Are companies, churches, and states genuine agents? Or are they just collections of individuals that give a misleading impression of unity? This question is important, since the answer dictates how we should explain the behaviour of these entities and whether we should treat them as responsible and accountable on the model of individual agents. Group Agency offers a new approach to that question and is relevant, therefore, to a range of fields from philosophy to law, politics, and the social sciences. (...) Christian List and Philip Pettit argue that there really are group or corporate agents, over and above the individual agents who compose them, and that a proper approach to the social sciences, law, morality, and politics must take account of this fact. Unlike some earlier defences of group agency, their account is entirely unmysterious in character and, despite not being technically difficult, is grounded in cutting-edge work in social choice theory, economics, and philosophy. Consider the hypothesis H that a defendant is guilty, and the evidence E that a majority of h out of n independent jurors have voted for H and a minority of k:=n-h against H. How likely is the majority verdict to be correct? By a formula of Condorcet, the probability that H is true given E depends only on each juror's competence and on the absolute margin between the majority and the minority h-k, but neither on the number n, nor (...) on the proportion h/n. This paper reassesses that result and explores its implications. First, using the classical Condorcet jury model, I derive a more general version of Condorcet's formula, confirming the significance of the absolute margin, but showing that the probability that H is true given E depends also on an additional parameter: the prior probability that H is true. Second, I show that a related result holds when we consider not the degree of belief we attach to H given E, but the degree of support E gives to H. Third, I address the implications for the definition of special majority voting, a procedure used to capture the asymmetry between false positive and false negative decisions. I argue that the standard definition of special majority voting in terms of a required proportion of the jury is epistemically questionable, and that the classical Condorcet jury model leads to an alternative definition in terms of a required absolute margin between the majority and the minority. Finally, I show that the results on the significance of the absolute margin can be resisted if the so-called assumption of symmetrical juror competence is relaxed. (shrink)

Philosophers have argued about the nature and the very existence of free will for centuries. Today, many scientists and scientifically minded commentators are skeptical that it exists, especially when it is understood to require the ability to choose between alternative possibilities. If the laws of physics govern everything that happens, they argue, then how can our choices be free? Believers in free will must be misled by habit, sentiment, or religious doctrine. Why Free Will Is Real defies scientific orthodoxy and (...) presents a bold new defense of free will in the same naturalistic terms that are usually deployed against it. -/- Unlike those who defend free will by giving up the idea that it requires alternative possibilities to choose from, Christian List retains this idea as central, resisting the tendency to defend free will by watering it down. He concedes that free will and its prerequisites—intentional agency, alternative possibilities, and causal control over our actions—cannot be found among the fundamental physical features of the natural world. But, he argues, that’s not where we should be looking. Free will is a “higher-level” phenomenon found at the level of psychology. It is like other phenomena that emerge from physical processes but are autonomous from them and not best understood in fundamental physical terms—like an ecosystem or the economy. When we discover it in its proper context, acknowledging that free will is real is not just scientifically respectable; it is indispensable for explaining our world. (shrink)

This is an edited transcript of a conversation to be included in the collection "Conversations on Rational Choice". The conversation was conducted in Munich on 7 and 9 February 2016.

I model sequential decisions over multiple interconnected propositions and investigate path-dependence in such decisions. The propositions and their interconnections are represented in propositional logic. A sequential decision process is path-dependent if its outcome depends on the order in which the propositions are considered. Assuming that earlier decisions constrain later ones, I prove three main results: First, certain rationality violations by the decision-making agent—individual or group—are necessary and sufficient for path-dependence. Second, under some conditions, path-dependence is unavoidable in decisions made by (...) groups. Third, path-dependence makes decisions vulnerable to strategic agenda setting and strategic voting. I also discuss escape routes from path-dependence. My results are relevant to discussions on collective consistency and reason-based decision-making, focusing not only on outcomes, but also on underlying reasons, beliefs, and constraints. (shrink)

