Resumen: A fines del siglo XV convergen múltiples experiencias de orden global que contribuyeron a producir una imagen de mundo específica tradicionalmente asociada al recorrido complejo de la modernidad. En este espacio de convergencias global y diferenciado, la Addizione Erculea de 1492 cumple ella misma una función de expresión de conflicto en la transformación del espacio público y de la representación iconográfica del poder hasta entonces vinculado con los frescos del Pallazo Schifanoia. En este artículo analizaremos esa transferencia, sus continuidades (...) y discontinuidades, poniendo especial énfasis en la historia urbana como diálogo con las tensiones entre las nociones teológicas de civitas dei, civitas deorum y città que surgen con su propia conflictividad en la tendencia a la producción de un espacio abstracto de administración del poder en la modernidad. ABSTRACT In the following pages we will address the internal and external dimensions of the Hegelian conceptualization of political economy in the analytical context of the Rechstphilosophie of 1820. We will understand by internal dimensions the moments proper to the Hegelian argument in its logical coherence and consistency and, by external dimensions, the validity and representativeness of that same argument in relation to the problems of political economy in the late eighteenth and early nineteenth centuries. To this end, we will (...) focus especially on the relationship between capitalism and mercantilism in its physiocratic and cameralist forms in order to establish the logical and historical horizon of the Hegelian exposition. Finally, on the basis of this relationship and its conceptualization, we will summarily address the limits of the meaning of political economy as a representation of the present in Rechtsphilosophie. Contrario al imaginario político, económico y cultural europeo de fines del siglo XVIII y comienzos del siglo XIX, que vio en la Revolución haitiana un acontecimiento que directa o indirectamente repercute en las transformación geopolítica global, en los discursos abolicionistas y en la flujos comerciales a través del Atlántico, Hegel parece (...) en principio desatender la especificidad del proceso, aunque, como sostenemos en este contexto, es posible rastrear los motivos de una exclusión deliberada que responder a una ideas precisas de libertad y terror que anteceden, y por tanto determinan, el lugar de la Revolución haitiana en la historia mundial. In this work we’ll present a part of the debates that configured la indirect reception of the Hegelian philosophy through the second quarter of the XIX century. For this we’ll briefly describe the experience and path of the Verein in charge of the first edition of Hegel’s works; the, we’ll analyze the disputes over the hypothetical Hegelian republicanism; and, finally, we’ll focus on the interpretation that the Young Hegelians made of that same debate in the context of Schelling’s arrival at (...) Berlin. En este trabajo presentaremos una parte de los debates que configuraron la recepción indirecta de la filosofía hegeliana durante el segundo cuarto del siglo XIX. Para ello describiremos brevemente la experiencia y recorrido de la Verein a cargo de la primera edición de las obras de Hegel, luego, analizaremos las disputas en torno al hipotético republicanismo hegeliano y, finalmente, nos enfocaremos en la interpretación que los jóvenes hegelianos realizaron de esa misma disputa en el contexto de la llegada de Schelling a Berlín. En este artículo abordaremos el problema de la relación entre el Estado y el capital como una disputa abierta en la modernidad entre la política y la economía. Desde la perspectiva de la filosofía hegeliana de la historia y el derecho, analizaremos la manera en la que la economía tiende en su proceso estructural de expansión espacial global a subsumir y subordinar las funciones administrativas y jurídicas de las formas estatales previas al ciclo sistémico inglés de acumulación capitalista. En este artículo abordo el problema del contexto político, ideológico y filosófico como trasfondo de las referencias lingüísticas de Karl Marx a la filosofía hegeliana, especialmente en virtud del célebre epílogo a la segunda edición alemana de El capital. Lo que sostengo es que, además de la ya compleja relación lógica entre la filosofía hegeliana y la crítica marxiana de la economía política, las referencias a Hegel en la narrativa marxiana refieren también a una dimensión simbólica propia de las disputas (...) previas y posteriores al Vormärz, en las que se cruzan los conflictos teológicos y políticos como horizonte de afirmación o negación de la realidad social de la época. En este artículo se aborda la relación entre la demolición y el embellecimiento de París durante el siglo xix desde diferentes perspectivas literarias y filosóficas que permitan situar en diferentes contextos narrativos la interpretación de la ciudad como un espacio metropolitano signado por la autopercepción como capitale du xixe siècle. Desde los primeros planos trigonométricos hasta la noción de transformación, la imagen de la ciudad como un espacio privilegiado y representativo de la transformación del presente aparece con diferentes matices en (...) las obras de Voltaire, Verne, Hugo y Baudelaire, no solamente como una dimensión expresiva común, sino también como un espacio de conflicto de posición política, estética e ideológica. Chat Generative Pre-Trained Transformer (ChatGPT) has been a growing point of interest in medical education yet has not been assessed in the field of bioethics. This study evaluated the accuracy of ChatGPT-3.5 (April 2023 version) in answering text-based, multiple choice bioethics questions at the level of US third-year and fourth-year medical students. A total of 114 bioethical questions were identified from the widely utilised question banks UWorld and AMBOSS. Accuracy, bioethical categories, difficulty levels, specialty data, error analysis and character count (...) were analysed. We found that ChatGPT had an accuracy of 59.6%, with greater accuracy in topics surrounding death and patient–physician relationships and performed poorly on questions pertaining to informed consent. Of all the specialties, it performed best in paediatrics. Yet, certain specialties and bioethical categories were under-represented. Among the errors made, it tended towards content errors and application errors. There were no significant associations between character count and accuracy. Nevertheless, this investigation contributes to the ongoing dialogue on artificial intelligence’s (AI) role in healthcare and medical education, advocating for further research to fully understand AI systems’ capabilities and constraints in the nuanced field of medical bioethics. We study probabilistic logic under the viewpoint of the coherence principle of de Finetti. In detail, we explore how probabilistic reasoning under coherence is related to model- theoretic probabilistic reasoning and to default reasoning in System . In particular, we show that the notions of g-coherence and of g-coherent entailment can be expressed by combining notions in model-theoretic probabilistic logic with concepts from default reasoning. Moreover, we show that probabilistic reasoning under coherence is a generalization of default reasoning in System (...) . That is, we provide a new probabilistic semantics for System , which neither uses infinitesimal probabilities nor atomic bound (or big-stepped) probabilities. These results also provide new algorithms for probabilistic reasoning under coherence and for default reasoning in System , and they give new insight into default reasoning with conditional objects. In the tradition of justified true belief theory, I provide an epistemic responsibility-based philosophical analysis of collective knowledge which is both coherentist and reliabilist.

