This is an account of a reading project that began in February 2020. Australia was burning, a pandemic was simmering, the two of us were early in our PhD journeys at the Melbourne Law School. Already, we felt exhausted by critical theory which seemed to amplify the affects we felt all too intensely. Our reading project began as an attempt to find and inhabit texts that might move beyond critique, that might allow us to find wonder and vitality in legal (...) theory. Taking up the literary critic Rita Felski’s invitation to craft a post-critical reading practice, our reading list evolved iteratively to encompass themes and concerns that we identified as possibly correlating with said practice. It evolved too, in conversation with Melbourne, as the city journeyed through different stages of the pandemic. Constantly changing restrictions changed the ways in which we met and conversed, influencing in turn the texts we chose to read and the manner in which we read them. In this account, we pay attention to the time and place of our encounters with these interlocutors, and to the feelings these encounters generated. As such, this article takes the form of a series of (revised) diary entries: first written in 2020, then revisited in the corresponding months of 2021. What we hope emerges from these entries is a sense of how these theoretical texts train us to live in a world undergoing a compounding series of crises – and, perhaps, to imagine that world otherwise. In a more jurisprudential register, we hope that our experiment will identify the methods these texts might give us for (re-)engaging with law in a spirit of wonder and vitality. (shrink)

Para solucionar a questão “sobre o que há” levantada por Quine, e realizar a tarefa de compreender de forma exauriente as muitas unidades ontológicas que povoam a grande província do Ser, propomos como alternativa à ontologia punteliana, uma nova ontologia designada de “Ontologia Estrutural” (OE). Tal ontologia parte de bases teóricas sistemático-estruturais, mas desemboca em uma visão diversa em que co-subsistem unidades factuais estruturadas, configurações estruturais (dinâmicas), bem como unidades ontológicas aparentes (objetos), todas englobadas pela subdimensão temporal que as interconexiona, (...) compreendida esta como uma subdimensão (interna) da macrodimensão do Ser. Nesse sentido, começamos situando a temática ontológica na discussão filosófica atual a partir de uma chave quineana; prosseguimos apresentando um conceito de verdade derivado de nossa leitura da filosofia punteliana, o qual constituirá o ponto de ligação entre linguagem e mundo. Na sequência, mostramos como do conceito de verdade trazido à lume, após uma breve incursão na semântica filosófica, chegamos ao campo ontológico a partir das categorias ontológicas de estrutura e estado ontológico. Ao final, delineamos, em seus caracteres gerais, a nossa ontologia estrutural, compreensiva de noções ontológicas próprias que dão novos rumos à compreensão filosófica desta grande temática. No último quartel do Séc. XX, instalou-se na Filosofia da Linguagem um vivo debate entre duas teorias acerca da referência, a teoria descritivista, formulada por Bertrand Russell e com raízes na filosofia de Frege, e, a desafiar esta, a teoria causal da referência, sob o impulso de Putnam e de Kripke. Há, por outro lado, importantes estudos do pensamento de Husserl, centrados sobretudo em Ideias I, que dão conta da possibilidade de uma sua leitura fregeana. O intuito desta comunicação reside, (...) primeiramente, em mostrar que, não obstante essas leituras, os aspectos semânticos mais originais na fenomenologia de Husserl e, além disso, também mais interessantes para o debate sobre o problema da referência, se encontram logo na Primeira das Investigações Lógicas. Com efeito, nesse texto, cremos ser possível mostrar que a teoria da expressão de Husserl não se ajusta nem à teoria descritivista nem à teoria causal da referência. As razões do desajustamento, segundo tese que propomos, prendem-se com o facto de ambas as teorias da referência, descritivista e causal, disputarem entre si o problema da frxação da referência das expressões como se esse fosse o problema de saber o que faz com que as expressões refiram. Mostrar que não é assim com Husserl, conduz-nos a um terceiro problema, na obra póstuma Experiência e Juízo, sobre a constituição dos referentes, enquanto objectos de uma relação directa ao individual, ou seja, enquanto objectos de experiência. Quererá isto dizer, concluindo, que o problema da referência, antes de respeitar às expressões referenciais, respeita à própria experiência e que tal problema deverá, por isso, resolver-se na constituição passiva e ante-predicativa da experiência. Visto em perspectiva histórica, o ensinamento de Santo Tomás sobre o desejo natural a Deus foi apenas um interlúdio na tradição agostiniana-escotista. Aqueles que continuam a falar da doutrina dele sobre um desejo natural pela visão "beatífica" dão testemunho da influência viva daquela tradição hoje. Embora ele não possa ser enquadrado na série que liga Santo Agostinho, São Boaventura, Duns Scotus e Domingo de Soto nessa questão, a posição dele não é menos cristã do que a da tradição com a (...) qual ele rompeu. A posição dele, entretanto, irá continuar a parecer incoerente e até mesmo contraditória, enquanto for colocada nos termos daquela tradição, em vez de nos seus próprios termos. (shrink)

