How do Dutch people let each other know that they disagree? What do they say when they want to resolve their difference of opinion by way of an argumentative discussion? In what way do they convey that they are convinced by each other’s argumentation? How do they criticize each other’s argumentative moves? Which words and expressions do they use in these endeavors? By answering these questions this short essay provides a brief inventory of the language of argumentation in Dutch.

Quantitative studies have assessed nurses’ attitudes toward and frequency of spiritual care [SC] and which factors are of influence on this attitude and frequency. However, we had doubts about the construct validity of the scales used in these studies. Our objective was to evaluate scales measuring nursing SC. Articles about the development and psychometric evaluation of SC scales have been identified, using, Web of Science, and CINAHL, and evaluated with respect to the psychometric properties and item content of the scales. Item content was evaluated by each of the five authors with respect to the following questions: Does the item (1) reflect a general opinion about SC instead of a personal willingness to offer SC; (2) reflect general psychosocial care instead of specific SC; (3) focus solely on religious care; (4) contain the words ‘spiritual’ (care/needs/health/strengths, etc.); and (5) contain multiple propositions, or have an unclear meaning? We found eight scales. Psychometric analysis of these scales was often meager and the items of all but one scale suffered from two or more of the five problems described above. This leads us to conclude that many quantitative results in this area are based on findings with questionable scales. Suggestions for improvements are provided. (shrink)

The introduction of the concept of strategic maneuvering into the pragma-dialectical theory makes it possible to formulate testable hypotheses regarding the persuasiveness of argumentative moves that are made in argumentative discourse. After summarizing the standard pragma-dialectical approach to argumentation, van Eemeren, Garssen, and Meuffels explain what the extension of the pragma-dialectical approach with strategic maneuvering involves and discuss the fallacies in terms of the extended pragma-dialectical approach as derailments of strategic maneuvering. Then they give an empirical interpretation of the (...) extended pragma-dialectical model in which they report the testing of three hypotheses which formulate preliminary conditions for effectiveness research within the framework of the extended pragma-dialectical theory and the results of the tests they consecutively carried out. The main finding of a comprehensive empirical research project on the intersubjective acceptability of the pragma-dialectical discussion rules (Van Eemeren, Garssen & Meuffels, 2009) is that ordinary language users judge discussion moves that are considered fallacious from an argumentation-theoretical perspective as unreasonable. In light of this finding it is remarkable that in everyday argumentative discourse fallacies occur regularly and seem many times not to be noticed by the participants in the discourse. This also goes for the abusive argumentum ad (...) hominem. While abusive ad hominem attacks are judged to be very unreasonable discussion moves when the unreasonableness of clear cases of this fallacy is rated in experiments, in real life this fallacy remains undetected more often than not. In this paper it is argued that this paradox can be explained by analysing abusive ad hominem attacks as a mode of strategic manoeuvring which takes on a reasonable appearance in real life situations when it mimics, as it often does, legitimate critical reactions to authority argumentation. The hypothesis that abusive fallacies are seen as less unreasonable when they are presented as if they are critical questions pertaining to the argument scheme for authority argumentation than when they are clear cases was tested systematically in two experiments. In this paper, a reaction is presented to Siegel’s claim that the pragma-dialectical theory of argumentation ignores or neglects epistemological viewpoints that he finds vital to any normative theory of argumentation. The focus is on the most important problems in Siegel’s argument: 1) the ambiguity of the term ‘argument’ and the alleged negligence of this ambiguity in pragma-dialectics; 2) the critical rational perspective of the pragma-dialectical account; and 3) the alleged negligence of the “abstract propositional sense” of argument in pragma-dialectics.

The International Agency for Research on Cancer (IARC) is an organization which seeks to identify the causes of human cancer. Per agent, such as betel quid or Human Papillomaviruses, they review the available evidence deriving from epidemiological studies, animal experiments and information about mechanisms (and other data). The evidence of the different groups is combined such that an overall assessment of the carcinogenicity of the agent in question is obtained. In this paper, we critically review the IARC’s carcinogenicity evaluations. First (...) we show that serious objections can be raised against their criteria and procedures – more specifically regarding the role of mechanistic knowledge in establishing causal claims. Our arguments are based on the problem of confounders, of the assessment of the temporal stability of carcinogenic relations, and of the extrapolation from animal experiments. Then we address a very important question, viz. how we should treat the carcinogenicity evaluations that were based on the current procedures. After showing that this question is important, we argue that an overall dismissal of the current evaluations would be too radical. Instead, we argue in favour of a stepwise re-evaluation of the current findings. (shrink)

