La question de la liberté politique effective des hommes dans un monde globalisé travaille la crise de l’État-nation. Cette crise ne renvoie nullement à un déclin mais à une double contradiction, celle d’être à la fois le lieu de naissance de la liberté du citoyen et celui d’une volonté collective contrainte, pour ne pas dire contrariée dans certains cas. Il ne s’agit pas de louer ou blâmer la dynamique de la mondialisation mais d’en comprendre l’ambivalence dès lors que l’on envisage (...) l’alliance de la puissance et de la volonté comme facteur d’une liberté nationale plus effective au plan interne et dans l’ordre international. À la fois irréductible et dépassable, l’État-nation comme réalité critique surgit dans l’entre-deux-guerres dans les débats qui animent tous les milieux intellectuels, notamment catholiques comme en témoignent les positions clivées entre Joseph Delos et Gaston Fessard. Ce premier moment fonde les interrogations qui travaillent notre réflexion présente balancée entre la volonté de replacer les nations démocratiques au cœur de la marche globalisée du monde et la nécessité d’intégrations stratégiques régionales. We propose and test a model of loyalty in games. Players can mutually maintain loyalty by working towards a common goal that is pareto-superior to any Nash equilibrium without it. Loyalty imposes a psychological cost on defecting in an ongoing cooperation, which is thus sustained. We distinguish loyalty from reciprocity and explain how it complements guilt aversion with two dynamic games from a field experiment conducted in a Pakistani factory. Historical work on the emergence of sheaf theory has mainly concentrated on the topological origins of sheaf cohomology in the period from 1945 to 1950 and on subsequent developments. However, a shift of emphasis both in time-scale and disciplinary context can help gain new insight into the emergence of the sheaf concept. This paper concentrates on Henri Cartan’s work in the theory of analytic functions of several complex variables and the strikingly different roles it played at two stages of the (...) emergence of sheaf theory: the definition of a new structure and formulation of a new research programme in 1940–1944; the unexpected integration into sheaf cohomology in 1951–1952. In order to bring this two-stage structural transition into perspective, we will concentrate more specifically on a family of problems, the so-called Cousin problems, from Poincaré (1883) to Cartan. This medium-term narrative provides insight into two more general issues in the history of contemporary mathematics. First, we will focus on the use of problems in theory-making. Second, the history of the design of structures in geometrically flavoured contexts—such as for the sheaf and fibre-bundle structures—which will help provide a more comprehensive view of the structuralist moment, a moment whose algebraic component has so far been the main focus for historical work. If so, how are they being redefined? Gadamer's philosophical hermeneutics rests largely on the concept of the classical. According to Gadamer, the classical stands for the continuity and the truth claim of the tradition, as transmitted by the written word. The normative character of the classical is directed against the neutrality and relativism of historicism: understanding does not occur primarily through distancing or methodological reconstruction but through belongingness to, and participation in, the past. The article shows how, given the central importance of dialogue and otherness in Gadamer's (...) theory, the philosopher does not seem to fully do justice to the critical intention of its own dialogical and philological dimensions. On the other hand, it shows also how Gadamer's hermeneutical practice, notably in his rehabilitation of Plato, stresses the learning from otherness more explicitly than does his own theory, thus correcting, as it were, the latter. The article aims, finally, at demonstrating how, by unduly emphasizing the continuity in the encounter between past and present, Gadamer's theory undermines the importance of reconstructing the otherness and specificity of the classical text. /// A hermenêutica filosófica de Gadamer, entendida como uma defesa das humanidades, assenta essencialmente sobre o conceito de clássico. O artigo mostra ainda como, ao sublinhar de forma indevida a continuidade e, com ela, a identidade no encontro entre opassado e opresente, a teoria de Gadamer parece comprometer a importância que se deve dar ao esforço de reconstrucção da alteridade e especificidade do próprio texto clássico. Some legal theorists deny that states can conceivably act extra-legally, in the sense of acting contrary to domestic law. This position finds its most robust articulation in the writings of Hans Kelsen, and has more recently been taken up by David Dyzenhaus in the context of his work on emergencies and legality. This paper seeks to demystify their arguments and, ultimately, contend that we can intelligibly speak of the state as a legal wrongdoer or a legally unauthorized actor.

