Methodology: Literature Review and medico-legal commentary. Results: Fatal one-punch assaults have been reported extensively in the media. This article provides a commentary on recent policy developments and legislative amendments in Australia regarding so called ‘one-punch’ assaults. Comparisons are made with the situation in other jurisdictions including the UK, US, and Europe. The clinical forensic medical aspect of fist strikes to the head and face is examined in the context of the recent media attention and public interest these cases have attracted. (...) The increased recognition of the risk of harm and death inherent in these types of assaultive behavior is reflected in the policy and legislative changes that have taken place in some jurisdictions. Conclusion: One punch strikes may result in a range of injuries that can include permanent neurological impairment and death. Recent media and community concern regarding these cases and the need for stronger deterrence has resulted in a change in public policy and consequent legislative amendments. (shrink)

This paper challenges historians’ portrayal of Elizabethan puritanism as rooted in the Marian exile of 1553-1558, through a fresh examination of three exiles who have been described as early puritans: James Pilkington, John Jewel, and Laurence Humphrey. By studying the value they placed on church unity, this paper brings out the fundamental differences between the early reformers and the later puritans. It also demonstrates that the religious selfidentity of these men pre-dated the accession of Mary. Thus, their exile was a (...) means of strengthening their faith, not finding it, and their return meant that there was more continuity between the Edwardian and Elizabethan churches than is often allowed in current scholarship. Little has been studied on the relationship between affect and school problems related with attendance. This study aims to identify different affective profiles and to determine whether these profiles differ from each other based on the four functional conditions of school refusal behavior. Participants comprised 1,816 Spanish adolescents aged 15–18 years. The Positive and Negative Affect Schedule for Children-Short Form and the School Refusal Assessment Scale-Revised for Children were administered. Latent profile analysis revealed five affective profiles: low affective profile, self-fulfilling (...) profile, low positive affect profile, self-destructive profile, and high affective profile. The self-destructive profile revealed the highest average scores in the first three factors of the SRAS-R-C, whereas the high affective profile reached the highest average score in the fourth factor. On the contrary, the self-fulfilling profile obtained the lowest average scores in the first two factors of the SRAS-R-C, whereas the low affective profile revealed the lowest average scores in the last two factors. Findings suggest the relevance of developing more adaptative affective profiles, such as the self-fulfilling profile, which would contribute to diminishing school attendance problems. (shrink)

