Background Only a few studies have been conducted to assess physicians’ knowledge of legal standards. Nevertheless, prior research has demonstrated a dearth of medical law knowledge. Our study explored physicians’ awareness of legal provisions concerning informed consent and confidentiality, which are essential components of the physician-patient relationship of trust. -/- Methods A cross-sectional study assessed attending physicians’ legal knowledge of informed consent and confidentiality regulations. The study was conducted in nine hospitals in Dolj County, Romania. Physicians were given a questionnaire (...) with ten scenarios and instructed to select the response that best reflected their practice. We assessed the responses of physicians who claimed their practice to be entirely legal. Their legal knowledge was evaluated by comparing their answers to applicable laws. We also calculated a score for the physicians who admitted to committing a legal breach. -/- Results Of the 305 respondents, 275 declared they never committed any law violation. However, their median correct answer score was 5.35 ± 1.66 out of 10. The specialty was the strongest predictor of legal knowledge, with emergency physicians rating the lowest and non-surgical physicians scoring the highest. Physicians who worked in both private and public sectors were better knowledgeable about legal issues than those who worked exclusively in the public sector. Results indicate that physicians are aware of the patient’s right to informed consent but lack comprehensive understanding. While most physicians correctly answered simple questions, only a tiny minority identified the correct solution when confronted with ethical dilemmas. The physicians who acknowledged breaching the law, on the other hand, had a slightly higher knowledge score at 5.45 ± 2.18. -/- Conclusion Legal compliance remains relatively low due to insufficient legal awareness. Physicians display limited awareness of legal requirements governing patient autonomy, confidentiality, and access to health data. Law should be taught in all medical schools, including undergraduate programs, to increase physicians’ legal knowledge and compliance. (shrink)

BackgroundAlthough the Covid-19 epidemic challenged existing medical care norms and practices, it was no excuse for unlawful conduct. On the contrary, legal compliance proved essential in fighting the pandemic. Within the European legal framework for the pandemic, patients were still entitled to be treated equally, by a specialized physician, with the possibility of seeking a second medical opinion, in a confidential setting, following prior and informed consent. This study examines physicians’ practices regarding patients’ rights during the Covid-19 pandemic and the (...) effects of age, experience, and specialty on physicians’ behavior and preferences. Additionally, it explores the nexus of malpractice complaints, malpractice fear, and legal compliance.MethodsA cross-sectional study was conducted on a convenience sample of attending physicians and general practitioners to assess compliance with patients’ rights regulations. Respondents were physicians practicing in private and public settings in Southwestern Romania from July 2021 to May 2022.Results396 attending physicians and 109 general practitioners participated in the research. Attending physicians acknowledged patients’ rights in 55.7% of statements, while general practitioners showed a slightly higher level of compliance at 59.9%. Emergency and Anesthesia and Intensive Care physicians showed the lowest compliance. There were no significant behavioral differences based on physicians’ age, years in practice, work sector, or location. However, when faced with the question of prioritizing treatment for patients with similar medical conditions, 46.2% of attending physicians reported favoring the younger patients. This preference was common among physicians under 39. Additionally, over half of the attending physicians reported working outside their area of expertise due to staff shortages. Malpractice fear was high among physicians, although unrelated to patients’ claims, legal compliance, or working outside the scope of practice. It resulted in pressure and behavioral changes.ConclusionAdherence to patients’ rights was low during the Covid-19 pandemic. Physicians could benefit from educational and administrative support to ensure better legal compliance. Further research is needed to determine if this behavior persists beyond the pandemic context. I connect two increasingly popular ideas in social epistemology—group knowledge and epistemic extension—both departures from mainstream epistemological tradition. In doing so, I generate a framework for conceptualizing and organizing contemporary epistemology along several core axes. This, in turn, allows me to delineate a largely unexplored frontier in group epistemology. The bulk of extant work in group epistemology can be dubbed intra-group epistemology: the study of epistemically salient happenings within groups. Social conventions are those arbitrary rules and norms governing the countless behaviors all of us engage in every day without necessarily thinking about them, from shaking hands when greeting someone to driving on the right side of the road. In this book, Andrei Marmor offers a pathbreaking and comprehensive philosophical analysis of conventions and the roles they play in social life and practical reason, and in doing so challenges the dominant view of social conventions first laid out by David (...) Lewis. Marmor begins by giving a general account of the nature of conventions, explaining the differences between coordinative and constitutive conventions and between deep and surface conventions. He then applies this analysis to explain how conventions work in language, morality, and law. Marmor clearly demonstrates that many important semantic and pragmatic aspects of language assumed by many theorists to be conventional are in fact not, and that the role of conventions in the moral domain is surprisingly complex, playing mostly an auxiliary and supportive role. Importantly, he casts new light on the conventional foundations of law, arguing that the distinction between deep and surface conventions can be used to answer the prevalent objections to legal conventionalism. Social Conventions is a much-needed reappraisal of the nature of the rules that regulate virtually every aspect of human conduct. (shrink)

