Two purported proofs of the incoherence of vague identity are considered. First gareth evans's attempt is criticized and reformulated to overcome certain formal difficulties. Despite the reformulation, However, Evans's proof is demonstrated invalid in accord with a supervaluational approach. Next nathan salmon's attempt is evaluated. Here the problem is salmon's implicit assumption of a version of leibniz's law which is stronger than that strictly guaranteed by the law as it is given in classical logic. The question is raised on what (...) grounds this stronger version is to be considered a logical law: without it the proof fails. (shrink)

This article provides an ISCT analysis of commercial bribery focused on transaction cost economics. In the language of Antitrust, commercial bribery is a form of vertical arrangement subject to the same efficiency analysis that has found other vertical arrangements potentially beneficial to consumers. My analysis shows that actions condemned as commerical bribery in the Honda case may well have benefited Honda's dealer network once promotional free riding and other forms of rent seeking by dealers are considered. I propose that the (...) term "commercial bribery" should be avoided until after an ISCT analysis shows that the community is likely to have been harmed. The term "third-party payments" is a more ethically neutral term with which to begin the analysis. (shrink)

This paper makes three important points regarding socially responsible investing. First, the current methodology involving SRI fund divestiture of the securities of firms that engage in socially irresponsible activity often results in unacceptable unintended consequences. Second, in many cases the proper methodology for SRI funds may be purposely to include the securities of such firms in the portfolio in an effort to internalize socially irresponsible interfirm spillovers. Finally, that SRI fund managers may be able to bound their performance by organizing (...) as closed-end funds subject to takeover and liquidation if the stated socially responsible objectives are not met. Socially responsible investing (SRI) is the practice of making investment decisions on the basis of both financial and social performance. The SRI movement has grown into a $1.185 trillion business, accounting for about 1 in 10 U.S. invested dollars. Not surprisingly, the industry has suffered severe growing pains along the way in the form of issues of credibility, demand, and performance. And, to date, the product itself has been limited to equity investing. This article explores these critical issues and whether (...) socially screened bonds can perform as well as or better than unscreened bonds. More than sixty reporters discuss ethical dilemmas facing the journalist and how they have personally coped with such problems as conflicts of interest, gifts, bribes, news leaks, and confidentiality of sources.

Can we legitimately speak of ethicsexperts? Recent literature in philosophy and medical ethics addresses this important question but does not offer a satisfactory answer. Part of the problem is the absence of an examination of what it means to be an expert in general. I therefore begin by reviewing my analysis of expertise which appeared earlier in this journal. We speak of two kinds of experts: persons whose expertise is in virtue of what theyknow (epistemic expertise), or what theydo (performative (...) expertise). Applying this analysis to the domain of ethics, I argue that we may speak of ethical expertise in three epistemic senses: a) expertise indescriptive ethics, b) expertise inmetaethics, c) expertise innormative ethics, and in a performative sense: d) expertise inliving a good life. I conclude with a brief description of some social roles of ethics experts. (shrink)

Prolife theorists typically hold to the claim that all human beings possess equal moral status from conception and consequently possess a right to life. This, they believe, entails that abortion is impermissible in all circumstances. Critics characterize this as an extreme anti-abortion position, as it prima facie allows no exceptions, even in cases of rape. Here, I examine whether the prolife claim regarding equal moral status is compatible with a more attractive moderate stance that permits an exception in the case (...) of rape. I show that Judith Jarvis Thomson's analysis of rights can be used to modify the prolife position in this way, but that doing so involves concessions that prolife theorists are unlikely to find acceptable. Mass literacy, mass communication, and the Internet have all increased the amount of information available. But false knowledge still abounds. Taking cues from Sir Thomas Browne, the English Renaissance skeptic, this title examines a host of contemporary errors in thinking and offers a powerful explanation of why they occur.