Over the past few decades, the dominant approach to explaining intentionality has been a naturalistic approach, one appealing only to non-mental ingredients condoned by the natural sciences. Karen Neander’s A Mark of the Mental (2017) is the latest installment in the naturalist project, proposing a detailed and systematic theory of intentionality that combines aspects of several naturalistic approaches, invoking causal relations, teleological functions, and relations of second-order similarity. In this paper, we consider the case of perceptual representations of colors, which (...) is a challenging case for Neander’s theory. This case will brings out a general methodological concern with Neander’s and other naturalistic theories: these theories generally rest on the assumption that the mental intentionality we are acquainted with in everyday life—the phenomenon exhibited by desires for cups of coffee, perceptual experiences of dogs playing in yards, and thoughts about the weather—is the very same kind of phenomenon that cognitive science studies under labels such as “mental representation” and, in some cases, “information processing.” This assumption is dubious, as the case of Neander’s theory illustrates. This paper presents a framework for the design of human-centric identity management systems. Whilst many identity systems over the past few years have been labelled as _human-centred,_ we argue that the term has been appropriated by technologists to claim moral superiority of their products, and by system owners who confuse administrative convenience with benefits for users. The framework for human-centred identity presented here identifies a set of design properties that can impact the lived experience of the individuals whose identity is (...) being managed. These properties were identified through an analysis of public response to 15 historic national identity systems. They capture the practical design aspects of an identity system, from structural aspects that affect the flow of information - _Control Points, Subject Engagement, Identity Exposure, Population Coverage_—to the metrical aspects that considers how information is used and perceived—_Expert Interpretation, Population Comprehension, Information Accuracy, Information Stability, Subject Coupling, Information Polymorphism_. Any identity system can be described in terms of these fundamental properties, which affect individuals’ lived experience, and therefore help to determine the acceptance or rejection of such systems. We first apply each individual property within the context of two national identity systems—the UK DNA Database and the Austrian Citizen Card, and then also demonstrate the applicability of the framework within the contexts of two non-government identity platforms—Facebook and Phorm. Practitioners and researchers would make use of this framework by analysing an identity system in terms of the various properties, and the interactions between these properties within the context of use, thus allowing for the development of the potential impacts that the system has on the lived experience. Growing ties to private industry have prompted many to question the impartiality of academic bioethicists who receive financial support from for-profit corporations in exchange for ethics-related services and research. To the extent that corporate sponsors may view bioethics as little more than a way to strengthen public relations or avoid potential controversy, close ties to industry may pose serious threats to professional independence. New sources of support from private industry may also divert bioethicists from pursuing topics of greater social importance, (...) such as the needs of medically underserved communities. To inform ongoing debates about the financing of bioethics and its transparency to those concerned about potential sources of bias, we examined funding disclosures appearing in original research reports in major bioethics journals. Reviewing research published over a 15-year period, we found little evidence that for-profit corporations are influencing bioethics research directly. Instead, we found evidence that a great number of organizations, both public and private, support bioethics research. These findings suggest that worries about the cooption of bioethics research by a few interested stakeholders are greatly overstated and undersupported by available data. (shrink)

Recent ideological positioning on the world stage has born a startling resemblance to a form of positioning within nursing theory – that of taking complex ideas, reducing them to a simplistic binary form, and uncritically adopting one half of that form. In some cases, this adoption of a binary position has led to a passionately held form of ‘othering’ that prohibits a healthy and critical engagement with ideas. As alluring as settling for the binary form may be – we argue (...) for holding binaries in tension as a catalyst for stimulating dialogue – reasoning and exploration of new ways of wrestling with the social and moral complexity of nursing. We previously reported a high level of information on the Austrian organ donation law in medical and non-medical students, patients and ICU nurses, whereby ICU nurses at University Hospital in Graz (n = 185) were very well informed and also had the most critical view of the Austrian organ donation law.

Advance directives, a set of written instructions that a person gives that specify what actions should be taken for their health if they are no longer able to make decisions due to illness or incapacity, are a well-implemented tool in America, but few European countries have specific provisions about them in the law. Significant differences exist regarding the way advance directives are regulated and implemented between countries. The authors analyze the attitudes of several professional categories in Romania and Lithuania towards (...) the advance directive using data obtained by conducting several interviews in Lithuania and a focus group in Romania. Both Romania and Lithuania are post-communist, now European Union member countries. All respondents thought that advance directives should be introduced in the law, but their social acceptance is expected to be low in Lithuania. (shrink)

Subset Spaces were introduced by L. Moss and R. Parikh in [8]. These spaces model the reasoning about knowledge of changing states.In [2] a kind of subset space called intersection space was considered and the question about the existence of a set of axioms that is complete for the logic of intersection spaces was addressed. In [9] the first author introduced the class of directed spaces and proved that any set of axioms for directed frames also characterizes intersection spaces.We give (...) here a complete axiomatization for directed spaces. Increasing the willingness to reduce animal product consumption has the potential to contribute to ameliorating the impact of animal agriculture on the environment, as well as foster healthier diets and improve the lives of farmed and wild animals. Reduction of animal product consumption is a prosocial behaviour (PSB), and factors that are considered to influence it are empathy and selfishness. In this research, animal-oriented empathy examined empathy specifically for animals. Animal oriented empathy and three types of selfishness: adaptive, egoistic, and (...) pathological were measured to determine if they could predict willingness to reduce animal product consumption. PSB is also influenced by motivations and motivations can lead to willingness. The three most common motivations to reduce animal product consumption: animal welfare, the environment, and health were examined to determine whether they predict willingness. A sample of 492 Australian adults completed questionnaires via the Zoho survey platform, and the data underwent a hierarchical regression. Higher pathological selfishness predicted a greater willingness to reduce animal product consumption, as did environmental and animal welfare motivations. However, higher health motivation predicted a lower willingness to reduce animal product consumption. Interpretation of the perplexing results in relation to pathological selfishness suggested further research. The practical value of utilising environmental and animal motivations to increase willingness to reduce animal products whilst bringing attention to the health issues was also discussed. (shrink)

