The distinction between clinical practice and surgical research may seem trivial, but this distinction can become a complex issue when innovative surgeries are substituted for standard care without patient knowledge. Neither the novelty nor the risk of a new surgical procedure adequately defines surgical research. Some institutions tacitly allow the use of new surgical procedures in series of patients without informing individuals that they are participating in a scientific study, as long as no written protocol or hypothesis exists. Institutions can (...) justify this practice by viewing human research in narrow terms as an activity outlined in a formal protocol. Application of limited definitions, however, erodes patients' rights and risks losing public confidence in how biomedical research is conducted. I propose an operational definition of human research also be recognised. Enforcing more rigid and less ambiguous guidelines of human research may curtail enrolment into some studies, but it will also protect patients from being used as subjects without their knowledge. This paper presents a clinically orientated illustration of the doctrine of double effect. The case of an elderly gentleman with advanced cancer is discussed, with particular emphasis on two dilemmas encountered during the terminal phase of his illness. The author describes how the doctrine of double effect was applied to help the team make some complex management decisions.

Background: In the USA, the Food and Drug Administration waiver of informed consent permits certain emergency research only if community consultation occurs. However, uncertainty exists regarding how to define the community or their representatives.Objective: To collect data on the actual preferences and values of a group—those at risk for stroke—most directly affected by the waiver of informed consent for emergency research.Design: Face to face focused interviews were conducted with 12 patients who were hospitalised with a stroke diagnosis in the previous (...) year. The interviews were audiotaped and a transcript based method was used for their analysis.Results: All 12 participants felt “that it was important that new treatments for stroke be developed”, but they were initially confused about the distinction between “research for stroke” and “emergency research for stroke”. However, after explanation, most expressed willingness to participate in the latter. In the absence of a surrogate to give informed consent in a stroke emergency situation, the majority said they would want the physician to “go ahead and enrol them in the trial”.Conclusions: This study is the first to identify the values and concerns of individuals most directly affected by stroke emergency research. Further interviews and focus groups are needed to develop and test a validated questionnaire on the preferences and values surrounding emergency research for stroke. (shrink)

The theories of most writers on Ethics, with whose works I am acquainted, appear to be based upon the assumption of the unique character of goodness or The Good. By the word unique these writers mean, I think, among other things that goodness cannot be analysed into or described in terms of anything other than itself, that it can be and is desired for its own sake and not for the sake of some other thing which is not goodness, and (...) that the apprehension of or desire for goodness is a distinct and specific character of our mental states. By asserting, however, that the state of mind constituted by the apprehension of goodness, or that the state of emotion aroused by the desire for goodness, is distinguished by a specific and unique property, they do not, I think, necessarily mean that this property is the same as the specific property of goodness itself. Most writers on Ethics have also believed that man is free to desire goodness, and to act in accordance with his desire, that is to say, they have held in some form or other the doctrine of free-will. ABSTRACT This paper focuses on the issue of aborting abnormal fetuses from the standpoint of the prerogatives and obligations of parents. First, two intuitively‐based models of parenthood are developed. In the Trustee Model, parental authority is grounded in the obligation of parents to promote the interests of children, while the Artisan Model locates parental authority in the intrinsic value of parenthood as a mode of parental self‐expression. Reasons are given for believing that neither of these models, taken individually, contains a (...) complete or adequate picture of parenthood and that both have counterintuitive implications. Under the assumption that there is little hope of developing a master model for parenthood to supplant the two inadequate models, five principles are developed for determining how the two models should be applied in making moral decisions. These principles are then applied to five categories of abnormal fetuses. The conclusion is that abortions are justified in the first three categories (involving severe abnormalities), but not in the fifth category (involving only slight deformities). The fourth category requires parental discretion. Finally, a check on these conclusions is provided by comparing them with a parental action that would generally be considered impermissible, namely the decision of a Jehovah's Witness not to permit a blood transfusion for his or her child in a life‐threatening situation.