The epistemologists Biro and Siegel have raised two objections against the pragma-dialectical approach to argumentation. According to the first objection the pragma-dialectical theory is not genuinely normative. According to the second objection the rejection of justificationism by pragma-dialecticians is unwarranted: they reject justificationism prematurely and they are not consistent in accepting some arguments (‘justifications’) as sound. The first objection is based on what we regard as the misconception that the goal of resolving differences of opinion cannot provide a normative approach. (...) The aim of this paper is to describe the way in which argumentative patterns come into being in plenary debate over legislative issues in the European Parliament. What kind of argumentative patterns are to be expected within this macro context? It is shown that the argumentative patterns that come into being in legislative debate in the European Parliament depend for the most part on the problem-solving argumentation that is put forward in the opening speech by the rapporteur of the parliamentary (...) committee report. This argumentation can be pragmatic problem-solving argumentation or complex problem-solving argumentation. The most important prototypical argumentative patterns are investigated in the argumentation put forward by the Members of parliament. This investigation is based on an inventory of the arguments that can in principle be used to support or attack the initial problem-solving argumentation put forward by the rapporteur. (shrink)

Unter Off-Label-Use versteht man den zulassungsüberschreitenden Einsatz eines Arzneimittels außerhalb der von Zulassungsbehörden genehmigten Anwendungsgebiete. Er ist in der medizinischen Praxis weit verbreitet und fächerübergreifend zu beobachten. Der Beitrag gibt eine Einschätzung der Off-Label-Anwendung aus ethischer Sicht. Dazu wird die Off- Label-Anwendung zunächst von anderen, sachlich verwandten Anwendungsweisen abgegrenzt. Danach wird über die aktuelle Verbreitung des Off-Label- Use informiert. Sodann wird gezeigt, dass sich bekannte Problemlagen aus der Medizinethik bei der Off-Label-Anwendung in spezifischer Weise verschärfen. Schließlich wird diskutiert, wie eine (...) ethisch akzeptable Off-Label-Anwendung von Arzneimitteln ausgestaltet werden könnte und auf welchen Ebenen sie ansetzen müsste. (shrink)

In spite of the remarkable progress made in the burgeoning field of social neuroscience, the neural mechanisms that underlie social encounters are only beginning to be studied and could —paradoxically— be seen as representing the ‘dark matter’ of social neuroscience. Recent conceptual and empirical developments consistently indicate the need for investigations, which allow the study of real-time social encounters in a truly interactive manner. This suggestion is based on the premise that social cognition is fundamentally different when we are in (...) interaction with others rather than merely observing them. In this article, we outline the theoretical conception of a second-person approach to other minds and review evidence from neuroimaging, psychophysiological studies and related fields to argue for the development of a second-person neuroscience, which will help neuroscience to really go social; this may also be relevant for our understanding of psychiatric disorders construed as disorders of social cognition. This paper focuses on argumentation the institutional context of debate in the European Parliament. A parliamentary debate is a distinct argumentative activity type. In the pragma-dialectical approach, argumentative activity types are defined as conventionalized argumentative practices in which the possibilities for strategic maneuvering are predetermined. What are the characteristics of the activity type of a debate in European Parliament that predetermine the possibilities for strategic maneuvering?

