According to a rights forfeiture theory of punishment, liability to punishment hinges upon the notion that criminals forfeit their rights against hard treatment. In this paper, I assume the success of rights forfeiture theory in establishing the permissibility of punishment but aim to develop the view by considering how forfeited rights might be reclaimed. Built into the very notion of proportionate punishment is the idea that forfeited rights can be recovered. The interesting question is whether punishment is the sole means (...) for reclaiming forfeited rights. I argue for a pluralistic theory of rights reclamation, according to which, there are multiple ways by which a wrongdoer can recapture her forfeited rights. In particular, I argue that offering remorseful compensation is a valid means by which a wrongdoer might partially, or fully, reclaim her right against punishment. (shrink)

Gender norms can guide our sense of what we feel like we ought to do, even when we don't want them to. Understanding this norm responsiveness is an important part of understanding how oppressive gender systems are sustained. According to a social constructionist position, gender norm responsiveness happens as a result of social training, or socialization. It's often assumed that this training depends on our gender categories—that, for example, those who occupy the category “man” will be responsive to masculine norms, (...) and so on. Call this a category-based view. But trans and gender-nonconforming people are often responsive to gender norms that don't match our gender categories. This is sometimes taken as evidence for the conclusion that normative masculinity and femininity are somehow innate or pre-socialized. I reject this inference. I argue that we should instead dispense with a category-based view, and instead adopt a traits-based view. Gender norms apply to individuals on the basis of the gender-coded traits that they express. A traits-based view represents a social constructionist account of gender norms which leaves room for trans and GNC experiences of normative gender, and thus represents an important step towards creating inclusive theory. Oppressive ideology regularly misrepresents features of structural injustice as normal or appropriate. Resisting such injustice therefore requires critical examination of the evaluative judgments encoded in shared concepts. In this paper, I diagnose a mechanism of ideological misevaluation, which I call "hermeneutical misfit." Hermeneutical misfit occurs when thick concepts, or concepts which both describe and evaluate, mobilize ideologically warped evaluative judgments which do not fit the facts (e.g. "slutty"). These ill-fitted thick concepts in turn are regularly deployed as if they merely (...) describe--a phenomenon I call "descriptive masquerade." I argue that, via descriptive masquerade, ill-fitted thick concepts smuggle in warped evaluative judgments alongside apparently value-neutral ‘mere facts’, a process which both reinforces those judgments and increases the difficulty of critique. I investigate the concept "obesity" as an example: scientists and medical practitioners will deploy this concept as if it "merely" describes, enabling the smuggling of a host of warped evaluative judgments. I suggest that, to resist this process, we should develop collective consciousness and articulate "meta-hermeneutical resources," or thick concepts which encode critique of other, ill-fitted concepts (e.g. "slut-shaming" or "fat-shaming"). My education in political poetry begins with William Blake’s remark about John Milton in The Marriage of Heaven and Hell: “The reason Milton wrote in fetters when he wrote of Angels & God, and at liberty when of Devils & Hell, is because he was a true Poet and of the Devil’s party without knowing it.”1 The statement is usually taken as a charming misreading of Milton or as some sort of hyperbole. We find it lumped with other readings (...) which supposedly view Satan as the hero of Paradise Lost, such as Percy Bysshe Shelley’s in A Defence of Poetry, although neither Blake nor Shelley says anything of the kind.2I consider Blake’s statement simply accurate. I think it the best single thing anybody has ever said about Paradise Lost. If not clear as a bell, then at least as compressed as diamonds. The insouciant opening gesture takes for granted what to Blake is obvious” that the poetry qua poetry is better, more exciting, more energetic in the sections dominated by Stan, worse, duller, less poetic in the sections dominated by God. As a lover of poetry Blake has evidently struck a perplexity. Why does Milton’s Satan excite me and this God bore me even though he plainly intends me to adore God and scorn Satan? The answer could have been that Milton “wrote in fetters” where constrained by theology and the danger of lapsing into inadvertent sacrilege, but “at liberty” otherwise. Other critics have claimed that it is impossible to make God talk successfully in a poem, but the Book of Job is enough to refute that position. Why did Milton choose to make God talk at all? Dante cleverly avoided that difficulty.The second half of Blake’s sentence not only solves the Paradise Lost problem but proposes a radical view of all poetry which might be summarized as follows: All art depends on opposition between God and the devil, reason and energy. The true poet is necessarily the partisan of energy, rebellion, and desire, and is opposed to passivity, obedience, and the authority of reason, laws, and institutions. To be a poet requires energy; energetic subjects make the best material for poems; the truer the poetry, the more it will embody the truths of Desire. But the poet need not think so. The United States carceral system, as currently designed and implemented, is widely considered to be an immoral and inhumane system of criminal punishment. There are a number of pressing issues related to this topic, but in this essay, I will focus upon the problem of prison violence. Inadequate supervision has resulted in unsafe prison conditions where inmates are regularly threatened with rape, assault, and other forms of physical violence. Such callous disregard and exposure to unreasonable risk constitutes a severe violation (...) of the rights of prisoners by the state. While there have been numerous legal, political, and activist efforts to draw attention to this issue—with the goal of reforming and making prisons safer—my goal is different. I argue that inmates who are victims of prison violence should have their sentences automatically reduced. Two distinct arguments are advanced in support of this claim. First, I argue that acts of prison violence are a sort of state-mediated harm which can thus be appropriately described as punishment-constituting. Second, and more straightforwardly, I argue that the compensation owed to prisoners who are victims of prison violence may naturally take the form of a reduced sentence. (shrink)