This article asks about the conditions of a sociological operationalization of the capability approach developed by Amartya Sen and Martha Nussbaum. Raising the question of freedom and social opportunities, the capability approach has so far mainly been discussed by economists and philosophers. In order to adopt this approach for a sociological and pragmatist perspective, it engages with methodological and theoretical issues. Whereas capabilities have until now mainly been studied within quantitative frameworks, the author opts for a qualitative method of inquiry (...) that draws on a pragmatist and configurational approach. Such a shift towards qualitative inquiry is a key condition for a better sociological understanding of notions like freedom and opportunities that stand at the core of the capability approach. La notion d'espace sonore est devenue de plus en plus prégnante dans le domaine musical, plus particulièrement dans la musique électroacoustique. Mais comment la définir? Cette simple interrogation, dont la réponse semble évidente soulève cependant, lorsqu'elle est approfondie, une multitude d'ambiguïtés, sources de nouvelles réflexions. Comment l'écoute appréhende-t-elle l'espace? Comment s'immerge-t- elle en lui? Qu'appréhende-t-on lorsqu'on écoute? Et finalement, qu'est-ce qu'un son? Quelles en sont les limites spatiales et temporelles? Lorsque l'écoute se confronte à l'espace sonore, où se situe la (...) frontière entre perception et imagination? Tout au long du présent ouvrage, l'auteur essaie de mettre en évidence l'empreinte effective de l'écoute dans la structuration de l'espace. Il tente de montrer, en s'appuyant sur les théories esthétiques, pourquoi l'espace n'est pas pris en compte par les pensées sur la musique avant le XXe siècle. A partir de cette observation et des dernières recherches phénoménologiques de Maurice Merleau-Ponty, il met en lumière le rôle essentiel du corps de l'auditeur dans notre perception de l'espace. Ensuite, il témoigne de la façon dont les compositeurs, à partir de la seconde moitié du XXe siècle et jusqu'à aujourd'hui, n'ont cessé de développer une implication active de l'écoute, ce qui a progressivement favorisé l'émergence d'un espace musical dynamique et mouvant. Puis, au terme de sa réflexion, à l'aide des travaux sur l'énaction du neurobiologiste Francisco J. Varela, Renaud Meric s'emploie à reconstruire le lien esthétique étroit entre l'espace, l'écoute et l'imagination, lien encore peu examiné, pourtant fondamental pour comprendre notre relation complexe à la musique. Health systems that provide for universal patient access through a scheme of prepayments—whether through taxes, social insurance, or a combination of the two—need to make decisions on the scope of coverage that they secure. Such decisions are inherently controversial, implying, as they do, that some patients will receive less than comprehensive health care, or less than complete protection from the financial consequences of ill-heath, even when there is a clinically effective therapy to which they might have access.Controversial decisions of this (...) sort call for a public justification for covering or not covering a given treatment. L’originalité de la métaphysique de Ruyer tient à ceci que le problème de l’incarnation de la conscience, décrite par la phénoménologie comme condition de possibilité de la perception, est résolu par le biais d’une identification de la conscience et du corps. Cette identification repose sur la découverte du concept fondamental de « surface absolue » ou « domaine de survol » : présence à soi sans distance d’une réalité étendue. Ce mode d’être convient également à la vie et à la (...) conscience vécue et il fonde par conséquent leur unité originaire. La conscience sensible, ou secondaire, doit alors être décrite comme l’autosurvol des aires cérébrales. Cependant, cette identification de la vie et de la conscience a pour contrepartie la perte de la dimension intentionnelle de la conscience et, par conséquent, l’impossibilité de rendre compte de la perception. La philosophie de Ruyer pose donc le problème suivant : cette conséquence est-elle nécessaire ou bien peut-on envisager au contraire une philosophie de la vie qui ne compromette pas mais fonde la conscience intentionnelle ?— The originality of Ruyer’s metaphysics is due to the fact that the problem of the incarnation of consciousness, described by phenomenology as a condition of possibility of perception, is solved by means of an identification between consciousness and body. This identification rests on the discovery of the basic concept of « absolute surface » or « flying-over domain » : self-presence without distance of a spatial reality. This mode of being is appropriate both to life and lived consciousness and, accordingly, grounds their originary unity. Then, sensible, or secondary consciousness is to be described as self flying-over of the cerebral areas. However, this identification between life and consciousness has as counterpart the lost of the intentional feature of consciousness and, consequently, the impossibility to account for perception. Thus, Ruyer’s philosophy poses the following problem : is that conclusion necessary or is it possible, on the contrary, to plan a philosophy of life that does not compromise but grounds intentional consciousness ? What are emergencies and why do they matter? In this chapter (in its penultimate version), I seek to outline the morally significant features of the concept of emergency, and demonstrate how these features generate corresponding first- and second-order challenges and responsibilities for those in a position to do something about them. In section A, I contend that emergencies are situations in which there is a risk of