In 2015, the major critical care societies issued guidelines outlining a procedural approach to resolving intractable conflict between healthcare professionals and surrogates over life-sustaining treatments (LST). We report our experience with a resolving conflict procedure. This was a retrospective, single-centre cohort study of ethics consultations involving intractable conflict over LST. The resolving conflict process was initiated eleven times for ten patients over 2,015 ethics consultations from 2000 to 2020. In all cases, the ethics committee recommended withdrawal of the contested LST. (...) In seven cases, the patient died or was transferred or a legal injunction was obtained before completion of the process. In the four cases in which LST was withdrawn, the time from ethics consultation to withdrawal of LST was 24.8 ± 12.2 days. Healthcare provider and surrogate were often distressed during the process, sometimes resulting in escalation of conflict and legal action. In some cases, however, surrogates appeared relieved that they did not have to make the final decision regarding LST. Challenges regarding implementation included the time needed for process completion and limited usefulness in emergent situations. Although it is feasible to implement a due process approach to conflict over LST, there are factors that limit the procedure’s usefulness. (shrink)

Recent financial fraud legislation such as the Dodd–Frank Act and the Sarbanes–Oxley Act (U.S. House of Representatives, Dodd-Frank Wall Street Reform and Consumer Protection Act of 2010, [H.R. 4173], 2010 ; U.S. House of Representatives, The Sarbanes–Oxley Act of 2002, Public Law 107-204 [H.R. 3763], 2002 ) relies heavily on whistleblowers for enforcement, and offers protection and incentives for whistleblowers. However, little is known about many aspects of the whistleblowing decision, especially the effects of contextual and wrongdoing attributes on organizational (...) members’ willingness to report fraud. We extend the ethics literature by experimentally investigating how the nature of the wrongdoing and the awareness of those surrounding the whistleblower can influence whistleblowing. As predicted, we find that employees are less likely to report: (1) financial statement fraud than theft; (2) immaterial than material financial statement fraud; (3) when the wrongdoer is aware that the potential whistleblower has knowledge of the fraud; and (4) when others in addition to the wrongdoer are not aware of the fraud. Our findings extend whistleblowing research in several ways. For instance, prior research provides little evidence concerning the effects of fraud type, wrongdoer awareness, and others’ awareness on whistleblowing intentions. We also provide evidence that whistleblowing settings represent an exception to the well-accepted theory of diffusion of responsibility. Introduction Included in a collection of manuscripts and early printed books recently acquired by the Library of the University of California, Los Angeles, from the Paris bookdealer Paul Jammes ~ are three manuscripts attributed to a certain Nicolas de la Toison, Baron de Bussy. Two of the three volumes contain extensive Latin commentaries on the major writings of Aristotle.2 The third is a miscellaneous volume written in three different hands, which contains, among other things, a complete French translation of the extant writings of Sextus Empiricus (c. Wittgenstein's Remarks on the Foundations of Mathematics was poorly received by the critics when it was first published, and only a few sympathetic commentators have made much of it since then. The book has not had a great success, because the majority of people interested in the philosophy of mathematics these days have a quite different approach to the subject from Wittgenstein. But not only that, they have a quite different logic from Wittgenstein. I believe one of the main sources (...) of the antipathy felt towards the Remarks lies in the foreignness of the logic Wittgenstein develops there. I hope, in what follows, to make that logic more understandable, and with it the philosophy of mathematics it supports. (shrink)

Speaking of Professor Geach's belief that pronouns in natural language function like the bound variables in quantification theory, Gareth Evans, in ‘Pronouns, Quantifiers, and Relative Clauses - I’ says :I want to try to show that there are pronouns with quantifier antecedents that function in a quite different way. Such pronouns typically stand in a different grammatical relation to their antecedents, and; in contrast with bound pronouns, must be assigned a reference, so that their most immediate sentential contexts can always (...) be assigned a truth value. The relevant grammatical relation appears to be Klima's relation of ‘in construction with’. When the pronoun is in construction with its antecedent, as in [‘Some man loves his mother’] and [‘No man is happy when he is in love’] the result is a bound pronoun. (shrink)

The paper presents and applies Hilbert's Epsilon Calculus, first describing its standard proof theory, and giving it an intensional semantics. These are contrasted with the proof theory of Fregean Predicate Logic, and the traditional (extensional) choice function semantics for the calculus. The semantics provided show that epsilon terms are referring terms in Donnellan's sense, enabling the symbolisation and validation of argument forms involving E-type pronouns, both in extensional and intensional contexts. By providing for transparency in intensional constructions they support a (...) Model Conceptualism to contrast with traditional intensional logic's Modal Realism. But epsilon-terms also symbolise fictions, and through their difference from iota terms enable the solution of a number of outstanding puzzles about Direct Reference and de re beliefs. (shrink)

Cesario provides a compelling critique of the use of experimental social psychology to explain real-world group disparities. We concur with his targeted critique and extend “the problem of missing information” to another common measures of bias. We disagree with Cesario's broader argument that the entire enterprise be abandoned, suggesting instead targeted utilization. Finally, we question whether the critique is appropriately directed at experimental social psychologists.

The author has made this treatise on Madhva’s realistic school of Ved?nta philosophy convincing to the modern mind by employing western logical apparatus in substantiating Madhva’s ideas. Following the Indian classical tradition, the author has examined the validity of Advaitaved?nta, the Absolute Monism of ?a?kara and Bh?skara as P?rvapak?a, and logically proved its inconsistencies. He has then established the Dvaitasiddh?nta i.e., the Monotheistic Dualism of Madhva. He has successfully brought out the nuances of the realistic school of Indian philosophical thought (...) in this work.
