Scholars and professional organizations in bioethics describe various approaches to “quality assessment” in clinical ethics. Although much of this work represents significant contributions to the literature, it is not clear that there is a robust and shared understanding of what constitutes “quality” in clinical ethics, what activities should be measured when tracking clinical ethics work, and what metrics should be used when measuring those activities. Further, even the most robust quality assessment efforts to date are idiosyncratic, in that they represent (...) evaluation of single activities or domains of clinical ethics activities, or a range of activities at a single hospital or healthcare system. Countering this trend, in this article we propose a framework for moving beyond our current ways of understanding clinical ethics quality, toward comprehensive quality assessment. We first describe a way to conceptualize quality assessment as a process of measuring disparate, isolated work activities; then, we describe quality assessment in terms of tracking interconnected work activities holistically, across different levels of assessment. We conclude by inviting future efforts in quality improvement to adopt a comprehensive approach to quality assessment into their improvement practices, and offer recommendations for how the field might move in this direction. This English translation of the author's original work has been thoroughly revised, expanded and updated. The book covers logical systems known as type-free or self-referential . These traditionally arise from any discussion on logical and semantical paradoxes. This particular volume, however, is not concerned with paradoxes but with the investigation of type-free sytems to show that: (i) there are rich theories of self-application, involving both operations and truth which can serve as foundations for property theory and formal semantics; (ii) these (...) theories provide a new outlook on classical topics, such as inductive definitions and predicative mathematics; (iii) they are particularly promising with regard to applications. Research arising from paradoxes has moved progressively closer to the mainstream of mathematical logic and has become much more prominent in the last twenty years. A number of significant developments, techniques and results have been discovered. The present essay provides a new metaphysical interpretation of Relational Quantum Mechanics (RQM) in terms of mereological bundle theory. The essential idea is to claim that a physical system in RQM can be defined as a mereological fusion of properties whose values may vary for different observers. Abandoning the Aristotelian tradition centered on the notion of substance, I claim that RQM embraces an ontology of properties that finds its roots in the heritage of David Hume. To this regard, defining what (...) kind of concrete physical objects populate the world according to RQM, I argue that this theoretical framework can be made compatible with (i) a property-oriented ontology, in which the notion of object can be easily defined, and (ii) moderate structural realism, a philosophical position where relations and relata are both fundamental. Finally, I conclude that under this reading relational quantum mechanics should be included among the full-fledged realist interpretations of quantum theory. (shrink)

According to simulation or shared-substrates models of emotion recognition, our ability to recognize the emotions expressed by other individuals relies, at least in part, on processes that internally simulate the same emotional state in ourselves. The term “emotional expressions” is nearly synonymous, in many people's minds, with facial expressions of emotion. However, vocal prosody and whole-body cues also convey emotional information. What is the relationship between these various channels of emotional communication? We first briefly review simulation models of emotion recognition, (...) and then discuss neuroscientific evidence related to these models, including studies using facial expressions, whole-body cues, and vocal prosody. We conclude by discussing these data in the context of simulation and shared-substrates models of emotion recognition. (shrink)

This book addresses two related questions that have first arisen in Toulmin’s seminal book on the uses of argument. The first question is the one of the relationship between the semantic analysis of modality and the structure of arguments. The second question is the one of the distinctive place, or role, of modality in the fundamental structure of arguments. These two questions concern how modality, as a semantic category, relates to the fundamental structure of arguments. The book addresses modality and (...) argumentation also according to another perspective by looking at how different linguistic modal expressions may be taken as argumentative indicators. It explores the role of modal expressions as argumentative indicators by using the Italian modal system as a case study. Cohen and Meskin 2006 have recently proposed a novel counterfactual account of information. I argue that it is a step down from its intended target, namely Dretske's 1981 theory of information. Thinking of the information carried by signals in terms of counterfactuals leads to falsely diagnosing bona fide instances of information transmission as not being instances of information transmission at all, with major loss of explanatory power.

