The effectiveness of information retrieval technology in electronic discovery (E-discovery) has become the subject of judicial rulings and practitioner controversy. The scale and nature of E-discovery tasks, however, has pushed traditional information retrieval evaluation approaches to their limits. This paper reviews the legal and operational context of E-discovery and the approaches to evaluating search technology that have evolved in the research community. It then describes a multi-year effort carried out as part of the Text Retrieval Conference to develop evaluation methods (...) for responsive review tasks in E-discovery. This work has led to new approaches to measuring effectiveness in both batch and interactive frameworks, large data sets, and some surprising results for the recall and precision of Boolean and statistical information retrieval methods. The paper concludes by offering some thoughts about future research in both the legal and technical communities toward the goal of reliable, effective use of information retrieval in E-discovery. In Against Moral Responsibility, Bruce Waller launches a spirited attack on a system that is profoundly entrenched in our society and its institutions, deeply rooted in our emotions, and vigorously defended by philosophers from ancient times to the present. Waller argues that, despite the creative defenses of it by contemporary thinkers, moral responsibility cannot survive in our naturalistic-scientific system. The scientific understanding of human behavior and the causes that shape human character, he contends, leaves no room for moral responsibility. (...) Waller argues that moral responsibility in all its forms--including criminal justice, distributive justice, and all claims of just deserts--is fundamentally unfair and harmful and that its abolition will be liberating and beneficial. What we really want--natural human free will, moral judgments, meaningful human relationships, creative abilities--would survive and flourish without moral responsibility. In the course of his argument, Waller examines the origins of the basic belief in moral responsibility, proposes a naturalistic understanding of free will, offers a detailed argument against moral responsibility and critiques arguments in favor of it, gives a general account of what a world without moral responsibility would look like, and examines the social and psychological aspects of abolishing moral responsibility. Waller not only mounts a vigorous, and philosophically rigorous, attack on the moral responsibility system, but also celebrates the benefits that would result from its total abolition. (shrink)

The Stern School is undertaking a program to teach business ethics to Stern professors and others who have an interest in ethics but no previous formal instruction. The two-year series of faculty seminars will produce a cadre of professors who are well equipped to do research, to write scholarly papers, and to teach business ethics at a high level. The documentation of the seminar series will be available for others to use.

The pressure to participate in the global community has as one of its manifestations the requirements of an adequate and even a “world class” university system. Historically, universities have had more in common with monasteries than with marketplaces. Universities were always places of retreat, drawing people apart from the world for the purpose of contemplation and self-improvement. At its worst, the focussed vocation of the monastery gives way to the irrelevance of the ivory tower. Indeed, the most common critique of (...) the university, and particularly the liberal arts, is that it does not contribute to the real needs or wants of people. Many believe that the governing metaphor should be changed from monastery to marketplace. Needless to say, this change comes with its own set of problems and, for many, a university which is primarily a marketplace is no longer a university. Nevertheless, in the minds of many, tensions between integrity and relevance are the core problems facing the university today. (shrink)

In this book, Bruce Waller attacks two prevalent philosophical beliefs. First, he argues that moral responsibility must be rejected; there is no room for such a notion within our naturalist framework. Second, he denies the common assumption that moral responsibility is inseparably linked with individual freedom. Rejection of moral responsibility does not entail the demise of individual freedom; instead, individual freedom is enhanced by the rejection of moral responsibility. According to this theory of "no-fault naturalism," no one deserves either (...) blame or reward.In the course of arguing against moral responsibility, Waller critiques major compatibilist arguments-by Dennett, Frankfurt, Strawson, Bennett, Wolf, Hampshire, Glover, Rachels, Sher, and others. In addition, the implications of denying moral responsibility-for individual freedom, for moral judgments and moral behavior, and for social justice-are examined; the supposed dire consequences of the denial of moral responsibility are challenged; and the benefits of denying moral responsibility are described. Morphological elements, or structures, are sorted into four categories depending on their level of anatomical isolation and the presence or absence of intrinsically identifying characteristics. These four categories are used to highlight the difficulties with the concept of structure and our ability to identify or define structures. The analysis is extended to the concept of homology through a discussion of the methodological and philosophical problems of the current concept of homology. It is argued that homology is fundamentally a similarity based (...) concept rather than a phylogenetic concept, and a proposal is put forth to return to a comparative context for homology. It is shown that for both the concepts of structure and homology ana priori assumption of stable underlying patterns (i.e. archetypes) is essential. (shrink)