The presence of fetal cells has been associated with both positive and negative effects on maternal health. These paradoxical effects may be due to the fact that maternal and offspring fitness interests are aligned in certain domains and conflicting in others, which may have led to the evolution of fetal microchimeric phenotypes that can manipulate maternal tissues. We use cooperation and conflict theory to generate testable predictions about domains in which fetal microchimerism may enhance maternal health and those in which (...) it may be detrimental. This framework suggests that fetal cells may function both to contribute to maternal somatic maintenance (e.g. wound healing) and to manipulate maternal physiology to enhance resource transmission to offspring (e.g. enhancing milk production). In this review, we use an evolutionary framework to make testable predictions about the role of fetal microchimerism in lactation, thyroid function, autoimmune disease, cancer and maternal emotional, and psychological health.Also watch the Video Abstract. This paper challenges Professor Myles Brand’s position on the role and value of intercollegiate athletics in U.S. colleges and universities on the ground that it fails to account for considerations of deep fiscal responsibility. It presents both a philosophical and ethical criticism of his position that broadens the discussion beyond athletics to include a particular kind of higher educational institution more generally.

The intention is to understand how Olympia was responsible for the origin and dissemination of Olympian Zeus´cult through the Greek world. In some recent articles, Dr. Leigh Turner [Doffing the Mask: Why Manuscript Reviewers Ought to Be Identifiable,” Journal of Academic Ethics, 1 (2003), pp. 41–48; “Promoting F.A.I.T.H. in Peer Review: Five Core Attributes in Effective Peer Review,” Journal of Academic Ethics, 1 (2003), pp. 181–188.] makes some rather critical observations regarding the processes of peer-review in academic journals. I shall note them in turn, note wherein I concur and wherein I disagree, and discuss some of Turner's suggestions to resolve such (...) difficulties. It is hoped that my comments on Turner's much-appreciated points will engage readers of this august and well-edited journal to take more seriously Turner's arguments for the sake of the betterment of academic research. This paper investigates philosophically the question of whether or not college and university athletes in the USA are doing something morally wrong should they terminate their college or university experience prior to graduation and enter the professional athletic ranks. Various moral arguments are brought to bear in order to attempt to shed light on this issue. One reason why such athletes ?turn professional? before they graduate is the perceived economic exploitation they experience as essentially underpaid workers earning much revenue for (...) their respective institutions. But who is exploiting whom here? Is it just student athletes who are exploited by the system? I expand the reasoning about the exploitation of intercollegiate athletics to include not just student athletes, but their supporting colleges and universities. In the end, it is proposed that the National Collegiate Athletic Association and similar academically related athletic agencies should permit and encourage each of their constituent institutions as a matter of policy to protect themselves (and their supporting taxpayers, in the cases of public institutions) contractually from economic exploitation by professional sports franchises. Thus the question of student athletes leaving college for professional sports contracts has hidden beneath it questions of private professional sports franchises? exploitation of the institutions with which such student athletes are affiliated. About 35 years ago Wheeler introduced the motto “law without law” to highlight the possibility that Physics may be understood only following regularity principles and few relevant facts, rather than relying on a