By virtue of what do alarm calls and facial expressions carry natural information? The answer I defend in this paper is that they carry natural information by virtue of changing the probabilities of various states of affairs, relative to background data. The Probabilistic Difference Maker Theory of natural information that I introduce here is inspired by Dretske's [1981] seminal analysis of natural information, but parts ways with it by eschewing the requirements that information transmission must be nomically underwritten, mind-independent, and (...) knowledge-yielding. PDMT includes both a qualitative account of information transmission and a measure of natural information in keeping with the basic principles of Shannon's communication theory and Bayesian confirmation theory. It also includes a new account of the informational content of a signal, understood as the combination of the incremental and overall support that the signal provides for all states of affairs at the source. A thriving literature has developed over logical and mathematical pluralism – i.e. the views that several rival logical and mathematical theories can be equally correct. These have unfortunately grown separate; instead, they both could gain a great deal by a closer interaction. Our aim is thus to present some novel forms of abstractionist mathematical pluralism which can be modeled on parallel ways of substantiating logical pluralism (also in connection with logical anti-exceptionalism). To do this, we start by discussing the Good (...) Company Problem for neo-logicists recently raised by Paolo Mancosu (2016), concerning the existence of rival abstractive definitions of cardinal number which are nonetheless equally able to reconstruct Peano Arithmetic. We survey Mancosu’s envisaged possible replies to this predicament, and suggest as a further path the adoption of some form of mathematical pluralism concerning abstraction principles. We then explore three possible ways of substantiating such pluralism—Conceptual Pluralism,Domain Pluralism,Pluralism about Criteria—showing how each of them can be related to analogous proposals in the philosophy of logic. It applies all the more during the pandemic when decisions require not only specialised knowledge in a number of disciplines, scientific consensus, and participants from different fields, but also responsibility and respect for moral principles in order to ensure that the human rights of all groups are observed. Pandemic measures are created (...) by politicians, healthcare policy-makers, and epidemiologists. However, what is the role of ethics as a moral philosophy and experts in ethics? Experts in ethics and philosophy are carefully scrutinising political decisions. Levy and Savulescu have claimed that Ethicists and philosophers are not epistemically arrogant if they question policy responses. They played an important role in the creation of a reliable consensus. This study analyses epistemic and moral responsibility, their similarities, analogies, and differences. Are they interconnected? Phenomenology has been defined by Husserl as “theory of the essences of pure phenomena,” yet the ontological status of essences in Husserlian phenomenology is far from a settled issue. The late Husserlian emphasis on genetic constitution and the historicity of the lifeworld is not immediately reconcilablewith the ‘unchangeable’ nature that is prima facie attributed to essences. However, the problem of the nature of ideality cannot be dropped from phenomenological accounts without jeopardizing the phenomenological enterprise as such. Through an immanent analysis (...) of Husserl’s meditation on essences a positive account of their ontological status is provided. Essences are interpreted as ontological thresholds, primordially rooted in our motivated confrontation with sensuous transcendence. Essences appear as emergent ontological features, which are not reducible to their particular realizations and which exhibit a fundamental continuity between consciousness and being. They manifest themselves as prospectively a priori (a precondition for further experiences), but retrospectively a posteriori (they are founded in experience). Finally, essences manifest the ‘co-essential’ nature of consciousness and sensuous transcendence: they are the way in which we are motivated and constitutively bound to articulate being, which in turn is apt to be thus articulated. Recent research put forward the hypothesis that eye movements are integrated in memory representations and are reactivated when later recalled. However, “looking back to nothing” during recall might be a consequence of spatial memory retrieval. Here, we aimed at distinguishing between the effect of spatial and oculomotor information on perceptual memory. Participants’ task was to judge whether a morph looked rather like the first or second previously presented face. Crucially, faces and morphs were presented in a way that the morph (...) reactivated oculomotor and/or spatial information associated with one of the previously encoded faces. Perceptual face memory was largely influenced by these manipulations. We considered a simple computational model with an excellent match that expresses these biases as a linear combination of recency, saccade, and location. Surprisingly, saccades did not play a role. The results suggest that spatial and temporal rather than oculomotor information biases perceptual face memory. (shrink)