serious harm and a need to react urgently if that harm is to be (...) averted or minimized. These conceptual features matter morally, since it is precisely to them that those who invoke emergencies to justify otherwise impermissible actions tend to appeal. The basic first-order challenge facing emergency responders is two-fold. It is, first, to identify how these features shape circumstances of action in ways that affect (or do not affect) which reasons for action and which corresponding courses of conduct are justifiably available to them. In situations when emergency responders are compelled to make authoritative determinations due to significant contestability and indeterminacies in the contours or materialization of the said features, their challenge is then also to make these determinations legitimately. In section B, I argue that second-order challenges having to do with the foreseeability of emergencies, the value(s) of exposure to them, and their preventability further compound the predicament of emergency responders. I conclude, in section C, by saying a few words about one last morally salient feature shared by many, though not all, emergencies considered in the chapter — namely, their public dimension. To say health is 'special' is to say that it has a moral significance that differentiates it from other goods (cars, say or radios) and, as a matter of justice, warrants distributing it separately. In this essay, I critique a new justification for the specialness thesis about healthcare (STHC) recently put forth by Engster. I argue that, regrettably, Engster's justification of STHC ultimately fails and fails on much the same grounds as have previous justifications of STHC. However, I also argue (...) that Engster's argument still adds something valuable to the debate around STHC insofar as it reminds us that the moral significance of healthcare may be wider than simply its effect on the incidence of disability and disease: one further reason we may think healthcare is morally significant is because it concerns the treatment and care of those who are already unwell. Spash, a British radical ecological economist well-known in his field who currently holds a professorship at the Vienna University of Economics and Business. We start with an examination of the principles of his “social ecological economics.” We then critically evaluate his attack on economic growth and his perspective on the standard economic models of climate change. Lastly, we explore his approach to science as a theoretical pursuit and his policy recommendations. In French, the verb "to live" designates both being alive and the experience of something. This ambiguity has a philosophical meaning. The task of a phenomenology of life is to describe an originary sense of living from which the very distinction between life in the intransitive sense and life in the transitive, or intentional, sense proceeds. Hans Jonas is one of those rare authors who has tried to give an account of the specificity of life instead of reducing life to (...) categories that are foreign to it. However, the concept of metabolism, by which Jonas characterizes vital activity, attests to a presupposition as to life: life is conceived as self-preservation, that is, as negation of death, in such a way that life is, in the end, not thought on the basis of itself. The aim of this article is to show that life as such must be understood as movement in a radicalized sense, in which the living being is no more the subject than the product. All living beings are in effect characterized by a movement, which nothing can cause to cease, a movement that largely exceeds what is required by the satisfaction of needs and that, because of this, bears witness to an essential incompleteness. This incompleteness reveals that life is originarily bound to a world. Because the world to which the living being relates is essentially non-totalizable and unpresentable, living movement can not essentially complete itself. Thus, in the final analysis, life must be defined as desire, and in virtue of this view, life does not tend toward self-preservation, as we have almost always thought, but toward the manifestation of the world. Background: The phenomenon of forceful physical restraint in pediatric care is an ethical issue because it confronts professionals with the dilemma of using force for the child’s best interest. This is a paradox. The perspective of healthcare professional working in pediatric wards needs further in-depth investigations. Purpose: To explore the perspectives and behaviors of healthcare professionals toward forceful physical restraint in pediatric care. Methods: This qualitative ethnographic study used focus groups with purposeful sampling. Thirty volunteer healthcare professionals (nurses, hospital aids, (...) physiotherapists, and health educators) were recruited in five pediatric facilities in four hospitals around Paris, France, from March to June 2013. The data were processed using NVIVO software (QSR International Ltd. 1999–2013). The data analysis followed a qualitative methodological process. Ethical Considerations: The research was conducted in compliance with the Declaration of Helsinki. Written informed consent was collected systematically from participants. Findings: This study provides elements to help understand why restraint remains common despite its contradiction with the duty to protect the child and the child’s rights. All participants considered the use of forceful physical restraint to be a frequent difficulty in pediatrics. Greater interest in the child’s health was systematically used to justify the use of force, with little consideration for contradictory or ethical aspects. Raising the issue of forceful restraint always triggered