The question which this paper examines is that of the correct scope of the claim that extra-linguistic factors (such as gender and social status) can block the proper workings of natural language. The claim that this is possible has been put forward under the apt label of silencing in the context of Austinian speech act theory. The ‘silencing’ label is apt insofar as when one’s ability to exploit the inherent dynamic of language is ‘blocked’ by one’s gender or social status (...) then one might justly be said to be silenced. The notion that factors independent of any person’s linguistic competence might block her ability to exploit the inherent dynamic of language is of considerable social as well as theoretical significance. I shall defend the claim that factors independent of a person’s linguistic competence can indeed block her ability to do things with words but I will show that the cases that have been previously considered to be cases of illocutionary failure are instances of rhetic or locutionary act failure instead. I shall refine the silencing claim as previously advanced in the debate in at least one fundamental respect. I also show that considering the metaphysics of speech acts clarifies many of the issues previously appearing as thorny bones of contention between those who hold that the only notion of silencing that is coherent is that of physically preventing someone from speaking or writing and those who hold the opposite sort of claim sketched above. Recently, a number of philosophers have begun to question the commonly held view that choice or voluntary control is a precondition of moral responsibility. According to these philosophers, what really matters in determining a person’s responsibility for some thing is whether that thing can be seen as indicative or expressive of her judgments, values, or normative commitments. Such accounts might therefore be understood as updated versions of what Susan Wolf has called “real self views,” insofar as they attempt to ground (...) an agent’s responsibility for her actions and attitudes in the fact (when it is a fact) that they express who she is as a moral agent. As such, they seem to be open to some of the same objections Wolf originally raised to such accounts, and in particular to the objection that they cannot license the sorts of robust moral assessments involved in our current practices of moral responsibility. My aim in this paper is to try to respond to this challenge, by clarifying the kind of robust moral assessments I take to be licensed by (at least some) non-volitional accounts of responsibility and by explaining why these assessments do not in general require the agent to have voluntary control over everything for which she is held responsible. I also argue that the limited applicability of the distinction between “bad agents” and “blameworthy agents” on these accounts is in fact a mark in their favor. (shrink)

This paper compares tracking and phenomenal intentionality theories of intentionality with respect to the issue of naturalism. Tracking theories explicitly aim to naturalize intentionality, while phenomenal intentionality theories generally do not. It might seem that considerations of naturalism count in favor of tracking theories. We survey key considerations relevant to this claim, including some motivations for and objections to the two kinds of theories. We conclude by suggesting that naturalistic considerations may in fact support phenomenal intentionality theories over tracking theories.

The purpose of this article is to show that animal rights are not necessarily at odds with the use of animals for research. If animals hold basic moral rights similar to those of humans, then we should consequently extend the ethical requirements guiding research with humans to research with animals. The article spells out how this can be done in practice by applying the seven requirements for ethical research with humans proposed by Ezekiel Emanuel, David Wendler and Christine Grady to (...) animal research. These requirements are i) social value, ii) scientific validity, iii) independent review, iv) fair subject selection, v) favorable risk-benefit ratio, vi) informed consent, and vii) respect for research subjects. In practice, this means that we must reform the practice of animal research to make it more similar to research with humans, rather than completely abolish the former. Indeed, if we banned animal research altogether, then we would also deprive animals of its potential benefits – which would be ethically problematic. (shrink)

There is an apparent tension in our everyday moral responsibility practices. On the one hand, it is commonly assumed that moral responsibility requires voluntary control: an agent can be morally responsible only for those things that fall within the scope of her voluntary control. On the other hand, we regularly praise and blame individuals for mental states and conditions that appear to fall outside the scope of their voluntary control, such as desires, emotions, beliefs, and other attitudes. In order to (...) resolve this apparent tension, many philosophers appeal to a tracing principle to argue that agents are morally responsible for those attitudes whose existence can be traced back, causally, to a voluntary action or omission in the past. My aim in this article is to critically evaluate this tracing strategy and to argue that it gives us a misguided picture of when and why we are morally responsible for our attitudes. I argue that we should accept a ‘judgment sensitivity’ condition of moral responsibility rather than a ‘voluntary control’ condition, and defend this account against various objections. (shrink)

Making data broadly accessible is essential to creating a medical information commons. Transparency about data-sharing practices can cultivate trust among prospective and existing MIC participants. We present an analysis of 34 initiatives sharing DNA-derived data based on public information. We describe data-sharing practices captured, including practices related to consent, privacy and security, data access, oversight, and participant engagement. Our results reveal that data-sharing initiatives have some distance to go in achieving transparency.