Este livro aborda algumas mudanças ocorridas recentemente na sociedade ocidental, resultantes de importantes inovações biomédicas e sociojurídicas, e os problemas bioético-religiosos delas decorrentes. Todas essas questões possuem implicações para a reprodução humana e social e afetam categorias analíticas consagradas, como as de casamento, família, filhos, paternidade/maternidade, entre outras. Os textos aqui reunidos dão a idéia das transformações sociais, políticas, demográficas e conceituais que estão em curso nessa primeira década do século XXI.

This article is part of the period of methodological expansion, proposed by the philosopher Arturo Roig (1922-2012), in the 70's and 80's. Although the analysis of categories is rooted in the philosophical field, this expansion is made in the direction of social categories. More specifically to the categories of “civilization” and “barbarism”, both in the field of the history of ideas and in the philosophical history of Latin American liberation. First, we give different definitions and their multiple uses of category (...) in philosophy. Subsequently, we analyze the category of “human dignity”, one of the arms of the very broad anthropological a priori category, systematized by the thinker from Mendoza. Then we disaggregate the proposal of a categorical rearmament, which has among its multiple functions: the rescue, criticism, replacement, reworking and integration of categories that have been forgotten, distorted, dehistoricized and decontextualized. The categories of “civilization” and “barbarism” have generated a semantic ordering of the discursive universe in Latin America. We review different theses proposed by Roig, in the historicization of the assessment -both negative and positive- of the category “barbarism” that different thinkers in Latin America have expressed. Among them: Juan Montalvo, Domingo Faustino Sarmiento, José Hernández, Juan Bautista Alberdi, Ezequiel Martínez Estrada, among the main ones. (shrink)

André Tosel, décédé en mars 2017, était un philosophe engagé, attaché tout au long de son existence à faire vivre un marxisme critique puisant notamment dans le meilleur de la tradition italienne de ce courant de pensée ; il fut l'un des rares français à introduire et discuter les oeuvres majeures d'A. Labriola et surtout d'A. Gramsci, ainsi par ailleurs que celles de Vico dont il fut un fin connaisseur. Il consacra sa thèse de doctorat d'état aux rapports entre (...) religion, politique et philosophie chez Spinoza et contribua de façon décisive à de nouvelles lectures du philosophe en le mettant en miroir de Marx. Professeur de philosophie des universités de Besançon, Franche Comté, de Paris 1 Panthéon-Sorbonne et de Nice Sophia-Antipolis, dans lesquelles il occupa de nombreuses fonctions de directions administratives et scientifiques, il était un homme de collectif attaché à faire vivre le savoir, s'engageant dans la vie universitaire et politique, contribuant également de manière décisive au lancement et à l'animation de la revue Actuel Marx. Passionné par l'évolution des pensées contemporaines, il intervenait régulièrement dans des débats d'actualité, sous la forme de contributions dans L'Humanité ou dans des ouvrages destinés à un public large, tout particulièrement dans la dernière période sur les questions de sécularisation, de laïcité et de religion. Cet ouvrage entend lui rendre hommage en abordant les différentes facettes de son oeuvre, traversant un demi-siècle de vie intellectuelle. (shrink)