discomfort, unease and an outpour of emotions among healthcare professionals. The findings have highlighted a form of hierarchy of duties that give priority to the execution of the technical procedure and legitimize the use of restraint. Professionals seemed to temporarily suspend their ability to empathize in order to apply restraint to carry out a technical procedure. This observation has allowed us to suggest the concept of “transient empathic blindness.” Conclusion: Using physical restraint during pediatric care was considered a common problem by participants. This practice must be questioned, and professionals must have access to training to find alternatives to strong restraint. Conceptualizing this phenomenon with the concept of “transient empathic blindness” could help professionals understand what happens in their minds when using forceful restraint. (shrink)

For all their various disagreements, one point upon which rights theorists often agree is that it is simply part of the nature of rights that they tend to override, outweigh or exclude competing considerations in moral reasoning, that they have ‘peremptory force’, making ‘powerful demands’ that can only be overridden in ‘exceptional circumstances’, Philosophical Foundations of Human Rights, Oxford University Press, Oxford, 2016, p. 240). In this article I challenge this thought. My aim here is not to prove that the (...) traditional view of rights’ stringency is necessarily false, nor even that we have no good reason to believe it is true. Rather, my aim is only to show that we have good reason to think that the foundation of the traditional position is less stable than we might have otherwise supposed and that an alternative conception of rights—one which takes the stringency of any given right as particular to the kind of right it is—is both viable and attractive. In short, to begin to move us towards a more ‘particularist’ conception of rights’ standing in moral reasoning and judgement. (shrink)

L'échec des printemps arabes et l'instauration d'un nouveau Califat de la terreur en Syrie et en Irak nous contraignent à repenser la place du religieux dans le monde contemporain. Rivés sur les questions sécuritaires, nous manquons encore néanmoins d'outils philosophiques pour comprendre la montée d'un nouveau totalitarisme millénariste et apocalyptique. Le présent ouvrage s'appuie sur les travaux d'Eric Voegelin (1901-1985), un philosophe américain d'origine allemande encore trop peu connu en France et dont toute l'oeuvre vise à mettre en lumière les (...) racines religieuses des totalitarismes qui ont ensanglanté le 20e siècle. Voegelin et l'Orient propose une relecture iconoclaste de ses écrits, souvent à rebours de la réception néoconservatrice dont ils ont fait l'objet outre-Atlantique. Renaud Fabbri nous fournit ainsi des clefs pour mieux comprendre les origines idéologiques de l'islamisme radical mais aussi du nationalisme hindou. Il montre aussi qu'une redécouverte des grandes traditions de la philosophie mystique peut nous aider à conjurer le spectre des "religions politiques" qui menacent aujourd'hui aussi bien les non-croyants que les croyants de toutes les confessions. This paper investigates how and when pairs of terms such as “local–global” and “im Kleinen–im Grossen” began to be used by mathematicians as explicit reflexive categories. A first phase of automatic search led to the delineation of the relevant corpus, and to the identification of the period from 1898 to 1918 as that of emergence. The emergence appears to have been, from the very start, both transdisciplinary (function theory, calculus of variations, differential geometry) and international, although the AMS-Göttingen connection played (...) a specific part. First used as an expository and didactic tool (e.g. by Osgood), it soon played a crucial part in the creation of new mathematical concepts (e.g. in Hahn’s work), in the shaping of research agendas (e.g. Blaschke’s global differential geometry), and in Weyl’s axiomatic foundation of the manifold concept. We finally turn to France, where in the 1910s, in the wake of Poincaré’s work, Hadamard began to promote a research agenda in terms of “passage du local au general.”. (shrink)

Knowledge of what it’s like to have perceptual experiences, e.g. of what it’s like to see red or taste Turkish coffee, is phenomenal knowledge; and it is knowledge the substantial or significant nature of which is widely assumed to pose a challenge for physicalism. Call this the New Challenge to physicalism. The goal of this paper is to take a closer look at the New Challenge. I show, first, that it is surprisingly difficult to spell out clearly and neutrally what (...) the New Challenge is in fact urging the physicalist to explain. What initially look like plausible or promising ways of making sense of it turn out to be either question begging or insufficient to generate a challenge to physicalism at all. I go on to suggest that what the New Challenge may be asking the physicalist to explain may be the fact that we come to token certain higher-order judgments about the significance of phenomenal knowledge. I end with a discussion of the implications of this interpretation of the New Challenge—which turns out to be as much a challenge for the anti-physicalist as it is for the physicalist. (shrink)

Developing Global Health Programming: A Guidebook for Medical and Professional Schools , edited by Jessica Evert, Paul Drain, and Thomas Hall, is reviewed. In spite of some editorial shortcomings, the book is a terrific aggregation of resources and reflections on the state of global health education that leaves readers with a multitude of useful and diverse tools, as well as directions about where to find additional ones.