Transparency lies at the heart of most modern slavery reporting legislation, but while publication of statements is mandatory, conformance with content guidance is voluntary, such that overall, corporate responses have been poor. Existing studies, concentrated in business to consumer rather than inter-organisational contexts, have not undertaken the fine-grained assessments of statements needed to identify which aspects of reporting performance are particularly poor and the underlying reasons that need to be addressed by policy makers. In a novel design, this study utilises (...) the ethical trade initiative assessment framework to evaluate the content of 95 UK government suppliers’ modern slavery statements. The findings suggest that in a modern slavery context, discovery challenges are more important than firms’ attitudes to disclosure. We contribute to the transparency literature through a model contrasting discovery costs and disclosure risks and by identifying the disclosure of unknowns as an additional relevant dimension of disclosure. We then discuss the model in relation to normativity theory to consider options through which the currently low legitimacy of the reporting governance regime can be enhanced and the intended norms established. In the course of his readings, Krajewski explores the complex relationship between truth-telling and lying, being and non-being, clarity and obscurity, the fixed and the unstable, the extraordinary and the commonplace. Underlying these dichotomies is an even more fundamental opposition between two approaches to language and discourse. One is the way of philosophy and linguistics, where the objective is to reduce language to its purest logical form. The other is the way of hermeneutics and rhetoric, where the aim is to (...) preserve the multifariousness of discourse as it occurs concretely in everyday life. It is not naive, in the sense that it does not argue that any diversity is helpful, but rather tries to distinguish some of the ways in which it can be helpful and, hence, some the conditions under which it can be helpful. It does this is a largely non technical language and using informal argument using argument, examples and a review of the evidence to support its conclusions. (...) According to the psychological account of personal identity, our identity is based on the continuity of psychological connections, and so we do not begin to exist until these are possible, some months after conception. This entails the psychological account faces a challenge from the non-identity problem—our intuition that someone cannot be harmed by actions that are responsible for their existence, even if these actions seem clearly to cause them harm. It is usually discussed with regard to preconception harms, but in (...) the context of the psychological account, it is also applicable to prenatal harms. Inflicting prenatal injury is widely thought to be morally impermissible, but if the injury is identity-determining on the psychological account, then no-one seems to be harmed—rather, the injury is responsible for bringing them into existence. Here, I argue that identity-determining injuries can routinely occur on the psychological account, and that this undermines the account. I assess Nicola Williams’ proposal to salvage the account based on a trans-world account of personal identity, and show that it is unsuccessful. I then show that Jeff McMahan’s embodied mind account of personal identity is also susceptible. I conclude that identity-determining prenatal injuries pose a significant challenge for the psychological account and its variants, and provide a reason for supporting alternative accounts that fix personal identity at conception. Many of our inherited civic institutions are dead or dying. We need an ambitious reform program to revive democratic life. This essay advances a four-pronged “citizenship agenda”: a campaign finance initiative granting each voter fifty “patriot dollars” to fund candidates and political parties of his or her choice; a proposal for a new national holiday, Deliberation Day, held before each national election, enabling citizens to deliberate on the merits of rival candidates; a system of federally financed electronic news-vouchers to permit (...) professional journalism to survive the destruction of its traditional business model; and a new form of citizenship inheritance, which provides $80,000 to all Americans as they start off life as adults. Working with collaborators, I have developed each of these initiatives at book length. This essay suggests how the “citizenship agenda” yields a whole that is larger than the sum of its parts. When modelling complex systems one can not include all the causal factors, but one has to settle for partial models. This is alright if the factors left out are either so constant that they can be ignored or one is able to recognise the circumstances when they will be such that the partial model applies. The transference of knowledge from the point of application to the point of learning utilises a combination of recognition and inference ­ a simple model of (...) the important features is learnt and later situations where inferences can be drawn from the model are recognised. Context is an abstraction of the collection of background features that are later recognised. Different heuristics for recognition and model formulation will be effective for different learning tasks. Each of these will lead to a different type of context. Given this, there are (at least) two ways of modelling context: one can either attempt to investigate the contexts that arise out of the heuristics that a particular agent actually applies (the `internal' approach); or (if this is feasible) one can attempt to model context using the external source of regularity that the heuristics exploit. There are also two basic methodologies for the investigation of context: a top-down (or `foundationalist') approach where one tries to lay down general, a priori principles and a bottom-up (or `scientific') approach where one can try and find what sorts of context arise by experiment and simulation. A simulation is exhibited which is designed to illustrate the practicality of the bottom-up approach in elucidating the sorts of internal context that arise in an artificial agent which is attempting to learn simple models of a complex environment. It ends with a plea for the cooperation of the AI and Machine Learning communities as both learning and inference is needed if context is to make complete sense. (shrink)

The relationship between ethics and economics in the modern age is typically viewed as external. This view is usually articulated in the notion that for economic relations to be ethical, an ethic must be imposed. Otherwise, economic relations are amoral. I try to show how the relationship is actually best explained by adopting an explanatory framework of inter-dependent arising, according to which the emergence and development of both ethical and economic relations is a matter of mutual determination. Ethical values emerge (...) in the course of developing economic relations and, in turn, direct or at least implicate economic relations. The consequences of such a view, however, are that exchange values inform moral concepts and moral concepts help frame economic ones. I offer an argument that starts with a description of an historical relationship between two disparate cultures. The interactions between these cultures were determined initially by trade and then military interests. These interests eventually underwent pressure to evolve into legal and even religiously informed arrangements that necessarily involved certain moral values. Using a presupposition analysis, I show how this evolution was no accident and did not depend on some agent imposing the moral values onto the relationship. Rather, those values arose as a matter of course. In conclusion, the paper advances the idea that, since the relationship between ethics and economics is internal, the ethics of economic relations needs to be formulated more in terms of understanding what economic relations are fundamentally designed to achieve. Mathematical models are potentially as useful for culture as for evolution, but cultural models must have different designs from genetic models. Social sciences must borrow from biology the idea of modeling, rather than the structure of models, because copying the product is fundamentally different from copying the design. Transfer of most cultural information from brains to artificial media increases the differences between cultural and biological information. (Published Online November 9 2006).

In three parts, this volume in the AP-LS series explores the phenomena of captivity and risk management, guided and informed by the theory, method, and policy of psychological jurisprudence. The authors present a controversial thesis that demonstrates how the forces of captivity and risk management are sustained by several interdependent "conditions of control." These conditions impose barriers to justice and set limits on citizenship for one and all. Situated at the nexus of political/social theory, mental health law and jurisprudential ethics, (...) the book examines and critiques constructs such as offenders and victims; self and society; therapeutic and restorative; health; harm; and community. So, too, are three "total confinement" case law data sets on which this analysis is based.
