On March, 24, 2020, 818 cases of COVID-19 had been reported in New South Wales, Australia, and new cases were increasing at an exponential rate. In anticipation of resource constraints arising in clinical settings as a result of the COVID-19 pandemic, a working party of ten ethicists was convened at the University of Sydney to draft an ethics framework to support resource allocation decisions. The framework guides decision-makers using a question-and-answer format, in language that avoids philosophical and medical technicality. The (...) working party met five times over the following week and then submitted a draft Framework for consideration by two groups of intensivists and one group of academic ethicists. It was also presented to a panel on a national current affairs programme. The Framework was then revised on the basis of feedback from these sources and made publicly available online on April 3, ten days after the initial meeting. The framework is published here in full to stimulate ongoing discussion about rapid development of user-friendly clinical ethics resources in ongoing and future pandemics. (shrink)

The paper by Mand et al raises important questions about the predictive genetic testing of children. They focus on those claims made by professionals that are open to empirical enquiry and give too little weight to those claims that do not require empirical support. The authors remind us that some commentators oppose empirical enquiry because of the concern that gathering evidence of the consequences of such testing may itself be harmful or unethical. They respond by asserting that the relevant research (...) questions are ‘eminently testable’ but fail to discuss the challenges of such research, including the questions of timescale, consent or the nature of the data whose collection (they assert) would resolve the perceived difficulties with the genetic testing of children. They conclude that empirical research is required without resolving the weighty arguments against predictive testing of young children or explaining how the evidence they wish to collect could overcome the force of the arguments that favour caution. This paper expands on “An Ethics Framework for Making Resource Allocation Decisions within Clinical Care: Responding to COVID-19,” which is also published in this special issue of the Journal of Bioethical Inquiry. I first describe and explain the steps we took to develop this framework, drawing on previous experience and literature to explain what frameworks can and cannot do. I distinguish frameworks from other kinds of guidance and justify why our framework takes the form it does. Our key aim was (...) to help answer practical questions faced by frontline clinicians. I then explain some of the normative issues that shape the content of the framework itself. Here, I engage critically with the resource allocation literature and justify the particular positions that we take in the framework. Although we undertook this work to address resource allocation decisions anticipated during the unfolding COVID-19 pandemic, it will also serve as an example for others who wish to design practical ethics frameworks for other bioethical issues that will emerge in the future. This paper proposes a roughly Aristotelian account of powers ontology. In doing so, the paper uses the distinction found in Aristotle between four analogous senses of potency to explain causation and the existence-essence distinction in substances. On this basis, the paper offers some justification in support of the claims that powers and dispositions are the truth-makers of categorical properties and that categorical properties are ontologically dependent upon powers and dispositions.

This article briefly reviews the various papers contained in this volume. They were originally presented at a research workshop held at Keele University in the UK in February 2003. It is suggested that the different papers raise a series of related legal, social and ethical issues and can be collectively seen to demonstrate the fact that policy formation in relation to reproductive matters is highly contested. It is concluded that ethical policy formation in this area needs to be based on (...) actual evidence of harm rather than assumed harm and that this therefore entails more empirical research into reproductive matters. In these twelve papers notable ethicists use the resources of ethical theory to illuminate important theoretical and practical topics, including the nature of public health, notions of community, population bioethics, the legitimate role of law, the use of cost-effectiveness as a methodology, vaccinations, and the nature of infectious disease.

Tyler Paetkau, in his paper ‘Ladders and Stairs: how the intervention ladder focuses blame on individuals and obscures systemic failings and interventions’, adds to the growing body of academic literature raising questions about the appropriateness and usefulness of the Nuffield Council on Bioethics (NCB)’s intervention ladder (2007) as a tool for policymakers.1 2 Paetkau is critical of the intervention ladder because he holds that it focuses on individual choice and personal responsibility and pays insufficient attention to ‘systemic interventions’. He suggests (...) substituting the new metaphor of an ‘intervention stairway’ for that of the intervention ladder. I argue that his diagnosis of the problems does not go far enough and that his suggested alternative metaphor is more confusing than helpful. Paetkau’s critical analysis of the intervention ladder makes some good points. It is true that this metaphor assumes a narrow range of policy options, with a focus on changing individual behaviour, and a consequent emphasis on personal responsibility. This is the flip-side of the NCB’s focus on liberty as always being a positive value and restriction seen as intrinsically wrong. Paetkau points out that this means that much routine public health action directed at changing the more structural features that impact on health is missing from the story. I set this …. (shrink)

Where science has often been used to explore the questions raised by art, this book does the reverse, suggesting that art can address a problem raised by science: the deep challenge to ethics posed by Darwin’s discovery that we are intentional beings living in an unintentional world. Angus Fletcher is one of our finest theorists of the arts, the heir to I. A. Richards, Erich Auerbach, Northrop Frye. This, his grandest book since the groundbreaking Allegory of 1964, aims to open another field of study: how thought--the act, the experience of thinking--is represented in literature. Recognizing that the field of formal philosophy is only one demonstration of the uses of thought, Fletcher looks for the ways other languages (and their framing forms) serve the purpose of certain (...) thinking activities. What kinds of thinking accompany the writing of history? How does the gnomic sentence manage to represent some point of belief? Every time we think ahead, we are crafting a story. Every daily plan—and every political vision, social movement, scientific hypothesis, business proposal, and technological breakthrough—starts with “what if?” Linking causes to effects, considering hypotheticals and counterfactuals, asking how other people will react: these are the essence of narrative. It is shown that the theory of fields with an automorphism has a decidable model companion. Quantifier-elimination is established in a natural language. The theory is intimately connected to Ax's theory of pseudofinite fields, and analogues are obtained for most of Ax's classical results. Since Freud's earliest psychoanalytic theorisation around the beginning of the twentieth-century, the concept of the unconscious has exerted an enormous influence upon psychoanalysis and psychology, literary, critical and social theory. Proposes a new theory of communication called "comparative media theory.".