Fraser is one of the most important American philosophers and one of the leading figures of contemporary critical theory. From the 1980s to the present, Fraser has published on political philosophy and social theory, reflected upon feminism, justice, and capitalism, and has participated in public debates on current issues. The interview aims at retracing the main themes of her thought, underlining the persisting link which joins her understanding of political philosophy with social critique and public engagement. The interview also emphasizes (...) the developments of her thought, starting from her formation in the American New Left, the encounter with feminism and the neo-Marxist cultural critique of capitalism, and the discussion of Habermas’s thought. Also discussed is Fraser’s complex feministic theory and her post-Westphalian and three-dimensional model of global justice. Another crucial topic is the recent elaboration of an enlarged view of capitalism, based on a combination of Karl Marx and Karl Polanyi, aimed at highlighting its structural crisis tendencies: not only economic, but also ecological, political, and social. The recent debate on the crisis of liberal democracy, the emergence of populism, the Covid-19 pandemic, as well as the Ukrainian war, become an opportunity to test how a renewed critical theory of society can develop a social diagnosis of the time, without abandoning the task of a reconstruction of the emancipatory potential present in the existing social reality. Finally, Fraser recalls her link with the Italian philosophical tradition, stressing in particular her debt to Antonio Gramsci. (shrink)

It is increasingly argued that polymathy—vocational and avocational pursuits in multiple domains—is deeply associated with creativity and innovation, and that its development enables the creation of important bridges between otherwise fragmented, dispersed sets of knowledge. Nevertheless, the dominant culture in both industry and academia is still that of narrow specialization. In this paper, we argue that in the context of COVID-19 crisis, with its wicked and transdisciplinary nature, the disciplinary approach of specialization is ill-suited to solve our increasingly complex problems, (...) and that polymathic thinking can be a crucial asset in this regard. Drawing on different literature strands, we first examine the interplay between polymathy and other well-developed constructs in personality and temperament research. We then advance theoretical predictions regarding the relationship between trait polymathy and resilience in the COVID-19 crisis. After that, we discuss learnable strategies that can be used in complex, uncertain and adverse situations, which are associated with development of a more polymathic set of knowledge. Later, we discuss how it may be possible to better capitalize on the key features of polymathic thinking at the societal level. Finally, we conclude with a reflection on the adequacy of our current institutions for dealing with complex problems, and we underscore the crucial role of polymathic thinking in an increasingly complex and interrelated world. Resumen: El presente trabajo explora el estatuto del arte en la filosofía de Spinoza, en el marco de la inversión copernicana que da origen a la estética y del barroco holandés. Si bien el pensamiento spinozista se inscribe en la conversión antropológica, en donde lo bello resulta ser un efecto en el sujeto y no una cualidad de los objetos, su comprensión del arte es inasimilable a la “estética” como ámbito diferenciado y autónomo que se consolida en el siglo XVIII, (...) y más bien concibe el arte integrado a la vida y a la experiencia común -a la vez que, en cuanto praxis de origen corporal al alcance de cualquiera, presenta puntos de contacto con las vanguardias históricas del siglo XX-. Spinoza, según se propone en este texto, concibe la producción de “obras de arte” menos como un hecho estético que como una actividad corporal éticamente orientada a la vida buena.: The present work explores the status of art in the philosophy of Spinoza, within the framework of the Copernican revolution that gives rise to aesthetics and the Dutch Baroque. Although the Spinozist thought is inscribed in the anthropological conversion by virtue of which beauty turns out to be an effect on the subject and not a property of objects, its understanding of art is unassimilable to "aesthetics" as a differentiated and autonomous area that it was consolidated in the eighteenth century, and rather conceived art integrated to life and common experience -at the same time, as praxis of bodily origin within the reach of anyone, presents points of contact with the historical avant-gardes of the twentieth century-. Spinoza conceives the production of "artworks" less as an aesthetic fact than as a body activity ethically oriented to the good life. (shrink)