Today, mechanisms and mechanistic explanation are very popular in philosophy of science and are deemed a welcome alternative to laws of nature and deductive‐nomological explanation. Starting from Mitchell's pragmatic notion of laws, I cast doubt on their status as a genuine alternative. I argue that (1) all complex‐systems mechanisms ontologically must rely on stable regularities, while (2) the reverse need not hold. Analogously, (3) models of mechanisms must incorporate pragmatic laws, while (4) such laws themselves need not always refer to (...) underlying mechanisms. In this article, I present two conceptual problems for Craver's mutual manipulability account of constitutive relevance in mechanisms. First, constitutive relevance threatens to imply causal relevance despite Craver (and Bechtel)'s claim that they are strictly distinct. Second, if (as is intuitively appealing) parthood is defined in terms of spatio-temporal inclusion, then the mutual manipulability account is prone to counterexamples, as I show by a case of endosymbiosis. I also present a methodological problem (a case of experimental underdetermination) and formulate two (...) partial, but fallible solutions based on the notions of parthood and synchronicity. This volume comprises a selection of contributions to the theorizing about argumentation that have been presented at the 9th conference of the International Society for the Study of Argumentation, held in Amsterdam in July 2018. The chapters included provide a general theoretical perspective on central topics in argumentation theory, such as argument schemes and the fallacies. Some contributions concentrate on the treatment of the concept of conductive argument. Other contributions are dedicated to specific issues such as the justification of questions, (...) the occurrence of mining relations, the role of exclamatives, argumentative abduction, eudaimonistic argumentation and a typology of logical ways to counter an argument. In a number of cases the theoretical problems addressed are related to a specific type of context, such as the burden of proof in philosophical argumentation, the charge of committing a genetic fallacy in strategic manoeuvring in philosophy, the necessity of community argument, and connection adequacy for arguments with institutional warrants. Many theories about human number representation stress the importance of a central semantic representation that includes the magnitude information of small integer numbers, and that is conceived as an abstract, compressed number line. However, thus far there has been little or no direct evidence that units and teens are represented on the same number line. In two masked priming experiments, we show that single-digit and two-digit Arabic numerals are equally well primed by an Arabic numeral with the same number of (...) digits as by an equally distant Arabic numeral with a different number of digits (e.g. the priming effect of 7 on the target 9 is the same as the priming effect of 11 on the target 9). The finding was obtained both with a number naming task and with a parity judgement task. This is in line with the hypothesis that units and teens are part of a continuous number line. (shrink)

In the traditional African view, words and sentences are not viewed as being liable to objective reflective truth/falsehood-judgments. It is not a person-word-reality-view, but a person-word-person-view: the sender's words are units of orally produced energy that have the power to improve or degenerate the receiver's vitality. Words received can make you more powerful by increasing your confidence and your control over your environment. But they can equally well harm (parts of) you, by discouraging you in certain endeavors. From the traditional (...) It has become evident that neuroimaging raises new normative questions that cannot be addressed adequately within the (in this regard unspecific) frameworks of existing research ethics. Questions that are especially troubling are, among others, provoked by incidental findings. Two questions are particularly intricate in view of incidental findings: (1) How can the research subject’s right not to know be guaranteed? And (2) should a diagnostic check of scans by a neuroradiologist become an obligatory part of neuroscientific research protocols? The present (...) paper examines these question against the background of two recent recommendations. The differentiation between difference position and similarity position serves as an analytic tool to further investigate the issue and to develop a distinct proposal for answering the questions. The conclusions reached by Hooks et al. urge the field to investigate the complex multipathway interactions between the microbiome and the gut-brain axis to understand the potential causal relationships involved. Claims in the field of microbiota-gut-brain research remain problematic without appropriate controls and adequate statistical power. A crucial question that follows from the authors' extensive review is: “Why don't probiotics work?”.