While human vulnerability has been discussed for some time in the contemporary philosophy and bioethics literature, animal vulnerability has received less attention. In this article, I investigate whether the concept of vulnerability, as it is currently used in bioethics, can be meaningfully extended to animals. Furthermore, I discuss the ethical implications of ascribing vulnerability to animals and I show what vulnerability discourse can add to debates on animal ethics. In a first step, I analyse the conditions of vulnerability ascription. By (...) taking as my basis the definition of vulnerability presented by Martin, Tavaglione and Hurst, I demonstrate that some animals fulfil the conditions of vulnerability ascription. I explore the ethical implications of vulnerability ascriptions in three domains: livestock farming, animal experimentation, and animals living in the wild. I argue that many groups of animals currently qualify as particularly vulnerable and should be afforded special protection so that they receive what they are due. I conclude by outlining the differences between vulnerability and sentience ascriptions: while sentience is a sufficient reason to ascribe moral status to a being, vulnerability draws our attention to those who are more likely to be denied what they are due. In his recent book, In Praise of Blame, George Sher argues (among other things) that a bad act can reflect negatively on a person if that act results in an appropriate way from that person's "character," and defends a novel "two-tiered" account of what it is to blame someone. In these brief comments, I raise some questions and doubts about each of these aspects of his rich and thought-provoking account.

In discussing water justice, this paper distinguishes four concepts of water justice: Distributive justice claims a fair share of water, ecological justice focuses on the integrity of water as a vulnerable resource, cultural justice addresses values attached to water reservoirs, and procedural justice explicates fair procedures in negotiating water conflicts. After having given an overview over recent contributions to the various meanings of water justice, the paper tries to answer the question of how standards of justice can be integrated into (...) an approach that overcomes the alleged tragedies of the commons. It focuses on the example of a water reservoir whose access conditions provoke conflicts among neighbors. (shrink)

In this chapter, it is argued that some animal shelters fulfill the conditions that make triage protocols necessary, namely, the operation with limited financial budgets, space, medical resources, and staff. It is suggested that requirements presented for triage in humans can be fruitfully applied to the context of animal shelters. The focus lies on the criteria of maximizing benefit, justice, medical criteria, life-span considerations, fair decision-making, patient will, re-evaluation of triage decisions and changes in the therapeutic goal, and burden of (...) triage and staff support. The establishment of triage protocols for shelters will make the decision-making process less arbitrary, fairer, and more transparent. Furthermore, it is argued that, in situations where disagreement persist among shelter staff, an external Ethics Board could be called in to help analyze and potentially resolve some of the remaining ethical issues. Over 60% of all epidemics have a zoonotic origin, that is, they result from the transmission of infectious diseases from animals to humans. The spill-over of diseases often happens because humans exploit and use animals. In this article, I outline the four most common interfaces that favour the emergence and spread of zoonotic infectious diseases: wildlife hunting, small-scale farming, industrialised farming practices and live animal markets. I analyse which practices serve human food security – and thus have a non-trivial purpose (...) – and which predominantly have an economic purpose or serve as a symbol of wealth. I conclude that many practices that increase the risk for zoonotic infectious disease outbreaks actually do not contribute to the survival and food security of humans. I make two arguments in turn. First, I argue that in cases where the consumption and use of animal products does not contribute to the food security of a population, then this population has a duty to abstain from them, since they impose a grave and avoidable risk to themselves as well as to innocent third-parties. However, some communities must sometimes rely on practices that increase the risk of emergence and transmission of zoonotic infectious diseases, because they have no healthy alternatives. That is, the food security of the local population depends on the consumption and use of risky animal products. The second argument I advance is that, in such scenarios, the international community has a duty to provide the communities concerned with alternative food options, as well as economic and educational opportunities and technologies, in order to reduce the spill-over risk of infectious diseases. Given that abstention from such practices contributes signifcantly to the public good and benefits the international community, the latter has a corresponding duty to provide local communities which abandon such practices with alternatives. This paper develops a Humean environmental meta-ethic to apply to the animal world and, given some further considerations, to the rest of nature. Our interpretation extends Hume’s account of sympathy, our natural ability to sympathize with the emotions of others, so that we may sympathize not only with human beings but also animals, plants and ecosystems as well. Further, we suggest that Hume has the resources for an account of environmental value that applies to non-human animals, non-sentient elements of nature (...) as well as nature as whole even without the appeal to sympathy. One consequence of this approach is that the reasons for promoting animal welfare need not be restricted to sentientist reasons. (shrink)