More and more organisations formulate a code of conduct in order to stimulate responsible behaviour among their members. Much time and energy is usually spent fixing the content of the code but many organisations get stuck in the challenge of implementing and maintaining the code. The code then turns into nothing else than the notorious "paper in the drawer", without achieving its aims. The challenge of implementation is to utilize the dynamics which have emerged from the formulation of the code. (...) This will support a continuous process of reflection on the central values and standards contained in the code. Social constructionists maintain that we invent the properties of the world rather than discover them. Is reality constructed by our own activity? Do we collectively invent the world rather than discover it? André Kukla presents a comprehensive discussion of the philosophical issues that arise out of this debate, analysing the various strengths and weaknesses of a range of constructivist arguments and arguing that current philosophical objections to constructivism are inconclusive. However, Kukla offers and develops new objections to constructivism, distinguishing (...) between the social causes of scientific beliefs and the view that all ascertainable facts are constructed. It is held by many philosophers that it is a consequence of epistemic contextualism that speakers are typically semantically blind, that is, typically unaware of the propositions semantically expressed by knowledge attributions. In his ?Contextualism, Invariantism and Semantic Blindness? (this journal, 2009), Martin Montminy argues that semantic blindness is widespread in language, and not restricted to knowledge attributions, so it should not be considered problematic. I will argue that Montminy might be right about this, but that contextualists still face a (...) serious and related problem: that it is a consequence of epistemic contextualism that subjects are typically unaware of contents conveyed by knowledge attributions, independently of whether these are semantic or non-semantic contents. Even if semantic blindness is widespread in language, it does not seem that content unawareness of this sort is. (shrink)

The interplay between computability and randomness has been an active area of research in recent years, reflected by ample funding in the USA, numerous workshops, and publications on the subject. The complexity and the randomness aspect of a set of natural numbers are closely related. Traditionally, computability theory is concerned with the complexity aspect. However, computability theoretic tools can also be used to introduce mathematical counterparts for the intuitive notion of randomness of a set. Recent research shows that, conversely, concepts (...) and methods originating from randomness enrich computability theory.The book covers topics such as lowness and highness properties, Kolmogorov complexity, betting strategies and higher computability. Both the basics and recent research results are desribed, providing a very readable introduction to the exciting interface of computability and randomness for graduates and researchers in computability theory, theoretical computer science, and measure theory. Semantics are given for modal extensions of relevant logics based on the kind of frames introduced in [7]. By means of a simple recipe we may obtain from a class FRM (L) of unreduced frames characterising a (non-modal) logic L, frame-classes FRM (L.M) characterising conjunctively regular modal extensions L.M of L. By displaying an incompleteness phenomenon, it is shown how the recipe fails when reduced frames are under consideration.

This paper advances the conception of social entrepreneurs as caring entrepreneurs. We argue that the care ethics of social entrepreneurs, implying the pursuit of caring goals through caring processes, can be challenged when they engage in the process of scaling up their ventures. We propose that social entrepreneurs can sustain their care ethics as the essential dimension of their venture only if they are able to build a caring enterprise. Organizational care designates the set of organizing principles that facilitate the (...) embedding of care ethics at an organizational level, beyond the imprinting induced by social entrepreneurs’ personal ethics. This volume gathers contributions at the intersection of history and politics. The essays, covering such topics as diverse as Italian identity in the Tientsin concession, international refugee policies in the interwar period and after, and the myths and realities of the Ukranian-Russian encounter in independent Ukraine, show that history provides better grounding as well as a more suitable paradigm for the study of politics than economics or other hard sciences. All of the contributors have a common link - doctoral work (...) supervised and shaped by Professor Andre Liebich - but have since expanded widely in the world. This book presents a comprehensive and detailed exploration of the relationship between the thought of G.W.F. Hegel and that of John McDowell, the latter of whom is widely considered to be one of the most influential living analytic philosophers. It serves as a point of entry in McDowell’s and Hegel’s philosophy, and a substantial contribution to ongoing debates on perceptual experience and perceptual justification, naturalism, human freedom and action. The chapters gathered in this volume, as well as McDowell’s responses, make (...) it clear that McDowell’s work paves the way for an original reading of Hegel’s texts. His conceptual framework allows for new interpretive possibilities in Hegel’s philosophy which, until now, have remained largely unexplored. Moreover, these interpretations shed light on various aspects of continuity and discontinuity between the philosophies of these two authors, thus defining more clearly their positions on specific issues. In addition, they allow us to see Hegel’s thought as containing a number of conceptual tools that might be useful for advancing McDowell’s own philosophy and contemporary philosophy in general. This book offers a superbly clear analysis of the standard arguments for and against scientific realism. In surveying claims on both sides of the debate, Kukla organizes them in ways that expose unnoticed connections. He identifies broad patterns of error, reconciles seemingly incompatible positions, and discovers unoccupied positions with the potential to influence further debate. Kukla's overall assessment is that neither the realists nor the antirealists may claim a decisive victory.