En el primer apartado del presente artículo busca evidenciarse la importancia del cuerpo en la práctica política a través del estudio de la antinomia vida-política, que desemboca en la configuración del Estado moderno. En este, el cuerpo individual padece sufrimiento y dolor como resultado de la lógica política de dicho contexto, cuyas estrategias se solidifican mediante las técnicas de poder denominadas anatomopolítica y biopolítica. Posteriormente, se reflexiona sobre el dolor como práctica de dominación política del gobierno neoliberal sobre la corporalidad (...) del sujeto a través de la lógica del hacer vivir dentro de lo que se concibe como el ejercicio de la normalización. Esta última se consigue a través de la vigilancia jerárquica y la sanción normalizadora, que, en oposición a Marx, Foucault no localiza en el Estado sino en la microfísica de poder. Ello permitirá concluir con la invitación a repensar la anatomopolítica como aspecto fundamental de la política y los sujetos y sujetas que la constituyen. (shrink)

This book discusses 'how' to respectfully and responsibly include pregnant women in clinical research. In sharp contrast, the existing literature predominantly focuses on the reasons 'why' the inclusion of pregnant women in clinical research is necessary - viz., to develop effective treatments for women during pregnancy, to promote fetal safety, to reduce harm to women and fetuses from suboptimal care, and to allow access to the benefits of research participation. This book supports the shift to a new default position, whereby (...) pregnant women are included in clinical research unless researchers argue convincingly for their exclusion. This shift raises many as yet unexplored ethical and policy questions about existing barriers to the equitable inclusion of pregnant women in research. This book is original in three key ways. First, it presents an unparalleled depth of analysis of the ethics of research with pregnant women, bringing together many of the key authors in this field as well as experts in research ethics and in vulnerability who have not previously applied their work to pregnant women. Second, it includes innovative theoretical work in ethics and disease specific case studies that highlight the current complexity and future challenges of research involving pregnant women. Introducción: Se presenta un análisis cualitativo del acompañamiento psicosocial a jóvenes en condiciones de vulnerabilidad desde la ecología humana durante 12 meses entre 2010 a 2011; utilizando técnicas pedagógicas evaluativas participativas. Éstas, son una alternativa para crear espacios reflexivos con el propósito de potenciar la resiliencia en las relaciones comunicativas y formar en el respeto. Objetivo: Generar bienestar, prevenir la farmacodependencia y contribuir a la promoción de la salud. Material y Métodos: Se revisaron los antecedentes temáticos, fueron seleccionados 100 estudiantes (...) entre 11 y 19 años de dos instituciones educativas públicas en condiciones vulnerables;se desarrollaron cuatro talleres reflexivos y cuatro prácticas lúdicas y se realizaron tres grupos focales con estudiantes, profesores y padres de familia. Resultados y Discusión: El contexto social de la población intervenida, revela problemas de abuso sexual, violencia intrafamiliar y eventos violentos en el vecindario por grupos armados ilegales, entre otros, que constituyen factores de riesgo importantes para la farmacodependencia. Conclusión: Se infiere que lo psicosocial incide en la farmacodependencia, afectando la convivencia de la población estudiada por múltiples causas del orden psicoafectivo, sociocultural, económico y político que van desde el consumo cultural hasta la seguridad alimentaria. Introduction: A qualitative analysis of the psycho-social support to young people in situations of vulnerability from human ecology is presented for 12 months between 2010 to 2011; using participatory evaluative pedagogical techniques. These are an alternative to create reflective spaces with the purpose of enhancing resilience in communicative relationships and working in respect. Objective: to generate well-being, prevent drug abuse and contribute to the health promotion. Material aids and methods: the thematic background was reviewed, 100 students between 11 and 19 years of two public schools in vulnerable