According to a model of inter-theoretic relations advocated by Patricia S. Churchland, psychology will need to revise its theories so as to fit them for "smooth reduction" to the neurosciences, and this will lead to the elimination of reference to intentional contents from psychology. It is argued that this model is ambiguous; on one reading it is empirically implausible, on the other its methodology is confused. The connectionist program NETtalk, far from exemplifying the model as Churchland claims, suggests a theoretical (...) rationale for employing relations to intentional contents in psychology. A summary is out of place because of the outlinish nature of the presentation. I have presented a taxonomy or general theory of ethics. The view is acceptable or not depending on how well it competes with rival theories. One thing that hinders such a comparison is the absence of sufficiently clearly articulated rivals. Perhaps this paper will stimulate the production of some rival views.

With this significant work from 1932, The Self-Conscious Determination of Nothingness, we have the third important book of Nishida’s period of philosophical maturity. Here, Nishida has moved beyond the unconvincing essays of the previous periods, such as the ingenuous psychologism of A Study of Good or the epistemological theorization of the hesitant neo-Kantian period. Nishida is now developing the consequences of his major philosophical notion, the “logic of place”. In Home Building & Loan Assn. v. Blaisdell, the Supreme Court upheld the constitutionality of the Minnesota Mortgage Moratorium Act. Under the terms of the Act---one of the many pieces of moratory legislation enacted due to the Great Depression---mortgagors who found themselves unable to make their payments could turn to the state courts for an alteration of their payment schedule. It is clear that if there ever was a state of affairs in which one could justify the imposition of debtor (...) relief, the circumstances in Minnesota during the early 1930s would have filled the bill. By most accounts, the Act was justifiable from a policy perspective. ;Nevertheless, the outcome did not please everyone. The question before the Court was whether the proceedings authorized by the Act violated the contracts clause of the Constitution. Article 1, §10 provides that "No State...pass any...law impairing the Obligation of Contracts." The Act did impair the obligation of mortgage contracts. Furthermore, the Act was exactly the kind of debtor relief legislation that the contracts clause meant to forbid. The basic premise underlying the majority opinion was that a constitutional provision should be interpreted both in the context of the entire Constitution and in the context of the social situation confronting the Court. According to the dissent, the framing of the Constitution fixed the meaning of a provision for all cases arising across time. The two approaches represent two extremes in constitutional interpretation. However, the basic agreement is over how the Constitution should evolve. The basic disagreement concerns the problem of constitutional change. ;In a recent work, Robert Lipkin radically rethinks modern constitutional jurisprudence, challenging the received view of constitutional change. His theory of "constitutional revolutions" implies that conventionalism, coherentism, pragmatism, and naturalism all fall short as the best theory of constitutional change. In addition to offering a critique of Lipkin's theory, the present work conducts an independent investigation the theories Lipkin rejects. Such an investigation will not only help ascertain the legitimacy of Lipkin's theory of constitutional revolutions in particular, but of radical constitutional change in general. (shrink)

Fragmento sintético de una investigación general, el presente articulo tematiza, en tres actos cortos, la singular analogía notada por Wittgenstein entre investigación filosófica e investigación estética . A partir del pensamiento de Wittgenstein, considerado como pensamiento musical, el artículo abre una perspectiva de estilo categorial, en su "isología"con el pensamiento musical, y define la posibilidad de una hermenéutica descriptiva de los estilos liberada de los modelos estructurales.

Dans les débats portant aujourd’hui sur les relations entre l’homme et l’animal, singulièrement à propos des luttes féroces entre « spécistes » et « antispécistes », Descartes est souvent convoqué pour justifier telle ou telle thèse extrémiste. Le plus souvent sa pensée est ramenée à une citation tronquée ou à une analyse coupée de son contexte. Il apparaît alors comme le repoussoir de la prétendue bienveillance moderne envers l’animalité. Les bêtes n’ayant pas d’âme « comme nous », il serait possible (...) de les traiter cruellement. Comme si elles ne disposaient pas d’une intelligence et d’une sensibilité proche des nôtres! On oublie d’abord que la théorie de l’« animal machine » vaut autant pour les hommes que pour les bêtes. C’est surtout un principe méthodologique qui permet à Descartes d’éviter les errances de la médecine humoriste. Il s’agit pour Descartes de penser les corps spatialement à l’aide de la seule mécanique. Afin d’éviter ce qui relève souvent de l’outrance caricaturale, peut-être serait-il bon d’en revenir aux textes mêmes. La pensée cartésienne y apparaît plus nuancée qu’on le dit parfois. (shrink)
