It has been hypothesized that our believing that, or its seeming to us as though, the world is in some way dynamical partially explains (and perhaps rationalizes) future-bias. Recent work has, in turn, found a correlation between future-bias and near-bias, suggesting that there is a common explanation for both. Call the claim that what partially explains our being both future- and near-biased is our believing/it seeming to us as though the world is dynamical, the dynamical explanation. We empirically test two (...) versions of the dynamical explanation. The first is the moving ego explanation—according to which it is our belief that the ego moves, or our phenomenology as of the ego moving, that jointly (partially) explains future- and near-bias. The second is the moving time explanation—according to which it is our belief that time robustly passes, or our phenomenology as of robust passage, which jointly (partially) explain future- and near-bias. This book develops and defends a version of utilitarianism, including expected-utility theory, as a normative model of decision making. The defense, based on the idea of utility as achievement of goals, considers the endorsement of a norm as a decision and asks what reasons we have to endorse norms for decision making. The reasons derive from our pre-existing goals, so any norm we endorse must not fly in the face of these goals, although it must not be selfishly biased, either. (...) This approach is further clarified by drawing distinctions between decisions for the self, for a single other person, for several others, and for the self and others. The book discusses the implications of this argument for the psychological study of decision making, the act--omission distinction, moral education, decision analysis, risk analysis, and other questions of public policy. A popular principle about grounding, “Internality”, says that if A grounds B, then necessarily, if A and B obtain, then A grounds B. I argue that Internality is false. Its falsity reveals a distinctive, new kind of explanation, which I call “ennobling”. Its falsity also entails that every previously proposed theory of what grounds grounding facts is false. I construct a new theory of what grounds grounding: the ennobling theory.

The counterfactual approach to explainable AI (XAI) seeks to provide understanding of AI systems through the provision of counterfactual explanations. In a recent systematic review, Chou et al. (Inform Fus 81:59–83, 2022) argue that the counterfactual approach does not clearly provide causal understanding. They diagnose the problem in terms of the underlying framework within which the counterfactual approach has been developed. To date, the counterfactual approach has not been developed in concert with the approach for specifying causes developed by Pearl (...) (Causality: Models, reasoning, and inference. Cambridge University Press, 2000) and Woodward (Making things happen: A theory of causal explanation. Oxford University Press, 2003). In this paper, I build on Chou et al.’s work by applying the Pearl-Woodward approach. I argue that the standard counterfactual approach to XAI is capable of delivering causal understanding, but that there are limitations on its capacity to do so. I suggest a way to overcome these limitations. (shrink)

The present paper advances an analogy between cases of extra-mathematical explanation and cases of what might be termed ‘extra-logical explanation’: the explanation of a physical fact by a logical fact. A particular case of extra-logical explanation is identified that arises in the philosophical literature on time travel. This instance of extra-logical explanation is subsequently shown to be of a piece with cases of extra-mathematical explanation. Using this analogy, we argue extra-mathematical explanation is part of a broader class of non-causal explanation. (...) Consider the following pair of theses: all fundamental physical objects are spatiotemporal and all non-fundamental physical objects are ultimately composed of fundamental objects. Work on the physics of quantum gravity suggests that spacetime is a non-fundamental, emergent phenomenon and thus that thesis is false. The fundamentals are non-spatiotemporal in nature. This paper will argue against on the grounds that non-fundamental spatiotemporal objects cannot be composed of fundamental non-spatiotemporal objects. So, assuming that spacetime is emergent, new metaphysical resources are needed to (...) explain the relationship between the fundamental objects posited by quantum gravity and spacetime. (shrink)

The principle of exchange seems to be limited in its application, and it cannot serve as a link between utilitarianism and the idea of a market for interpersonal relations. Our preferences concern the inner states of other people as well as their overt behavior. The neglect of this aspect of our preferences is a result of the coupling of utilitarianism with behaviorism. The problem is thus behaviorism, not consequentialism. It might be argued that commensurability is wrong because it sanctions impure (...) practices - aside from any principle of exchange. In reply, it may be argued that the principle of purity is an intuitive one, which must be justified at a higher level. At the intuitive level, the purity principle competes with the view that practices are in some cases too pure already, and that blind purity cannot be maintained without educational deception. The apparent difficulty of making tradeoffs among different kinds of consequences is a problem in practice, not a problem in principle. The difficulty may indeed justify certain prescriptive rules, but a blanket prohibition against impure practices would seem to require considerable defense. (shrink)