Forgiveness seems especially apt in cases where the wrongdoer first performs some act of reparation. Suppose Valerie betrays Madison's trust out of careerist self-interest. The betrayal is serious, no excusing or exempting conditions obtain, and Madison responds with justified resentment. In one world, Valerie never acknowledges the impropriety of her past act and continues on as before. In another world, Valerie apologizes and sends Madison a beautiful bouquet of flowers. All else being equal, forgiveness seems called for or apt in (...) the second case in a way that it does not in the first. Reparative activities have a certain power, and forgiving in response to the wrongdoer's reparation strikes many as especially apt. (shrink)

In what seems to have been his last paper, Insight and Reflection (1954), Hermann Weyl provides an illuminating sketch of his intellectual development, and describes the principal influences—scientific and philosophical—exerted on him in the course of his career as a mathematician. Of the latter the most important in the earlier stages was Husserl’s phenomenology. In Weyl’s work of 1918-22 we find much evidence of the great influence Husserl’s ideas had on Weyl’s philosophical outlook—one need merely glance through the pages of (...) This forward-thinking collection presents new work that looks beyond the division between the analytic and continental philosophical traditions—one that has long caused dissension, mutual distrust, and institutional barriers to the development of common concerns and problems. Rather than rehearsing the causes of the divide, contributors draw upon the problems, methods, and results of both traditions to show what post-divide philosophical work looks like in practice. Ranging from metaphysics and philosophy of mind to political philosophy and ethics, the papers gathered here (...) bring into mutual dialogue a wide range of recent and contemporary thinkers, and confront leading problems common to both traditions, including methodology, ontology, meaning, truth, values, and personhood. A central tenet of moral individualism is that only an entity’s intrinsic (non-relational) properties can ground moral status because only intrinsic properties give rise to agent-neutral reasons. However, I show that the two main approaches to making the agent-neutral/agent-relative distinction fail to exclude morally salient relational (extrinsic) properties from giving rise to agent-neutral reasons. As such, moral individualism accounts of moral status are false. Further, arguments that depend on moral individualism’s central tenet—like the argument from “marginal” cases—are unable to defend (...) their thesis by merely claiming that special relations cannot ground moral status. People with grapheme-color synesthesia perceive specific colors when viewing different letters or numbers. Previous studies have suggested that synesthetic color experience can be bistable when induced by an ambiguous character. However, the exact relationship between processes underlying the identity of an alphanumeric character and the experience of the induced synesthetic color has not been examined. In the present study, we explored this by focusing on the temporal relation of inducer identification and color emergence using inducers whose identity could be rendered (...) ambiguous upon rotation of the characters. Specifically, achromatic alphabetic letters and digits were presented at varying angles to 9 grapheme-color synesthetes. Results showed that grapheme identification and synesthetically perceived grapheme color covary with the orientation of the test stimulus and that synesthetes were slower naming the experienced color than identifying the character, particularly at intermediate angles where ambiguity was greatest. Colour synaesthesia is the mental experience involving a strong association between specific colours and specific auditory stimuli, such as words, or achromatic visual stimuli, such as numerals or letters. In the contemporary literature on colour synaesthesia, the majority view treats the phenomenon as one arising from some of the same neural events mediating colour perception triggered by genuinely coloured objects; this view that synaesthesia is perceptually based, however, is not universally endorsed. What strategies have been utilized to evaluate the perceptual (...) reality of colour synaesthesia, and what is the evidence produced by those strategies? This chapter tackles those questions within the context of colour graphemic synaesthesia, the most widely studied form of synaesthesia. We divide the research strategies into those employing behavioral measures to assess whether synaesthetia influences performance on tasks known to be sensitive stimulus colour and those employing indirect measures that use physiological responses as proxies for colour perception. Our chapter concludes that there is sufficient justification for the belief in the perceptual reality of colour grapheme synaesthesia. At the same time, we applaud those who remain disbelievers, for their skepticism has underscored the logical issues surrounding research on this question. (shrink)