In the study of the soul between psychology and phenomenology in Edith Stein works it becomes clearer that it is only phenomenology that really comes to gripswith the question of psychic causality by correlating the two moments and it is therefore only phenomenology that can respond to Hume’s objections while yetremaining on his selfsame terrain. It is very important to distinguish between psychology and phenomenology and also to clarify the relationship between psyche and consciousness; there is thus reproposed the distinction (...) already made by Husserl, who stressed that when one sets out to look for the causes that determine psychic life, they must not be sought in life feelings but rather in the „modes” of a life force that is announced in them. All this is indicated here within limits because psychology in itself is undoubtedly not a science of the spirit, though the psychic states, on the other hand, will not be validly understood unless and until one arrives, as is demonstrated in the essay under consideration, at the motivation and therefore the spiritual sphere. We would say that our body is animated by a psyche and further enlivened by the spirit. (shrink)

Over the past several decades, geneticists have succeeded in identifying the genetic mutations associated with disease. New strategies for treatment, including gene transfer and gene therapy, are under development. Although genetic science has been welcomed for its potential to predict and treat disease, interventions may become ethically objectionable if they threaten to alter characteristics that are distinctively human. Before we can determine whether or not a genetic technique carries this risk, we must clarify what it means to be “human”. This (...) paper inquires how “humanness” has been defined within various academic fields. The views of several legal theoreists, scientists, bioethicists, psychologists, philosophers and anthropologists whose works seem to best reflect how “humanness” is understood in their respective fields of study are considered. Our survey attempts to chart a path for a more detailed study on the meaning of “humanness” in the future. (shrink)

Vivacity, the “liveliness” of perceptions, is central to Hume’s epistemology. Hume equated belief with vivid ideas. Vivacity is a conscious quality so believable ideas are felt to be lively. Hume’s empiricism revolves around a phenomenological, inner epistemology. Through copying, Hume bases vivacity in impressions. Sensory vivacity also concerns liveliness or patterns of change. Through learnt skillful use, it tracks change specific to intentional sense-perceptual experience, Hume’s “coherent and constant” complex impressions. Copying, in turn, communicates the conscious skill of vivacity to (...) ideas where it becomes an indicator of believable ideas. Hume’s copying concerns then the causation of conscious skills required for the identification of empirically warranted structures. Copying allows Hume to combine a radically externalist empiricism with a portable phenomenological inner epistemology. (shrink)

Contrary to intuitions that human beings are free to think and act with “buck-stopping” freedom, philosophers since Holbach and Hume have argued that universal causation makes free will nonsensical. Contemporary neuroscience has strengthened their case and begun to reveal subtle and counterintuitive mechanisms in the processes of conscious agency. Although some fear that determinism undermines moral responsibility, the opposite is true: free will, if it existed, would undermine coherent systems of justice. Moreover, deterministic views of human choice clarify the conditions (...) in which we ought to protect people from themselves, for example when they cannot give informed consent to medical procedures. Some of the most unresolved questions in this domain are just now emerging; they include robot ethics and the responsibilities of groups. We propose a philosophical and scientific research program to apply complex systems science to these problems. (shrink)

The effects of colonisation including racism continue to impact negatively on Aboriginal health outcomes, despite being under‐recognised and under‐reported. Many Aboriginal people (...) find hospitals unwelcoming and are reluctant to attend for diagnosis and treatment, particularly with few Aboriginal health professionals employed on these facilities. In this paper, scientific literature and reports on Aboriginal health‐care, methodology and cross‐cultural education are reviewed to inform a collaborative model of hospital‐based organisational change. The paper proposes a collaborative model of care to improve health service delivery by building capacity in Aboriginal and non‐Aboriginal personnel by recruiting more Aboriginal health professionals, increasing knowledge and skills to establish good relationships between non‐Aboriginal care providers and Aboriginal patients and their families, delivering quality care that is respectful of culture and improving Aboriginal health outcomes. A key element of model design, implementation and evaluation is critical reflection on barriers and facilitators to providing respectful and culturally safe quality care at systemic, interpersonal and patient/family‐centred levels. Nurses are central to addressing the current state of inequity and are pivotal change agents within the proposed model. (shrink)

Previous experiences with the Viable Systems Model (VSM) and Team Syntegrity (TS) illustrate ways of enabling social networks to create a shared language, reach democratic agreements, and develop knowledge networks.

