This work adopts H. Kelsen’s concept of legal system, proposes a formal definition for such notion, and introduces an operational semantical framework for legal systems that are situated in agent societies. Agent societies are defined. Relevant formal properties of situated legal systems are discussed; the way they are exposed in the operational semantical framework is explained, and their truth formally proved. Also, for the sake of a better understanding of the legal-theoretic assumptions of the paper, recurring issues regarding Kelsen’s theory (...) of law are briefly reviewed. They are put in confrontation with the points of view of R. Dworkin, H. Hart, and J. Raz, and an attempt is made to clarify them from the perspective of the provided formalization. A brief case study in agent-based modeling and simulation of public policy processes is presented, as an illustration of the way of using situated legal systems, and the proposed operational semantical framework, in a practical application. This paper presents an exercise in the formalization of political principles, by taking as its theme the concept of distributive justice that Karl Marx advanced in his Critique of the Gotha Programme. We first summarize the content of the Critique of the Gotha Programme. Next, we transcribe the core of Marx’s presentation of the concept of distributive justice. Following, we present our formalization of Marx’s conception. Then, we make use of that formal analysis to confront Marx’s principle of distributive justice (...) with John Rawls’ conception of justice as fairness, and the principles of distributive justice that derive from it. The paper introduces the concept of relativistic ontological realism, and the corresponding notion of relativistic realization of objects. The conditions that allow for the relativistic realization of objects are determined. In particular, the paper indicates the way the imposition of organizational structures on already existent objects supports the relativistic realization of new, more complex ones. A type-theoretic presentation of the principles of relativistic ontological realism is given in the language of predicate calculus, making use of the notion of typed world (...) and the condition of effectiveness in the determination of the existence of objects. Two case studies illustrating the way the notion of relativistic ontological realism supports ontological analysis are presented, both concerning the ontology of computations, more specifically, the relativistic realization of computational levels in computational systems. The first case study deals with the realization of logical circuits through structural arrangements of electrical circuits. The second, with the realization of software systems through computer programming. A conception of the mechanics of the relativistic realization of objects, taking the imposition of organizational structures on previously extant objects as its basis, is proposed and briefly analyzed. In this paper, we present a formal interpretive account of Jean Piaget’s theory of the morality that regulates social exchanges, which we call interactional morality. First, we place Piaget’s conception in the context of his epistemological and sociological works. Then, we review the core of that conception: the two types of interactional moralities that Piaget identified to be usual in social exchanges, and the role that the notion of respect-for-the-other plays in their definition. Next, we analyze the main features of (...) social exchanges that are subject to each of those two types of interactional moralities. Following, we formalize Piaget’s account of how the two types of interactional moralities can be put to regulate social exchanges in which values, norms, beliefs, and goals are exchanged, so that interactional commitments can be established among the participants. Then, we sketch a moral reasoning system able to support formal reasonings about interactional moralities. Finally, we illustrate the usefulness of the overall formal model of interactional moralities that resulted from our study by applying it to the explication of some of the conclusions achieved by Piaget in his moral studies about children games. Este artigo traz, desde uma perspectiva lógico-hegeliana, uma proposta de articulação operatória das noções de interseccionalidade e lugar de fala, com as quais, muitas vezes, se realizam análises de discursos e de situações sociais. O fundamento da proposta é a sequência de silogismos de ideias que, derivados da Lógica de Hegel, estratificam a noção de mundo em três níveis: mundo do sujeito, mundo do gênero e mundo do espírito. O artigo complementa esse fundamento introduzindo duas operações, particionamento de ideias e (...) superposição de partições de ideias, com as quais é derivado o conceito geral mundo setorial. O artigo mostra, então, como as noções de interseccionalidade e lugar de fala podem ser articuladas operatoriamente pelas três formas