The use of with the future indicative is admittedly rare in post-Homeric Greek. In the passages concerned many deny the usage completely and either omit the particle or resort to emendation, or dismiss the construction as a mere ana-colouthon. In an instructive article in the Classical Quarterly, xl , Moorhouse argues in favour of retaining many of the readings, and it is only his interpretation that is in question here. His main thesis is that in Homeric Greek, where the usage (...) is common enough, κ or with the future means either ‘in that case’ or ‘probably’ . The latter usage, however, he regards as sometimes assuming a tone of dogmatic certainty , and this ‘emphatic future’ came to be the regular and literal meaning of the later idiom, without any irony being involved. This article deals with the relationship between argumentation and persuasion. It defends the idea that these two concepts are not as opposed as all too often said. If it is important to recognize their differences (there are argumentative discourses without persuasion and persuasive discourses without argumentation), there is nevertheless an overlap, in which characteristics are taken from both. We propose to call this overlap “persuasive argumentation”. In order to bridge argumentation and persuasion, we will first distinguish the latter from manipulation. (...) As one tries to grasp love and its images within José Leonilson's production, a multiplicity of aspects and meanings are seen that also relate to Louise Bourgeois's oeuvre in regard to the interest in human relations. Through a comparative approach to both artists' poetics, an understanding is created that love is not a simplistic action and all the words read in or applied to their visual discourse must be considered within a wide range of love in visual and literary images. Pretendemos analisar a crítica ao direito marxiana exposta nos comentários à obra Lectures on the early history of institutions, do jurista inglês Henry Sumner Maine, presentes nos "assim chamados" Cadernos Etnológicos. Para tal, passaremos pela crítica de Karl Marx à teoria do direito de Maine, passando também por considerações sobre os juristas analíticos John Austin e Jeremy Bentham, nos quais o autor das Lectures se baseia fortemente. Em seguida, trataremos das críticas à concepção de Maine sobre a origem do Estado (...) e do direito. Então, explicaremos como Marx se contrapõe a Maine voltando-se para o solo da história real, e assim analisa a gênese e o desenvolvimento direito na Irlanda e sua associação com a religião cristã, tanto antes quanto durante a colonização inglesa, observando também a violência por trás da imposição das leis coloniais. Este trabalho, tangenciando principalmente uma atmosfera nietzscheana, como já sugere o título, quer deslocar a questão da utilidade da filosofia - o "para que serve?" - para uma questão que procura pela força da filosofia - "a quem aflige?".

Las primeras teorías sociológicas son deudoras de las filosofías ilustradas de la historia, las cuales aparecieron para proporcionar un marco de sentido a la acción moral, una vez que la teoría moral renunció a los compromisos metafísicos de la filosofía moral premoderna. Al tiempo que defendió la autonomía de la sociología frente a la filosofía, Durkheim le prescribió a aquélla una tarea específica: realizar una ciencia moral que atendiendo a dos rasgos con los que los hechos morales se muestra a (...) la conciencia —solidaridad y coerción— pueda dar cuenta del sentido moral de la división del trabajo, hasta entonces considerado un proceso casi natural. El propósito de este artículo es mostrar cómo el enfoque durkheimiano permite descubrir una semejanza estructural entre el análisis sociológico y la tradicional perspectiva filosófico-moral de las obligaciones mutuas. BackgroundFor a long time, in sports, researchers have tried to understand an expert by comparing them with novices, raising the doubts if the visual search characteristics distinguish experts from novices. Therefore, the aim of the present study was to review and conduct a meta-analysis to evaluate the differences in visual search behavior between experts and novices in team sports athletes.MethodsThis systematic review with meta-analysis followed the PRISMA 2020 and Cochrane's guidelines. Healthy team athletes were included, which engaged in regular practice, (...) from any sex or competitive level, specifically classified a priori as expert or novice in the original research. We considered only research published in peer-reviewed journals, with no limitations regarding date or language. It was considered healthy team sport athletes engaged in regular practice. The scenarios could be in situ or film-based. The databases of EBSCO, PubMed, Scopus, SPORTDiscus, and Web of Science were used to perform the searches. The risk of bias was calculated through the RoBANS tool.ResultsFrom a total of 6,257 records, of which 985 were duplicates, titles and abstracts of 5,272 were screened, and 45 required full-text analysis. Of those, 23 were excluded due to not fulfilling the eligibility criteria regarding participants. In the end, 22 studies were selected, however, as two studies were part of the same trial and were analyzed conjointly.DiscussionExperts showed to be older and with more years of practice. The ability to distinguish experts from novices was not so clear regarding the variables analyzed. This could be due to the strategies chosen in each study, which were specific to each scenario, and when grouping all together, it was lost information within non-representative averages. The distinction between experts and novices was not clear, showing a lot of heterogeneity in the included studies. The expert classification itself may have been the conditioning aspect for these results, retaining the doubt and the need for more studies in the field.Systematic review registrationThe protocol was pre-registered in OSF. In online communication, writers incorporate into fictional representation imaginaries that arise from the interaction between various artistic manifestations. This paper explores the work of two spanish authors, Patricia Esteban Erlés and Albert Soloviev in order to study the social impact and ethical aspects of hypermedial short stories in the virtual space, since their works function as vehicles for social criticism. At the same time, the paper addresses fundamental questions associated with the understanding and interpretation of hybrid narrative microtexts.