Suppose that the members of a group each hold a rational set of judgments on some interconnected questions, and imagine that the group itself has to form a collective, rational set of judgments on those questions. How should it go about dealing with this task? We argue that the question raised is subject to a difficulty that has recently been noticed in discussion of the doctrinal paradox in jurisprudence. And we show that there is a general impossibility theorem that that (...) difficulty illustrates. Our paper describes this impossibility result and provides an exploration of its significance. The result naturally invites comparison with Kenneth Arrow's famous theorem (Arrow, 1963 and 1984; Sen, 1970) and we elaborate that comparison in a companion paper (List and Pettit, 2002). The paper is in four sections. The first section documents the need for various groups to aggregate its members' judgments; the second presents the discursive paradox; the third gives an informal statement of the more general impossibility result; the formal proof is presented in an appendix. One fundamental thesis within the rapidly growing literature on deliberative democracy is that the stability and quality of a democracy depend not only on formal institutions such as the electoral system or the structure of parliamentary representation. They depend also on certain democratic competences of the citizens, especially their capacity for democratic communication. According to this thesis, above all the capacity for democratic deliberation, i.e., for argumentation, evaluation and for a balanced decision between policy alternatives, belongs to the central competences (...) relevant to maintaining and developing a democracy. Max Albert has recently argued that the theory of power indices “should not ... be considered as part of political science” and that “[v]iewed as a scientific theory, it is a branch of probability theory and can safely be ignored by political scientists”. Albert’s argument rests on a particular claim concerning the theoretical status of power indices, namely that the theory of power indices is not a positive theory, i.e. not one that has falsifiable implications. I re-examine the theoretical status (...) of power indices and argue that it would be unwise for political scientists to ignore such indices. Although I agree with Albert that the theory of power indices is not a positive theory, I suggest that it is a theory of measurement that can usefully supplement other positive and normative socialscientific theories. Can collectives be wise? The thesis that they can has recently received a lot of attention. It has been argued that, in many judgmental or decision-making tasks, suitably organized groups can outperform their individual members. In this paper, I discuss the lessons we can learn about collective wisdom from the emerging theory of judgment aggregation, as distinct from the literature on Condorcet’s jury theorem.

The concept of preference structuration not only provides possible escape-routes from socialchoice-theoretic impossibility problems, but also points towards ways of formalizing notions of 'pluralism', 'consensus' and 'issue-dimensionality'. The present note introduces two methods of (operationally) measuring preference structuration, giving attention to both their conceptual characteristics and their computational feasibility. The method to be advocated, called the 'fractionalization' approach, combines well-known social-choice-theoretic criteria of preference structuration (such as single-peakedness or value-restriction) with the frequently used Rae-Taylor (1970) and Laakso-Taagepera (1979) approaches towards (...) measuring the level of fractionalization, and the effective number of components, in a system. It is often argued that higher-level special-science properties cannot be causally efficacious since the lower-level physical properties on which they supervene are doing all the causal work. This claim is usually derived from an exclusion principle stating that if a higher-level property F supervenes on a physical property F* that is causally sufficient for a property G, then F cannot cause G. We employ an account of causation as difference-making to show that the truth or falsity of this principle is (...) a contingent matter and derive necessary and sufficient conditions under which a version of it holds. We argue that one important instance of the principle, far from undermining non-reductive physicalism, actually supports the causal autonomy of certain higher-level properties. (shrink)

