Nirbhaya, Asifa, Manisha Valmiki, and the list of victims, (be it women, children or men) in India goes on. There is myriad of legislations enacted in the past to curb the offences, but the crimes in the society seem to be unstoppable. During the COVID time, in the lockdown too, the crimes continued to take place. There were several instances of domestic violence and rapes heard in news. Many instances of suicides were reported. It is really difficult to understand what (...) place in the country is safe for the existence and peaceful survival of any person? The question that arises is whether a victim who comes before the court is provided with the adequate relief? Has the Judiciary or the Parliament done something with this regard? Does the concept of compensatory jurisprudence exist in India? What more is required to be done to enhance the position of victims and rehabilitate them? The research article shall look into the concept of compensatory jurisprudence with respect to India and other nation states as well. There are prevailing enormous laws which discuss about the punishment to be given to the accused person guilty to have committed crime, but unfortunately, there is no specific law regarding the steps to be taken to rehabilitate a victim who has been the subject matter of any crime. The research paper shall deal with various aspects and try to analyse laws or rules, if any, existing with regard to the protection of victims in India or around the globe. It shall also try to look into the role that the States play in rehabilitating and compensating the sufferers and victims of various crimes. The Mahabharata, one of the major epics of India, is a sourcebook complete by itself as well as an open text constantly under construction. This volume looks at transactions between its modern discourses and ancient vocabulary. Located amid conversations between these two conceptual worlds, the volume grapples with the epic's problematisation of dharma or righteousness, and consequently, of the ideal person and the good life through a cluster of issues surrounding the concept of agency and action. ABSTRACT 'The Duologue of King/Governor Pāyāsi' has long been recognised as a source for the proto-materialism current at the time of the Buddha. What needs to be stressed is the significance of the text as a pointer to the development of Logic in India. Perception, which is an accepted method of experimental enquiry, and reasoning from analogy, which can lead at best to a probable conclusion - these two are the only means employed to settle the dispute concerning the existence (...) of the other-world. The Jain version of the same duologue-cum-parable, though varying in minor details regarding the name and identity of the monk refuting the king/governor, contains the same contrast, namely, perception versus analogical reasoning. There can be little doubt that the original parable was conceived with a view to asserting the existence of the other-world. In the Kaṭha Upaniṣad, an earlier Brahmanical text, however, instead of argument by analogy, verbal testimony was invoked to settle the same point. Naciketas is assailed by doubt about the existence of a person after his or her death. The authority of Yama, the Pluto of Indian mythology, is invoked to convince him that the other-world does exist. Thus, the three parables taken together exhibit three means of knowledge in operation: verbal testimony and argument by analogy pitted against perception. RESUMO 'O duólogo do rei/governador Pāyāsi' há muito tempo é reconhecido como uma fonte da corrente protomaterialista da época do Buda. O que é necessário ressaltar é o significado desse texto como um indicador do desenvolvimento da lógica na Índia. Percepção, aceita como método de investigação experimental, e raciocínio por analogia, que no máximo pode conduzir a uma conclusão provável - apenas esses dois são os meios utilizados para dirimir a disputa que diz respeito à existência do outro-mundo. A versão jaina do mesmo duólogo-cum-parábola, mesmo com variações que concernem ao nome e à identidade do monge que se opõe ao rei/governador, contém o mesmo contraste, a dizer, percepção contra raciocínio por analogia. Não há muita dúvida de que a parábola original foi concebida com o intuito de afirmar a existência do outro-mundo. Entretanto, na Kaṭha Upaniṣad, um texto bramânico mais antigo, em vez do argumento por analogia, o testemunho verbal foi invocado para resolver o mesmo ponto. Jābāli, one of the priest-cum-counsellors of king Daśaratha, has long been recognized as an odd character, preaching materialism in order to persuade Rāma to go back to Ayodhyā after the death of his father. The critical edition of the Vālmīki Rāmāyaṇa reveals several stanzas interpolated in the vulgate so as to denigrate Jābāli and brand him as a rank opportunist. In spite of that, whatever remains of Jābāli’s speech addressed to Rāma evinces one of the basic tenets of materialist ontology, (...) i.e., denial of the existence of any other-world, and hence the futility of performing rites for the ancestors. However, nothing is said about the epistemology,, ethics, and metaphysics of materialism as it existed at the time when the Rāmāyaṇa was redacted. Considering all this it is better to call Jābāli a proto-materialist who speaks of a philosophy akin to the teachings of Ajita Kesakambala, a senior contemporary of the Buddha, whose doctrine has been dubbed as that of annihilation in the Tipiṭaka. Both of them belong to the pre-Cārvāka materialist tradition in India. (shrink)

This paper examines how employees react to their organizations’ corporate social responsibility initiatives. Drawing upon research in internal marketing and psychological contract theories, we argue that employees have multi-faceted job needs and that CSR programs comprise an important means to fulfill developmental and ideological job needs. Based on cluster analysis, we identify three heterogeneous employee segments, Idealists, Enthusiasts, and Indifferents, who vary in their multi-faceted job needs and, consequently, their demand for organizational CSR. We further find that an organization’s CSR (...) programs generate favorable employee-related outcomes, such as job satisfaction and reduction in turnover intention, by fulfilling employees’ ideological and developmental job needs. Finally, we find that CSR proximity strengthens the positive impact of CSR on employee-related outcomes. This research reveals significant employee heterogeneity in their demand for organizational CSR and sheds new light on the underlying mechanisms linking CSR to employee-related outcomes. (shrink)