particulares e estratificadas desse conceito geral: mundo do sujeito setorial, mundo do gênero setorial e mundo do espírito setorial. AimTo evaluate the cognitive functioning of subjects practicing trance mediumship in Brazil.MethodThe study was based on the measurement of cognitive functions of 19 spirits mediums through neuropsychological tests such as the Brief Cognitive Screening Battery, the Verbal Fluency Test, the digit span test, the cube test, the five digit test and an evaluation of mental health through scales such as the Beck Depression Inventory, the Self-Report Questionnaire, and the Trauma History Questionnaire. The sample included the participation of spirit mediums divided (...) into two groups. The more experienced group with 11 subjects had more than 10 years of mediumistic practice, while the other less experienced group with 8 subjects had 1–5 years of experience. The inclusion criteria were psychophonic mediums with regular trance practices for at least one year. The data collected were analyzed using the SPSS statistical package.ResultsRegarding performance on the BCSB and digit span test, all subjects reached scores at the median or higher in comparison to standardized scores of Brazilians. Scores of 90% on the cube test and 42% on the FAS were reached in comparison to median or higher values, versus the median of standardized scores among Brazilians. On the FDT, we found statistical significance in the choice stage, with higher performance of subjects whose initial age of trance recognition occurred before 21 years old. On the BDI scale, no participant met the criteria for major depression. The SRQ showed an incidence of common mental disorders in 21% of the sample, which was more prevalent in the LEG.ConclusionThe cognitive functioning of subjects who practice trance mediumship in Brazil is associated with cognitive health. Executive dysfunction may be a tendency in LEG. However, an incidence of common mental disorders in the LEG was observed. Executive processing was higher in the subgroup with early practices of recognizing the phenomenon. (shrink)

Este artigo aborda de maneira preliminar a efetivação das políticas públicas educacionais no Assentamento Roça do Povo, no município de Itabuna-BA, analisando a legislação vigente, pontuando direitos conquistados pelas populações rurais e principalmente pelos campesinos por meio das suas lutas e reivindicações. Também foram analisadas as dificuldades, desafios, progressos, formação de professores e a importância da educação no campo para os campesinos. Desta forma, abordamos a importância de conhecer e estudar as leis que regulamentam a Educação do Campo, pois, a (...) prática educacional deve ser condizente com a realidade cotidiana, buscando valorizar a identidade e a cultura do campesinato. Além disso, este estudo visa ainda valorizar e defender a importância da educação no campo. Por fim, a presente pesquisa busca difundir as informações coletadas no Assentamento Roça do Povo, objetivando provocar inquietação na sociedade e aos órgãos públicos, para que possam olhar com maior atenção para a Educação do Campo e compreender a importância dela para os campesinos no Brasil, em especial na Bahia. Como procedimentos metodológicos apresenta uma pesquisa de natureza qualitativa e exploratória baseada em uma revisão bibliográfica. O estudo possibilitou a confirmação dos elementos relacionais para uma compreensão dialógica entre a pós-modernidade, a complexidade e a Ciência da Informação. The majority of antimicrobials that are produced are administered to animals, particularly food animals. While the overall impact of antimicrobial use in animals on antimicrobial resistance in humans and the environment is unclear, it undeniably has a role. Yet, some degree of antimicrobial use in animals is necessary for animal health and welfare purposes. Balancing the benefits and risks of antimicrobial use in animals is challenging because of the complexity of the problem and limitations in available data. However, a range (...) of measures can be implemented to reduce, refine and optimize antimicrobial use in animals, with a goal of minimizing the impact on human and environmental health while maintaining necessary therapeutic use in animals. A pandemic instrument can provide the necessary foundation for the whole-of-society and whole-of government One Health approach that is required to strengthen surveillance, communication, collaboration, and action. A democratização da deliberação política evidencia-se como cristalina preocupação da produção habermasiana nas seis décadas que separam A Mudança Estrutural da Esfera Pública (1984) e Uma Nova Mudança Estrutural da Esfera Pública e a Deliberação Política (2023). Na primeira obra, percebe-se desde o reconhecimento de que “a peculiar força explosiva da imprensa” consegue erigir o consenso da opinião pública como critério “único de legitimação das leis”, com a publicidade crítica, até a denúncia da encenação do