoral para presidente cuando amenazó con construir un muro entre Estados Unidos y México. Planteamos que aquí la descortesía es una práctica política de (auto)legitimación ideológica que amerita un estudio más allá de la construcción de la imagen social de los interlocutores individualmente porque, en este caso, se trata de una descortesía con implicaciones sociales, económicas y políticas para el diálogo internacional. Desde una perspectiva lingüística, interaccional y crítica (Bolívar, 2018, 2019) analizamos la situación, analizamos la situación entre México y EUA a través de los editoriales de La Jornada, concebidos como un espacio para el diálogo mediado por la prensa. Analizamos un corpus de editoriales que comprende de 2016 a 2020. El estudio revela cómo funciona la descortesía en la práctica política de Trump y la forma en que La Jornada responde en su rol de actor social. (shrink)

BackgroundFor a long time, in sports, researchers have tried to understand an expert by comparing them with novices, raising the doubts if the visual search characteristics distinguish experts from novices. Therefore, the aim of the present study was to review and conduct a meta-analysis to evaluate the differences in visual search behavior between experts and novices in team sports athletes.MethodsThis systematic review with meta-analysis followed the PRISMA 2020 and Cochrane's guidelines. Healthy team athletes were included, which engaged in regular practice, (...) from any sex or competitive level, specifically classified a priori as expert or novice in the original research. We considered only research published in peer-reviewed journals, with no limitations regarding date or language. It was considered healthy team sport athletes engaged in regular practice. The scenarios could be in situ or film-based. The databases of EBSCO, PubMed, Scopus, SPORTDiscus, and Web of Science were used to perform the searches. The risk of bias was calculated through the RoBANS tool.ResultsFrom a total of 6,257 records, of which 985 were duplicates, titles and abstracts of 5,272 were screened, and 45 required full-text analysis. Of those, 23 were excluded due to not fulfilling the eligibility criteria regarding participants. In the end, 22 studies were selected, however, as two studies were part of the same trial and were analyzed conjointly.DiscussionExperts showed to be older and with more years of practice. The ability to distinguish experts from novices was not so clear regarding the variables analyzed. This could be due to the strategies chosen in each study, which were specific to each scenario, and when grouping all together, it was lost information within non-representative averages. The distinction between experts and novices was not clear, showing a lot of heterogeneity in the included studies. The expert classification itself may have been the conditioning aspect for these results, retaining the doubt and the need for more studies in the field.Systematic review registrationThe protocol was pre-registered in OSF. In online communication, writers incorporate into fictional representation imaginaries that arise from the interaction between various artistic manifestations. This paper explores the work of two spanish authors, Patricia Esteban Erlés and Albert Soloviev in order to study the social impact and ethical aspects of hypermedial short stories in the virtual space, since their works function as vehicles for social criticism. At the same time, the paper addresses fundamental questions associated with the understanding and interpretation of hybrid narrative microtexts.

The subject of this paper is the debate between externalism and internalism about mental content presented by Tim Crane in Chapter 4 of his book Elements of Mind. Crane’s sympathies in this debate are with internalism. The paper attempts to show that Crane’s argumentation is not refuting the Twin Earth argument and externalism, and that in its basis it does not differ much from externalism itself Crane’s version of the argument for externalism features two key premises: (1) The content of (...) a thought determines what the thought is about/what it refers to (the Content Determines Reference Principle); and (2) Twins are referring to different things when they use the word “water”. From these, in a few simple steps, Crane’s externalist infers: Therefore, their thoughts are not “in their heads”. Crane suggests denying the Content Determines Reference Principle in the light of indexical thoughts. In the first stage, Crane reduces “content” to “some aspect of content”, although he needs all aspects of content to secure identity of thoughts. However, his view then comes close to something acceptable to externalists. In the second stage, Crane makes content relative to context, but then reference still determines content. (shrink)

La figura de Medea, mujer y extranjera, es el hilo conductor que trata de ofrecer un análisis sobre la pasión de la ira desde la tradición clásica, que la rechaza como pasión destructiva, hasta la apropiación realizada por el feminismo negro norteamericano de Lorde. Ambas iras tendrán algo en común: Audre Lorde hablará de la rabia por la misoginia, homofobia y racismo sufrido y en Medea habrá ira por la misoginia y xenofobia de la época. Para ello en primer lugar (...) el artículo analiza el vocabulario relacionado con la cólera y la ira tanto en griego y en latín. A partir de ahí desarrollan dos hilos. En el primero se ofrece la lectura tradicional del mito de la Medea infanticida que es la que se encuentra en la tragedia de Séneca y que se relacionada con su tratado filosófico _Sobre la ira_. De ese modo se convierte a Medea en _exemplum e contrario_ y contraimagen del sabio estoico. En el segundo se recupera la otra tradición del mito según la cual Medea no fue la que mató a sus hijos sino los corintios. Este segundo hilo del enfoque clásico de la ira para mostrar su validez como herramienta de cambio. (shrink)

