Restorative justice should have greater weight as a criterion in criminal justice sentencing practice. It permits a realistic recognition of the kinds of harm and damage caused by offences, and encourages individualized non-custodial sentencing options as ways of addressing these harms. Non-custodial sentences have proven more effective than incarceration in securing social reconciliation and preventing recidivism, and they avoid the serious social and personal costs of imprisonment. This paper argues in support of restorative justice as a guiding idea in sentencing. (...) Philosophy, as I conceive it, is a journey and a quest. Conducted individually, it is nevertheless a collective attempt on the part of human beings from differing cultures and times to make sense of the arbitrary contingency of human existence, to find meaning in life. So understood, the impulse to philosophise needs no explanation or apology. It belongs to us all, and it exerts its own categorical imperative. For various domains in proportional reasoning cognitive development is characterized as a progression through a series of increasingly complex rules. A multiplicative relationship between two task features, such as weight and distance information of blocks placed at both sides of the fulcrum of a balance scale, appears difficult to discover. During development, children change their beliefs about the balance scale several times: from a focus on the weight dimension (Rule I) to occasionally considering the distance dimension (Rule II), guessing (Rule (...) III), and applying multiplication (Rule IV; Siegler, 1981). Because of the detailed empirical findings the balance scale task has become a benchmark task for computational models of proportional reasoning. In this article, we present a large empirical study (N = 420) of which the findings provide a challenge for computational models. The effect of feedback and the effect of individually adapted training items on rule transition were tested for children using Rule I or Rule II. Presenting adapted training items initiates belief revision for Rule I but not for Rule II. The experience of making mistakes (by providing feedback) induces a change for both Rule I and Rule II. However, a delayed posttest shows that these changes are preserved after 2 weeks only for children using Rule I. We conclude that the transition from Rule I to Rule II differs from the transition from Rule II to a more complex rule. Concerning these empirical findings, we will review performance of computational models and the implications for a future belief revision model. High blood pressure is a disease of unknown cause. Family history of the disease indicates higher risk, but it is not known which genes are involved or how they interact with environmental influences to produce the disorder. Molecular biology offers an approach to problems that have not so far been solved by classical physiology or biochemistry. By analysing polymorphic variation in chromosome markers such as minisatellite sequences, or by restriction fragment polymorphism analysis of candidate genes, attempts are being made to (...) link genetic variations with hypertension. In genetically hypertensive rats, hypertension is associated with a polymorphism of the renin gene and with other loci on chromosomes 10 and 18. The role of these loci in human hypertension remains to be determined. Other genes such as sodium‐lithium countertransport may be involved. This comparative case analysis contrasts two nations – Viet Nam and The United States of America (U.S.) – in terms of processes each employed and results each achieved in respective response to the COVID-19 pandemic. We use a general theory of teaching to contrast the countries in terms of their approaches to COVID public health education. Viet Nam followed the recommendations of the theory. The U.S. did not. While our analysis does not and cannot prove educational theory acted as the (...) sole causal factor in realization of the disparate results in the countries, our case study does illustrate that the different approaches to public health education used by the countries may be counted among factors contributing to wide differences in the contrasting cases. The argument proceeds by 1) describing differences in relevant statistics between Viet Nam and the U.S., 2) outlining the theory of teaching we use to analyze differences in public health education in the two contexts, and 3) discussing successful implementation of the theory in Viet Nam and failure to implement in the U.S. Finally, we 4) dismiss competing explanations of differences between the countries and 5) offer considerations about how the U.S. may educate citizens away from turning the pandemic into a pan(en)demic. Brenda Almond throws down a timely challenge to liberal consensus about personal relationships. She maintains that the traditional family is fragmenting in Western societies, causing serious social problems. She urges that we reconsider our attitudes to sex and reproduction in order to strengthen our most important social institution, the family.

Despite a growing body of research by management scholars to understand and explain failures in ethical decision making (EDM), misconduct prevails. Scholars have identified character, founded in virtue ethics, as an important perspective that can help to address the gap in organizational misconduct. While character has been offered as a valid perspective in EDM, current theorizing on how it applies to EDM has not been well developed. We thus integrate character, founded in virtue ethics, into Rest’s (1986) EDM model to (...) reveal how shifting attention to the nature of the moral agent provides critical insights into decision making more broadly and EDM specifically. Virtue ethics provides a perspective on EDM that acknowledges and anticipates uncertainties, considers its contextual constraints, and contemplates the development of the moral agent. We thus answer the call by many scholars to integrate character in EDM in order to advance the understanding of the field and suggest propositions for how to move forward. We conclude with implications of a character-infused approach to EDM for future research. (shrink)

