Yet “many others” did not fit into those two groups, for a large contingent of bishops favorable to religious liberty nonetheless sought to undergird the juridical reasoning for the right with an ontological foundation.David L. Schindler and Nicholas Healy promote these other voices in Freedom, Truth, and Human Dignity. Indeed, they argue that the other voices—the “French” or “ontological” school comprised of bishops such as Alfred Ancel and Karol Wojtyła—provide the true key to DH’s meaning and significance. The book thus responds from the perspective of Communio theology to Murray-ite political theologies that are critical of John Paul II’s emphasis on truth as the basis for freedom. Accompanying Schindler’s and Healy’s essays are conciliar texts charting the origin and influence of this ontological school: the six conciliar drafts, the oral and written interventions of Wojtyła, and an oral intervention of Ancel. These texts, transcribed from the Acta Synodalia Sacrosancti Concilii Oecumenici Vaticani II (AS), have been translated by Patrick T. Brannon, S.J., and Michael Camacho. Also included is a side-by-side comparison of the third and sixth drafts that displays the changes made to the juridical position in response to the ontological school.Schindler’s 170-page essay, “Freedom, Truth, and Human Dignity: An Interpretation of Dignitatis Humanae on the Right to Religious Freedom,” is the heart of the work. Schindler recapitulates in a fresh way themes from his prior analyses of liberalism and Murray. In section 1, he summarizes how Wojtyła’s interventions influenced the evolution of DH such that Murray’s juridical approach became subordinated to an emphasis on truth as the foundation and telos of freedom. He conveys Wojtyła’s concern that DH not divide reason and revelation, but that reason be presented as capable of knowing that religion is “nature’s crown and summit” (50). Section 2 outlines Murray’s postconciliar objections to DH’s final version, namely, that it assumes that the American juridical approach leads to relativism and that its insistence on truth as religious liberty’s foundation undermines the universality of the right by degrading the liberty of those in error. To the first, Schindler replies (in section 3) that Murray’s juridical approach necessarily entails what Servais Pinckaers, O.P., called the “freedom of indifference,” Murray’s denials of relativism notwithstanding. The juridical approach leads to the conception of civil space as something neutral to truth-claims about God, but finally results in a state-enforced indifferentism that limits the religious liberty of those who hold that all of existence, prior to human freedom, is intrinsically ordered to God. “The human act, considered from the perspective of the juridical order, is first empty; and truth thus becomes, from that same juridical perspective, adventitious, something that, as such, cannot but logically burden the free-intelligent human act by arbitrarily limiting and closing what is considered by government, for legal purposes, to be simply open, or abstracted from all (metaphysical-religious) content... Victorian poets Elizabeth Barrett (1806-1861) and Robert Browning (1812-1889) first fell in love through letters, which they began to write to each other in 1845 (Figures 1 and 2). Their growing relationship, slowly progressing from letter to first encounter and eventual secret marriage in 1846, is documented in two volumes of letters, with a plot that unfolds as warmly and compellingly as the best page-turner invented by a novelist. Both were master wordsmiths, so the beauty of their letters (...) is no surprise. Decades of research conducted in Western, Educated, Industrialized, Rich, & Democratic (WEIRD) societies have led many scholars to conclude that the use of mental states in moral judgment is a human cognitive universal, perhaps an adaptive strategy for selecting optimal social partners from a large pool of candidates. However, recent work from a more diverse array of societies suggests there may be important variation in how much people rely on mental states, with people in some societies judging accidental harms just (...) as harshly as intentional ones. To explain this variation, we develop and test a novel cultural evolutionary theory proposing that the intensity of kin-based institutions will favor less attention to mental states when judging moral violations. First, to better illuminate the historical distribution of the use of intentions in moral judgment, we code and analyze anthropological observations from the Human Area Relations Files. This analysis shows that notions of strict liability—wherein the role for mental states is reduced—were common across diverse societies around the globe. Then, by expanding an existing