conditionswere selected; four reflective workshops and four playful practices were developed and three focus groups with students, teachers and parentswere conducted. Results and discussion: the social context of the manipulated population reveals sexual abuse problems, domestic violence and violent events in the neighborhood by illegal armed groups, among others, which constitutemajor risk factors for drug abuse. Conclusion: It can be inferred that the psychosocial factors impact on drug dependence, affecting the coexistence of the population studied by multiple causes of the psychological, socio-cultural, economic and political order, ranging from cultural consumption to food security. In this chapter, it is argued that some animal shelters fulfill the conditions that make triage protocols necessary, namely, the operation with limited financial budgets, space, medical resources, and staff. It is suggested that requirements presented for triage in humans can be fruitfully applied to the context of animal shelters. The focus lies on the criteria of maximizing benefit, justice, medical criteria, life-span considerations, fair decision-making, patient will, re-evaluation of triage decisions and changes in the therapeutic goal, and burden of (...) triage and staff support. The establishment of triage protocols for shelters will make the decision-making process less arbitrary, fairer, and more transparent. Furthermore, it is argued that, in situations where disagreement persist among shelter staff, an external Ethics Board could be called in to help analyze and potentially resolve some of the remaining ethical issues. This paper describes the content and evolution of a fourth-year course for medical students on teaching pathographies of mental illness. (It is a follow-up to Nathan Carlin’s Pathographies of Mental Illness that appeared as an Element in the Bioethics and Neuroethics series published by Cambridge University Press.) The course originally centered on classic (and some contemporary) memoirs; however, responding to student evaluations, newer material now ensures more diversity, with material written by women and people of color, and describes the difference (...) that can make. In Brentano’s Philosophical System: Mind, Being, Value, Uriah Kriegel argues that Brentano’s work forms a “live philosophical program” (p. 14, italics omitted) that contemporary philosophy has much to learn from and that is promising and largely correct. To this end, Kriegel argues that Brentano’s notion of consciousness is the contemporary notion of phenomenal consciousness, that Brentano’s rejection of unconscious mentality is a grave mistake that can be fairly neatly excised from his overall view, and that Brentano’s notion of intentionality is (...) the contemporary notion of phenomenal intentionality. This paper raises some doubts about these claims, suggesting that Brentano’s notion of consciousness might more closely align with the contemporary notion of transitive consciousness than with that of phenomenal consciousness, that Brentano’s rejection of unconscious mentality cannot be so easily excised from his overall view but that it is not such a grave mistake, and that Brentano’s notion of intentionality may not be that of phenomenal intentionality but rather that of generic abountness. I wrap up by considering the extent to which we might agree with Kriegel that Brentano’s work forms a live philosophical program that contemporary philosophy has much to learn from. (shrink)

This article examines some central issues in the study of gender in film, including the link between filmic conventions and social ideology; gender and the viewer's emotional response to film; and challenges by cognitivist philosophers of film to the claim that movies effect the viewer through mobilizing unconscious responses.

En este trabajo se analiza la idea de justicia como principio inspirador de buen gobierno y, de cómo ha evolucionado. La estrecha relación actual entre orden y justicia, ha supuesto la aparición de un paradigma democrático que tiene más que ver con las ideas de estabilidad y seguridad que con la idea de justicia. Tal circunstancia ha desembocado en una utopía normativa en la que orden y justicia, libertad y seguridad, se oponen entre sí en detrimento de la pluralidad política (...) y de los espacios participativos.