The subject of this paper is the debate between externalism and internalism about mental content presented by Tim Crane in Chapter 4 of his book Elements of Mind. Crane’s sympathies in this debate are with internalism. The paper attempts to show that Crane’s argumentation is not refuting the Twin Earth argument and externalism, and that in its basis it does not differ much from externalism itself Crane’s version of the argument for externalism features two key premises: (1) The content of (...) a thought determines what the thought is about/what it refers to (the Content Determines Reference Principle); and (2) Twins are referring to different things when they use the word “water”. From these, in a few simple steps, Crane’s externalist infers: Therefore, their thoughts are not “in their heads”. Crane suggests denying the Content Determines Reference Principle in the light of indexical thoughts. In the first stage, Crane reduces “content” to “some aspect of content”, although he needs all aspects of content to secure identity of thoughts. However, his view then comes close to something acceptable to externalists. In the second stage, Crane makes content relative to context, but then reference still determines content. (shrink)

La figura de Medea, mujer y extranjera, es el hilo conductor que trata de ofrecer un análisis sobre la pasión de la ira desde la tradición clásica, que la rechaza como pasión destructiva, hasta la apropiación realizada por el feminismo negro norteamericano de Lorde. Ambas iras tendrán algo en común: Audre Lorde hablará de la rabia por la misoginia, homofobia y racismo sufrido y en Medea habrá ira por la misoginia y xenofobia de la época. Para ello en primer lugar (...) el artículo analiza el vocabulario relacionado con la cólera y la ira tanto en griego y en latín. A partir de ahí desarrollan dos hilos. En el primero se ofrece la lectura tradicional del mito de la Medea infanticida que es la que se encuentra en la tragedia de Séneca y que se relacionada con su tratado filosófico _Sobre la ira_. De ese modo se convierte a Medea en _exemplum e contrario_ y contraimagen del sabio estoico. En el segundo se recupera la otra tradición del mito según la cual Medea no fue la que mató a sus hijos sino los corintios. Este segundo hilo del enfoque clásico de la ira para mostrar su validez como herramienta de cambio. (shrink)

A patent is a property granted to any new shape, configuration or arrangement of elements, of any device, tool, instrument, mechanism or other object or part thereof, that allows for a better or different operation, use or manufacture of the object that incorporates it or that provides it with some utility, advantage or technical effect that it did not have before. As a document, a patent really is a title that recognizes the right to exploit the patented invention exclusively, preventing (...) others from making, selling or using it without the consent of the owner. The fact of making a patent is motivated by the fact of promoting creativity, hindering competition in the market as only one person holds the patent, thus protecting the initial investment and fighting against plagiarism. Patents are available to the public for dissemination and general knowledge. It is generally recognized in the specialized literature that patents can be used as an indicator to calculate the results generated by research and development activities, being a very useful indicator to measure various social, economic or technological aspects. For this reason, it is of relevant interest to have tools or systems that allow us to obtain the patents developed in a specific period of time and to carry out analyses of various economic and social factors. These analyses can serve to obtain a social perspective of society’s progress in the technological field, and this is why an analysis of patents is of our interest. This paper proposes a platform specifically designed to obtain knowledge about patents as an indicator of Spanish social, economic or technological aspects. For this purpose, the platform retrieves, analyses and visualizes functionalities that represent data on the landscape of patents obtained from the Spanish Patent and Trademark Office as a particular case of study. El discurso primordialista sobre el origen de las identidades sociales etno-nacionales sigue latiendo en algunos enfoques históricos, antropológicos, políticos y jurídicos de las sociedades modernas, camuflado en otras formas iusnaturalistas y biologicistas de concebir los atributos culturales, étnicos, religiosos, conductuales, e incluso económicos de los pueblos. Este artículo pretende presentar, por el contrario, la construcción de las identidades nacionales desde el punto de vista modernista y analizar su papel como