consenso fabricado pela publicidade manipulativa (...) da estrutura de poder para instaurar uma comunicação sistematicamente distorcida. Assim, o conceito de ética do discurso é apresentado para diferenciar o processo autêntico de construção das decisões do consenso forjado pelo discurso hegemônico para simular um compromisso com o conjunto da sociedade e dissimular o seu intuito de dominação. Contudo, na análise da ética da discussão, Habermas (1989) concebe os princípios do discurso - exigência da inclusão no debate de todos concernidos pelas questões tratadas, e de universalização - vinculação de todos os envolvidos no reconhecimento da validade da deliberação. A concepção da universalização, no entanto, vai ser ponderada (Habermas, 2003) com a ressalva de que se impõe um conceito aproximativo da universalidade, pois seria regredir à posição transcendentalizada da presunção positivista do conhecimento, da razão e da verdade como absolutos. No último trabalho, na análise da esfera pública plataformizada, Habermas (2023) vai destacar o dissenso resistente como a referência imprescindível para viabilização da mudança social e o avanço do processo civilizatório. O presente artigo analisa a compatibilidade das leis de iniciativa parlamentar que instituem isenções tributárias em face da Constituição da República de 1988 e da Lei de Responsabilidade Fiscal, no contexto de crise econômica. Em conclusão, observou-se o risco de consequências prejudiciais ao Estado se não for enfrentado o problema da legalidade das leis tributárias de iniciativa parlamentar. O método de abordagem utilizado na pesquisa foi o dialético jurídico, notadamente à confrontação dos modelos econômicos de John Maynard Keynes e Friedrich (...) Instituciones políticas como la Comisión Europea y el Gobierno de España han manifestadosu interés y predisposición para sentar las bases de una gobernanza ética de la Inteligencia Artificial (IA). En particular, han planteado el impulso de una Inteligencia Artificial confiable a través de unconjunto de directrices y estrategias. A pesar del beneficio que reportan estas iniciativas políticas, no es posible apreciar en su conjunto una estrategia educativa específica que contribuya a la generación de un ecosistema ético de IA fundamentado en (...) la confianza. En ese sentido, el objetivo principal de este trabajo consiste en explicar que la enseñanza de la ética aplicada en los estudios de ingeniería constituye una apuesta para el fortalecimiento profesional, la gobernanza ética yuna investigación e innovación responsables. Para alcanzar este objetivo, en primer lugar, serándetallados algunos de los aspectos esenciales que dotan de un valor significativo a la enseñanza de la ética aplicada, subrayando la responsabilidad social que presentan las universidades en este terreno. En segundo lugar, se mostrará una clasificación de las asignaturas de ética relacionadas con la ingeniería en el entorno de las universidades públicas españolas. Y, en tercer lugar, se ofrecerá un marco teórico enraizado en la ética discursiva, promoviendo una mirada cívica en el contexto educativo de las profesiones. (shrink)

The work aims to briefly present some points of Paul Ricoeur's analysis, especially The Living Metaphor in his Study I Between Rhetoric and Poetics carried out by the philosopher in the study mentioned above, divided into five parts: 1- The unfolding of rhetoric and poetics. 2- The common core of poetics and rhetoric: "the epiphora of the name". 3- An enigma: metaphor and comparison (eikõn). 4- The "rhetorical" place of the lexis. 5- The "poetic" place of the lexis. Based on (...) the analysis of Ricoeur's text on the subject, and with the help of reference commentators, we seek to introduce the reader in a didactic way to the discussion and points of view on linguistic hermeneutics in the contemporary period, highlighting the contribution of Ricoeur's thought. Where the philosopher discusses the place of metaphor in the field of language, exploring its historical evolution from classical rhetoric to a broader and more transformative poetic approach. This paper begins with a discussion of the scientia sexualis/ars erotica distinction, which Foucault first advances in History of Sexuality Vol. 1, and which has been employed by many scholars to do a variety of analytical work. Though Foucault has expressed his doubts regarding his conceptualization of the differences between Western and Eastern discourses of desire, he never entirely disowns the distinction. In fact, Foucault remains convinced that China must have an ars erotica. I will explore Foucault’s sources of authority. (...) To this end, I introduce the work of famous Dutch sinologist Robert Hans van Gulik, who published the tremendously influential Sexual Life in Ancient China in 1961, and also explore Joseph Needham’s view on Chinese sex. I argue that, Foucault, in his fierce polemic against the “Repressive Hypothesis”, himself imagined a utopian Other where pleasure and desire were organised differently. I end on a discuss on Orientalism and the project of “Sinography” of comparative literature scholars Haun Saussy, Eric Hayot and others. (shrink)