That the maximization of quality-adjusted life years violates concerns for fairness is well known. One approach to face this issue is to elicit fairness preferences of the public empirically and to incorporate the corresponding equity weights into cost-utility analysis (CUA). It is thereby sought to encounter the objections by means of an axiological modification while leaving the value-maximizing framework of CUA intact. Based on the work of Lübbe (2005, 2009a, 2009b, 2010, forthcoming), this paper questions this strategy and scrutinizes the (...) concomitant assumptions concerning the nature of prioritization decisions. Empirical studies indicate that these premises are in fact unwarranted. People chose a certain resource allocation because they perceive it as a fair way to treat the persons concerned, not because it maximizes something valuable, and it is questionable if prioritization decision can be represented as value-maximizing choices at all. This reflection on the fundamental distinction between deontological and consequentialist reasoning bears general implications for the scope of ‘economic imperialism.’. (shrink)

One challenge while learning scientific concepts is to select relevant information and to integrate different representations of the learning content into one coherent mental model. Virtual reality learning environments offer new possibilities to support learners and foster learning processes. Whether learning in VR is successful, however, depends to a large extent on the design of the VRLE and the learners themselves. Hence, adding supportive elements in VRLEs, such as annotations, might facilitate the learning process by guiding attention and supporting the (...) selection of relevant information. Additionally, the mapping of pictorial and verbal information is eased by these annotations. The beneficial effect of annotations is highly dependent on learners' intrinsic motivation as intrinsic motivation while learning also affects the information selection and visual search patterns. In our experimental study, we compared two conditions: learning in a VRLE with or without annotations. We measured the learning outcome on three different levels. Additionally, we investigated intrinsic motivation as a moderator for the effect of annotations on learning outcome. We found no significant main effect of annotations on learning outcome. The moderating effect of intrinsic motivation for annotations on the overall learning outcome was significant. Our results imply that learners are either intrinsically motivated or need additional support by annotations as these support the selection of relevant information in the VRLE and therefore enable them to learn successfully. Which type or quantity of annotations supports learning processes best needs to be explored in future research. (shrink)

Artists have been one of the occupational categories that has suffered the most from the economic crisis due to COVID-19. Artists’ “portfolio careers”, generally based on freelancing and self-employment not protected by regulations and welfare, are one of the main reasons of this financial emergency. Their odd forms of employment are rooted – among other things – in a peculiar understanding of artistic work, which I call artistic work exceptionalism (AWE). AWE sees artistic work as essentially different from regular jobs. (...) It finds its conceptual source in Western philosophical aesthetics, which presents the making of art in contrast with regular jobs. In this paper, I take issue with AWE and show its limits and negative implications. By placing emphasis on the heretofore neglected relationship between art and work, I argue that, in principle, creating art is (or should be regarded as) in continuity with other forms of employment, and therefore there is much to be learned from other professions at the level of artistic labor reforms. I call this view artistic work normalism (AWN). In defending AWN, my goal is not to desecrate artists’ occupation. Quite the contrary, my theoretical framework stems from a desire to recognize the social value of the arts. I propose two different approaches to the economics of art promoting artists’ well-being and the exercise of creativity: strengthened public art funding and the financialization of art. (shrink)