discurso que pretende reforzar estructuras de poder, producidas porque tienen utilidad (...) estratégica para el logro de bienes materiales o políticos, formalmente en nombre del grupo, pero de hecho solamente con objeto de dar ventaja a los líderes o las élites. Cuando llevan aparejado un carácter político, las identidades nacionales, culturales y étnicas son susceptibles de provocar conflictos violentos, la naturalización de la violencia y la deshumanización de otros grupos tienen lugar a menudo cuando de conflictos etno-nacionalistas se trata. Sister chromatid cohesion mediated by the ring‐shaped cohesin complex is essential for faithful chromosome segregation. A tight spatial and temporal control of cohesin release is observed in mitosis and meiosis, and a family of proteins known as shugoshins play a major role in this process. Shugoshin (Sgo) protects centromeric cohesin from dissociation in early mitosis and from cleavage by separase in meiosis I. Three exciting new reports indicate that this is accomplished by recruiting the serine/threonine protein phosphatase 2A (PP2A) to (...) centromeres.(1–3) The proposed targets of PP2A activity include cohesin and Sgo, both of which would otherwise dissociate from chromosomes upon phosphorylation by Polo kinase. Thus, a balance of kinase and phosphatase activities seems to be the key to the conserved mechanism that regulates the stepwise release of cohesin from mitotic and meiotic chromosomes. Supranational governance is being challenged by politicians and citizens around the EU as over-centralized and undemocratic. This book is premised on the idea that polycentric governance, developed by Vincent and Elinor Ostrom, is a fruitful place to start for addressing this challenge. Assessing the presence of, and potential for, polycentric governance within the EU means approaching established principles and practices from a new perspective. While the debate on these issues is rich, longstanding and interdisciplinary, it has proven difficult to sidestep (...) the 'renationalisation/federalisation' dichotomy. The aim of this volume is not to reject the EU's institutional structure but provide a different benchmark for the assessment of its functioning. Polycentric theory highlights the importance of multilevel horizontal relationships within the EU - between states, but also between many sub-state actors, all the way down to individuals. This helps us answer the question: how do we achieve self-governance in an interdependent world? (shrink)

The proposed reflection intends to present the problem of judicial adjudication as a substantially-axiologically founded autonomous moment on the practical realization of law, and to explore this understanding in confrontation with external exigencies, mostly teleologically determined—hence, beyond strict deductive application, as a syllogistic reference of facts to norms, and finalistically determined decision, as an option among possible alternatives to achieve specific aims. The main objective is to enter into a discussion on the methodological meaning of “integrity”, “hard cases” and “right (...) answer”, as presented by Ronald Dworkin, and a critical reflection on the criticism of that approach levelled by Neil MacCormick, so as to confront the relevance of principle and policy arguments, in order to bring about a different methodological approach, an alternative jurisprudentialist conception of adjudication, incorporating a practical-normative constitutive dialectics between legal controversy and legal system, such as that presented by Castanheira Neves. The focus will, then, be the legitimacy of the connection of arguments of principle and consequentialist arguments in adjudication, its selection and its justification, stating, therefore, a specifically assumed judicium, a judicative decision, having the legal system as its horizon of normative reference and of substantial and institutional autonomy. The Platonic myth in Book X of The Republic tells us how the choice of “destinies” is carried out by human souls about to be born. The revenant Er, in his particular nekia, returns to life to tell all he has seen and heard: that what life bring us is related to the good or bad choice of our future life trough a draw carried out under the eyes of Necessity and her three daughters: Lachesis, Clotho and Atropo, who weave (...) the destiny of men (The Republic, Book X, 617e): Theintelligible character of this choice has the burden of a determinism ab origine without possibility of rewriting it, making our fate an inalterable journey. Kant could say the same in KrV, although it is true that the doctrine of the “intelligible character” only appears specifically in 1781, in the light of the Third Antinomies, in the“Dialectic” of