This paper argues for the thesis that objectless vibration plays a central role in the reconstruction proposed Kandinsky’s first book, ”Concerning the Spiritual in Art”. This kind of vibration includes as a virtual field both shapes, sounds and colors. All these “fall” in an organized way from the virtual vibrations, and the purpose of abstract painting (...) is to lift the mind beyond the specific distinctions of the visible world of objects to the abstract level of primordial vibrations. Recent years have witnessed a search for new sources for archaeological inspiration within areas which until recently have not been imagined as a source for science. Archaeology has become more â oeanthropologizedâ, and, as such, is becoming increasingly influenced by the Zeitgeist, although some European schools are yet to recognize this. The process of scientific research that archaeologists have always considered to be an objective approach has been revealed to be the result of different subjective cognitive processes, forming part of (...) the contemporary humanistic paradigm, a fact confirmed by new tendencies in contemporary archaeology. Consequently, this book considers the question: how does the archaeologist think today? Beginning with simple analogies issued from archaeological experiments or from ethnography, the structure of the contemporary archaeological thought is increasingly complex, working today with concepts that only yesterday were a subject of study. Are there any prima facie reasons that democracies might have for disenfranchising older citizens? This question reflects increasingly salient, but often incompletely theorized complaints that members of democratic publics advance about older citizens’ electoral influence. Rather than rejecting these complaints out of hand, we explore whether, suitably reconstructed, they withstand democratic scrutiny. More specifically, we examine whether the account of political equality that seems to most fittingly capture the logic of these complaints – namely, equal opportunity of political influence over (...) electoral outcomes – can justify disenfranchising older citizens. We conclude that equal opportunity of influence cannot ground a blanket disenfranchisement of older people and that, taken in conjunction with other general considerations that apply to all sound electoral policies, partial disenfranchisement proposals (i.e. proposals for reducing the electoral influence of older citizens via age-weighted voting) are both quasi-inapplicable and practically unrobust across a relevant range of political contexts. Many powers-realists assume that the powers of objects are identical with the dispositions of objects and, hence, that ‘power’ and ‘disposition’ are interchangeable. In this article, I aim to disentangle dispositions from powers with the goal of getting a better sense of how powers and dispositions relate to one another. I present and defend a modest realism about dispositions built upon a standard strong realism about powers. Cohen’s “Logic of Pure Knowledge” marks a transformation of transcendental philosophy through its new and radical interpretation of pure thinking. For Cohen, thought is in its essence creative and needs no external elements in order to produce knowledge. This study is an attempt to reconstruct the way in which Cohen understands how thinking can create its pure content from nothing. My thesis is that Kant’s distinction between the determinable and the determining I offers the theoretical context in which the productivity (...) of thinking in Cohen’s system can be understood. This collection brings together the best contemporary philosophical work in the area of intersection between philosophy of language and the law. Some of the contributors are philosophers of language who are interested in applying advances in philosophy of language to legal issues, and some of the participants are philosophers of law who are interested in applying insights and theories from philosophy of language to their work on the nature of law and legal interpretation. By making this body of recent work (...) available in a single volume, readers will gain both a general overview of the various interactions between language and law, and also detailed analyses of particular areas in which these interactions manifest. The contributions to this volume are grouped under three main general areas: The first area concerns a critical assessment, in light of recent advances in philosophy of language, of the foundational role of language in understanding the nature of law itself. The second main area concerns a number of ways in which an understanding of language can resolve some of the issues prevalent in legal interpretation, such as the various ways in which semantic content can differ from law's assertive content; the contribution of presuppositions and pragmatic implicatures in understanding what the law conveys; the role of vagueness in legal language, for example. The third general topic concerns the role of language in the context of particular legal doctrines and legal solutions to practical problems, such as the legal definitions of inchoate crimes, the legal definition of torture, or the contractual doctrines concerning default rules. According to traditional Judeo-Christian-Islamic theism, God is an omniscient, omnipotent, and morally perfect agent. This volume shows that philosophy of religion needs to take seriously alternative concepts of the divine, and demonstrates the considerable philosophical interest that they hold.