A central problem of democracy is the aggregation of divergent individual inputs into overall collective decisions. Social-choice-theoretic impossibility results famously demonstrate the intractability of a large class of such aggregation problems. This paper develops a taxonomy of two concepts of agreement, agreement at a substantive level and agreement at a meta-level, and discusses the escape-routes these concepts open up from the impossibility problems of social choice. Specifically, two contexts of democratic aggregation are addressed: first, the familiar context of preferences, and (...) second, the largely unexplored context of sets of judgments over multiple interconnected propositions. Drawing on some recent developments in social choice theory and democratic theory, I will defend the view that, when agreement is conceptualized in democratic theory and when it is sought in democratic practice, more emphasis should be placed on agreement at a meta-level than is commonly done. Finally, I will address the more general question to what extent it is acceptable for the stability of institutions for democratic aggregation to be dependent on specific empirical contingencies. The aim of this exploratory paper is to review an under-appreciated parallel between group agency and artificial intelligence. As both phenomena involve non-human goal-directed agents that can make a difference to the social world, they raise some similar moral and regulatory challenges, which require us to rethink some of our anthropocentric moral assumptions. Are humans always responsible for those entities’ actions, or could the entities bear responsibility themselves? Could the entities engage in normative reasoning? Could they even have rights and (...) a moral status? I will tentatively defend the (increasingly widely held) view that, under certain conditions, artificial intelligent systems, like corporate entities, might qualify as responsible moral agents and as holders of limited rights and legal personhood. I will further suggest that regulators should permit the use of autonomous artificial systems in high-stakes settings only if they are engineered to function as moral (not just intentional) agents and/or there is some liability-transfer arrangement in place. I will finally raise the possibility that if artificial systems ever became phenomenally conscious, there might be a case for extending a stronger moral status to them, but argue that, as of now, this remains very hypothetical. Do hunting and fishing lead to the development of environmental virtues? This question is at the heart of philosopher Charles List’s engaging study, which provides a defense of field sports when they are practiced and understood in an ethical manner. In his argument, List examines the connection between certain activities and the development of virtue in the classical sources, such as Aristotle and Plato. He then explores the work of Aldo Leopold, identifying three key environmental virtues that field (...) sports instill in practitioners in the kind of conservation advocated by Leopold and others. After reviewing several powerful philosophical objections to his viewpoint, List considers the future of environmental sportsmanship. He suggests that, in order to incorporate a revived connection between field sports and environmental virtue, the practice of hunting and angling must undergo changes, including shifts that would impact hunter education, civic engagement, the role of firearms, our understanding of “game” animals, and alliances with other sorts of outdoor recreation. _ Hunting, Fishing, and Environmental Virtue_ will appeal to academics interested in the ethical issues surrounding hunting and fishing, professionals in wildlife management, and hunters and anglers interested in conservation. Many groups make decisions over multiple interconnected propositions. The “doctrinal paradox” or “discursive dilemma” shows that propositionwise majority voting can generate inconsistent collective sets of judgments, even when individual sets of judgments are all consistent. I develop a simple model for determining the probability of the paradox, given various assumptions about the probability distribution of individual sets of judgments, including impartial culture and impartial anonymous culture assumptions. I prove several convergence results, identifying when the probability of the paradox converges to (...) 1, and when it converges to 0, as the number of individuals increases. Drawing on the Condorcet jury theorem and work by Bovens and Rabinowicz , I use the model to assess the “truth-tracking” performance of two decision procedures, the premise- and conclusion-based procedures. I compare the present results with existing results on the probability of Condorcet’s paradox. I suggest that the doctrinal paradox is likely to occur under plausible conditions. (shrink)

After distinguishing political theory from related fields, such as political science, moral philosophy, and legal theory, the article discusses the analysis of political concepts. It then turns to the notions of principles and theories, as distinct from concepts, and reviews the methods of assessing such principles and theories, for the purpose of justifying or criticizing them. Finally, it looks at a recent debate (...) on how abstract and idealized political theory should be, and assesses the significance of disagreement in political theory. The ``doctrinal paradox'' or ``discursive dilemma'' shows that propositionwise majority voting over the judgments held by multiple individuals on some interconnected propositions can lead to inconsistent collective judgments on these propositions. List and Pettit (2002) have proved that this paradox illustrates a more general impossibility theorem showing that there exists no aggregation procedure that generally produces consistent collective judgments and satisfies certain minimal conditions. Although the paradox and the theorem concern the aggregation of judgments rather than preferences, they invite (...) comparison with two established results on the aggregation of preferences: the Condorcet paradox and Arrow's impossibility theorem. We may ask whether the new impossibility theorem is a special case of Arrow's theorem, or whether there are interesting disanalogies between the two results. In this paper, we compare the two theorems, and show that they are not straightforward corollaries of each other. We further suggest that, while the framework of preference aggregation can be mapped into the framework of judgment aggregation, there exists no obvious reverse mapping. Finally, we address one particular minimal condition that is used in both theorems – an independence condition – and suggest that this condition points towards a unifying property underlying both impossibility results. I argue that free will and determinism are compatible, even when we take free will to require the ability to do otherwise and even when we interpret that ability modally, as the possibility of doing otherwise, and not just conditionally or dispositionally. My argument draws on a distinction between physical and agential possibility. Although in a deterministic world only one future sequence of events is physically possible for each state of the world, the more coarsely defined state of an agent (...) and his or her environment can be consistent with more than one such sequence, and thus different actions can be “agentially possible”. The agential perspective is supported by our best theories of human behaviour, and so we should take it at face value when we refer to what an agent can and cannot do. On the picture I defend, free will is not a physical phenomenon, but a higher-level one on a par with other higher-level phenomena such as agency and intentionality. (shrink)