Gestational surrogacy is ethically complex, generating very different responses in law and policy worldwide. This paper argues that contemporary surrogacy law and policy, across many jurisdictions, fail to give sufficient attention to the significance of the relationship between the child and the gestational surrogate. This failure risks repeating the mistakes of historical, discredited approaches to adoption and donor‐assisted conception. This paper argues that proper recognition of the significance of gestation must be an organising principle in surrogacy law and policy. The (...) paper begins by pointing to examples of surrogacy law and practice where the role of the gestator is unacceptably minimised, most notably the framing of the surrogate as a mere ‘carrier’. It goes on to examine the nature of gestation, including consideration of contemporary scholarship on the metaphysics of pregnancy and emerging work in epigenetics, and argues that current evidence supports the view that the gestational relationship must be taken more seriously than it currently is. The paper then draws analogies with parenthood in donor‐assisted conception and adoption to argue that approaches to parental status in novel family formations that fail to promote transparency and seek to deny the truth of familial relationships are doomed to fail. The paper concludes by suggesting some implications for law and policy that flow from placing sufficient emphasis on the gestational role. The overarching thesis of this paper is that gestational surrogacy is ethically permissible when these fundamental requirements are adhered to, and that surrogacy law should proceed on this basis. This paper focuses on the emergent neo-Jamesian perspective concerning the phenomenology of art and aesthetic experience. Starting from the distinction between nucleus and fringe in the stream of thought described by William James, it can be argued that our appreciation of a work of art is guided by a vague and blurred perception of a much more powerful content, of which we are not fully aware. Accordingly, a work of art is seen as a kind of metaphor of our mental (...) life, objectified to be able to reach out to a much larger audience. However, it is a “realistic” theory rooted in evolutionary psychology, which claims that our mind developed within a framework shaped by environmental pressures. The aesthetics illustrated by several novelists develops a paradigm for this theory. The search for the neuronal correlates of stream of consciousness allows to make a comparison with the recent findings of neuroaesthetics and to reject its claim that it is unnecessary to take phenomenology and psychology into account. Appeals to the miraculous are common in healthcare, and arguments about end-of-life decision-making can quickly become theological. Assessments of hope have been recommended within the biopsychosocialspiritual model of medicine, but these assessments fail to account for the theological dimension of hope. Examples of failed assessments include recent efforts in palliative care and classic works, such as On Death and Dying by Elisabeth Kübler-Ross. Can genetic testing and manipulation be done ethically? -- Is the use of human embryos in stem cell research ethical? -- Chapter 3:is assisted reproductive technology ethical?

Anecdotal evidence has long lamented the status of social studies in elementary classrooms as observed by preservice teachers. As standardized testing has risen for mathematics and language arts, social studies has been pushed aside. In the aftermath of accountability legislation such as No Child Left Behind, research indicates that social studies is less visible in elementary classrooms due to an instructional focus on tested content areas (e.g. math, language arts, reading). In this study, approximately 90 elementary preservice teachers enrolled in (...) a social studies methods course responded to a survey and indicated the frequency and quality of lessons they observed over the course of a single semester. Findings report that preservice elementary teachers witnessed few, if any, lessons in social studies in the elementary classroom. Implications for teacher education are discussed. (shrink)

Während allerdings beispielsweise Medizin und Public Health offensichtlich eine wichtige Rolle für die Bekämpfung der Pandemie spielen, lässt sich durchaus die Frage stellen, welchen Beitrag die Philosophie in einer solchen, anhaltenden Ausnahmesituation spielen kann und spielen sollte. In der Einleitung zum Schwerpunkt zur Corona-Pandemie werden daher drei Interpretationen des Einwands, es sei illegitim, dass sich die Philosophie mitten in (...) der Krise zu dieser äußere, diskutiert und zurückgewiesen. Philosophische Auseinandersetzungen mit der Corona-Pandemie in der Corona-Pandemie, so das Fazit, können einen relevanten Beitrag sowohl zur fachinternen als auch zur öffentlichen Debatte leisten, sind nicht per se pietätlos gegenüber Betroffenen und stellen auch keine spezifische Ungerechtigkeit gegenüber den von der Pandemie stärker betroffenen Kolleg*innen dar. In this paper I begin to fashion a theory of musical form that I call historical formalism. Historical formalism posits that our perception of the formal properties of a musical work is informed by considerations not only of artistic categories but also of the historical, sociopolitical, and cultural circumstances within which that work was composed.