This analysis of Herbert Marcuse’s appropriation of the argument concerning the “mathematization of nature” in Edmund Husserl’s Crisis of the European Sciences and Transcendental Phenomenology shows that Marcuse and Husserl both assume that the perception of real, concrete individuals in the lifeworld underlies formal scientific abstractions and that the critique of the latter requires a return to such qualitative perception. In contrast, I argue that no such return is possible and that real, concrete individuals are constituted by the relation between (...) a given perception and its horizon. In this manner, Marcuse’s social critique can be combined with Husserl’s theoretical-perceptual one, making possible an ecological critique. L’analyse de l’appropriation que fait Herbert Marcuse de l’argument concernant la « mathématisation de la nature » dans la Crise des sciences europe ennes et la phénoménologie transcendantale de Husserl démontre que Marcuse et Husserl assument tous les deux que la perception des individus réels concrets dans le monde de la vie sous-tend les abstractions scientifiques formelles et que la critique de ces dernières nécessite un retour à la perception qualificative. BackgroundEthics consultation is recognized as an opportunity to share responsibility for difficult decisions in prenatal medicine, where moral intuitions are often unable to lead to a settled decision. It remains unclear, however, if the general standards of ethics consultation are applicable to the very particular setting of pregnancy.Main textWe sought to analyze the special nature of disagreements, conflicts and value uncertainties in prenatal medicine as well as the ways in which an ethics consultation service (ECS) could possibly respond to them (...) and illustrated our results with a case example. Ethics facilitation and conflict mediation, currently, have no broadly consented normative framework encompassing prenatal diagnosis and therapy as well as reproductive choice to draw on. Even so, they can still be helpful instruments for ethically challenging decision-making in prenatal medicine provided two additional rules are respected: For the time being, ECSs should (a) refrain from issuing content-heavy recommendations in prenatal medicine and (b) should not initiate conflict mediations that would involve the pregnant woman or couple as a conflict party.ConclusionIt seems to be vital that ethics consultants as well as health care professionals acknowledge the current limitations and pitfalls of ethics consultation in prenatal medicine and together engage in the advancement of standards for this particularly complex setting. It is argued that reliance on the testimony of others cannot be viewed as reliance on a kind of evidence. Speech being essentially voluntary, the speaker cannot see his own choice of words as evidence of their truth, and so cannot honestly offer them to others as such. Rather, in taking responsibility for the truth of what he says, the speaker offers a guarantee or assurance of its truth, and in believing him the hearer accepts this assurance. As we have now completed 15 years of journal content, it seems like a good time to take stock and reflect upon the development and nature of public health ethic.

I argue that materialism is unable to account for knowledge deriving from such abstracta as rules of inference, algorithms, and the ideals of infinity, perfection, and eternity. Both reductive and nonreductive materialism subscribe to the causal closure of the physical world, which implies that a creature’s concepts derive exclusively from the interactions of brains with the physical environment. These resources do not explain the acquisition of abstract concepts or the successful use of these concepts in gaining important knowledge about the (...) world. By contrast, if both God and souls exist, we can understand how knowledge based on abstracta is possible. (shrink)

The ontological argument from reason aims to show that deliberative reasoning cannot be located in a naturalistic ontology, because such reasoning requires a unified, enduring self with libertarian free will. The most popular way of avoiding this argument is to claim that some version of naturalistic compatibilism suffices for human reason, because even in a world of event causation, some creatures may be responsive to reason. In this paper, I argue that the best versions of this approach either smuggle in (...) nonnaturalistic commitments or else cannot distinguish between compulsive rationality merely occurring in someone’s brain from reasoning an agent does. The complexity of the real history of economic planning in practice, as well as the variety of rationales that have been offered in theory for various (more or less comprehensive) forms of planning, both suggest that political philosophy would benefit from a more nuanced and less simplistic approach to the discussion of state planning of the economy. The aim of our article is to clear some ground for a discussion of markets and democratic economic planning within normative political philosophy that (...) takes a less stark and dichotomous approach in considering the relationship between markets and state planning, and takes more account of the complexities of both the theory and historical practice of economic planning. The article considers some of the different varieties of democratic economic planning, and the rationales for different forms of imperative and indicative planning regimes, as well as other alternative planning mechanisms. In particular the article looks to bring renewed attention to the theoretical rationales for planning offered by two important theorists of the mixed economy: James Meade and Stuart Holland. We close by revisiting the powerful normative case for economic planning provided by Barbara Wootton, whose rejection of F. A. Hayek’s critique of planning, as well as her positive case for planning on grounds of freedom, democracy, and social equality, deserves to be much better known, and whose work is ripe for reintegration into contemporary normative discussions of social justice and political economy. ABSTRACT This essay is an attempt to examine the idea that a professional code of practice can entail ethical conduct. It is focused around two differing perspectives on ethics. It will be argued that the professions have, perhaps too hastily, adopted one theory without considering the merits, or the objections offered by the alternative account. This alternative, a ‘cognitivist’ theory, is sketched, and the possible advantages of such an approach are discussed. Such a perspective means adopting a radically different approach (...) to the nature of ethics and what it is to be a moral agent, and could have interesting consequences for professional practice. Even if a cognitivist account is ultimately unconvincing, it does provide a number of worrying arguments for those professionals who believe that ethical conduct is generated by following a code of practice, and these arguments need to be addressed.