Ockham's razor asks that we not multiply entities beyond necessity. The razor is a powerful methodological tool, enabling us to articulate reasons for preferring one theory to another. There are those, however, who would modify the razor. Schaffer, for one, tells us that, ‘I think the proper rendering of Ockham's razor should be ‘Do not multiply fundamental entities without necessity’’. Our aim, here, is to challenge such re-workings of Ockham's razor.

This article provides a non-technical overview of the conflict between the special theory of relativity and the dynamic theories of time. The chief argument against dynamic theories of time from relativistic mechanics is presented. The space of current responses to that argument is subsequently mapped.

This article argues that a particular metaphysical model permeates cultural practices surrounding pregnancy: the foetal container model. Widespread uncritical reliance on this view of pregnancy has been highly detrimental to women's liberty and reproductive autonomy. In this article, I extend existing critiques of the medical treatment of pregnant women to the context of the burgeoning commercial surrogacy industry. In doing so, I aim to show that our philosophical analysis in both spheres is constrained by the presupposition that the foetus and (...) pregnant woman are metaphysically and ethically distinct entities. By exploring the similarities and differences between the expectations placed on pregnant women in these two spheres, I show that the foetal container model is not a homogeneous understanding of pregnancy applied consistently across contexts; rather, it has been used to justify various practices and attitudes toward pregnancy and pregnant women through different moral frameworks, in the service of different overarching aims. Call an explanation in which a non-mathematical fact is explained—in part or in whole—by mathematical facts: an extra-mathematical explanation. Such explanations have attracted a great deal of interest recently in arguments over mathematical realism. In this article, a theory of extra-mathematical explanation is developed. The theory is modelled on a deductive-nomological theory of scientific explanation. Recently, nominalists have made a case against the Quine–Putnam indispensability argument for mathematical Platonism by taking issue with Quine’s criterion of ontological commitment. In this paper I propose and defend an indispensability argument founded on an alternative criterion of ontological commitment: that advocated by David Armstrong. By defending such an argument I place the burden back onto the nominalist to defend her favourite criterion of ontological commitment and, furthermore, show that criterion cannot be used to formulate a plausible form of (...) the indispensability argument. This paper offers a new way to evaluate counterfactual conditionals on the supposition that actually, there is no time. We then parlay this method of evaluation into a way of evaluating causal claims. Our primary aim is to preserve, at a minimum, the assertibility of certain counterfactual and causal claims once time has been excised from reality. This is an important first step in a more general reconstruction project that has two important components. First, recovering our ordinary language claims involving (...) notions such as persistence, change and agency and, second, recovering enough observational evidence so that any timeless metaphysics is not empirically self-refuting. However, the project of investigating causation in a timeless setting has a greater relevance than its application to timeless physical theory alone. For, as we show, it can be used to model the assertibility conditions of causal claims more generally. (shrink)

Open peer commentary on the article “Designing Academic Conferences in the Light of Second-Order Cybernetics” by Laurence D. Richards. Upshot: Richards’s long history and commitment to cybernetics provides a well-rounded view of the dichotomy between the traditional conference and one aspiring for second-order cybernetic attributes. We examine why traditional conferences have proved so resilient, despite their shortcomings, and discuss some issues that underlie the dynamics of the participation of academics in non-traditional conferences.