Neste artigo discutiremos o conceito de experiência [Erfahrung] em Walter Benjamin a partir de seus ensaios entre 1913 e 1936. Partiremos de seus escritos de militância juvenil a respeito da experiência com a intenção de identificarmos uma oposição entre figuras que reivindicam para si a experiência, a saber, o adulto, o que aconselha o jovem a desistir de si mesmo, e o jovem, que se encontra desorientado em razão dessa cisão entre gerações conflitantes, impossibilitando a continuidade da experiência, mesmo que (...) aqui seja compreendida de forma singular. Em seu ensaio sobre a experiência em Kant e nos neokantianos, a definição de experiência deve ser expandida, não deixando de alcançar o ato de contar histórias e de dar conselhos. Nos escritos de 30, consideraremos a abordagem da decadência da experiência (enquanto coletiva e perpassada por gerações), bem como a ascensão da vivência, que se trata de um vínculo isolado com as coisas em geral, restando formas privadas de lidar com a vida, causando desorientação no indivíduo isolado de sua comunidade real. Rendre hommage à un auteur, ce n'est pas seulement célébrer ce qu'il fut mais c'est aussi alerter sur ce que son oeuvre apporte au présent et à l'avenir de la connaissance. C'est bien le sens donné à cet hommage à André-Jean Arnaud. Repenser le droit, c'était pou r cet auteur érudit : repenser les lieux, les conditions et les façons de l'étudier en dépassant les frontières géographiques en même temps que les frontières disciplinaires. En montrant en quoi André-Jean (...) Arnaud fut, hors des sentiers battus et des orthodoxies de la production et de la transmission des savoirs en la matière, un exceptionnel précurseur et l'infatigable artisan d'un nouveau régime de connaissance sur le droit, le présent ouvrage s'adresse à toutes celles et à tous ceux, enseignants, chercheurs, étudiants ou simples citoyens, pou r qui l'étude du droit permet de mieux comprendre ce que sont et ce que sont susceptibles de devenir nos sociétés. At last it has become the focus of great national problems which until now were evoked most frequently with regard to and for the benefit of cities, or even of metropolitan areas. Its very representation, until very recent ages held to be terribly abstract and reserved to technicians, today belongs to the public domain. Exhibitions bearing titles such as Maps and Illustrations of the Earth (Paris, 1980) or Landscape: Image and Reality (Bologna, 1981) (...) attract as many visitors as an Impressionist retrospective, not only because of the novelty of the theme, the rarity of certain documents or the beauty of most of them, as proven by the success of even more specialized events such as those dedicated to the 1730 Sardinian cadastre in Savoy or to the one of Maria-Theresa in Lombardy (Chambéry and Pavia, 1980). Andre Breton discusses the meaning, aims, and political position of the Surrealist movement.