The purpose of this essay is to explore some of the main pragmatic aspects of communication within the legal context. It will be argued that in some crucial respects, the pragmatics of legal language is unique, involving considerations that are not typically present in ordinary conversational contexts. In particular, certain normative considerations that are typically settled in a regular conversational context are unresolved and potentially contentious in the legal case. On the other hand, the essay also argues that a careful (...) distinction between various pragmatic aspects of language use enables us to offer some generalizations about types of pragmatic enrichment that could be taken to form, or not to form, part of what is actually determined by legal expressions. In Philosophy of Law, Andrei Marmor provides a comprehensive analysis of contemporary debates about the fundamental nature of law—an issue that has been at the heart of legal philosophy for centuries. This Element focuses on some core conceptual and ontological issues related to pantheistic conceptions of God by engaging with recent work in analytic philosophy of religion on this topic. The conceptual and ontological commitments of pantheism are contrasted with those of other conceptions of God. The concept of God assumed by pantheism is clarified and the question about what type of unity the universe must exhibit in order to be identical with God receives the most attention. It is argued that (...) the sort of unity the universe must display is the sort of unity characteristic of conscious cognitive systems. Current developments in fields such as quantum physics, fine arts, robotics, cognitive sciences or defense and security indicate the emergence of creative systems capable of producing new and innovative solutions through combinations of machine learning algorithms. These systems, called machine invention systems, challenge the established invention paradigm in promising the automation of – at least parts of – the innovation process. This paper’s main contribution is twofold. Based on the identified state-of-the-art examples in the above mentioned fields, key components for (...) machine invention systems and their relations are identified, creating a conceptual model as well as proposing a working definition for machine invention systems. The differences and delimitations to other concepts in the field of machine learning and artificial intelligence, such as machine discovery systems are discussed as well. Furthermore, the paper briefly addresses the social and societal implications and limitations that come with the adoption of the technology. Because of their revolutionizing potential, there are widespread implications to consider from ethical and moral implications to policymaking and societal changes, like changes in the job structure. The discussion part approaches some of these implications, as well as solutions to some of the proposed challenges. The paper concludes by discussing some of the systemic benefits that can be accessed through machine invention. (shrink)

Law in the Age of Pluralism contains a collection of essays on the intersection of legal and political philosophy. Written within the analytical tradition in jurisprudence, the collection covers a wide range of topics, such as the nature of law and legal theory, the rule of law, the values of democracy and constitutionalism, moral aspects of legal interpretation, the nature of rights, economic equality, and more. The essays in this volume explore issues where law, morality and politics meet, and discuss (...) some of the key challenges facing liberal democracies. Marmor posits that a liberal state must first and foremost respect people's personal autonomy and their differing, though reasonable, conceptions of the good and the just. This basic respect for pluralism is shown to entail a rather skeptical attitude towards grand theories of law and state, such as contemporary constitutionalism or Dworkin's conception of 'law as integrity'. The values of pluralism and respect for autonomy, however, are also employed to justify some of the main aspects of a liberal state, such as the value of democracy, the rule of law, and certain conceptions of equality. The essays are organized in three groups: the first considers the rule of law, democracy and constitutionalism. The second group consists of several essays on the nature of law, legal theory, and their relations to morality. We propose that human reasoning relies on an inherence heuristic, an implicit cognitive process that leads people to explain observed patterns (e.g., girls wear pink) in terms of the inherent features of their constituents (e.g., pink is an inherently feminine color). We then demonstrate how this proposed heuristic can provide a unified account for a broad set of findings spanning areas of research that might at first appear unrelated (e.g., system justification, nominal realism, is–ought errors in moral reasoning). By revealing (...) the deep commonalities among the diverse phenomena that fall under its scope, our account is able to generate new insights into these phenomena, as well as new empirical predictions. A second main goal of this paper, aside from introducing the inherence heuristic, is to articulate the proposal that the heuristic serves as a foundation for the development of psychological essentialism. More specifically, we propose that essentialism—which is the common belief that natural and social categories are underlain by hidden, causally powerful “essences”—emerges over the first few years of life as an elaboration of the earlier, and more open-ended, intuitions supplied by the inherence heuristic. In the final part of the paper, we distinguish our proposal from competing accounts (e.g., Strevens' K-laws) and clarify the relationship between the inherence heuristic and related cognitive tendencies (e.g., the correspondence bias). In sum, this paper illuminates a basic cognitive process that emerges early in life and is likely to have profound effects on many aspects of human psychology. (shrink)