Is time necessary for causation? We argue that, given a counterfactual theory of causation, it is not. We defend this claim by considering cases of counterfactual dependence in quantum mechanics. These cases involve laws of nature that govern entanglement. These laws make possible the evaluation of causal counterfactuals between space-like separated entangled particles. There is, for the proponent of a counterfactual theory of causation, a possible world in which causation but not time exists that can be reached by ‘stripping out’ (...) time from the actual world, leaving quantum mechanical laws intact. When people tend toward a political decision, such as voting for the Republican Party, they are often attracted to this decision by one issue, such as the party’s stance on abortion, but then they come to see other issues, such as the party’s stand on taxes, as supporting their decision, even if they would not have thought so in the absence of the decision. I demonstrate this phenomenon with opinion poll data and with an experiment done on the World Wide (...) Web using hypothetical candidates. For the hypothetical candidates, judgments about whether a candidate’s position on issue A favors the candidate or the opponent are correlated with judgments about other positions taken by the candidate (as determined from other hypothetical candidates). This effect is greater in those subjects who rarely make conflicting judgments, in which one issue favors a candidate and another favors the opponent. In a few cases, judgments even reverse, so that a position that is counted as a minus for other candidates becomes a plus for a favored candidate. Reversals in the direction of a candidate’s position are more likely when the candidate is otherwise favored. The experiment provides a new kind of demonstration of “belief overkill,” the tendency to bring all arguments into line with a favored conclusion. (shrink)

This paper draws together two strands in the debate over the existence of mathematical objects. The first strand concerns the notion of extra-mathematical explanation: the explanation of physical facts, in part, by facts about mathematical objects. The second strand concerns the access problem for platonism: the problem of how to account for knowledge of mathematical objects. I argue for the following conditional: if there are extra-mathematical explanations, then the core thesis of the access problem is false. This has implications for (...) nominalists and platonists alike. Platonists can make a case for epistemic access to mathematical objects by providing evidence in favour of the existence of extra-mathematical explanations. Nominalists, by contrast, can use the access problem to cast doubt on the idea that mathematical objects play a substantive role in scientific explanation. (shrink)

Since its inception the ‘mindblindness’ theory of autism has greatly furthered our understanding of the core social-communication impairments in autism spectrum conditions . However, one of the more subtle issues within the theory that needs to be elaborated is the role of the ‘self’. In this article, we expand on mindblindness in ASC by addressing topics related to the self and its central role in the social world and then review recent research in ASC that has yielded important insights by (...) contrasting processes relating to both self and other. We suggest that new discoveries lie ahead in understanding how self and other are interrelated and/or distinct, and how understanding atypical self-referential and social-cognitive mechanisms may lead to novel ideas as to how to facilitate social-communicative abilities in ASC. Recent work on quantum gravity suggests that neither spacetime nor spatiotemporally located entites exist at a fundamental level. The loss of both brings with it the threat of empirical incoherence. A theory is empirically incoherent when the truth of that theory undermines the empirical justification for believing it. If neither spacetime nor spatiotemporally located entities exist as a part of a fundamental theory of QG, then such a theory seems to imply that there are no observables and so no way (...) that the theory can be confirmed. The threat of empirical incoherence can be addressed by treating spacetime and spatiotemporally located entities as emergent. The question then arises as to what the metaphysical nature of this emergence might be. In this paper, I explore a functionalist approach to this kind of emergence in the context of loop quantum gravity. I begin by rehearsing the spacetime functionalist’s account of emergence, clarifying the view along the way. I proceed to sketch out a functionalist treatment of spatiotemporally located entities and combine the two forms of functionalism into a double functionalism, according to which both spacetime and matter have the same functional realisers. According to dialetheism, there are some true contradictions. According to the A-theory, the passage of time is a mind-independent feature of reality. On some A-theories, the passage of time involves the movement of the present. I show that by appealing to dialetheism one can explain why the present moves. I then argue that A-theorists should adopt this explanation. To do this, I defend two claims. First, that the dialetheic explanation is an improvement on the only other explanation available for why (...) the present moves and, second, that adopting the explanation is better than leaving the motion of the present unexplained. Assuming that A- theorists should adopt the best available version of their view, it follows that they should adopt a dialetheic explanation of why time passes. (shrink)

Most scientists and theorists concerned with the problem of consciousness focus on our consciousness of the physical world (our sensations, feelings, and awareness). In this paper I consider our consciousness of the mental world (our thoughts about thoughts, intentions, wishes, and emotions).The argument is made that these are two distinct forms of consciousness, the evidence for this deriving from studies of autism. Autism is a severe childhood psychiatric condition in which individuals may be conscious of the physical world but not (...) of the mental world. Relevant experimental evidence is described, including some recent neuroimaging studies pointing towards the neural basis of our consciousness of the mental. (shrink)