This paper examines the vagaries of war and peace discourse which seek to legitimise the notion of brutality over the principle of morality. In recognition of the limitlessness of brutality the just war tradition was developed to take account of the reasons for going to war and of the conduct of war. Nevertheless, the just war solution can invoke a mode of binary thinking dictating the imperative of brutality over morality during a conflict situation. Feminist scholars argue that traditional just (...) war theory is inadequate to the task to which it is directed. The political theorist Laura Sjoberg is one such scholar who attempts to reformulate just war theory from a feminist perspective. I assess the contribution made by Sjoberg as it relates to the gendered impact of war on women arguing that Sjoberg’s reformulation of just war theory fails to deliver a sufficient rejoinder to the problem of gendered violence in war. The use of social media for medical crowdfunding links people with unmet healthcare needs to charitable donors. There is no doubt that fundraising campaigns using such platforms facilitates access to financial resources to the benefit of patients and their caregivers.Main textThis paper reports on a critical review of the published literature and information from other online resources discussing medical crowdfunding and the related ethical questions. The review (...) highlighted the benefits of crowdfunding as well as the under-exploration of the risk of having patients’ desires and human rights undermined during online fundraising campaigns. Majority of these campaigns get initiated on behalf of the patients, especially the very sick and dependant. The ethical questions raised relate to the voluntariness of informed consent and the possibility of patients being used as a means to an end. Vulnerability of patients may expose them to coercion, undue influence, manipulation, and violation of their human rights. The success of these campaigns is influenced by the digital skills, pre-existing social networks and, the emotional potency. Healthcare is a public good, and online market forces should not determine access to essential health services. The benefits of crowdfunding cannot be subverted, but it can perpetuate unintended injustices, especially those arising from socio-economic factors.ConclusionsPolicymakers ought to monitor the utilisation of crowdfunding sites to identify policy failures and unmet essential health care needs responsible for driving individuals to use these platforms. The upholding of human rights and the fundamental respect of the individual’s wishes is a moral imperative. The need for an ethics framework to guide different stakeholders during medical crowdfunding needs further examination. (shrink)

The American states have demonstrated varying levels of support for animal rights legislation. The activities of interest groups, including pressures from competing groups, help to explain the presence or absence of ten pro-animal regulations and laws. This article analyzes and ranks each of the fifty states with regard to ten key areas of animal protection and welfare legislation. The analysis reveals that states with a more agricultural economic base are less likely to provide protection to animals. This article focuses on the experiences of social care workers during the first wave of the Covid pandemic. The method involved analyzing diaries kept by 65 professionals in 8 French regions during the first lockdown in France in the spring of 2020. As a form of non-binding, narrative expression, keeping diaries breaks with traditional models of reporting common in social care structures and allowed professionals to reflect on the experience as it was lived. In the diaries, professionals explored how the (...) crisis disrupted and challenged their personal and professional values but also allowed innovation in care practices for vulnerable populations that will continue beyond the pandemic period. Five care values were put to forefront by professionals: (1) spontaneity/flexibility; (2) respect for persons; (3) team reflexivity; (4) innovation; (5) solidarity. Mobilizing philosopher Paul Ricoeur’s ideas on recognition, Payet and Laforgue’s analysis of weak actors, as well as research on moral distress, we discuss how these values were tested during the crisis and what effect they had on professionals’ and users’ vulnerabilities. We will also elaborate the interest of keeping account of social care work through narrative methods. (shrink)

Canada's Royal Commission on New Reproductive Technologies rejects all forms of surrogacy arrangement under the rubric of objecting to commercial surrogacy. Noncommercial surrogacy arrangements, however, can be defended against the commission's objections. They can be viewed as cases of giving a benefit or service to another in a way that expresses benevolence, and establishes a relationship between surrogates and prospective 'social' parents that allows mutual understanding and reciprocal personal interaction between them.

First, two aspects of the partiality issue are identified: (1) Is it right/reasonable for professionals to favour their clients interests over either those of other individuals or those of society in general? (2) Are special non-universalisable obligations attached to certain professional roles?Second, some comments are made on the notions of partiality and reasonableness. On partiality, the assumption that only two positions are possible – a detached universalism or a partialist egoism – is challenged and it is suggested that partiality, e.g. (...) to family members, lies between these two positions, being neither a form of egoism, nor of impersonal detachment. On reasonableness, it is pointed out that reasonable is an ambiguous concept, eliding the notions of the morally right and the rational. (shrink)

ABSTRACT There are three kinds of bonds between human beings: biological and natural; legal and artificial; social and voluntary. Marriage can be seen as an artificial and legal means of shifting the loose bonding of the third category of relationship into the deep and inescapable bonding of the first. The desire to create bonds of this type is widespread, but non‐bonding, too, has been recommended either as good in itself—a way of achieving peace of mind or personal emancipation through wider (...) relationships—or as necessary self‐denial for some higher cause. In the latter case, the bonds of family are seen as a positive good, a view shared, though for different reasons, by religious and political conservatives and by revisionist feminists. In contrast to this, three philosophical conceptions which would favour unbonding, or detachment from emotional ties, are categorised here as (a) the Stoic, (b) the Existentialist and (c) the Feminist. Within the Feminist ideal, it is radical, rather than liberal or socialist feminism that has most in common with Stoic or Existentialist ideals. These ideals are considered, together with various alternatives to marriage, and are judged not to override the need for deep personal bonds between human beings. These personal bonds of love and commitment are compared with the alternative bonds of religion and politics and it is concluded that, whatever forms they take, personal bonds have fundamental moral priority in the lives of human beings.