In a recent paper on ‘The Many as One’, Lewis A. Kornhauser and Lawrence G. Sager look at an issue that we take to be of great importance in political theory. How far should groups in public life try to speak with one voice, and act with one mind? How far should public groups try to display what Ronald Dworkin calls integrity? We do not expect the many on the market to be integrated in this sense. But should we expect (...) integration among the many in the legislature, for example, or among the many on the courts? We agree with Kornhauser and Sager about a number of their claims but think that they miss out on important detail and do not achieve a fully general perspective on the issues raised. Our own contribution is in three sections. We address, first, the nature of the integrity challenge; second, the range of cases in which the challenge arises; and third, the question of whether public groups should be designed and required to meet that challenge. This paper sketches a new and somewhat heterodox metaphysical theory of consciousness: the “many-worlds theory”. It drops the assumption that all conscious subjects’ experiences are features of one and the same world and instead associates different subjects with different “first-personally centred worlds”. We can think of these as distinct “first-personal realizers” of a shared “third-personal world”, where the latter is supervenient, in a sense to be explained. This is combined with a form of modal realism, according to which different subjects’ (...) first-personally centred worlds are all real, though only one of them is present for each subject. The theory offers a novel way of capturing the irreducibly subjective nature of conscious experience without lapsing into solipsism. The paper also looks at some scientific theories of consciousness, such as integrated information theory, through the proposed lens and reconsiders the hard problem of consciousness. (shrink)

Although controversy concerning the morality of hunting is generally focused on sport hunting, sport hunting itself is not a morally distinctive kind of hunting. The understanding of hunting in general needs to be supplemented with reference to the goods which hunting seeks. Attempts to draw a moral distinction between sport and subsistence hunting are inadequate and historically suspect. Likewise, trying to establish sport hunting as morally distinctive by emphasizing its similarities to other sports also fails. Nevertheless, there are standards accepted (...) by hunters that support ethical judgments about hunting. Ethical hunting requires reentry into a community of nonhuman beings governed by ecology and evolution, not human constructs, the development of virtues such as tenacity, courage, moderation, and discipline, and the achievement of a heightened respect for the biotic community in which the hunt takes place. By means of such standards, we may yet be able to determine what good hunting is even though we are unable to determine whether sport hunting is good. (shrink)

