Even lawyers who obey the law often seem to act unethically--interfering with the discovery of truth, subverting justice, and inflicting harm on innocent people. Standard arguments within legal ethics attempt to show why it is permissible to do something as a lawyer that it would be wrong to do as an ordinary person. But in the view of most critics these arguments fail to turn wrongs into rights. Even many lawyers think legal ethics is flawed because it does not accurately (...) describe the considerable moral value of their work. In Lawyers and Fidelity to Law, Bradley Wendel introduces a new conception of legal ethics that addresses the concerns of lawyers and their critics alike.Wendel proposes an ethics grounded on the political value of law as a collective achievement that settles intractable conflicts, allowing people who disagree profoundly to live together in a peaceful, stable society. Lawyers must be loyal and competent client representatives, Wendel argues, but these obligations must always be exercised within the law that constitutes their own roles and confers rights and duties upon their clients. Lawyers act unethically when they treat the law as an inconvenient obstacle to be worked around and when they twist and distort it to help their clients do what they are not legally entitled to do. This chapter explores the term “landscape” and its utility for indigenous people. If indigenous people do not have an understanding of the term, the question is posed whether “landscape” is merely a form of “restricted” speech that is meant to signify power and authority over them and the land they call home. In Australia, certain literary works describe the rich relationship indigenous people have with their land, providing a foundation for the study of “cultural landscapes.” These works share the common (...) trait of presenting a way in which landscape becomes evidence of the cosmological processes that define kinship, group alignments, and cultural practices. The literature on mathematical explanation contains numerous examples of explanatory, and not so explanatory proofs. In this paper we report results of an empirical study aimed at investigating mathematicians’ notion of explanatoriness, and its relationship to accounts of mathematical explanation. Using a Comparative Judgement approach, we asked 38 mathematicians to assess the explanatory value of several proofs of the same proposition. We found an extremely high level of agreement among mathematicians, and some inconsistencies between their assessments and claims in the (...) literature regarding the explanatoriness of certain types of proofs. The UK has been ‘following the science’ in response to the COVID-19 pandemic in line with the national framework for the use of scientific advice in assessment of risk. We argue that the way in which it does so is unsatisfactory in two important respects. Firstly, pandemic policy making is not based on a comprehensive assessment of policy impacts. And secondly, the focus on reasonable worst-case scenarios as a way of managing uncertainty results in a loss of decision-relevant information and (...) does not provide a coherent basis for policy making. Drawing on an array of sources, from Deleuze and Guattari’s philosophy through to non-philosophy, this paper concerns itself with the manifestation of the concepts of hope and despair in utopian thought and continental philosophy and the experience of hopelessness, despair and exhaustion in the contemporary moment. I aim to demonstrate such pressing concerns through a comparison of Japanese philosopher Kojin Karatani and Japanese fiction writer Ryū Murakami with the American science fiction-thriller film directed by Michael Bay, The Island. The focus of the paper is on the fecund moment inhering in the incapacity of thought to think the possibility of utopia. Preimplantation genetic diagnosis generates a series of ethical and legal questions: Which goals does it pursue? Does it protect the embryo? Should this technique be regulated by the legal system? And if so, which is the incumbent criteria? This research describes the limits that some international laws regulating this technique have considered. Additionally, a series of judgments about the legal problems that have occurred with the application of this technique will be analyzed, among them, the misdiagnosis.

Se propone un análisis de la relación entre el factor _valor pragmático del enunciado interrogativo _y el orden sujeto-verbo y su variación dialectal según las zonas geográficas reconocidas en el mundo hispánico. Teóricamente, esta investigación se fundamenta, por un lado, en estudios que plantean una correlación entre la función comunicativa de la interrogación y su estructura sintáctica y, por otro, en la conocida tendencia al orden SV que experimentan las interrogativas parciales del Caribe. El corpus de análisis está conformado por (...) 700 oraciones interrogativas totales, extraídas del Corpus de Referencia del Español del Siglo XXI (CORPES). El análisis estadístico revela solo una correspondencia parcial con los postulados de Freed (1994) y Escandell (1999) respecto de la asociación del orden con el valor pragmático del enunciado. Además, se observó un comportamiento diferenciado según las zonas geográficas, siendo España la zona que tiende a la posposición del sujeto de manera más acusada, independientemente del valor pragmático, mientras que las zonas Caribe Continental, Chile y Río de la Plata muestran una tendencia a la anteposición. El análisis de regresión logística mostró que, de las categorías observadas en el estudio, son las _interrogativas subjectio _y _problemáticas _las que favorecen de manera fuerte el orden VS, mientras que la _pregunta real_, sorprendentemente, favorece la anteposición del sujeto. La llegada del covid-19 a Chile generó un gran cambio en la educación, se implementaron medidas estrictas de confinamiento la cual obligó a la educación presencial ir de manera virtual. La finalidad de este estudio es mostrar la percepción del estudiantado del programa Bachillerato en Ciencias de la Universidad Santo Tomás frente al proceso educativo virtual que se llevo a cabo en los años 2020-21. Se utilizó un cuestionario de tipo cualitativo, con 32 preguntas. Los resultados muestran que la educación (...) virtual en tiempos de pandemia, genero diversos factores de stress, problemas de conectividad, acceso a tecnologías y falta de aprendizaje. (shrink)

In this essay, after critically evaluating the original cases for and against the possibility of legal gluts, I adjudicate a recent debate in this Journal regarding their possibility and provide new reasons for countenancing them. If my considerations are correct, then I will have provided new grounds for the possibility of legal gluts.