The article argues that the work of literary theorist Mikhail M. Bakhtin presents a starting point for thinking about the instrumentalization of climate change. Bakhtin’s conceptualization of human–world relationships, encapsulated in the concept of ‘cosmic terror’, places a strong focus on our perception of the ‘inhuman’. Suggesting a link between the perceived alienness and instability of the world and in the exploitation of the resulting fear of change by political and religious forces, Bakhtin asserts that the latter can only be (...) resisted if our desire for a false stability in the world is overcome. The key to this overcoming of fear, for him, lies in recognizing and confronting the worldly relations of the human body. This consciousness represents the beginning of one’s ‘deautomatization’ from following established patterns of reactions to predicted or real changes. In the vein of several theorists and artists of his time who explored similar ‘deautomatization’ strategies – examples include Shklovsky’s ‘ ostranenie’, Brecht’s ‘ Verfremdung’, Artaud’s emotional ‘cruelty’ and Bataille’s ‘base materialism’ – Bakhtin proposes a more playful and widely accessible experimentation to deconstruct our ‘habitual picture of the world’. Experimentation is envisioned to take place across the material and the textual to increase possibilities for action. Through engaging with Bakhtin’s ideas, this article seeks to draw attention to relations between the imagination of the world and political agency, and the need to include these relations in our own experiments with creating climate change awareness. Nosso intuito neste texto é elaborar uma reflexão que possa mostrar como o enigma configurado pela proximidade do outro, do diferente, pode perturbar e afetar ambientes organizacionais frequentemente hierarquizados e desiguais. A partir de estudo de caso do programa de Trainee exclusivo para pessoas negras colocado em prática pelo Magazine Luiza, investigamos como as ações de Luiza Trajano demonstram uma tensão entre a escuta do Rosto (Lévinas, Han, Ribeiro) e a reprodução de estratégias e ideologias neoliberais. De um lado, o (...) eu-corpo da liderança feminina se constitui como uma “existência para outrem”, assumindo responsabilidade ética. De outro, a presença de 19 pessoas negras na empresa, aproxima corporeidades que são tensionadas na disputa por um lugar de destaque em uma empresa assentada no capitalismo neoliberal. Argumentamos que é justamente esse conflito que interpelar as organizações a questionarem as lógicas de dominação, apagamento e morte que perpetuam a agonia do eros. (shrink)

The Centers for Disease Control and Prevention’s goal is to develop a surveillance system of public health laws that would both support research and analysis among policymakers and legislators, and support the scientific basis for public health law. This session was convened, in part, to discuss the value of creating an electronic system to track public health legal information. Public health surveillance is the “ongoing, systematic collection, analysis, interpretation, and dissemination of data regarding a health-related event for use in public (...) health action to reduce morbidity and mortality and to improve health. Data disseminated by a public health surveillance system can be used for immediate public health action, program planning and evaluation, and formulating research hypotheses.” There is currently no system available that meets the goals of this definition of “surveillance” for public health laws. Indaga le analogie tra lo sviluppo del cervello nei bambini affetti da disturbi dello spettro affettivo e relazionale (autismo) e le rappresentazioni iconografiche degli uomini primitivi, dal paleolitico al neolitico. Un’ampia sezione descrive dinamiche cerebrali dovute ai cosiddetti neuroni specchio e di come questi influiscono sull’espressione e la fruizione dell’opera d’arte, analizzando le produzioni di due degli artisti contemporanei più famosi: Damien Hirst e Jeff Koons, collegati da una complementarità culturale ancestrale, quella tra eros e thanatos, che affonda le radici nell’arte funeraria etrusca. Il testo continua con l’analisi neuroestetica della visione e i suoi effetti sull’organismo umano, seguendo l’evoluzione che ha subito il punto di visuale. Dal basso verso l’alto nel barocco, dal basso a “volo d’uccello” nell’arte futurista e dall’alto verso il basso nella produzione pittorica dell’archistar anglo-irachena Zaha Hadid. Lo stesso punto di vista che fugge i confini della rappresentazione pittorica, fino ad abbandonare totalmente i confini del corpo e le dinamiche cerebrali nell’arte riferita al metaumanesimo e transumanesimo. Contemporary Cosmopolitanism is the first, much-needed, introduction to contemporary political cosmopolitanism. Although it has its roots in classical philosophy and politics, Cosmopolitanism has undergone a major revival in the last forty years, stirring far-reaching and intense international debates.Cosmopolitanism is a way of thought and life which entails an identification of the individual with the whole humankind, and implies a moral obligation to promote social and political justice at the global level.