vignette-based experimental dataset containing observations from 321 people in a diverse sample of 10 societies, we show that the intensity of a society's kin-based institutions can explain a substantial portion of the population-level variation in people's reliance on intentions in three different kinds of moral judgments. Together, these lines of evidence suggest that people's use of mental states has coevolved culturally to fit their local kin-based institutions. We suggest that although reliance on mental states has likely been a feature of moral judgment in human communities over historical and evolutionary time, the relational fluidity and weak kin ties of today's WEIRD societies position these populations' psychology at the extreme end of the global and historical spectrum. According to the conceptual act theory, emotions emerge when physical sensations in the self and physical actions in others are meaningfully linked to situations during a process that can be called both cognitive and perceptual (creating emotional experiences, and emotion perceptions, respectively). There are key four hypotheses: (a) an emotion (like anger) is a conceptual category, populated with instances that are tailored to the environment; (b) each instance of emotion is constructed within the brain’s functional architecture of domain-general core systems; (...) (c) the workings of each system must be holistically understood within the momentary state of the brain, the body, and the surrounding context; (d) being emergent states, emotional episodes have functional features that physical states, alone, do not have. MinerdAmong the various types of law discussed in St. Thomas's theological "treatise on law"—questions 90–108 of Summa theologia [ST] I-II—the classification known as the "law of nations" (ius gentium) holds an ambiguous epistemological position. Marking a kind of halfway point between the natural law and civil law, it seems to straddle both domains. In fact, in a particularly important text dedicated (...) to this topic in the ST (I-II, q. 95, a. 4), Aquinas classes the ius gentium as being closely connected to the natural law, though in a way that is somewhat derivative, not as immediately flowing from human nature (especially in its animality) as does the natural law, but also not as marked by human contingency as is human civil law.As was recently discussed in a well-documented and insightful article by Barrett H. Turner in The Thomist, there have historically been two main lines of Thomist interpretation concerning the exact character of the "law of nations." Very broadly stated, what he refers to as the "Salamancan" line, indebted to Francisco de Vitoria, "interprets Thomas's doctrine of the ius gentium as a body of universal positive institutions (that is, specifications, determinationes) added to the natural law by agreement of the human race."1 [End Page 1043] This position, which would be common for several centuries among members of the Thomist school, would locate the law of nations essentially in the domain of nearly universally adopted customs and institutions, not strictly deduced from the natural law, but rather grounded on "the quasi-political authority of the entire human race, which promulgates the ius gentium by customs whose utility for attaining the ends of the natural law under a certain set of social conditions is easily recognized by rational creatures."2Turner calls the other line of thought "Maritain's Neo-Thomist Line,"3 an outlook that would be shared with various nuances by thinkers like Jean-Marie Aubert, Yves Simon, Marie-Michel Labourdette, John Finnis, and others. Setting aside my qualms about his appellation "neo-Thomist," which does more to obscure than to illumine (for it covers a host of Thomistic figures who have significantly different views on what constitutes "Thomism"), Turner does fairly lay out the major lines of Jacques Maritain's position, which is most directly articulated in Man and the State and La loi naturelle ou loi non-écrite.4 Basing himself on his particular view of knowledge of the natural law through connaturality,5 Maritain contrasted this sort of moral cognition with that which develops in the line of conceptual articulation, thus having a different "gnoseological" character from our knowledge of the natural law, while nonetheless still sharing the same "ontological" foundation. Such conceptually articulated law would be the ius gentium.Rather than add my voice to the dialectic of the various thinkers arrayed by Turner into the two aforementioned camps, I would like to propose a slightly different approach to the "moral epistemology of the law of nations," though one that I believe lies in line with the best aspects of Maritain's approach. In Salmon's discussion of his account of statistical