A patent is a property granted to any new shape, configuration or arrangement of elements, of any device, tool, instrument, mechanism or other object or part thereof, that allows for a better or different operation, use or manufacture of the object that incorporates it or that provides it with some utility, advantage or technical effect that it did not have before. As a document, a patent really is a title that recognizes the right to exploit the patented invention exclusively, preventing (...) others from making, selling or using it without the consent of the owner. The fact of making a patent is motivated by the fact of promoting creativity, hindering competition in the market as only one person holds the patent, thus protecting the initial investment and fighting against plagiarism. Patents are available to the public for dissemination and general knowledge. It is generally recognized in the specialized literature that patents can be used as an indicator to calculate the results generated by research and development activities, being a very useful indicator to measure various social, economic or technological aspects. For this reason, it is of relevant interest to have tools or systems that allow us to obtain the patents developed in a specific period of time and to carry out analyses of various economic and social factors. These analyses can serve to obtain a social perspective of society’s progress in the technological field, and this is why an analysis of patents is of our interest. This paper proposes a platform specifically designed to obtain knowledge about patents as an indicator of Spanish social, economic or technological aspects. For this purpose, the platform retrieves, analyses and visualizes functionalities that represent data on the landscape of patents obtained from the Spanish Patent and Trademark Office as a particular case of study. El discurso primordialista sobre el origen de las identidades sociales etno-nacionales sigue latiendo en algunos enfoques históricos, antropológicos, políticos y jurídicos de las sociedades modernas, camuflado en otras formas iusnaturalistas y biologicistas de concebir los atributos culturales, étnicos, religiosos, conductuales, e incluso económicos de los pueblos. Este artículo pretende presentar, por el contrario, la construcción de las identidades nacionales desde el punto de vista modernista y analizar su papel como discurso que pretende reforzar estructuras de poder, producidas porque tienen utilidad (...) estratégica para el logro de bienes materiales o políticos, formalmente en nombre del grupo, pero de hecho solamente con objeto de dar ventaja a los líderes o las élites. Cuando llevan aparejado un carácter político, las identidades nacionales, culturales y étnicas son susceptibles de provocar conflictos violentos, la naturalización de la violencia y la deshumanización de otros grupos tienen lugar a menudo cuando de conflictos etno-nacionalistas se trata. Sister chromatid cohesion mediated by the ring‐shaped cohesin complex is essential for faithful chromosome segregation. A tight spatial and temporal control of cohesin release is observed in mitosis and meiosis, and a family of proteins known as shugoshins play a major role in this process. Shugoshin (Sgo) protects centromeric cohesin from dissociation in early mitosis and from cleavage by separase in meiosis I. Three exciting new reports indicate that this is accomplished by recruiting the serine/threonine protein phosphatase 2A (PP2A) to (...) centromeres.(1–3) The proposed targets of PP2A activity include cohesin and Sgo, both of which would otherwise dissociate from chromosomes upon phosphorylation by Polo kinase. Thus, a balance of kinase and phosphatase activities seems to be the key to the conserved mechanism that regulates the stepwise release of cohesin from mitotic and meiotic chromosomes. Supranational governance is being challenged by politicians and citizens around the EU as over-centralized and undemocratic. This book is premised on the idea that polycentric governance, developed by Vincent and Elinor Ostrom, is a fruitful place to start for addressing this challenge. Assessing the presence of, and potential for, polycentric governance within the EU means approaching established principles and practices from a new perspective. While the debate on these issues is rich, longstanding and interdisciplinary, it has proven difficult to sidestep (...) the 'renationalisation/federalisation' dichotomy. The aim of this volume is not to reject the EU's institutional structure but provide a different benchmark for the assessment of its functioning. Polycentric theory highlights the importance of multilevel horizontal relationships within the EU - between states, but also between many sub-state actors, all the way down to individuals. This helps us answer the question: how do we achieve self-governance in an interdependent world? (shrink)

The revenant Er, in his particular nekia, returns to life to tell all he has seen and heard: that what life bring us is related to the good or bad choice of our future life trough a draw carried out under the eyes of Necessity and her three daughters: Lachesis, Clotho and Atropo, who weave (...) the destiny of men (The Republic, Book X, 617e): Theintelligible character of this choice has the burden of a determinism ab origine without possibility of rewriting it, making our fate an inalterable journey. Kant could say the same in KrV, although it is true that the doctrine of the “intelligible character” only appears specifically in 1781, in the light of the Third Antinomies, in the“Dialectic” of the Critique of Pure Reason. Anyway, its long shadow appears in other texts (as in Religion Within Limits of Reason Alone of 1793)– that each one of voluntary acts of men: “it is predetermined, well before it occurs, in the empirical character of man” (KrV, A 553 / B 581) would suppose that this intelligiblecharacter would have to be understood together with the problem of freedom and decision. That threshold pointed out by Kant will be trespassed by Schelling, who will form a concept of freedom of a metaphysical character (libertas ex) which will send us to an origin, beyond all times, in which the de-cision, as ex-cision, restructures and sets in order our time. Cut or beginning, it is a wound without stitches which implies the proper opening of being into existence. (shrink)

Estudo comparado sobre o tratamento dado à reprodução humana assistida no direito do Brasil, Estados Unidos, Portugal, Espanha e Itália.

This paper attempts to draw on management theory and practice and, more specifically, on know-how from the study of teamwork, to seek insights into enhancing the effectiveness of hospital ethics committees and clinical ethics committees (CECs), with the aim of contributing to heath-care organizations’ effective and efficient decision-making and operation. Based on an analysis of the obstacles that stand in the way of ethics committees’ (ECs’) efficient functioning, five specific conditions for EC success are brought forth. A couple of practical (...) tools for their attainment are proposed. The article suggests that the construction of those committees, as well as the working procedures that may render them effective, should be flexible and made adaptable to the specific assignment or case, which is dealt with by that committee, at the time; and that the optimal set of procedures to adopt, throughout the working sessions of ECs, are those which will gear the committee with the means to contribute to the eventual materializing and finalization of a quality and practical set of decisions; for the benefit of patients, their families, health-care organizations and the community, alike. O objetivo deste trabalho é apresentar a Lógica TK em sistemas de dedução natural, cálculo de sequentes e tableaux assim como demonstrar a equivalência entre esses novos sistemas e o original.