the Critique of Pure Reason. Anyway, its long shadow appears in other texts (as in Religion Within Limits of Reason Alone of 1793)– that each one of voluntary acts of men: “it is predetermined, well before it occurs, in the empirical character of man” (KrV, A 553 / B 581) would suppose that this intelligiblecharacter would have to be understood together with the problem of freedom and decision. That threshold pointed out by Kant will be trespassed by Schelling, who will form a concept of freedom of a metaphysical character (libertas ex) which will send us to an origin, beyond all times, in which the de-cision, as ex-cision, restructures and sets in order our time. This paper attempts to draw on management theory and practice and, more specifically, on know-how from the study of teamwork, to seek insights into enhancing the effectiveness of hospital ethics committees and clinical ethics committees (CECs), with the aim of contributing to heath-care organizations’ effective and efficient decision-making and operation. Based on an analysis of the obstacles that stand in the way of ethics committees’ (ECs’) efficient functioning, five specific conditions for EC success are brought forth. A couple of practical (...) tools for their attainment are proposed. The article suggests that the construction of those committees, as well as the working procedures that may render them effective, should be flexible and made adaptable to the specific assignment or case, which is dealt with by that committee, at the time; and that the optimal set of procedures to adopt, throughout the working sessions of ECs, are those which will gear the committee with the means to contribute to the eventual materializing and finalization of a quality and practical set of decisions; for the benefit of patients, their families, health-care organizations and the community, alike. In 1877 Louis Paul Cailletet in France and Raoul Pictet in Switzerland liquefied oxygen in the form of a mist. The liquefaction of the first of the so-called permanent gases heralded the birth of low-temperature research and is often described in the literature as having started a ‘race’ for attaining progressively lower temperatures. In fact, between 1877 and 1908, when helium, the last of the permanent gases, was liquefied, there were many priority disputes—something quite characteristic of the emergence of a (...) new research field. This paper examines Cailletet’s path to the liquefaction of oxygen, as well as a debate between him and the Polish physicist Zygmunt Wróblewski over the latter’s contribution to the liquefaction of gases. Este artigo apresenta uma prática pedagógica realizada no Estágio Curricular Supervisionado II do Curso de Letras - Português e Espanhol na Universidade Federal da Fronteira Sul (UFFS) campus Cerro Largo. O estágio foi desenvolvido em uma turma de segundo ano de uma escola pública de Ensino Médio, com duração de 16 horas. O plano de aula trabalhou o texto dissertativo-argumentativo através da temática “Regulamentação das Redes Sociais” baseado no método de Sequência Didática (Dolz, Noverraz, Schneuwly, 2004). Essa ferramenta didática consiste (...) em atividades de pré-leitura, leitura e pós-leitura, com duas produções textuais: o texto de sondagem, que visa identificar o conhecimento prévio dos alunos, e a produção textual final, que consiste no desenvolvimento de uma redação em um simulado do Exame Nacional do Ensino Médio (ENEM). Ademais, realizamos uma autoavaliação, em que os alunos puderam refletir criticamente sobre seu processo de ensino e aprendizagem, identificando, através de um questionário, suas dificuldades e evolução ao longo das aulas, não detendo-se somente à avaliação quantitativa feita pelo professor. Dessa forma, a partir dos resultados apresentados na autoavaliação e nas produções textuais, concluímos que os alunos demonstraram um bom aproveitamento do conteúdo trabalhado, desenvolvendo o senso crítico, a argumentação e, consequentemente, a cidadania. La titularidad de derechos fundamentales de los sujetos integrantes y el valor de la dignidad humana como valor cualif icado debe regir las relaciones, incluso en el caso de que tales derechos deban ser limitados. Para Ferrajoli son derechos fundamentales todos aquellos derechos subjetivos que corresponden universalmente a todos los seres humanos en cuanto dotados del status de ciudadanos o personas con capacidad de obrar, entendiendo por derecho subjetivo (...) cualquier expectativa positiva o negativa adscrita a un sujeto por una norma jurídica positiva. Los derechos fundamentales son universales y ese universalismo puede relacionarse, según Ferrajoli, con el multiculturalismo. Dicha universalidad no debe entrar en contraposición con la identidad cultural. (shrink)