In his Perception and Reason, Bill Brewer argues that one can only have empirical beliefs if one’s perceptual experiences serve as reasons for such beliefs. His argument for this idea relies on a premise according to which in order for the relations with perceptual experience to determine the contents of empirical beliefs, these relations must be reason-giving. He offers an argument for this premise, the so-called Switching Argument. In this paper, I show that the Switching Argument does not work, in (...) which case we have no reason to accept the premise the argument is supposed to establish, and hence no reason to accept Brewer’s argument in favour of the idea that one can only have empirical beliefs if one’s perceptual experiences serve as reasons for such beliefs. Nottelman (2016) and Peels (2023) identify several categories of ignorance: factive, objectual, and practical, with erotetic ignorance —understood as the lack of knowledge of answers to questions—viewed as reducible to factive ignorance. This paper argues that erotetic ignorance is not in fact reducible to factive ignorance. More precisely, erotetic knowledge does not solely involve a relationship between a subject and a true proposition or set of propositions; instead, it involves a relationship between a subject, a true proposition or set of (...) propositions and epistemic goals of inquiry. Antimicrobial resistance (AMR) is a global public health disaster driven largely by antibiotic use in human health care. Doctors considering whether to prescribe antibiotics face an ethical conflict between upholding individual patient health and advancing public health aims. Existing literature mainly examines whether patients awaiting consultations desire or expect to receive antibiotic prescriptions, but does not report views of the wider public regarding conditions under which doctors should prescribe antibiotics. It also does not explore the ethical significance of public views (...) or their sensitivity to awareness of AMR risks or the standpoint (self-interested or impartial) taken by participants. Methods: An online survey was conducted with a sample of the U.S. public (n = 158). Participants were asked to indicate what relative priority should be given to individual patients and society-at-large from various standpoints and in various contexts, including antibiotic prescription. Results: Of the participants, 50.3% thought that doctors should generally prioritize individual patients over society, whereas 32.0% prioritized society over individual patients. When asked in the context of AMR, 39.2% prioritized individuals whereas 45.5% prioritized society. Participants were significantly less willing to prioritize society over individuals when they themselves were the patient, both in general (p = .001) and in relation to AMR specifically (p = .006). Conclusions: Participants’ attitudes were more oriented to society and sensitive to collective responsibility when informed about the social costs of antibiotic use and when considered from a third-person rather than first-person perspective. That is, as participants came closer to taking the perspective of an informed and impartial “ideal observer,” their support for prioritizing society increased. Our findings suggest that, insofar as antibiotic policies and practices should be informed by attitudes that are impartial and well-informed, there is significant support for prioritizing society. Some versions of moral naturalism are faulted for implausibly denying that moral obligations and prescriptions entail categorical reasons for action. Categorical reasons for action are normative reasons that exist and apply to agents independently of whatever desires they have. I argue that several defenses of moral naturalism against this charge are unsuccessful. To be a tenable meta-ethical theory, moral naturalism must accommodate the proposition that, necessarily, if anyone morally ought to do something, then s/he has a categorical reason to do (...) it. Versions of moral naturalism that deny this claim would, if widely believed, disable some crucial practical uses of moral concepts. In particular, if the existence of normative reasons for action is taken to be dependent on agents’ desires, it would breed profound skepticism about the legitimacy of evaluating others’ actions from a moral point of view. Also, it would raise doubts about whether people ought to correct their own behavior in light of moral considerations. Following Richard Joyce, I take these consequences to indicate that the concept of a categorical reason is a “non-negotiable” part of moral concepts. (shrink)

Occasions of Identity is an exploration of timeless philosophical issues about persistence, change, time, and sameness. Andre Gallois offers a critical survey of various rival views about the nature of identity and change, and puts forward his own original theory. He supports the idea of occasional identities, arguing that it is coherent and helpful to suppose that things can be identical at one time but distinct at another. L'unique tâche philosophique de Lequier a consisté dans la recherche d'une première vérité. Le récit existentiel est la voie qu'il a choisie. Cette voie, loin de mettre en question la métaphysique, expose, sous une forme phénoménologique, comment la vérité peut s'accomplir comme liberté dans l'histoire grâce à laquelle un être humain affirme son identité.

Au coeur du parcours philosophique d'André Jacob, qui enseigna la philosophie du langage et l'éthique à l'université de Paris X de 1966 à 1990 et a dirigé l'Encyclopédie philosophique universelle aux P.U.F. entre 1980 et 1998, ce volume s'ouvre avec le texte inaugural (prononcé au Congrès mondial de Philosophie à Brighton en 1988) "De la théorisation de la condition humaine" qui l'a toujours retenu : "Une Anthropo-logique : comprendre ou expliquer l'homme?" ; suivi de six autres conférences, appelant à (...) être relayées par une éthique renouvelée correspondant à la seconde partie de l'ouvrage. Une axio-genèse y apporte sa signifiante au "devenir Sujet" du corps, dans un versant d'altérité. On croisera le parcours singulier "de la langue au mal" dans le débat avec Robert Lafont, initiateur d'une praxématique linguistique à Montpellier, comme dans la Postface d'Hervé Barreau. A côté de conférences à l'UNESCO (1991), à Houston (1993) ou à Tokyo (1997), dont "Temps et liberté" (2000) pourrait annoncer l'éthicité ; tandis que "Langue et pouvoir" (2009) éclairera plus directement la figuration anthropo-logique, impensable dans les philosophies de la conscience traditionnelles. La diversité des approches pourrait compléter les témoignages venus d'horizons différents, lors d'un Colloque récent à l'E.N.S. de la rue d'Ulm sur Les conditions de l'humain, autour de la pensée de l'auteur, à paraître.
