We commend the authors for their comprehensive discussion on consent and episiotomies.1 They correctly observe that informed consent for all proposed interventions in maternity care is always necessary. The claim that consent for maternity health services does not always have to be fully informed or explicit, however, is erroneous. We are especially concerned with, and surprised by, the endorsement of ‘opt-out consent’. ‘Opt-out consent’ (a.k.a. substitute decision making) is already standard practice in maternity healthcare, with obstetric violence a normalised response (...) to conclusive refusals or requests for explanations. Informed consent is based on the fundamental human rights to bodily autonomy and integrity, which healthcare providers are obliged to respect. Healthcare structured around human rights violations is not care. It is cruel and inhumane treatment—a violation of yet another fundamental human right—and a reflection of poor-quality care. To be valid, consent must always be informed, specific, timely, freely given and reversible. The provider must provide information specific to each and every proposed intervention in a timely manner. The consumer has the right to consider, freely accept or refuse before providers can act. They can also change their mind at any time. Provider attempts to substitute consumer decision-making rights constitute assault and battery. Whether the infraction was major or minor is of no consequence to human rights law. The success of models of human behavior based on Bayesian inference over logical formulas or programs is taken as evidence that people employ a “language-of-thought” that has similarly discrete and compositional structure. We argue that this conclusion problematically crosses levels of analysis, identifying representations at the algorithmic level based on inductive biases at the computational level.

We read commentaries on our feature article ‘The ethics of consent during labour and birth: episiotomies’1 with gratitude and interest. Nearly all commenting authors agree that consent for in-labour procedures is necessary and ideally given at the point of intervening. Both Shalowitz & Ralston and Stirrat note that this is already required by professional statements and guidelines in the USA2 and UK3, respectively, but also note that practice does not yet conform. The Americans authors helpfully emphasise the importance of multilevel (...) institutional measures for closing this gap, including consent policies and reporting mechanisms, as well as ongoing education.2 The UK writer seconds the role for education within wider shared decision-making and informed choice approaches, and generously commends our paper for close study by all maternity care providers. Others add a cautionary note. Lee applauds all our recommendations, but notes our proposals cannot fully secure autonomy because of, among others, epistemic injustice and other power differentials.4 Kumar-Hazard and Dahlen worry that opt-out consent is equal to substitute decision-making; weakens women’s rights; and is open to abuse.5 Nelson and Clough object to our willlingness to work within a flawed conceptual framework, which ought to be challenged.6 We agree that there are limits to what our proposal can do. The agroecological transition of agriculture not only requires changes in practices but also in ways of thinking and in their underlying values. Agroecology proposes broad scientific principles that need to be adapted to the singularities of each farm. This contextualization leads to the identification of agroecological practices that work locally and could serve as evidence-based practices to be transferred to local practitioners. This strategy was tested in a 4-year experiment conducted with dairy-sheep farmers in the South of France. The aim (...) was to collectively engage in the agroecological transition. Our work focused on the creation of a diagnostic tool that was used to analyze local farms and identify virtuous practices to be promoted locally as evidence-based practices. But this strategy came up against the complexity and singularity of the situations to be transformed: not only was no evidence found but the construction of the diagnostic tool itself led to controversy concerning the models of agriculture to be promoted. The experiment then took a pragmatic turn: on-farm workshops were organized to enable farmers to benefit from the professional judgment of peer farmers who were willing to help their colleagues accomplish their agroecological transition. The diagnostic tool, which was designed to be prescriptive, was then used to judge the social acceptability of solutions that made sense in each farmer’s own situation. Our experiment led us to conclude that managing the agro-ecological transition of farmers and their farming system is better conceived as a value-based process than as an evidence-based one. Given the rapid growth and emerging trend of e-commerce have changed consumer preferences to buy online, this study analyzes the current Indian legal framework that protects online consumers’ interests. A thorough analysis of the two newly enacted laws, i.e., the Consumer Protection Act, 2019 and Consumer Protection Rules, 2020 and literature review support analysis of 290 online consumers answering the research questions and achieving research objectives. The significant findings are that a secure and reliable system is essential for e-business firms (...) to work successfully; cash on delivery is the priority option for online shopping; website information and effective customer care services build a customer's trust. The new regulations are arguably strong enough to protect and safeguard online consumers' rights and boost India’s e-commerce growth. Besides factors such as security, privacy, warranty, customer service, and website information, laws governing consumer rights protection in e-commerce influence customers’ trust. Growing e-commerce looks promising with a robust legal framework and consumer protection measures. The findings contribute to the body of knowledge on e-commerce and consumer rights protection by elucidating the key factors that affect customer trust and loyalty and offering an informative perspective on e-consumer protection in the Indian context with broader implications. Appropriate and balanced decision-making is sentinel to goal setting and the provision of appropriate clinical care that are attuned to preserving the best interests of the patient. Current family-led decision-making in family-centric societies such as those in Singapore and other countries in East Asia are believed to compromise these objectives in favor of protecting familial interests. Redressing these skewed clinical practices employing autonomy-based patient-centric approaches however have been found wanting in their failure to contend with wider sociocultural considerations that impact (...) care determinations. Evaluation of a number of alternative decision-making frameworks set out to address the shortcomings of prevailing atomistic and family-centric decision-making models within the confines of end-of-life care prove these alternative frameworks to be little