This paper generalises the classical Condorcet jury theorem from majority voting over two options to plurality voting over multiple options. The paper further discusses the debate between epistemic and procedural democracy and situates its formal results in that debate. The paper finally compares a number of different social choice procedures for many-option choices in terms of their epistemic merits. An appendix explores the implications of some of the present mathematical results for the question of how probable majority cycles (as in (...) Condorcet's paradox) are in large electorates. El documental Palabras mágicas (para romper un encantamiento) (2012) de Mercedes Moncada presenta la tierra como una extensión del yo, primero, como una alegoría del país, de la revolución y del individuo y, segundo, por la contingencia y la vulnerabilidad del medio ambiente y el pueblo nicaragüense. Tanto los nicaragüenses como la naturaleza son víctimas de un (...) sistema político que se repite a lo largo de los siglos XX y XXI. A partir de la corporalidad o la materialidad, el documental establece un vínculo entre la tierra y el sujeto nicaragüense a través de la discursividad, ambos como sitios de inscripciones que se someten a relaciones de poder, un hecho que precariza a los dos. Palabras mágicas (2012) propone que el pueblo y el medio ambiente nicaragüense son víctimas del somocismo del siglo XX y el neosandismo de Ortega en el siglo XXI. Por último, a partir del vínculo metafórico entre la naturaleza y el pueblo nicaragüense, uno de los resultados es encuadrar el medio ambiente dentro de un marco de precariedad y vulnerabilidad, destacando la dependencia y contingencia entre seres humanos y él. Political theory, sometimes also called “normative political theory”, is a subfield of the disciplines of philosophy and political science that addresses conceptual, normative, and evaluative questions concerning politics and society, broadly construed. Examples are: When is a society just? What does it mean for its members to be free? When is one distribution of goods socially preferable to another? What makes a political authority legitimate? How should we trade off different values, such as liberty, prosperity, and security, against one another? (...) What do we owe, not just to our fellow citizens, but to people in the world at large? In this article, we review the methodology of a core branch of contemporary political theory: the one commonly described as “analytic” political theory. In Section 1, we briefly demarcate the scope of political theory. In Section 2, we comment on the analysis of political concepts. In Section 3, we introduce the notions of principles and theories, as distinct from concepts. In Section 4, we discuss the methods of assessing such principles and theories, for the purpose of justifying or criticizing them. In Section 5, we review a recent debate on how abstract and idealized political theory should be. In Section 6, finally, we discuss the significance of disagreement in political theory. Although we cover established ground, we do so from an angle that will be somewhat unfamiliar to at least some political theorists – namely an angle inspired by the philosophy of science. We have chosen this angle with a view to systematizing the activity of analytic political theorizing so as to make its connections with other fields of philosophy and positive science more transparent. Political science is divided between methodological individualists, who seek to explain political phenomena by reference to individuals and their interactions, and holists (or nonreductionists), who consider some higher-level social entities or properties such as states, institutions, or cultures ontologically or causally significant. We propose a reconciliation between these two perspectives, building on related work in philosophy. After laying out a taxonomy of different variants of each view, we observe that (i) although political phenomena result from underlying individual attitudes and behavior, (...) individual-level descriptions do not always capture all explanatorily salient properties, and (ii) nonreductionistic explanations are mandated when social regularities are robust to changes in their individual-level realization. We characterize the dividing line between phenomena requiring nonreductionistic explanation and phenomena permitting individualistic explanation and give examples from the study of ethnic conflicts, social-network theory, and international-relations theory. The existence of group agents is relatively widely accepted. Examples are corporations, courts, NGOs, and even entire states. But should we also accept that there is such a thing as group consciousness? I give an overview of some of the key issues in this debate and sketch a tentative argument for the view that group agents lack phenomenal consciousness. In developing my argument, I draw on integrated information theory, a much-discussed theory of consciousness. I conclude by pointing out an implication (...) of my argument for the normative status of group agents. (shrink)

Distributed cognition refers to processes which are (i) cognitive and (ii) distributed across multiple agents or devices rather than performed by a single agent. Distributed cognition has attracted interest in several fields ranging from sociology and law to computer science and the philosophy of science. In this paper, I discuss distributed cognition from a social-choice-theoretic perspective. Drawing on models of judgment aggregation, I address two questions. First, how can we model a group of individuals as a distributed cognitive system? Second, (...) can a group acting as a distributed cognitive system be ‘rational’ and ‘track the truth’ in the outputs it produces? I argue that a group’s performance as a distributed cognitive system depends on its ‘aggregation procedure’ – its mechanism for aggregating the group members’ inputs into collective outputs – and I investigate the properties of an aggregation procedure that matter. Most accounts of welfare aggregation in the tradition of Arrow's and Sen's social-choice-theoretic frameworks represent the welfare of an individual in terms of a single welfare ordering or a single scalar-valued welfare function. I develop a multidimensional generalization of Arrow's and Sen's frameworks, representing individual welfare in terms of multiple personal welfare functions, corresponding to multiple 'dimensions' of welfare. I show that, as in the one-dimensional case, the existence of attractive aggregation procedures depends on certain informational assumptions, specifically about the (...) measurability of welfare and its comparability not only across individuals but also across dimensions. I state several impossibility and possibility results. Under Arrow-type conditions, insufficient comparability across individuals leads to dictatorship of a single individual, while insufficient comparability across dimensions leads to dominance of a single dimension. Given sufficient comparability both across individuals and across dimensions, a range of possibilities emerges. I discuss the substantive implications of the results. (shrink)

How can collective decisions be made among individuals with conflicting preferences or judgments? Arrow’s impossibility theorem and other social-choice-theoretic results suggest that, for many collective decision problems, there are no attractive democratic solutions. In response, deliberative democrats argue that group deliberation makes collective decisions more tractable. How can deliberation accomplish this? In this paper, I explore the distinction between two different types of agreement and discuss how they can facilitate collective decision making. Deliberative democrats have traditionally defended the hypothesis that (...) group deliberation generates consensus on what decision option should be chosen: "substantive agreement". But substantive agreement is not only empirically unrealistic, but also logically unnecessary for meaningful collective decision making. An alternative, less demanding hypothesis is that, under certain conditions, group deliberation generates consensus on how a decision problem should be conceptualized: "meta-agreement". I assess the latter hypothesis, explain how it can be empirically tested, and cite some evidence consistent with it. My discussion addresses two contexts of democratic decision making: preference aggregation and judgment aggregation. (shrink)

