When the benefits of surgery do not outweigh the harms or where they do not clearly do so, surgical interventions become morally contested. Cutting to the Core examines a number of such surgeries, including infant male circumcision and cutting the genitals of female children, the separation of conjoined twins, surgical sex assignment of intersex children and the surgical re-assignment of transsexuals, limb and face transplantation, cosmetic surgery, and placebo surgery.

Tarski's equivalence, as he allows, applies only roughly to assertions in ordinary language. Some of the relevant exceptions are of merely grammatical importance but others leave scope for interesting metaphysical pronouncements on science, mathematics and other fields of assertion. To understand these latter exceptions is to gain insight into Baylis' and Lukasiewicz' views on the question "Are some Propositions neither True nor False?" (this journal, 1936). The debate about what constitutes the discipline of ethics and who qualifies as an ethics consultant is linked unavoidably to a debate that is potentiated by the reality of a rapidly changing and high-stakes health care consultation marketplace. Who we are and what we can offer to the moral gesture that is medicine is shaped by our fundamental understanding of the place of expert knowledge in the transformation of social reality. The struggle for self-definition is particularly freighted since clinical ethics (...) consultation aspires to be more than academic contemplation. Two recent books (Ethics Consultation by John La Puma and David Schiedermayer and The Health Care Ethics Consultant: A Practical Guide, edited by Francoise Baylis) exemplify the two most popular but most widely divergent positions on these issues. We argue that while useful, neither book addresses fully the particular and distinct role of the professional ethicist. (shrink)

Der Neue Experimentalismus musste sich angesichts seines Gegensatzes zwischen experimentellen Praktiken und grundlegenden Theorien mit dem Problem der Beziehung zwischen der Einmaligkeit der ersteren und der Allgemeinheit der letzteren auseinandersetzen. Andere Autoren (von Charles A. Baylis und Nelson Goodman bis Catherine Elgin) haben das Konzept der Exemplifikation verwendet, um die Beziehung zwischen partikulären und universellen/allgemeinen Begriffen oder Gesetzen zu klären. Es stellt sich jedoch die Frage, ob sie zwar einen Gesichtspunkt andeuten, der neue Aspekte des Problems beleuchten kann, das (...) Problem selbst aber nicht lösen. In diesem Artikel wird auf der Grundlage von Überlegungen, die an anderer Stelle entwickelt wurden, sowie in Anlehnung an eine Anregung von Aristoteles vorgeschlagen, den Begriff der Exemplifikation mit dem Problem der Induktion und der Abduktion zu verknüpfen, die hier als Bezeichnung für eine Vielzahl methodischer Verfahren verstanden werden, die darauf abzielen, eine kognitive Beziehung zwischen der Reproduzierbarkeit wissenschaftlicher Begriffe oder Gesetze und der Konkretheit, der Lokalität und dem situierten Charakter experimenteller Praktiken herzustellen. Eine notwendige Voraussetzung für die Lösung des durch diese Beziehung aufgeworfenen Problems ist die Unterscheidung zwischen zwei Bedeutungen − einer reflexiv-transzendentalen und einer genetisch-methodologischen − des Begriffspaares Entdeckung/Rechtfertigung. Dies wirft gleichzeitig Licht auf das Problem der Induktion sowie auf das Problem des Verhältnisses zwischen der Universalität wissenschaftlicher Gesetze und dem stets lokalen und situierten Charakter experimenteller Praktiken. Abstract Recently, there has been a growing interest in public health and public health ethics. Much of this interest has been tied to efforts to draw up national and international plans to deal with a global pandemic. It is common for these plans to state the importance of drawing upon (...) a well-developed ethics framework and we argue that this framework should reflect the values and insights of feminist relational theory. More specifically, we argue that pandemic planning must be squarely situated in the larger realm of public health and that an ethics framework for public health will be one that recognizes the need to pay particular attention to the vulnerability of subpopulations lacking in social and economic power. We propose an ethics framework for public health that builds on the notions of relational personhood (including relational autonomy and social justice) and relational solidarity. The primary objective of The Health Care Ethics Con sultant is to focus attention on an immediate practical problem: the role and responsibilities, the education and training, and the certification and accreditation of health care ethics consultants. The principal questions addressed in this book include: Who should be considered health care ethics consultants? Whom should they advise? What should be their responsi bilities and what kind of training should they have? Should there be some kind of accreditation or certification program (...) to ensure that those who call themselves ethics consultants are in fact qualified to advise, consult, research, and write in health care ethics? The distinguished authors ofthese articles are persons with diverse backgrounds, interests, presumptions, and val ues. Not surprisingly, therefore, diverse responses have emerged to the questions posed. Though the book's chapters are individually authored, they are informed by the group discussions that went on during active workshop sessions, and by knowledge of the contributions of others. All of the chapters meaningfully represent their consensus. This is not to say that there were no disagreements regarding specific details, but rather that there were no fundamental objections on the book's basic content among a panel of authors who share basic premises regarding the role, responsibilities, education, and certifica tion of health care ethics consultants. All Canadian bioethicists need to reflect on the meaning and value of their work, to see more clearly how the ethics of bioethics is being undermined from within. In the case involving Dr Olivieri, the Hospital for Sick Children, the University of Toronto, and Apotex Inc, there were countless opportunities for bioethical heroism. And yet, no bioethics heroes emerged from this case. Much has been written about the hospital’s and the university’s failures in this case. But what about the deafening (...) silence from the Canadian bioethics community? Given the duty of bioethicists to “speak truth to power”, this silence is troubling. To date, nothing has been written about the silence. This article is intended as a partial remedy. As well, the article pays tribute to heretofore unsung heroes among Dr Olivieri’s research colleagues. (shrink)

With the advent of CRISPR gene-editing technology, designer babies have become a reality. Françoise Baylis insists that scientists alone cannot decide the terms of this new era in human evolution. Members of the public, with diverse interests and perspectives, must have a role in determining our future as a species.

