Background: Informed consent is a legal as well as ethical prerequisite in clinical research. For dementia research, informed consent can be a problem if subjects with dementia, whose capacity for understanding and thus also decision making might be limited, are to be exam- ined. This might result in exclusion of dementia patients from research, as capacity for understanding and decision making are often equated with the ability for rational decision making. However, this valuation has been criticized at times for attaching (...) too much impor- tance to the cognitive aspect of decision making. -/- Methods: This qualitative study investigates the actual consent procedure of a clini- cal research study in Germany with regard to dementia patients’ subjective and objective understanding of informed consent information. Research participants were ten dementia patients, who volunteered in two clinical research studies, as well as their caregivers. Data were collected by use of semi-structured interviews. -/- Results: It was determined that the patients’ comprehension of informed consent infor- mation was rather limited. However, a number of patients were quite aware of this. In con- trast, all caregivers claimed to have fully understood the provided information, while their objective comprehension was also incomplete. Several participants indicated that they did not attach much importance to the information given in the consent procedure and that their consent did not primarily depend on this information. Rather, participation in the research study for them seemed to be more of a problem-focused coping strategy for dealing with their diagnosis of dementia. -/- Conclusion: For research ethics these results raise the question whether the currently prevailing emphasis on the cognitive aspect of autonomous decision making, i.e., compre- hension, may be too one-sided, and to what extent the “volitional” aspect in giving consent should be given greater consideration. Robots are slowly, but certainly, entering people's professional and private lives. They require the attention of regulators due to the challenges they present to existing legal frameworks and the new legal and ethical questions they raise. This paper discusses four major regulatory dilemmas in the field of robotics: how to keep up with technological advances; how to strike a balance between stimulating innovation and the protection of fundamental rights and values; whether to affirm prevalent social norms or nudge social norms (...) in a different direction; and, how to balance effectiveness versus legitimacy in techno-regulation. The four dilemmas are each treated in the context of a particular modality of regulation: law, market, social norms, and technology as a regulatory tool; and for each, we focus on particular topics? such as liability, privacy, and autonomy? that often feature as the major issues requiring regulatory attention. The paper then highlights the role and potential of the European framework of rights and values, responsible research and innovation, smart regulation and soft law as means of dealing with the dilemmas. Modeling law search and retrieval as prediction problems has recently emerged as a predominant approach in law intelligence. Focusing on the law article retrieval task, we present a deep learning framework named LamBERTa, which is designed for civil-law codes, and specifically trained on the Italian civil code. To our knowledge, this is the first study proposing an advanced approach to law article prediction for the Italian legal system based on a BERT (Bidirectional Encoder Representations from Transformers) learning framework, which (...) has recently attracted increased attention among deep learning approaches, showing outstanding effectiveness in several natural language processing and learning tasks. We define LamBERTa models by fine-tuning an Italian pre-trained BERT on the Italian civil code or its portions, for law article retrieval as a classification task. One key aspect of our LamBERTa framework is that we conceived it to address an extreme classification scenario, which is characterized by a high number of classes, the few-shot learning problem, and the lack of test query benchmarks for Italian legal prediction tasks. To solve such issues, we define different methods for the unsupervised labeling of the law articles, which can in principle be applied to any law article code system. We provide insights into the explainability and interpretability of our LamBERTa models, and we present an extensive experimental analysis over query sets of different type, for single-label as well as multi-label evaluation tasks. Empirical evidence has shown the effectiveness of LamBERTa, and also its superiority against widely used deep-learning text classifiers and a few-shot learner conceived for an attribute-aware prediction task. Transformer-based language models (TLMs) have widely been recognized to be a cutting-edge technology for the successful development of deep-learning-based solutions to problems and applications that require natural language processing and understanding. Like for other textual domains, TLMs have indeed pushed the state-of-the-art of AI approaches for many tasks of interest in the legal domain. Despite the first Transformer model being proposed about six years ago, there has been a rapid progress of this technology at an unprecedented rate, whereby BERT (...) and related models represent a major reference, also in the legal domain. This article provides the first systematic overview of TLM-based methods for AI-driven problems and tasks in the legal sphere. A major goal is to highlight research advances in this field so as to understand, on the one hand, how the Transformers have contributed to the success of AI in supporting legal processes, and on the other hand, what are the current limitations and opportunities for further research development. In den letzten Jahren hat sich eine Vielfalt unterschiedlicher Gremien zur Ethikberatung entwickelt: vom Konsil mit einem einzelnen Berater bis zum Ethikkomitee. In dem Band werden die Ethikberatung, ihre Entwicklung und Anwendung, sowie die Gründung von Gremien in Krankenhäusern, Pflegeeinrichtungen, Hospizen und von niedergelassenen Ärzten anhand von Fallbeispielen erläutert. Dabei schlagen die Autoren eine Brücke zwischen traditioneller philosophischer Ethik und anwendungsbezogener klinischer Ethik. Auch rechtliche Fragen werden erörtert.