We ordinarily think that we human beings have agency: we have control over our choices and make a difference to our environments. Yet it is not obvious how agency can fit into a physical world that is governed by exceptionless laws of nature. In particular, it is unclear how agency is possible if those laws are deterministic and the universe functions like a mechanical clockwork. In this short paper, I first explain the apparent conflict between agency and physical determinism (referring (...) to recent work by Helen Steward on "agency incompatibilism"), then review some salient responses one might give to this conflict, and finally sketch a response that rests on a distinction between “physical” and “agential possibilities.” Agency, I suggest, is a higher-level phenomenon, which comes with its own level-specific notion of possibility, and it cannot be adequately analyzed in physical terms alone or just through the lens of physical possibility. We offer a new argument for the claim that there can be non-degenerate objective chance (“true randomness”) in a deterministic world. Using a formal model of the relationship between different levels of description of a system, we show how objective chance at a higher level can coexist with its absence at a lower level. Unlike previous arguments for the level-specificity of chance, our argument shows, in a precise sense, that higher-level chance does not collapse into epistemic probability, despite higher-level properties (...) supervening on lower-level ones. We show that the distinction between objective chance and epistemic probability can be drawn, and operationalized, at every level of description. There is, therefore, not a single distinction between objective and epistemic probability, but a family of such distinctions. (shrink)

The theory of judgment aggregation asks how several individuals' judgments on some logically connected propositions can be aggregated into consistent collective judgments. The aim of this introduction is to show how ideas from the familiar theory of preference aggregation can be extended to this more general case. We first translate a proof of Arrow's impossibility theorem into the new setting, so as to motivate some of the central concepts and conditions leading to analogous (...) impossibilities, as discussed in the symposium. Priming is a useful tool for ascertaining the circumstances under which previous experiences influence behavior. Previously, using hierarchical stimuli, we demonstrated (Justus & List, 2005) that selectively attending to one temporal scale of an auditory stimulus improved subsequent attention to a repeated (vs. changed) temporal scale; that is, we demonstrated intertrial auditory temporal level priming. Here, we have extended those results to address whether level priming relied on absolute or relative temporal information. Both relative and absolute temporal information are (...) important in auditory perception: Speech and music can be recognized over various temporal scales but become uninterpretable to a listener when presented too quickly or slowly. We first confirmed that temporal level priming generalized over new temporal scales. Second, in the context of multiple temporal scales, we found that temporal level priming operates predominantly on the basis of relative, rather than absolute, temporal information. These findings are discussed in the context of expectancies and relational invariance in audition. (shrink)

Much recent philosophical work on social freedom focuses on whether freedom should be understood as non-interference, in the liberal tradition associated with Isaiah Berlin, or as non-domination, in the republican tradition revived by Philip Pettit and Quentin Skinner. We defend a conception of freedom that lies between these two alternatives: freedom as independence. Like republican freedom, it demands the robust absence of relevant constraints on action. Unlike republican, and like liberal freedom, it is not moralized. We show that freedom as (...) independence retains the virtues of its liberal and republican counterparts while shedding their vices. Our aim is to put this conception of freedom more firmly on the map and to offer a novel perspective on the logical space in which different conceptions of freedom are located. (shrink)

Like biological species, languages change over time. As noted by Darwin, there are many parallels between language evolution and biological evolution. Insights into these parallels have also undergone change in the past 150 years. Just like genes, words change over time, and language evolution can be likened to genome evolution accordingly, but what kind of evolution? There are fundamental differences between eukaryotic and prokaryotic evolution. In the former, natural variation entails the gradual accumulation of minor mutations in alleles. In the (...) latter, lateral gene transfer is an integral mechanism of natural variation. The study of language evolution using biological methods has attracted much interest of late, most approaches focusing on language tree construction. These approaches may underestimate the important role that borrowing plays in language evolution.