treatment in terms of fundamental theories. Such a proposal can be seen as part of a more general attempt summarized by the slogan “it from bit”, which privileges the information as the basic ingredient. Apparently it seems that it is possible to obtain, without the use of physical (...) laws, some important results in an easy way, for instance, the probability distribution of the canonical ensemble. In this paper we will present a general discussion on those ideas of Wheeler’s that originated the motto “law without law”. In particular we will show how the claimed simplicity is only apparent and it is rather easy to produce wrong results. We will show that it is possible to obtain some of the results treated by Wheeler in the realm of the statistical mechanics, using precise assumptions and nontrivial results of probability theory, mainly concerning ergodicity and limit theorems. This article is a critical philosophical assessment of John Searle’s theory of human rights as it is articulated both in his earlier book, The Construction of Social Reality and especially in his more recent book, Making the Social World.

I set forth and defend an analysis of corporate moral responsibility (retrospective moral liability), which, I argue, ought to serve as the foundation for corporate legal responsibility, punishment, and compensation for environmental damage caused by corporations.

Conhecido como Debate Hart-Dworkin, o entrechoque de opiniões entre esses dois autores gerou intensa discussão acerca do positivismo jurídico e das teorias que buscam refutar suas teses fundamentais. Neste contexto, Ronald Dworkin se empenha em repreender a doutrina positivista demonstrando que as noções elementares dessa teoria não são capazes de produzir uma doutrina eficaz sobre a natureza do direito. No presente artigo, pretendo analisar as críticas lançadas por Dworkin ao positivismo jurídico e às conceituações de Herbert Hart, com específica atenção (...) para o conceito de discricionariedade que Dworkin imputa ao positivismo. A partir de uma discussão teórica envolvendo as principais obras desses autores, procuro confirmar a hipótese de que a teoria positivista moderna não está comprometida com o sentido atribuído por Dworkin à noção de discricionariedade, prejudicando assim o fundamento da crítica de Dworkin acerca da interpretação no positivismo jurídico. Ao final, irei considerar também a gravidade desta vicissitude para a teoria dworkiniana como um todo, avaliando se as críticas de Dworkin restam comprometidas ou resistem a este empecilho. (shrink)

On the 3rd of March 380, Theodosius, moved by the qualitas (pro reverentia religionis) of the pre-paschal period, a special time of preparation for Easter,mandates the suspension during Christian Lent of all penal trials which normally resulted in torture (Cod. Theod. 9,35,4 = Cod. Iust. 3,12,5). Lent is a specifically Christian time which developed to a large degree in the course of the fourth century, but which varied in duration and organization in the various churches. The law adapts the judicial (...) calendar for the administration of justice to the rhythms of Christian liturgy. Theodosius in 389 (Cod. Theod. 9,35,5; 9,35,7) decrees that during Lent supplicia corporis could not take place, due to the sacredness of those days intended as a salutary penance which culminates in Easter reconciliation. Since the duration of Lent varied within the various churches, civil authorities of the provinces were to be informed by local Christians of the beginning and end of Lent. (shrink)

Esse processo teve início na juventude desse filósofo em seus cursos e que culminou na elaboração de seu procedimento fenomenológico conhecido como os indícios formais. A intenção desse artigo é encontrar elementos que elucidem a gênese desse processo que se encontra, em especial, no curso proferido em 1919, entre outros. Além disso, intenta-se perceber o inevitável desembocar dessa abordagem para uma das questões (...) centrais do pensamento do jovem filósofo, que é a questão do tempo. (shrink)