This thesis consists of four essays and an introduction dedicated to two main topics: indexicality and presupposition. The first essay is concerned with an alleged problem for the standard treatment of indexicals on which their linguistic meanings are functions from context to content. Since most indexicals have their content settled, on an occasion of use, by the speaker’s intentions, some authors have argued that this standard picture is inadequate. By demonstrating that intentions can be seen as a parameter of the (...) kind of context that characters operate on, these arguments are rejected. In addition, it is argued that a more recent, variable-based framework is naturally interpreted as an intention-sensitive semantics. The second essay is devoted to the phenomenon of descriptive uses of indexicals on which such an expression seems to contribute, not its standard reference as determined by its character, but a property to the interpretation. An argument that singular readings of the cases in question are incoherent is shown to be incorrect, and an approach to descriptive readings is developed on which they arise from e-type uses akin to other well known cases. Further, descriptive readings of the relevant kind are seen to arise only in the presence of adverbs of quantification, and all sentences in which such an adverb takes scope over an indexical are claimed to be ambiguous between a referential and an e-type reading. The third essay discusses a version of the variable analysis of pronouns on which their descriptive meanings are relegated to the so-called phi-features – person, gender and number. In turn, the phi-features are here seen as triggering semantic presuppositions that place constraints on the definedness of pronouns, and ultimately of sentences in which they appear. It is argued that the descriptive information contributed by the phi-features diverges radically from presuppositional information of both semantic and pragmatic varieties on several dimensions of comparison, and instead the main role of the phi-features is seen to be that of guiding hearers’ attempts to ascertain the speaker’s intentions. The fourth essay addresses an issue concerning the treatment of presuppositions in dynamic semantics. Representing a semantic treatment of pragmatic presuppositions, the dynamic framework is shown to incorrectly regard conversational infelicity as sufficient for semantic undefinedness, given the standard way of defining truth in terms of context change. Further, it is shown that a proposal for a solution fail to make correct predictions for epistemic modals. A novel framework is developed on which context change potentials act on contexts that have more structure than the contexts usually countenanced by dynamic semantics, and it is shown that this framework derives truth from context change while making correct predictions for both presuppositions and modals. Der vorliegende Band umfasst den Briefwechsel Schleiermachers von April 1806 bis Ende 1807, dem Zeitpunkt seiner endgültigen Übersiedlung nach Berlin. Im Sommer 1806 lehrt Schleiermacher das letzte Semester an der Hallenser Universität, wobei er zum ersten Mal Kirchengeschichte und Christliche Sittenlehre liest. Mit dem Zusammenbruch Preußens und der Besetzung Halles durch französische Truppen im Oktober 1806 findet Schleiermachers akademische Wirksamkeit ein abruptes Ende durch die Schließung der Universität und die Vertreibung der Studenten. Er bleibt zunächst in Halle, um das Schicksal (...) der Universität abzuwarten, beginnt aber im Sommer 1807 mit Privatvorlesungen in Berlin, wohin er Ende 1807 endgültig übersiedelt, in der Hoffnung auf eine Berufung an die neu zu gründende Berliner Universität. Der drohende Krieg und die Niederlage Preußens sind zentrale Themen des Briefwechsels. Eine große Rolle spielen die beruflichen Perspektiven Schleiermachers und die Hoffnung auf die neu zu errichtende Berliner Universität. Von den insgesamt 425 Briefen dieses Bandes sind 240 an Schleiermacher gerichtet und 185 von ihm selbst geschrieben. 127 der hier dokumentierten Briefe konnten nur erschlossen werde; von ihnen ist kein Text überliefert. Von den übrigen Briefen waren bisher nur 80 vollständig gedruckt. 41 Briefe waren bisher im Verhältnis zu den überlieferten Texten bzw. Textzeugen nur gekürzt publiziert; sie werden hier erstmals entsprechend der Überlieferungslage vollständig ediert. 177 Briefe werden im vorliegenden Band überhaupt erstmals ediert. (shrink)