relevance and statistical explanation there is a peculiarity in the selection of examples. Where he wishes to show that statistical accounts are reasonably treated as explanatory, he draws examples from the social sciences, such as juvenile delinquency. But when he explains the concept of 'causal' relevance, the examples are selected from the natural sciences. This conceals difficulties with salmon's account of causality in the face of multiple causes such as are characteristic of (...) the social sciences. Shaun Gallagher applies enactivist thinking to a staggeringly wide range of topics in philosophy of mind and cognitive science, even venturing into the realms of biological anthropology. One prominent point Gallagher makes that the holistic approach of enactivism makes it less amenable to scientific investigation than the cognitivist framework it seeks to replace, and should be seen as a “philosophy of nature” rather than a scientific research program. Gallagher also gives truth to the saying that “if you want new ideas, (...) read old books”, showing how the insights of the American pragmatists, particularly Dewey and Mead, offer a variety of resources and tools that can be brought to bear on modern day enactivism. Here, I suggest that the adoption of enactivist thinking would undermine the assumptions of certain scientific positions, requiring their abandonment, rather than simply making it more difficult to conduct research within an enactivist framework. I then discuss how Mead’s work has been used previously as a “pragmatist intervention” to help resolve problems in a related 4E endeavour, Gibson’s ecological psychology, and make a case for the inclusion of radical behaviorism as another pragmatist resource for 4E cognition. I conclude with a plea for further enactivist intervention in studies of comparative cognition. (shrink)

Through a re-articulation of Derridean différance, Bernard Stiegler claims that the human is defined by an originary default that displaces all psychic and social life onto technical supplements. His philosophy of technics re-articulates the logic of the supplement as concerning both human reflexivity and its supports, and the history of the différance of life itself. This has been criticised for reducing Derrida's work to a metaphysics of presence, and for instituting a humanism of the relation to the inorganic. By refuting (...) these claims, this article will show that Stiegler's doubling of différance enables him to articulate the human as constituted by both the individuation characteristic of ‘life’, and that of a technical, psychic, and collective individuation. Putting forward a reading of the logic of the trace in life, and emphasising the aspects of Leroi-Gourhan, Simondon, and Canguilhem that Stiegler uses in his reading of Derrida, I will demonstrate that the political stakes of adaption and adoption in his Noopolitics require this re-articulation of différance. Technics shapes the human future, arising from this differential mutation; marking the invention of the human as the site of the political. (shrink)

In order to defend the regress argument for foundationalism against Post’s objection that relevant forms of inferential justification are not transitive, Lydia McGrew and Timothy McGrew define a relation E of positive evidence, which, they contend, has the following features: It is a necessary condition for any inferential justification; it is transitive and irreflexive; and it enables both a strengthened regress argument proof against Post’s objection and an argument that nothing can ever appear in its own justificational ancestry. In reply, (...) we construct in their own terms both a counterexample to the would-be transitivity of E, and a related objection to their never-in-its-own-ancestry argument. We also rebut their rejection of certain counterexamples to the would-be transitivity of some forms of inferential justification. By doing so, and by questioning their transitivity claim for E, we aim to further the project of undermining the circularity arguments advanced by a zoo of skeptics, relativists, antirealists and internalists against realism and externalism. The present paper shows how one might model Everettian quantum mechanics using hyperfinitely many worlds. A hyperfinite model allows one to consider idealized measurements of observables with continuous-valued spectra where different outcomes are associated with possibly infinitesimal probabilities. One can also prove hyperfinite formulations of Everett’s limiting relative-frequency and randomness properties, theorems he considered central to his formulation of quantum mechanics. Finally, this model provides an intuitive framework in which to consider no-collapse formulations of quantum mechanics more generally.