Its various parts focus on the connected theme that some sensible component is essential to the production and comprehension of art. Each part, however, investigates a different aspect of the theme and (...) could stand on its own. In particular it discusses, first, Deleuze's engagement with Hume's empiricism, which he understands to be founded on a thesis of the externality of relations; and, second, what Deleuze calls the problem of subjectivity, which is what he takes Hume's account of human nature to concern. The chapter provides some support for Deleuze's innovative readings and concludes with remarks on a contrast (...) between Deleuze's and Kant's transcendental philosophies, tracing a source for the contrast in Deleuze's and Kant's responses to Hume. Political encounters between settler governments and indigenous communities are freighted with the unresolved issues of indigenous independence asserted under ongoing conditions of colonial domination. Within political science, these encounters have been primarily theorised and analysed as struggles of indigenous communities for political recognition from settler states. Further, the politics of recognition is widely understood as colonising by indigenous scholars, with some arguing for an alternative politics of resurgence and refusal, a ‘turning away’ from the state. In this article, we argue (...) that in the case of Māori in Aotearoa ‘turning up’ is the ethical and correct practice of politics, a practice stemming from the relational ontology of the Māori world. Thus ‘turning up’ rather than ‘turning away’ can, for Māori, itself be a practice of refusal. We outline the centrality of the embodied, face-to-face encounter within Māori politics, and identify the ongoing presence of the sovereign’s body and embodiment more broadly within the Westminster tradition, as symbolised in the concept of the Crown. Building on these compatibilities within distinct political ontologies, we argue for the potential and productivity of face-to-face political encounters, and call on the New Zealand Crown to also prioritise ‘turning up’ in its engagement with indigenous communities. The coordination of beliefs, norms, and behaviors is foundational to theories of group formation. However, because beliefs and norms are not directly observable, signaling mechanisms are required to build reliable signals of latent traits. Although the mathematical theory behind these signals is robust, there is very little testing of ethnic marker theory or of its key propositions that markers become more prevalent along ethnic boundaries and where more than two cultural groups are in contact. We present an ethnographic test of (...) this theory with phonetic differences serving as potential group signals. The data derive from an ethnographic and linguistic investigation in two contrasting secondary school settings in Utah, one that is majority European American and one that is ethnically more diverse. Word list recordings were collected as part of interviews with teens from different backgrounds. We extracted acoustic data from the speech of European Americans (EAs) and Pacific Islanders (PIs), then analyzed differences in the pronunciation of the vowel in words such as “bit.” We found evidence of greater phonetic marking at the more diverse school, along more prominent boundaries of ethnic interaction. These results align with predictions made by the theoretical models. This initial empirical test of model predictions provides justification for the development of more complex models that could account for more variables within the environment. (shrink)

At the core of Swedenborg’s thought is the understanding that our purpose in this life is to progress spiritually—to learn, to grow, to do good works, and, ultimately, to allow as much of God’s love as possible to enter into us and manifest through us. Scattered throughout his works are descriptions of our mind and how it relates to both the physical and spiritual worlds. In this book, Taylor pulls these loose threads together and weaves them into a simple, coherent (...) whole, presenting Swedenborg’s teachings as a system that anyone can follow. Taylor describes the external or natural mind as primarily concerned with material things, and the inner mind, in its essence, as love. As we elevate our thoughts toward higher and higher types of love and wisdom, we draw closer to God and begin the process of regeneration, or rebirth as spiritual beings. This is the first time in many decades that a book has been published on Swedenborg’s philosophy of the mind. Taylor’s straightforward commentary gives readers a rare insight into this crucial aspect of Swedenborg’s theology. (shrink)