What is the nature of the decision-related personal values of corporate management? Managers' attitudes and behaviors are built upon their personal value systems (PVS). Knowledge about the structure of management's PVS assists in understanding the attributes of corporate decision making. Utilizing a survey instrument developed and used by England (1967, 1975), this article updates this research into corporate managers' personal value systems. England's PVS consists of sixty-six pre-tested values clustered into five groups. As one could expect with personal values, statistical (...) tests reveal that even with dramatic changes in the business environment the overall personal values structure has not changed over the intervening three decades. The results also reveal that corporate managers retain their pragmatic value orientation as discussed by England. (shrink)

This article offers a historical inquiry into behaviorism and its impact on standard of judgement concerning education policies. Drawing from Aldous Huxley’s reservation towards behaviorism as a scientific movement that naturalizes the role of control in human affairs, the paper maps the impact of behaviorism on economics of education. By tracing the influence of behaviorism in both rational (human capital theory) and quasi-rational (behavioral insight) economics, we draw attention to the activity of knowledge-making that describes and prescribes agency. The paper (...) demonstrates how policy instruments and outcomes are intimately linked to assumptions about personhood, and in the case of behavioral insight, they contribute to the scope of decision-making entrusted to government and business. Utilizing a genealogical approach, the paper invites ethical reflections on the long-term implications of behavioral economics in light of automation. (shrink)

Methane emissions from sheep and cattle production have gained increasing profile in the context of climate change. Policy and scientific research communities have suggested a number of technological approaches to mitigate these emissions. This paper uses the concept of co-production as an analytical framework to understand farmers’ evaluation of a 'good animal’. It examines how technology and sheep and beef cattle are co-produced in the context of concerns about the climate change impact of methane. Drawing on 42 semi-structured interviews, this (...) paper demonstrates that methane emissions are viewed as a natural and integral part of sheep and beef cattle by farmers, rather than as a pollutant. Sheep and beef cattle farmers in the UK are found to be an extremely heterogeneous group that need to be understood in their specific social, environmental and consumer contexts. Some are more amenable to appropriating methane reducing measures than others, but largely because animals are already co-constructed from the natural and the technical for reasons of increased production efficiency. Many educators today recognise the importance of online data sources for all sorts of research and writing projects. Some now permit students to include online sources in their work and others actually require their use. There are abundant resources available online, including real-time video; radio stations from around the world; reference tools, such as encyclopaedias, dictionaries, thesauri and collections of quotes; libraries of poetry, short stories, images and music; critical studies and research articles on every conceivable topic; information about authors (...) and historical figures; government and public policy data; current events; interactive software; and much, much more. At the same time, most users quickly see the problems that arise. Issues of privacy, plagiarism, pornography, hate sites, commercialism and simply wasting time arise regardless of the topic. The abundance soon yields thousands of Websites of dubious quality and relevance. (shrink)