In this paper we offer a response to one argument in favour of Priority Monism, what Jonathan Schaffer calls the nomic argument for monism. We proceed in three stages. We begin by introducing Jonathan Schaffer’s Priority Monism and the nomic argument for that view. We then consider a response to the nomic argument that we presented in an earlier paper. We show that this argument suffers from a flaw. We then go on to offer a different response to the nomic (...) argument. The core idea is that the current laws of physics are not integrated in the manner that Schaffer requires to get the nomic argument for monism off the ground. (shrink)

Focusing primarily on papers and books discussing the evolutionary and systematic interpretation of the Cambrian animal fossils from the Burgess Shale fauna, this paper explores the role of epistemic values in the context of a discipline striving to establish scientific authority within a larger domain of epistemic problems and issues . The focal point of this analysis is the repeated claims by paleontologists that the study of fossils gives their discipline a unique ‘historical dimension’ that makes it possible for them (...) to unravel important aspects of evolution invisible to scientists who study the extant biosphere. The first part of the paper explores the shifting of emphasis in the writings of paleontologists between two strategies that employ opposing views on the classical positivist and physicalist ideal of science. The second part analyzes paleontologists’ claims of privileged access to life’s historical dimension in a situation where a theoretical upheaval occurring independent of the epistemical problem at hand completely shifts the standards for evaluating the legitimacy of various knowledge claims. Though the various strategies employed in defending the privileged historical perspective of paleontology have been disparate and, to an extent contradictory, each impinges on the acceptance of a specific epistemic ideal or set of values and success or failure of each depends on the compatibility of this ideal with the surrounding community of scientists. We argue that a certain variety of presentist time travel ends up significantly undermining the motivational foundations which lead some, but not all, presentists to their view. We suggest that if presentism is motivated by phenomenology, and part of that phenomenology is that it’s an experiential datum that we experience temporal passage, then the basis for believing presentism is less secure than we might have thought.

Over recent years, lawyer misconduct and regulation of the profession have been topics of considerable interest. Yet, when the topic of legal ethics is raised, the focus tends to be on lawyer conduct external to the firm: lawyer conduct in court; lawyer conduct vis-a-vis client; or lawyer conduct vis-a-vis opposing counsel or the judiciary. The recent National Attrition and Re-engagement Study, however, raises a different aspect of legal professional ethics. This Report found a widespread incidence of bullying, intimidation, discrimination and (...) harassment within law firms, primarily affecting though not confined to, female lawyers. Of course, bullying and associated behaviours are not confined to the legal profession. But these behaviours are at odds with a profession that purports to be deeply concerned with the ethical conduct of its members. Arguing that ‘ethics begins at home’, this paper suggests NARS raises uncomfortable questions about legal professional ethics: if law firms cannot treat their own staff members ethically, what does that say about the firm’s approach to ethical conduct more generally? And if this culture is as widespread as the report suggests, what does this say about the ethics of the legal profession as a whole? (shrink)

Justifying the Obligation to Die provides a critical survey covering classical, medieval, and modern political thinking on how the state or sovereign may justifiably oblige members of the community to risk their lives on its behalf by being sent into war, and it uses Zionism to illustrate how this obligation has been argued in practice. The author then turns to the political thought of Hannah Arendt in order to argue how the obligation could become justifiable.

The effectiveness of information retrieval technology in electronic discovery (E-discovery) has become the subject of judicial rulings and practitioner controversy. The scale and nature of E-discovery tasks, however, has pushed traditional information retrieval evaluation approaches to their limits. This paper reviews the legal and operational context of E-discovery and the approaches to evaluating search technology that have evolved in the research community. It then describes a multi-year effort carried out as part of the Text Retrieval Conference to develop evaluation methods (...) for responsive review tasks in E-discovery. This work has led to new approaches to measuring effectiveness in both batch and interactive frameworks, large data sets, and some surprising results for the recall and precision of Boolean and statistical information retrieval methods. The paper concludes by offering some thoughts about future research in both the legal and technical communities toward the goal of reliable, effective use of information retrieval in E-discovery.