O presente artigo busca apresentar a perspectiva educativa de Paulo Freire a partir da relação com o personalismo de Emmanuel Mounier. O ponto de destaque em tal relação é a visão da construção de uma educação pautada na autonomia e na abertura à comunidade, uma educação não meramente técnica, mas que seja capaz de preparar o ser humano para o fazer e para o ser. Esta educação, segundo Paulo Freire, não pode esquecer a importância do Protagonismo do educando no processo (...) educativo, deve ser fundamentada no diálogo e sempre aberta a refletir a vida concreta que se manifesta no ambiente onde o processo educativo está se desenvolvendo. Biobanks challenge the traditional model in research ethics, in which the autonomy of subjects donating samples for biomedical research is to be protected by means of informed consent. This paper identifies a global trend towards governance models more favourable to research, in which a single act of consent is used to authorize a wide range of research projects. It argues that the protection of autonomy is often understood just as the requirement to sign an informed consent form; but the autonomy (...) of research subjects is neither an isolated decision nor a purely individual one, as it affects groups of people along time. Some ways out of this problem are discussed, both by re-conceptualizing autonomy and by expanding the informed consent process. Taking into account the relationship between public trust and donor participation, the possibility of respecting autonomy by means of narrative is suggested, with the aim of promoting the scientific culture of a population and debating the ethical issues raised by biobanks. Although bioethics is a lively and expanding interdisciplinary field, there is not enough research about the patient‐doctor relationship, a central issue in philosophy of medicine. This article surveys the state of the field, paying attention to recent work by Alfred Tauber, and supplementing it with insights from Hans Jonas's philosophy of technology in order to propose a principle of responsible autonomy for health care. Based on a comparative look across different sub‐fields in bioethics, the resulting model claims that physician responsibility (...) is essential to professional integrity, providing an alternative to other active trends emphasizing patient autonomy, such as Robert Veatch's contractual model. En la intersección entre la ética aplicada y los estudios sobre divulgación científica en los medios, este trabajo propone un concepto de «cultura bioética» y lo aplica a la exitosa serie de televisión House. Nuestro análisis de la serie muestra la relación existente entre la tensión entre autonomía del paciente y paternalismo médico presente en la teoría bioética y la práctica asistencial, por un lado, con el debate abierto en filosofía de la medicina entre posiciones naturalistas y normativistas sobre los (...) conceptos de salud y enfermedad, por el otro. This paper aims to study from the perspective of bioethics the controversy about door-to-door waste collection (DtD). Three goals are pursued: (1) to provide terms of comparison between different systems of urban waste management, (2) to distinguish the specifically ethical issues introduced by DtD, and (3) analyze its innovative character as a social technology. After briefly considering the state of the art, in which a bibliographical revision shows that the ethics literature has relatively neglected this topic, Siurana’s “moral compass” is (...) applied to the question concerning waste. Next this proposal is used to describe and assess the two main models being discussed. Tras una revisión bibliográfica, el artículo proporciona una presentación de la filosofía política de Henry D. Thoreau, enfatizando en su obra un concepto de autodeterminación cívica que Habermas descompone en una autonomía pública y otra privada. Sostengo que Thoreau no era un anarquista antisocial, ni tampoco un mero liberal individualista, sino que su liberalismo presenta elementos propios de la teoría democrática e incluso del comunitarismo político. Finalmente, identifico y describo una tensión entre esos temas liberales y democráticos, tanto en la (...) obra de Thoreau como en la vida política de las sociedades occidentales, mostrando así la relevancia de este autor. Mounier não aceita o que ele chama de redução materialista do ser pessoal e insiste na consideração do espírito como constituinte da pessoa tanto quanto a matéria. Um reforma da sociedade precisa estar atenta tanto ao aspecto material como espiritual e moral da pessoa e da sociedade em que ela está situada. Não é um contato que tem como objetivo um consenso entre os dois autores, mas que procura apontar como podemos aliar a consciência do perigo de alienação na educação