better at protecting the best interests of vulnerable patients. As a result, we propose the Welfare Model that we believe is attentive to the relevant socio-culturally significant considerations of a particular case and better meets the needs of end-of-life care goals of preserving the welfare of patients. Employing a multi-professional team evaluation guided by regnant psychosocial, legal, and clinical standards and the prevailing practical and clinical realities of the particular patient’s setting the Welfare Model provides a clinically relevant, culturally sensitive, transparent, and evidence-based approach to care determinations. In this paper, I argue that Will Kymlicka’s theory of “mult”-iculturalism serves to unwittingly perpetuate a form of neo-colonial agenda in which Indigenous claims for recognition and sovereignty in Canada are accommodated to the degree and extent to which they are willing to “liberalize” and promote distinctly Euro-Western self-understandings and conceptions of individual autonomy (tied to substantive notions such as private property) – the supposedly foundational value and defining feature of liberalism. In fact, Kymlicka vehemently attacks Rawls’ theory of political (...) liberalism, whose tolerance-based conception provides a far more open theoretical normative architecture within which to dialogue with non-Western nations, where views of self, autonomy, property, land, non-human animals, and secularism may differ radically from those of liberal Western nations – or so I contend here. This article attempts to create the space for rethinking the politics and ethics of consumption by initiating dialogues with Swadeshi movements and Gandhi in order to transform the spaces ofproduction transcending the concern for consumption choices. Analysing the history of Swadeshi movements in pre-independence India, especially Bengal, and drawing inspiration from Gandhi 's Swadeshi movement and his principles of swaraj and satyagraha, an attempt has been made here to provide an aesthetic, ethical and spiritual foundation for the present version of (...) the Swadeshi drive in India, which is substantively immersed in the logic of market capitalism and mindless consumption. : Classical Sāmkhya, as represented by Īśvarakrsna's Sāmkhya-kārikā, is well known for its attempt to prove not only the reality but the plurality of selves (purusa-bahutva). The Sāmkhya argument, since it proceeds from the reality of the manyness of the bodies as its basic premise, approximates, even if not in every detail, the 'argument from analogy' in its traditional form (which the essay tries to explicate). One distinguished modern interpreter, K. C. Bhattacharyya, however, not satisfied with this account, attempts to (...) interpret and expound Sāmkhya pluralism in terms of a radically different strategy consisting of showing that the self is known in buddhi in its pure asmita function as an infinite I and so as necessarily involving all Is or selves. This solution, which in the process offers reflections on such issues as infinity, universals, the role of 'I', the individuality (of self ), et cetera, is examined and criticized at length with respect to some of its basic assumptions, with a brief focus on the idea of 'self-consciousness', which according to some (Western) philosophers presupposes 'other'-consciousness and which in certain respects seems to inform Bhattacharyya's thoughts on the main issue. With the technological evolutionary advent, a vision-based approach presents the remote measuring approach for the analysis of vibration. The structure vibration test and model parameter identification in the detection of the structure of the bridge evaluation occupies the important position. The bridge structure to operate safely and reliably is ensured, according to the geological data of qixiashan lead-zinc mine and engineering actual situation, with the aid of international mining software Surpac. To build the 3D visualization model of the application of (...) visualization in mine production are discussed. The results show that the final solid model of -425 stope can accurately display the spatial form of each layer of stope through rotation, amplification and movement. The proposed system is effectually able to perform cutting, volume calculation and roaming in any direction, which has certain guiding significance for mine production management. An accuracy value of 98.75%, the sensitivity of 99%, specificity of 99.64% and PPV of 99.89% are achieved using the proposed 3D modelling and visualization algorithm for vibration signal processing and management. This article discusses the importance of human beings ‘material’ (matter) and ‘spiritual’ (spirit) advancement in Rammanohar Lohia’s concept of modernity and modern civilization. Lohia consistently defended materialism (reason) and spirituality as pivotal human values in his writing and speeches. This article engages with his ideas through a detailed reading of his works, focusing particularly on his essays: ‘Materiality and Spirituality’ and ‘Meaning of Modern Civilisation’. According to him, rational thinking emerges from materialism. He believed spiritual instinct keeps a check on (...) the malicious employment of rationality and science; similarly, rationality prevents the perversion of spirituality into superstition and dogmatism. This article articulates two aspects of interpreting modernity: first, it reframes the epistemological understanding of materialism and spirituality, challenging and clarifying prevailing misconceptions; second, it advocates a comprehensive reconstruction of Indian society, which we understand as praxis. His concept of modernity is an amalgamation of theory and praxis. But how did human morality evolve? This article analyzes the way in which the Israeli military exercises control over life in Gaza by regulating who and what may enter or leave. Using primary source documents obtained via the Freedom of Information Act proceedings, the article details a military bureaucracy that micro-manages requests to move people and goods through Gaza’s crossings. For example, the transfer of chickpea paste requires approval from a senior military official holding the rank of major general, and soldiers evaluate the quality of care (...) offered to an orphan by his or her surviving parent, as a condition of authorizing the child’s passage to his parent’s home. The article discusses the effects of such control on the lives of those inside Gaza, including their exercise of rights and their social and economic choices. It then explores the motivations behind the restrictions, relying on statements and actions by Israeli officials. The article extends the current literature on deliberately nonrational bureaucracies in the context of rule by a foreign power by showing how the Israeli military bureaucracy maintains some functions of control over the local population in Gaza, despite its withdrawal and dismantling of its military government. It concludes by noting that the effects of the travel restrictions and their purpose are relevant to the normative debate over their legitimacy and suggests areas for further research. (shrink)
