Abstract This article examines the common claim that there are gaps in international law that undermine accountability of private military and security companies. A multi-actor analysis examines this question in relation to the commission of international crimes, violations of fundamental human rights, and ordinary crimes. Without this critical first step of identifying specific deficiencies in international law, the debate about how to enhance accountability within this sector is likely to be misguided at best.

How well did Renan know Malebranche? What did he think of him? Did his opinion of him undergo any evolution? To find the answers to these questions one must go back to about 1840, when Renan, a.t seventeen, began his study of Malebranche. By the time he was twenty, Renan, under the guidance of M. Gosselin, who little suspected how great a contribution Malebranche would make to Renan's decision to leave the Church, was reading the philosopher with enthusiastic regularity. Indeed, the Oratorian had become "l'objet perp6tuel" of his reflections, he tells us. The speculative terminology of the Entretiens sur la M6taphysique and the M6ditations chrgtiennes echoed through his class compositions and notebooks. His ideas on the general action of Providence in the universe were already similar to those of this philosopher, who, "illustre" and "saint," soon became for him a kind of spiritual hero, a hero whose exemplary intellectual zeal drew Renan instinctively ever more deeply into the contemplative life, into.the fervent and determined quest for "Truth." Is an appropriate causal connection to the past experience it represents a necessary condition for a mental state to qualify as an episodic memory? For some years this issue has been the subject of an intense debate between the causalist theory of episodic memory (CTM) and the simulationist theory of episodic memory (STM). This paper aims at exploring the prospects for an embodied approach to episodic memory and assessing the potential case for causalism that could be founded on it. In (...) a critical section, it argues that the empirical data to which STM appeals are both incomplete and inconclusive, and on closer examination even provide support for a proceduralist version of CTM. In a constructive section, it elaborates on the notion of a necessary causal connection in terms of particular procedural patterns acquired at encoding and operative at retrieval, grounding this move on recent empirical data about eye movements in mnemonic mental imagery. This paper tackles the issue of the diversity of déjà experiences. According to the standard view in the neuropsychological literature, they should all be defined by means of a psychological criterion, by which they are experiences triggered by a perceived item and consist of a conscious clash between a first-order feeling of familiarity about the item and a second-order evaluation that assesses the first-order feeling as erroneous. This paper dismisses the standard view and contends there are two types of déjà (...) experiences, labeled déjà vu and déjà vécu respectively. But it also takes issue with the rare proponents of a distinct déjà vécu type. Contrary to their achievement view, it argues that recollection is not involved in déjà vécu experiences as an actual mental state or a component thereof. In our ability view, déjà vécu involves the feeling that one could recollect past occurrences of a currently lived episode of experience. (shrink)

Lies are typically defined as believed falsehoods asserted with the intention of deceiving the hearer. A particularly problematic case for this definition is that of false implicatures. These are prototypically cases where the proposition expressed by the speaker's utterance is true, yet an implicature conveyed by this proposition in context is false. However, implicature is a diverse category and whether a blanket statement such as “false implicatures are lies,” as some have argued can account for all of them is open (...) to investigation. We present an experimental investigation of whether naïve participants define different types of implicatures as lies. Our results show that only a couple of types of implicatures were strongly rated as lies by participants. These results suggest that participants distinguish between different types of communicated meanings on linguistic grounds, contributing both to the literature on lying, as well as to theoretical discussions of how different types of meaning are communicated. This article provides a survey of Walker Percy's criticism of what Pope Benedict XVI calls “scientificity,” which entails a constriction of the dynamic interaction of faith and reason. The process can result in the diminishment of ethical considerations raised by science's impact on public policy. Beginning in the 1950s, Percy begins speculating about the negative influence of scientificity. The threat of a political regime using weapons of mass destruction is only one of several menacing developments. The desacrilization of human life (...) from cradle to grave leads Percy to assert that modern science's impact is often radically incoherent. Placebo-controlled trials are held by many, including regulators at agencies like the United States Food and Drug Administration, to be the gold standard in the assessment of new medical interventions. Yet the use of placebo controls in clinical trials has been the focus of considerable controversy. In this two-part article, we challenge a number of common beliefs concerning the value of placebo controls. Part I critiques statistical and other scientific justifications for the use of placebo controls in clinical research. The (...) continued use of placebo controls in clinical trials on diseases for which accepted treatment exists raises equally important ethical, legal, and regulatory issues for which various justifications have been given. Defense of this practice relies on normative as well as empirical myths.In their attack on the prevailing use of placebo controls, Kenneth Rothman and Karin Michels emphasize that this practice stands in violation of the World Medical Association's guidelines on the ethics of human experimentation, most commonly known as the Helsinki Declaration. The present study investigated how the magnitude the word blindness suggestion effect on Stroop interference depended on hypnotic suggestibility when given as an imaginative suggestion and under conditions in which hypnosis was not mentioned. Hypnotic suggestibility is shown to be a significant predictor of the magnitude of the imaginative word blindness suggestion effect under these conditions. This is therefore the first study to show a linear relationship between the imaginative word blindness suggestion effect and hypnotic suggestibility across the whole hypnotizability (...) spectrum. The results replicate previous findings showing that highs respond to the word blindness suggestion to a greater extent than lows but extend previous work by showing that the advantage for those higher on the hypnotizability spectrum occurs even in a non-hypnotic context. Negative attitudes about hypnosis may not explain the failure to observe similar effects of the word blindness suggestion in less hypnotizable individuals. (shrink)

Schupbach and Sprenger introduce a novel probabilistic approach to measuring the explanatory power that a given explanans exerts over a corresponding explanandum. Though we are sympathetic to their general approach, we argue that it does not adequately capture the way in which the causal explanatory power that c exerts on e varies with background knowledge. We then amend their approach so that it does capture this variance. Though our account of explanatory power is less ambitious than Schupbach and Sprenger’s in (...) the sense that it is limited to causal explanatory power, it is also more ambitious because we do not limit its domain to cases where c genuinely explains e. Instead, we claim that c causally explains e if and only if our account says that c explains e with some positive amount of causal explanatory power. (shrink)

This article is an attempt to examine and clarify the truth theory of American pragmatism. Three central ideas of this truth theory will be considered in light of Whitehead's metaphysics: a rejection of the correspondence theory of truth, a defense of fallibilism, and a recognition of the temporality of truth.

In this paper the centrality of concepts for intellectual history is stressed. Naturally, this focus on concepts requires an account of what concepts are. More contentiously, an account of how concepts are best approached by intellectual historians also requires taking a stand vis-à-vis some prevailing notions of concepts. In particular, I will direct attention to the weaknesses of the historicist theory of concepts derived from the later Wittgenstein. By contrast, I will put forward an account of conceptual innovation and change (...) in intellectual history based on a notion of concept loosely inspired by Frege. The first three parts of the paper lay out a framework for what I call “analytic contextualism,” which is then briefly illustrated with an example from the history of political thought in the fourth part. I argue that this framework should be attractive to intellectual historians for two reasons: First, Fregean concepts, due to their relative independence from context, explain long-term conceptual stability and change better than competing notions of concepts. Second, a Fregean notion of concept is better suited than its competitors to explain how concepts and conceptual innovation sometimes manage to have causal effect on institutions and social reality. To demonstrate the latter point, it will be shown that my account of concepts is consistent with, and well placed to exploit, recent philosophical advances in social ontology. (shrink)