We analyze the interrelation of quantum and classical entanglement. The latter notion is widely used in classical optic simulation of some quantum-like features of light. We criticize the common interpretation that “quantum nonlocality” is the basic factor differing quantum and classical realizations of entanglement. Instead, we point to the breakthrough Grangier et al. experiment on coincidence detection which was done in 1986 and played the crucial role in rejection of classical field models in favor of quantum mechanics. Classical entanglement sources (...) produce light beams with the coefficient of second order coherence \} \ge 1.\) This feature of classical entanglement is obscured by using intensities of signals in different channels, instead of counting clicks of photo-detectors. The interplay between intensity and clicks counting is not just a technicality. We elevate this issue to the high foundational level. (shrink)

Within the semiotic approach to explaining human behavior, individual actions can be understood as signs expressing senses of other actions. Such an understanding makes it possible to combine the description of actions in the individual and systemic societal perspective. The individual sense of an action refers to a finite number of other actions given to a person both in consciousness and in bodily experience as a whole. Social senses link actions into a single chain and are extracted from the senses (...) of previous actions. This model, while generally correct, is too abstract and requires a more detailed explanation of exactly how senses are extracted. The suggested possible explanation is that actions are mediated by situations in accordance with the formula of K. Lewin: the actual form of behavior is a function of the situation, understood as a set of properties of the acting person and her circumstances. The idea being expressed in the form of rules, according to which a typical form of behavior is performed by a person with a typical social status, being in a typical psychophysiological state and typical circumstances, gets a variant of the so-called “grammar of behavior”, explicating innate predispositions and implicit rules of culture. The question of how to understand the forms of behavior and situations typical for a particular culture can be solved on the basis of the biosemantics of R.G. Millikan. They can be understood as natural conventions — such that two conditions are sufficient for their existence: that they reproduce, and that this reproduction be based on the weight of precedents. Conventional language constructs are understood in biosemantics as lineages of tokens that were copied from each other and copies of which were used for repeated solutions to the same problem. They may have appeared by accident, but they survive and proliferate due to the performance of a vital function. At the same time, it is not at all necessary that the absolute majority of people conform to these conventions, just as the conventions do not have to be explicit prescriptions. Ideas about what forms of behavior are most appropriate in a given situation cannot be the same for different people, but this does not prevent the proliferation of conventional behavior. (shrink)

Nicolas d'Autrécourt (c. 1298-1369) is one of the most daring thinkers in the history of philosophy, and Zénon Kaluza, who has devoted to him nearly thirty years of study, presents him to us through his sources, his doctrines and his manuscripts. The reader will find studies on some of the most relevant philosophical doctrines (such as perception, the final causality, the categories and the eternity of the world) as well as a new edition of the Prologues of the _Exigit ordo_, enriched with a running commentary. The texts gathered here—some of which have been published previously but are difficult to access and others which have been unpublished until now—reveal a philosopher who wished to free philosophy from institutional constraints and dared to criticize Aristotle's metaphysics, at the risk of upsetting traditions and contradicting the dogmas of the faith, and who was condemned by the theological authorities of his time. Heymeric de Campo († 1460) discusses the Trinity several times in a largely unpublished metaphysical treatise, the Colliget principiorum. This paper analyses only some of these references, especially in relation to the creation of the world, which Heymeric understands in two stages : first as a creation in thought by the Father in the Son, and then as an outflow from the Trinity through the participation of the Holy Spirit. To better situate this position in the medieval context, the paper (...) shows that some authors associate the thesis of creation in the Word with the archetypal world of Plato’s Timaeus, while others reject it, such as Albert the Great. Heymeric de Campo chooses an intermediate path : he accepts that creation in the Son is the archetypal world, but he stresses that the latter neither exists nor acts outside the Trinity. This can be interpreted as a reaction against the Prague realists (Jerome of Prague and John Hus) condemned at the Council of Constance. Heymeric draws on Albert’s interpretation of Proposition IV of the Liber de causis to show that God’s going out from the Trinity is through a particular type of flow of the first created being. This first created being is a third kind of being, neither that of the Creator nor that of the creature, but creation. It is passage and becoming, that by which God manifests himself and allows himself to be known. Heymeric calls it quid neutrum and quo fit, an indeterminate being, simple but filled with forms, both finite and infinite, a form without form, but informing and transporting forms (in an inchoative manner). Yet it is the subject of metaphysics, and that opens a different perspective from that of the onto‑theology to which we are accustomed. (shrink)