This paper offers a paleobiological perspective on the debate concerning the possible use of biotechnology to bring back extinct species. One lesson from paleobiology is that extinction selectivity matters in addition to extinction rates and extinction magnitude. Combining some of Darwin’s insights about artificial selection with the theory of species selection that paleobiologists developed in the 1970s and 1980s provides a useful context for thinking about de-extinction. Using recent work on the prioritization of candidate species for de-extinction as a test (...) case, the paper argues that de-extinction would be a form of artificial species selection in which humans influence which species persist vs. go extinct. This points to a serious gap in our ethical theory: Much work has been done to clarify the value of biological diversity, but we also need theoretical guidance for decisions that amount to species sorting, and that will shape the macroevolutionary future. Bioethicists disagree over methods, theories, decision-making guides, case analyses and public policies. Thirty years ago, the thinking of many scholars coalesced around a principlist approach to bioethics. That mid-level mode of moral reasoning is now one of many approaches to moral deliberation. Significant variation in contemporary approaches to the study of ethical issues related to medicine, biotechnology and health care raises the question of whether bioethics exists as widely shared method, theory, normative framework or mode of moral reasoning.

In the sixteenth century, Sir Thomas More criticized Martin Luther’s purported denial of a conscious intermediate state between bodily death and bodily resurrection. In the same century, William Tyndale penned a response in defense of Luther’s view. His argument essentially defended the proposition: If the Intermediate State obtains, then bodily resurrection is superfluous for those in the paradisiacal state. In this article, I enter the fray and argue for the truth of this conditional claim. Lawrence Kohlberg's writings on moral education remain the greatest influ-- ence on moral education today in the United States. His student, Carol Gilligan, is one of the most influential writers on feminist ethics and on the idea that there are gender differences in morals. In a remarkable passage, Kohlberg described Emile Durkheim's conception as 'the most philosophi-- cally and scientifically comprehensive, clear and workable approach to moral education extant'. He went on to say that the workability of the system has (...) been demonstrated in Soviet Russia, and describes what he calls the 'logical but to us rather horrifying innovations' suggested by Durkheim's ideas. This article describes the racial integration of Emory University and the subsequent creation of Pre-Start, an affirmative action program at Emory Law School from 1966 to 1972. It focuses on the initiative of the Dean of Emory Law School at the time, Ben F. Johnson, Jr.. Johnson played a number of leadership roles throughout his life, including successfully arguing a case before the United States Supreme Court while he was an Assistant Attorney General of Georgia, promoting legislation to create Atlanta (...) 's subway system as a state senator, and representing Emory in its lawsuit to strike down the state statute that would have rescinded its tax exemption if it admitted African American students ). This account supplements my related article on Pre-Start, "'A Bulwark against Anarchy': Affirmative Action, Emory Law School, and Southern Self-Help", providing more information about historical context generally, and particularly about Emory v. Nash. Johnson was ambitious for Emory as a whole, and particularly for the Law School, and he saw in segregation the single largest impediment to making Emory a nationally prominent research university. The story of Emory's integration, and Johnson's leadership, requires revision of the prevailing story of integration generally, and especially of universities. Integration at Emory came about because of the pressure that African Americans and their supporters created through the civil rights movement, but Emory administrators responded to such pressure more constructively than most. Their actions provide an interesting case study in effective leadership during a period of significant moral and political conflict. (shrink)

The Consequence Argument has long been a staple in the defense of libertarianism, the view that free will is incompatible with causal determinism and that humans have free will. It is generally held that libertarianism is consistent with a certain naturalistic view of the world—that is, that libertarian free will can be accommodated without the postulation of entities or events which neither are identical to nor supervene on something physical. In this paper, I argue that libertarians who support their view (...) with the Consequence Argument are forced to reject this naturalistic worldview, since the Consequence Argument has a sister argument, which I call the Supervenience Argument, that cannot be rejected without threatening either the Consequence Argument or the naturalistic worldview in question. Max Weber, German economist, historian, sociologist, methodologist, and political thinker, is of philosophical significance for his attempted reconciliation of historical relativism with the possibility of a causal