The discussion about the possibilities of human freedom is by far not tinished yet, Iet alone worn out. The discourse on freedom again became the focus of critical discussion, especially due to the immensely pushed and successful neurosciences and their findings and- following in their wake- newly established philosophical concepts. But also inner-philosophical problems demand re-orientation. This has tobe of interest for theology, too, as freedom is at the core of Christian self-understanding and theological explication.

The modern term >fascination fascination force divided self< allow to indicate them as prototypical descriptions of fascination. References to Plato by Marsilio Ficin and Friedrich Nietzsche expose the importance of Socrates in the conceptual history of fascination.

This commentary compares the P-FIT model with psychometric and developmental models of intelligence and shows that there are isomorphisms and divergences between them. All three models involve some common dimensions, but the P-FIT model lacks many of the dimensions of the other models. Then we point to research that can lead to the integration of brain models with cognitive-developmental models.

Adolf Loos is one of the few figures that Wittgenstein explicitly named as an influence on his thought. Loos’s influence has been debated in the context of determining Wittgenstein’s relation to modernism, as well as in attempts to come to terms with his work as an architect. This paper looks in a different direction, examining a remark in which Wittgenstein responded to Heidegger’s notorious pronouncement that ‘the Nothing noths’ by reference to Loos’s critique of ornamentation. Wittgenstein draws a parallel between (...) the requirement to start philosophy with an inarticulate sound and the need, in certain cultural periods, to highlight the borders of tablecloths using lace. Paying heed to Wittgenstein’s remark sheds further light on a Loosian influence at work in his thinking about modern civilization, both in his well-known ‘Lectures on Aesthetics’ and in the earlier notes from his 1930 lectures at Cambridge. Zusammenfassung Zu der Frage, von welcher Instanz oder welchem Sozialisationsagenten im Sport welche Wirkung ausgeht, finden sich kaum differenzierte Studien. In einer Fragebogenstudie wurden in Anlehnung an Goncalves Trainer und von ihnen trainierte Jugendliche zur Bedeutung verschiedener Sozialisationsagenten für das Sporttreiben der Jugendlichen, zu ihrer Haltung zum Thema Fairness sowie zu diversen sozialen Normen befragt. Beide Gruppen sprechen übereinstimmend dem Trainer hohe Bedeutung zu. Weitere Analysen zeigen, dass sich aus den beim Trainer wahrgenommenen sozialen Normen regressionsanalytisch ein relativ hoher Anteil (...) der entsprechenden Einstellungen der Jugendlichen hervorsagen lässt. Dies bestätigt die große Bedeutung der Trainer als Sozialisationsagenten. (shrink)

Freud's principal contribution to clarifying persons' relations to themselves lies in his exploration of the dynamic relations between conscious and unconscious processes. This paper addresses another aspect of Freud's ideas, one to which he himself and his followers accorded insufficient attention, namely, unconscious knowledge, in particular, unconscious knowledge of one's own mind and hence of one's own unconscious. First I show that Freud's idea of unconscious knowledge of one's own mind is epistemologically coherent and that it can be understood in (...) different ways within the framework of his basic concepts. I then discuss select examples of such knowledge from his clinical and theoretical writings. In conclusion, I pose the question of the scope of these ideas for depth psychology. (shrink)