This paper concerns the reformulation by British expatriates and the first generation of English-speaking Indian intellectuals of the key ideas of European constitutional liberalism between 1810 and 1835. The central figure is Rammohan Roy, usually seen as a of Hinduism. Here Rammohan's thought is set in the context of the Iberian and Latin American constitutional revolutions and the movement for free trade and parliamentary reform in Britain. Rammohan and his coevals created a constitutional history for India that centred on the (...) institution of the panchayat, a local judicial body. While some expatriates and Indian radicals discussed or for the country as early as the 1830s, Rammohan himself argued for constitutional limitations on the Company's power and Indian representation in Parliament. Under liberal British government, he believed, an Indian public would emerge, empowered by service on juries and the operations of a free press. (shrink)

Beverly Beckham writes in the Boston Globe in praise of Lisa Genova’s Still Alice: “You have to get this book. … I couldn’t put it down. …” After I read Still Alice, a book of fiction about an accomplished Harvard professor with early-onset Alzheimer’s disease, I too wanted to tell everyone to get this book, but not because “I couldn’t put it down.” The first time I read it, I put it down several times to cry. It was too painful (...) to read in one stretch. Years back, my mother, Gloria Baylis,1 had been diagnosed with vascular dementia, and recently there had been findings suggestive of an atypical presentation of Alzheimer’s disease. In responding to Ms Rowell’s commentary on her original paper the author points out that the job of all bioethicists, namely, speaking truth to power, is a daunting task which is unlikely to succeed “if we do not learn to ask for and to accept, to offer and to provide, moral support and meaningful help.”In my article “The Olivieri debacle: where were the heroes of bioethics?”1 I make four comments about Ms Rowell’s involvement in the case. In my first comment (...) relating to Ms Rowell, I suggest that a careful reader of the Naimark report could reasonably conclude “that the role of bioethics in helping to resolve the controversy was, at best, very limited”. In reaching this conclusion, I relied on the findings of the two official reports/inquiries about this case. Though the two reports reach different conclusions about the case, there appears to be agreement on the very limited role of bioethics. As noted in my original article, in the 160 page Naimark report there are but a few paragraphs about bioethics and Ms Rowell’s role in the Olivieri case. This is surprising, and I say as much in my article. In the 540 page report of the Committee of Inquiry, which Ms Rowell describes as “a review that I believe to provide a public report of integrity”, little more detail is provided regarding Ms Rowell’s role. I included all references to Ms Rowell from the first report in the original article. I did not do so with the second report. This was not done to diminish any contribution Ms Rowell might have made. In my view, no new evidence germane to the points I wanted to make was provided in the text that I did not include in my article.In …. (shrink)

This paper critically examines the biology of species identity and the morality of crossing species boundaries in the context of emerging research that involves combining human and nonhuman animals at the genetic or cellular level. We begin with the notion of species identity, particularly focusing on the ostensible fixity of species boundaries, and we explore the general biological and philosophical problem of defining species. Against this backdrop, we survey and criticize earlier attempts to forbid crossing species boundaries in the creation (...) of novel beings. We do not attempt to establish the immorality of crossing species boundaries, but we conclude with some thoughts about such crossings, alluding to the notion of moral confusion regarding social and ethical obligations to novel interspecies beings. It is not unusual for patients and their families, when confronted with difficult medical choices, to ask their physicians for advice. This paper outlines the shades of meaning of two questions frequently put to physicians: “What should I do?” and “What would you do?” It is argued that these are not questions about objective matters of fact. Hence, any response to such questions requires an understanding, appreciation, and disclosure of the personal context and values that inform the recommendation. A framework (...) for considering and articulating a response to these questions is suggested, using as a heuristic the phrasing “If I were you…/If it were me…” Journal of Medical Ethics. (shrink)

The dominant approach to conscience in contemporary bioethics presumes that conscience functions to promote personal moral integrity, and therefore presumes that the relevant values are inherently personal. This approach fails to demonstrate when and why claims of conscience should be taken seriously by others. I draw on Hannah Arendt’s deliberative model of conscience and Cheshire Calhoun’s social model of integrity to develop an alternative relational view of conscience—one that demonstrates that the relevant values are social as well as personal. In this article, I argue that there is no compelling therapeutic ‘need’ for human nuclear genome transfer to prevent mitochondrial diseases caused by mtDNA mutations. At most there is a strong interest in this technology on the part of some women and couples at risk of having children with mitochondrial disease, and perhaps also a ‘want’ on the part of some researchers who see the technology as a useful precedent – one that provides them with ‘a quiet way station’ in (...) which to refine the micromanipulations techniques essential for other human germline interventions and human cloning. In advance of this argument, I review basic information about mitochondrial disease and novel genetic strategies to prevent the transmission of mutated mitochondria. Next, I address common features of contemporary debates and discussions about so-called mitochondrial replacement. First, I contest the cliché that science-and-technology is fast outpacing ethics. Second, I dispute the accuracy of the term ‘mitochondrial replacement’. Third, I provide a sustained critique of the purported ‘need’ for genetically-related children. In closing, I call into question the mainly liberal defense of human nuclear genome transfer. I suggest an alternative frame of reference that pays particular attention to issues of social justice. I conclude that our limited resources should be carefully expended in pursuit of the common good, which does not include pandering to acquired desires. (shrink)