With this goal in mind, the pace is lively, yet thorough. Basic notions of independence and conditional expectation are introduced relatively early on in the text, while conditional expectation is illustrated in detail in the context of martingales, Markov property and strong Markov property. Weak convergence of probabilities on metric spaces and Brownian motion are two highlights. The historic role of size-biasing (...) is emphasized in the contexts of large deviations and in developments of Tauberian Theory. Problems in peer review, the backbone of maintaining high standards in scientific publishing, have led to wide spread discontent within the scientific community. Training in the peer review process and a simpler format to assist in decision making are possible courses to improve and expedite the process of peer review and scientific publishing. The authors discuss problems in the peer review process focusing on challenges related to major revisions and reviewer's wish list of experiments; this leads to the loss of (...) time and money. Major revisions rarely lead to significant improvements, while simultaneously delay the dissemination of knowledge. The task of rhetorical role labeling is to assign labels (such as Fact, Argument, Final Judgement, etc.) to sentences of a court case document. Rhetorical role labeling is an important problem in the field of Legal Analytics, since it can aid in various downstream tasks as well as enhances the readability of lengthy case documents. The task is challenging as case documents are highly various in structure and the rhetorical labels are often subjective. Previous works for automatic rhetorical role identification (...) (i) mainly used Conditional Random Fields over manually handcrafted features, and (ii) focused on certain law domains only (e.g., Immigration cases, Rent law), and a particular jurisdiction/country (e.g., US, Canada, India). In this work, we improve upon the prior works on rhetorical role identification by proposing novel Deep Learning models for automatically identifying rhetorical roles, which substantially outperform the prior methods. Additionally, we show the effectiveness of the proposed models over documents from five different law domains, and from two different jurisdictions—the Supreme Court of India and the Supreme Court of the UK. Through extensive experiments over different variations of the Deep Learning models, including Transformer models based on BERT and LegalBERT, we show the robustness of the methods for the task. We also perform an extensive inter-annotator study and analyse the agreement of the predictions of the proposed model with the annotations by domain experts. We find that some rhetorical labels are inherently hard/subjective and both law experts and neural models frequently get confused in predicting them correctly. (shrink)

Two words, pañcagupta and kuṇḍakīṭa, are found in modern Sanskrit lexicons such as the Śabdakalpadruma, the Vācaspatya, the Sanskrit-Wörterbuch, and A Sanskrit English Dictionary. They are said to signify the Cārvāka philosophy and an expert in the Cārvāka philosophy respectively. Both the words have been taken from some twelfth-century Sanskrit kośas but no example of actual use is available. Nor do they occur in any earlier Sanskrit kośa, such as the Amarakośa and the Halāyudhakośa. The inference is that the words (...) must have appeared in some late philosophical work that was critical of the materialist Cārvāka system of philosophy and the kośakāras found them in the same source. Corporate social responsibility (CSR) continues to gain attention atop the corporate agenda and is by now an important component of the dialogue between companies and their stakeholders. Nevertheless, there is still little guidance as to how companies can implement CSR activity in order to maximize returns to CSR investment. Theorists have identified many company-favoring outcomes of CSR; yet there is a dearth of research on the psychological mechanisms that drive stakeholder responses to CSR activity. Borrowing from the literatures on meansend (...) chains and relationship marketing, we propose a conceptual model that explains how CSR provides individual stakeholders with numerous benefits (functional, psychosocial, and values) and how the type and extent to which a stakeholder derives these benefits from CSR initiatives influences the quality of the relationship between the stakeholder and the company. Every individual in this world seeks to achieve a healthy, wealthy, secured and blissful life as suggested by Maslow’ Need Hierarchy. A regression analysis taking Life Satisfaction Index (as obtained from World Database of Happiness between 1995–2005) as the dependent variable indicated rule of law, voice and accountability, regularity authority as well as economic freedom indicators (as obtained from Heritage Foundation Database, 1995–2006) as very significant predictors. In this article, an attempt has been made to understand this tridimensional concept of (...) happiness and combining them to arrive at a Composite Index of Happiness. Efforts have also been made to evaluate performance of various nations in their persistency to achieve these dimensions of happiness. Most studies have been either in direction of Subjective Well-being or Developmental Well-being. This article has been in an effort to combine both the factors and incorporating age-old values and virtues required for reaching higher realm of lasting peace, tranquility and happiness for one and all. The study shows that mental happiness has significant positive correlation with materialistic and spiritualistic happiness, perhaps for being the intermediary step, but materialistic has no significant correlation with spiritualistic happiness. Prior research on the impact of mandatory quotas in one dimension of diversity, on other dimensions, shows contradictory results. We seek to resolve this puzzle by relying on theory in social psychology on homophily and recategorization processes in hiring. In the context of a law mandating a gender quota on Indian boards, we predict and find that boards respond to the law by hiring new women directors who are similar to existing directors in terms of caste and community dimensions. We (...) find that this homophily effect is impactful to the extent that even high-status women directors cannot overcome it. At the aggregate level, these organizational-level practices result in caste and community inequalities remaining intact despite the introduction of 1309 new women directors. Corporate social responsibility positively impacts relationships between firms and customers. Previous research construes this as an outcome of customers’ warm glow that results from supporting firms’ benevolence. The current research demonstrates that beyond warm glow, CSR positively impacts firms’ sales through mitigating their customers’ perceptions of purchase risk. We demonstrate this effect across three conditions in which customers’ perceived risk of purchase is heightened, using both secondary data and two lab experiments. Under conditions of greater purchase risk, CSR positively impacts (...) both sales and customer purchase intentions to a greater extent than in conditions of lower purchase risk. In addition to measuring purchase risk as the mediating process behind these effects, we demonstrate that the effect of CSR on sales is stronger for those CSR activities that signal a stakeholder orientation.