com a esperança que a educação pode representar se for desenvolvida com os devidos cuidados e tendo em vista uma concepção integral da pessoa, o (...) que se alcança se a educação é entendida não só como instrução, mas também como formação. Dentro do pensamento arenditiano, a experiência da solidão é uma das formas mais radicais de afastamento do ser humano da própria humanidade. Para Arendt existem caminhos que podem apontar e conduzir à solidão, e que devem ser vigiados e evitados. Arendt entende que esta experiência tão radical atinge seu ápice no contexto do totalitarismo, em especial nos campos de concentração. A solidão se torna estrutural e é fabricada continuamente no contexto totalitário. Como experiencia onde a pessoa se perde do mundo, (...) dos outros e de si mesma, a solidão é usada pelo regime totalitário como antecipação do aniquilamento final, onde a pessoa se torna um mero feixe vital, um morto vivo, sem expressão do ser pessoa, restando apenas o aniquilamento nos campos. This section welcomes submissions addressing literature as a means to explore ethical issues arising in healthcare. “Literature” will be understood broadly, including fiction and creative nonfiction, illness narratives, drama, and poetry; film studies might be considered if the films are adaptations from a literary work. Topics include in-depth analysis of literary works as well as theoretical contributions, discussions, and commentary about narrative approaches to disease and medicine, the way literature shapes the relationship between patients and healthcare professionals, the role of (...) speculative fiction as a testing ground for future scenarios in healthcare, and so on. Articles discussing the uses of literature for bioethics education and outreach will be particularly appreciated. This is done by means of a comparison between three end-of-life scenarios: Tolstoy’sThe Death of Ivan Ilyichand two related contemporary stories by Lorrie Moore and Bernhard Schlink, which explore some problems arising when extremely individualistic notions of patient autonomy are put into practice. It is argued that the best model for palliative care is a cooperative one in which patient autonomy is understood as essentially social, and that involves decisional, executive, informational, and narrative dimensions. In this paper we address a frontier topic in the humanities, namely how the cultural and natural construction that we call landscape affects well-being and health. Following an updated review of evidence-based literature in the fields of medicine, psychology, and architecture, we propose a new theoretical framework called “processual landscape,” which is able to explain both the health-landscape and the medical agency-structure binomial pairs. We provide a twofold analysis of landscape, from both the cultural and naturalist points of view: in (...) order to take into account its relationship with health, the definition of landscape as a cultural product needs to be broadened through naturalization, grounding it in the scientific domain. Landscape cannot be distinguished from the ecological environment. For this reason, we naturalize the idea of landscape through the notion of affordance and Gibson’s ecological psychology. In doing so, we stress the role of agency in the theory of perception and the health-landscape relationship. Since it is the result of continuous and co-creational interaction between the cultural agent, the biological agent and the affordances offered to the landscape perceiver, the processual landscape is, in our opinion, the most comprehensive framework for explaining the health-landscape relationship. The consequences of our framework are not only theoretical, but ethical also: insofar as health is greatly affected by landscape, this construction represents something more than just part of our heritage or a place to be preserved for the aesthetic pleasure it provides. Some conceptual and methodological structures are presented in this article as the effective sources that prevent the realization of a creative philosophy of religion. The article demonstrates the invalidity of the opposition between the historiography of philosophy as merely exegesis or reproductive reconstruction and creative philosophy as the resolution or dissolution of problems. A supposed lack of creativity is not based on a specific outdated methodological or pedagogical model but on the absence of an investigation into a series of assumptions (...) that simultaneously constitute what is thought to be philosophy and what is regarded as the history of philosophy. These assumptions will be elucidated through the outline of a theory of phantom tropes about religion. In the end, we will highlight that the few discussions about the theory of history, the history of philosophical historiography, and concrete interdisciplinary investigations are responsible for caricatures both of doing philosophy of religion and of doing the history of philosophy.