This article’s point of departure is from the presupposition that an effort to instill norms, values and a sense of purpose is always a significant element in the educational process. Indeed, questions concerning values and meaning are always a necessary aspect of the process of raising children. In their day-to-day engagement with children and young people, contemporary adults are continually striving to obtain some perspective on the future of the present generation and of generations to come. The questions that arise (...) about this future are ‘meaning’ questions, questions concerning the significance and purpose of their engagement.It is often true, of course, that such sensitivity for personal values and meaning leads something of a hidden life because of the fact that parents today tend to act under pressure from the society around them. Nevertheless, the so-called moral indifference, which is considered such a defining characteristic of contemporary social life, does not mean that we are free to conclude that parents and educators have no clue as to what is important for the welfare of their children. On the contrary, contemporary parents are far from indifferent.The kind of adults their children will become, or rather, the kind of adults they hope their children will not become, is a matter of serious concern to them.1 Parents want ‘the best’ for their children. They want them to share in the ‘good life’ and they are inclined to ask themselves incisive and self-critical questions when things do not turn out as they ‘ought’ in the raising of their children. In a time of moral uncertainty, such as ours, the desire for the good fortune and well-being of future generations is both strong and fragile at the same time. A rule of recognition for a legal order L seems utterly circular if it refers to behaviour of “officials.” For it takes a rule of recognition to identify who, for L, counts as an official and who does not. I will argue that a Kelsenian account of legal authority can solve the aporia, provided that we accept a, perhaps unorthodox, re‐interpretation of Kelsen's norm theory and his idea of the Grundnorm. I submit that we should learn to see it as (...) the vanishing point rather than the final basis of validity in a legal order. To prepare the ground for this proposal, I will briefly explore the claim to authority that is characteristic of politics. Then I sketch a multi‐layered canonical form of the legal norm, including their “empowering” character (Paulson) in terms of performative operators. I show how it leads to a “perspectival” account of the basic norm. In conclusion, I briefly point to the example of sovereignty and acquis communautair in international law to illustrate this view. In lieu of an abstract, here is a brief excerpt of the content:IntroductionFrom the closing decades of the fourteenth century onwards, reform attempts within the various religious orders gained impetus under the banner of so-called Observant movements. In nearly all orders, these Observant movements advocated a return to the lifestyle of an imagined pristine beginning in the face of a real or perceived crisis.1Within the Clarissan world, there were a number of signs pointing towards such a crisis. Adherence to the (...) rule, as well as a viable form of communal religious life could be conspicuously absent by the later fourteenth century. This was not solely the result of failing religious stamina, due to the interference of lay benefactors or sheer lack of motivation among the choir nuns. From the later 1340s onwards, many religious houses suffered heavily from recurrent Plague epidemics and the effects of prolonged military campaigns.This was particularly visible in some areas in France that were touched by the Plague and the Hundred Years War. In Toulouse, the Clarissan monastic community was reduced from around 80 women in 1330 to just four by 1370. Other houses more or less disappeared altogether because of the Plague, as was the case in Carcassone, Lavaur, Narbonne and Samatan, and had to be refounded. The Clarissan monasteries of Auterive, Béziers, Boisset, Les Cassés, Gourdon, and Le Pouget were heavily damaged or completely destroyed by warfare, and needed rebuilding.2In many cases, surviving nuns from destroyed monasteries extra muros moved into town. They had to restart their community life under very difficult circumstances. To make ends meet, the women sometimes had to engage in forms of economic exploitation of their goods that were not in line with the requirements of their rule. To make up for extreme losses in population and revenue, they also had to resort to recruitment practices that brought in people not equipped to embrace the vows of poverty, abstinence and obedience.There was no uniformity in the ways in which reforms were initiated. Nor did they always have the same results. This becomes clear as soon as we take into account the choice for a specific rule, the implementation of additional reform constitutions and convent statutes, and the role played by nuns and abbesses, secular authorities, secular clergymen and, of course, leading Observant and non-Observant friars of the Franciscan order.The Tordesillas congregationAn early attempt at reform in Castile resulted in a congregation named after the Poor Clare monastery at Tordesillas. This royal foundation had been created around 1363 to perform intercessory prayers on behalf of Pedro I of Castile and his new wife Maria of Padiella. The house was well endowed, and papal privileges freed the house from episcopal oversight, in line with important Urbanist houses elsewhere.3 In 1377, this autonomy was augmented, when Pope Gregory XI, ‘for certain reasons’ , freed the house from control from the Franciscan provincial minister.4 This might have been motivated by thoughts towards religious reform.5In any case, the new Castilian ruler Juan I was not content with the nuns’ intercessory works for the royal family. He obtained several papal bulls from the Avignon Pope Clement VII to entice the monastery to return to its former “observance” of the rule and its prayer obligations. These bulls made the Franciscan confessor of the king, friar Fernando of Illescas, perpetual visitator of the Tordesillas house, with full powers for the duration of his life.6 He could remove the abbess from office and enter the monastic enclosure to correct abuses. He could also absolve nuns and monastic personnel from sins and excommunication, as well as appoint and dismiss confessors and deliver punishments.7From 1410 onwards, the Tordesillas reform model began to attract other monasteries, which coagulated into the reform congregation of Santa Maria la Real or Santa Clara de Tordesillas. Mechanistic approaches are very common in the causal interpretation of biological and neuroscientific experimental work in today’s philosophy of science. In the mechanistic literature a strict distinction is often made between causal relations and constitutive relations, where the latter cannot be causal. One of the typical reasons for this strict distinction is that constitutive relations are supposedly synchronic whereas most if not all causal relations are diachronic. This strict distinction gives rise to a number of problems, however. Our end goal (...) in this paper is to argue that it should be given up, at least in the context of the biological and the psychological sciences. To that effect, we argue that constitutive relations in this context are diachronic, thus undermining the aforementioned reason. We offer two cases from scientific practice in which constitutive relations are regarded as both diachronic and causally efficacious, review three existing ways of dealing with the apparent diachronic nature of interlevel relations in mechanisms and propose a new account of diachronic, causal constitutive relevance.