social science; his notion of a verstehende sociology; his formulation, use and epistemic account of the concept of ‘ideal types’; his views on the rational irreconcilability of ultimate value choices, and particularly his formulation of the implications for ethical political action of the conflict between ethics of conviction and ethics of responsibility; and his (...) sociological account of the causes and uniqueness of the western rationalization of life. These topics are closely related: Weber argued that the explanatory interests of the historian and social scientist vary historically and that the objects of their interest were constituted in terms of cultural points of view, and that consequently their categories are ultimately rooted in evaluations, and hence subjective. But he also argued that social science cannot dispense with causality, and that once the categories were chosen, judgments of causality were objective. The explanatory interests of the sociologist, as he defined sociology, were in understanding intentional action causally, but in terms of categories that were culturally significant, such as ‘rational action’. Much of his influence flowed from his formulation of the cultural situation of the day, especially the idea that the fate of the time was to recognize that evaluations were inescapably subjective and that the world had no inherent ‘meaning’. The existential implications of this novel situation for politics and learning were strikingly formulated by him: science could not tell us how to live; politics was as a choice between warring Gods. Weber’s scholarly work and his politics served as a model for Karl Jaspers, and a subject of criticism and analysis for other philosophers, such as Karl Löwith, Max Scheler, and the Frankfurt School. The standard issues with experts are about the nature of scientifi c expertise; problems of legitimacy and problems having to do with the limits of expertise; problems having to do with the place of experts in democratic politics and bureaucracies; as well as more general problems about the knowledge that experts possess: what the role of tacit knowledge and knowledge embodied in things and routines is, and to what extent expertise can be replaced or augmented by expert systems and technical (...) means. The chapters collected in this volume will be concerned with all of these issues, with the exception of tacit knowledge and technological “expert systems,” which will be the subject of a separate volume, Understanding the Tacit. The chapters in the present volume, however, go beyond the problem of scientifi c expertise, which will be treated as one type among many forms of expertise. (shrink)

Open any standard bioethics textbook, and therein can be found a host of subjects ranging from the abortion rights controversy to the morality of xenographic tissue transplantation. Just as there is a wide scope to the subject matter of bioethics, its practitioners come from a multitude of disciplines, including law, medicine, nursing, theology, philosophy, sociology, and anthropology. And yet, despite a rich variety of investigators and methods, bioethicists overlook numerous subjects that deserve to be addressed. In particular, they neglect issues (...) of public health, preventive medicine, and social medicine. Although topics such as physician-assisted suicide, prenatal genetic testing, and the ethics of new reproductive technologies constitute the contemporary canon of bioethics and deserve sustained analysis, these subjects are not so significant that they should eclipse other issues. For example, gun control policies, the regulation of food additives. immunization programs, prenatal care, leave programs enabling employees to care for dying relatives, the provision of nutrition and medical care to the homeless, and the use of emergency rooms by the most impoverished citizens are all topics neglected by bioethicists. We propose that learning has a top-down component, but not in the propositional terms described by Mitchell et al. Specifically, we propose that a host of learning processes, including associative learning, serve to imbue the representation of the conditioned stimulus (CS) with affective meaning.

Since 9/11, the possibilities for pluralism and tolerance have been severely tested by a discourse of terrorism and security. The development of an intelligent and cosmopolitan understanding between religious communities in Europe and America has been compromised by a range of legal and political responses to terrorism. While the debate about the berqa has clearly indicated the problems relating to Muslim cultural differences, we argue that legal pluralism and in particular the question of Shari’a tribunals may prove to be a (...) more decisive test of Western multiculturalism. This article examines the many criticisms raised against religious arbitration in domestic affairs and considers the presence of the Shari’a at various levels of society, claiming that the evolution of Sharia-mindedness is compatible both with a faith-based life and with liberal ideals. However, the problem with religious courts lies elsewhere, namely with the fragmentation of social life and the erosion of citizenship. The article concludes by examining the prospects and problems of Turkish entry into the European Union with special reference to the domestic policies of the Justice and Development Party. (shrink)