Transparency lies at the heart of most modern slavery reporting legislation, but while publication of statements is mandatory, conformance with content guidance is voluntary, such that overall, corporate responses have been poor. Existing studies, concentrated in business to consumer rather than inter-organisational contexts, have not undertaken the fine-grained assessments of statements needed to identify which aspects of reporting performance are particularly poor and the underlying reasons that need to be addressed by policy makers. In a novel design, this study utilises (...) the ethical trade initiative assessment framework to evaluate the content of 95 UK government suppliers’ modern slavery statements. The findings suggest that in a modern slavery context, discovery challenges are more important than firms’ attitudes to disclosure. We contribute to the transparency literature through a model contrasting discovery costs and disclosure risks and by identifying the disclosure of unknowns as an additional relevant dimension of disclosure. We then discuss the model in relation to normativity theory to consider options through which the currently low legitimacy of the reporting governance regime can be enhanced and the intended norms established. This paper criticizes the epistemological doctrine of moderate rationalism that has been defended in recent years by such writers as Laurence BonJour, Alvin Plantinga, and George Bealer. It is argued that this new form of rationalism is really no better than the old one and that the key claim common to both---that intuition or rational insight provides a satisfactory basis for a priori knowledge---is untenable. Most of the criticism is directed specifically against Laurence BonJour’s recent “dialectical” defense of the doctrine. (...) Since BonJour’s defense is essentially an attempt to show how a priori knowledge is possible, an alternative, empiricist view of a priori knowledge is presented that eludes his objections and is supported by the criticism brought against moderate rationalism. Continuing his quest to bring American philosophy back to its roots, Bruce Wilshire connects the work of such thinkers as Thoreau, Emerson, Dewey, and James with Native American beliefs and practices. His search is not for exact parallels, but rather for fundamental affinities between the equally "organismic" thought systems of indigenous peoples and classic American philosophers. Wilshire gives particular emphasis to the affinities between Black Elk’s view of the hoop of the world and Emerson’s notion of horizon, and also (...) between a shaman’s healing practices and James’s ideas of pure experience, willingness to believe, and a pluralistic universe. As these connections come into focus, the book shows how European phenomenology was inspired and influenced by the classic American philosophers, whose own work reveals the inspiration and influence of indigenous thought. Wilshire’s book also reveals how artificial are the walls that separate the sciences and the humanities in academia, and that separate Continental from Anglo-American thought within the single discipline of philosophy. The first proposition of the Principia records two fundamental properties of an orbital motion: the Fixed Plane Property (that the orbit lies in a fixed plane) and the Area Property (that the radius sweeps out equal areas in equal times). Taking at the start the traditional view, that by an orbital motion Newton means a centripetal motion – this is a motion ``continually deflected from the tangent toward a fixed center'' – we describe two serious flaws in the Principia's argument (...) for Proposition 1, an argument based on a polygonal impulse approximation. First, the persuasiveness of the argument depends crucially on the validity of the Impulse Assumption: that every centripetal motion can be represented as a limit of polygonal impulse motions. Yet Newton tacitly takes the Impulse Assumption for granted. The resulting gap in the argument for Proposition 1 is serious, for only a nontrivial analysis, involving the careful estimation of accumulating local errors, verifies the Impulse Assumption. Second, Newton's polygonal approximation scheme has an inherent and ultimately fatal disability: it does not establish nor can it be adapted to establish the Fixed Plane Property. Taking then a different view of what Newton means by an orbital motion – namely that an orbital motion is by definition a limit of polygonal impulse motions – we show in this case that polygonal approximation can be used to establish both the fixed plane and area properties without too much trouble, but that Newton's own argument still has flaws. Moreover, a crucial question, haunted by error accumulation and planarity problems, now arises: How plentiful are these differently defined orbital motions? Returning to the traditional view, that Newton's orbital motions are by definition centripetal motions, we go on to give three proofs of the Area Property which Newton ``could have given'' – two using polygonal approximation and a third using curvature – as well as a proof of the Fixed Plane Property which he ``almost could have given.''. I examine the role played in Schürmann’s philosophy by the notion of epoch. This means showing on one side that his critique of the philosophy of history begins from a particular conception of history centered on the demise of the hegemonies, and on the other that this ultimate epoch of history itself escapes the history of hegemonies. This demonstration puts in question the ontological paradigm of the contingent, the anarchic foundation of tragic philosophy.