: This paper combines Simondon’s philosophy of individuation with some aspects of post-humanist and‘new materialist’ thought, while, at the same time, remaining within the ambit of a more classically ‘historical’characterisation of materialism. Two keywords drawn from Karen Barad and Simondon respectively – ‘ontoepistemology’and ‘axiontology’ – represent the red thread of a narrative that connects the early modern invention of civil science to Wiener’s cybernetic theory ofsociety. The political stakes common to these forms of what I call ‘banal’ materialism, Simondon attacked (...) ontologically,epistemologically and politically. The conceptual tools Simondon’s philosophy of individuation elaborates prove tosupport a ‘non-banal’ materialist critique of the alleged ‘unsocial sociability’ of human nature theorised in modernpolitical theory. A genuine materialist approach, as I will argue, allows us to shift political thinking from politicsconceived as a problem to be solved to politics as an arena of strategic experimentation. (shrink)

In the process of professionalization, the American Society for Bioethics and Humanities (ASBH) has emphasized process and knowledge as core competencies for clinical ethics consultants; however, the credentialing program launched in 2018 fails to address both pillars. The inadequacy of this program recalls earlier critiques of the professionalization effort made by Giles R. Scofield and H. Tristram Engelhardt, Jr.. Both argue that ethics consultation is not a profession and the effort to professionalize is motivated by self-interest. One argument they offer (...) against professionalization is that ethics consultants lack normative expertise. Although the question of expertise cannot be resolved completely, the accusation of self-interest can be addressed. Underlying these critiques is a concern for hubris, which can be addressed in certification and the vetting of candidates. Drawing on the virtue ethics literature of Alasdair MacIntyre and Edmund D. Pellegrino, I argue that medicine is a moral community in which ethics consultants are moral agents with a duty to foster the virtue of humility (or what Pellegrino and Thomasma call self-effacement). The implications of this argument include a requirement for self-reflection in one’s role as a moral agent and reflection on one’s progress toward developing or deepening virtuous engagement with the moral community of medicine. I recommend that professionalization of clinical ethics consultants include a self-reflective narrative component in the initial certification and ongoing renewal of certification where clinical ethics consultants address the emotional dimensions of their work as well as their own moral development. Adopting a teleological view of ethics consultation and incorporating narratives that work toward that purpose will mitigate the self-interest and hubris of the professionalization project. (shrink)

Knowledge and Self-Knowledge in Plato's "Theaetetus" examines the dialogue in conversation with others, arriving at the conclusion that it is the absence of self-knowledge in the Theaetetus which leads to its closing impasse regarding knowledge. What Socrates accomplishes in the dialogue is to lead the mathematician Theaetetus to the recognition of his ignorance—the first step toward self-knowledge.

Human genetic research databases cast a new light on the controversial issue of which uses of the human body are morally permissible. More specifically, banking human tissue raises issues relating to the ownership of the samples that the participants have donated, to the ownership of the data that are derived through processing the donated samples, and to the management arrangements that better balance the interest of genetic research with the protection of participants' rights. Winickoff & Winickoff suggest that the charitable-trust (...) model is a superior legal arrangement for biobanking compared with private biobanking. This paper critically assesses Winickoff & Winickoff's claim by highlighting some areas of implementation where such a model could be problematic. The charitable trust is certainly an advantageous arrangement because (1) it favors the separation between control and use of the samples, (2) it provides a procedural mechanism that facilitates the participation donor groups in the biobank management and (3) it mediates the different interests that are affected. On the other hand, the charitable-trust model leaves unresolved several issues--among them the ownership of the sample, the right of withdrawal, access and funding mechanism. I conclude that further theoretical and empirical analysis is required in the area. (shrink)

The present article is an analysis of Heidegger's notorious Rectoral Address in terms of its attempt to bring together philosophy and politics in a way that would revitalise both. Through the repossession and reconfiguration of common words and concepts, Heidegger hoped to provide the intellectual impetus for a radical, invigorating cultural revolution in Germany. Given this apparently laudable aim, one is faced with the pressing question concerning the tension between his philosophical insight, on the one hand, and his inexplicable political (...) blindness on the other. Hence the paper focuses, firstly, on the radical nature of Heidegger's transformation of traditional conceptions of philosophy (science), and secondly, on his failure to separate the originality and significance of this philosophy from a catastrophic ideological attachment to the idea of German spiritual unity and destiny.