A educação do homem interior: O cultivo da vontade em Agostinho de Hipona Resumo: O estudo aqui apresentado tem como objetivo principal a investigação da formação humana nas obras filosóficas Comentários Literal ao Gênesis, A Trindade e O livre-arbítrio, de Agostinho de Hipona. Para isso, aborda-se a noção da antropologia do referido autor; a sua compreensão de corpo e alma (dimensão humana no homem animal) e, por último, objetiva-se explicitar alguns pressupostos de uma educação do ser humano orientada a uma (...) boa formação da vontade. Trata-se de uma pesquisa bibliográfica, exploratória e de caráter hermenêutico. Agostinho concebe a ideia de homem como um ser dotado de corpo e alma. A alma, quando bem formada, pode conduzir os indivíduos à vida com sabedoria e, portanto, a uma beata vita. A vontade é o que movimenta toda as outras dimensões do ser humano e, por isso, ela deve ser bem formada. A educação da vontade, para o pensador, consiste em realizar o jogo de utilizar os objetos que servem de meio para algo e fruir ou contemplar aquilo que é fim em si mesmo. A vontade humana difere do que se passa no reino animal e é capaz de guiar bem o homem, concedendo-lhe minimamente uma relação de desprendimento com a matéria. Conclui-se, a partir dessas linhas mestras do pensamento do autor, que a ética agostiniana ao mesmo tempo que estabelece princípios para o bem agir e lograr uma vida feliz, exige, para isso, um processo formativo que consiste na educação da vontade, uma vez que Agostinho compreende-a como livre em si, isto é, como autodeterminante, ela pode voltar-se por si àquilo que é presença constante, isto é, a objetos de foro contemplativo e afastar-se, tanto quanto possível, dos ditames de uma vida submetida ao mundo material. Es una investigación bibliográfica, exploratoria y de carácter hermenéutico. Agostinho concibe la idea de hombre como un ser dotado de cuerpo y alma. La voluntad es lo que conduce todas las otras dimensiones del ser humano y, de esta manera, ella debe de ser bien formada. La voluntad humana es distinta de lo que se pasa en el reino animal y es capaz de guiar bien el hombre, le permitiendo mínimamente una relación de desprendimiento con la materia. Se concluye, desde esas líneas maestras del pensamiento del autor, que la ética agostiniana al tiempo que establece principios para el bien actuar y lograr una vida feliz, exige, para eso, un proceso formativo que consiste en la educación de la voluntad, una vez que Agostinho la comprende como libre en sí, es decir, como auto determinante, ella puede volverse a lo que es presencia constante, o sea, volverse a objetos de foro contemplativo y aislarse, tanto como sea posible, de los dictados de una vida sometida al mundo material. The education of the inner-man: The cultivation of will in Augustine of Hippo Abstract: This study is aimed at investigating human formation in the philosophical works On the literal meaning of Genesis, On the Trinity and On free choice of the will, by Augustine of Hippo. To meet that aim, the author’s notion of anthropology is addressed; his understanding of body and soul (human dimension in the human animal) and, finally, we explain some assumptions related to the education of the human being as leading to the good formation of will. This is a bibliographical, exploratory and hermeneutical study. Augustine conceives the idea of man as a being with body and soul. The soul, when well formed, can lead individuals to life with wisdom and, therefore, to a beata vita. Will moves all the other dimensions of the human being and, thus, it must be well formed. For Augustine, the education of the will consists of performing the game of using objects that work as means for something and enjoy or contemplate what is an end in itself. Human will differs from that of the animal kingdom and is capable of guiding man well, granting him a minimal relation of detachment from the material. The conclusion, based on such guidelines from Augustine’s thought, is that Augustinian ethics establishes principles for acting well and reaching a happy life and, at the same time, demands, for those aims, a formative process that consists of the education of the will, as Augustine understands it as free in itself, i.e., as self-determining, for it can turn by itself to what is a constant presence, i.e., to objects of contemplative scope and move away, as far as possible, from the dictates of a life submitted to the material world. El orden geométrico consiste en partir de definiciones y axiomas evidentes por sí mismos. El paralelismo entre ambos órdenes en el sistema de Spinoza, el ordo cognoscendi y el ordo essendi, hace posible postular la intensidad total de lo real, implicando necesariamente una semejanza entre el entendimiento finito, en cuanto productor del primer orden, y el entendimiento infinito, en cuanto productor del segundo orden, ausente en el cartesianismo. Martial Gueroult afirma el método como geométrico en Descartes porque obedece estrictamente a (...) la regla que asegura a la Geometría todo su rigor; mientras que en Spinoza lo es porque, como Geometría, construye los conceptos de los objetos.
