This paper discusses an algorithmic tool introduced in the Basque Country (Spain) to assess the risk of intimate partner violence. The algorithm was introduced to address the lack of human experts by automatically calculating the level of violence based on psychometric features such as controlling or violent behaviour. Given that critical literature on risk assessment tools for domestic violence mainly focuses on English-speaking countries, this paper offers an algorithmic accountability analysis in a non-English speaking region. It investigates the algorithmic risks, (...) harms, and limitations associated with the Basque tool. We propose a transdisciplinary approach from a critical statistical and legal perspective. This approach unveils issues and limitations that could lead to unexpected consequences for individuals suffering from partner violence. Moreover, our analysis suggests that the algorithmic tool has a high error rate on severe cases, i.e., cases where the aggressor could murder his partner—5 out of 10 high-risk cases are misclassified as low risk—and that there is a lack of appropriate legal guidelines for judges, the end users of this tool. The paper concludes that this risk assessment tool needs to be urgently evaluated by independent and transdisciplinary experts to better mitigate algorithmic harms in the context of intimate partner violence. Violence risk assessment is an internationally recognised methodology, aimed to manage different forms of violence. Most risk assessment tools, as is the case of the reviewed one, are designed to protect victims in the context of pressure, little time, or little information. This paper presents a reply to Valdivia et al. (AI & Society, July 2024) criticism of the algorithm for intimate partner violence risk assessment—EPV—used in the Basque Country. They concluded that more than 50% of high-risk victims are in (...) danger, using results from a pilot version of the instrument, not the reviewed one published in 2010, nor the system in use since May 2013. In addition, qualitative information from a single professional generates global criticisms of the tool. Neither the current cut-off points nor the real weighting of the items nor the real risk management procedure are considered, and the personal opinion of a judge is assumed to be better than the use of tools when the accumulated research shows the opposite. When EPV risk assessment reports are used in courts, they may only temporarily affect some perpetrator rights, imposing restraining orders or, in the worst case, pretrial prison waiting for sentence. However, risk management can save the life of the victim. Cautions and suggestions related to the judicial context, such as improving risk reports or training judicial professionals, are shared. However, Valdivia et al.’s paper leads to misconceptions that extend to different sectors when echoing the wrong conclusions of their paper. (shrink)

This article shows how feminism welcomed and was influenced by the pragmatism of John Dewey. While in real terms his impact on European feminism has been minimal, this was not the case in contemporary America. In this article we study both how Dewey’s ideas were received amongst American feminists, as well as certain aspects of his thinking that could be enormously useful in present-day debates between critical and postmodern feminists. We compare the Deweyan and feminist arguments against the traditional dualisms (...) that acted as philosophical support for social inequality, paying particular attention to mind–body dualism, and the consequent undervaluation of physical and emotional wellbeing. We also show that John Dewey’s proposals were, in fact, more radical than those of the feminists of the day. Indeed, democracy has to be understood as a way of life that affects every dimension of experience, and is crucial to the personal and social growth that enables the unjust social inequalities between men and women to be overcome. De este modo se va configurando una organización que se gobierna con escaso control sobre el que la dirige, mientras que se acentúa el control para quienes trabajan en ella y hacen posible su supervivencia. Todo ello no (...) se ha visto acompañado por la consecución de una mayor relevancia de la institución en el sistema científico-técnico español. Al reconocer la importancia de los recursos humanos en la investigación, se pone de manifiesto la responsabilidad del propio personal del CSIC en la aceptación (y consolidación) de esta situación. Everyday Aesthetics, radicalizing Dewey’s notion of the continuity between art and experience, aims to find aesthetic qualities in ordinary experience. The problem is that it reduces the aesthetic significance that Dewey attributed to artistic production. Analyzing Dewey’s work and its interpreters, I will demonstrate that the continuity of ordinary experience and art is what lends art its vital and distinctive character. El psicólogo del deporte cuenta con una relativa larga historia en el fútbol español. Los objetivos del presente trabajo son realizar una aproximación a un mapa laboral de la actual presencia del psicólogo en los clubes de primera división y las funciones o acciones que realiza. Para ello, se ha realizado una búsqueda de información a través de medios de comunicación, páginas web y psicólogos/as del ámbito, así como una revisión de 68 trabajos sobre la temática. Los resultados indican que (...) el psicólogo está presente en el 80% de las categorías inferiores y en un 25% de los primeros equipos de los clubes de primera división de España. Las principales funciones y acciones que realizan son la organización de escuela de padres y mediación deportiva, formación, asesoramiento e intervención con el cuerpo técnico, asesoramiento e intervención con la directiva, intervención y entrenamiento psicológico con jugadores y el equipo, entrenamiento integrado, educación, formación y entrenamiento en valores con jugadores, intervención psicológica durante la concentración y competición, desarrollo de proyecto y seguimiento académico, realización de evaluación y redacción de informes psicológicos, selección de jugadores, intervención psicológica con los servicios médicos y lesiones deportivas, retiro del jugador, estudios, formación y entrenamiento psicológico con árbitros, observación y registro de sesiones de entrenamiento y competición y divulgación e investigación en Psicología del Deporte y rol profesional del psicólogo del deporte. Se concluye que el rol del psicólogo está consolidado en el fútbol base y avanza lentamente en el fútbol profesional, en el que se requiere una labor multifunciones que aborde a la amplia población deportiva y cubra sus requerimientos desde una perspectiva científica-profesional. This article aims to contribute to the recognition of Jane Addams' aesthetic reflections. Her reflections extended pragmatism by anticipating some themes of Dewey’s aesthetics and some of its current aesthetic derivations. Addams broke down the barriers that separated art and life with the practices at Hull House in which immigrants of different ethnicities and women had an active and leading part. She thus expanded the social meaning of some of the avant-garde art movements that influenced her, such as the Art (...) and Crafts Movement, by trying to make aesthetic sensibility a part of the everyday life of Hull House’s neighbors. In this way, she anticipated current everyday aesthetics, but without diluting the artistic specificity. Art transfigures events through poetics, allowing us to transform our lives through the values that are the common heritage of humanity. In Addams, we find a social aesthetic that sheds light on some of the problems of contemporary theories, expands the considerations of the artistic movements of her time, and contributes to reflections on the vital importance of aesthetics. Este artículo recoge la propuesta de Nancy Fraser de paridad en la participación como criterio que integra las reivindicaciones más valiosas de otras corrientes feministas con el objetivo de ampliar la justicia social en nuestras sociedades neoliberales. Asimismo, muestra los límites de su formulación: Fraser considera los condicionantes sociales que permitirían la realización de la paridad en la participación, pero no analiza en profundidad los condicionantes subjetivos de los que también depende. Por último, se sugiere superar esos límites ampliando el (...) ideal normativo de Fraser con el pragmatismo de Dewey. El objetivo es visualizar aspectos de la justicia ocultos en la propuesta de Fraser en pro de una radicalización democrática.This article describes Nancy Fraser’s proposal of participatory parity as a criterion for the integration of the most valuable claims of other feminist schools with the goal of increasing social and gender justice within our neoliberal societies. At the same time, it shows its limits: Fraser examines the social constraints that would allow for the implementation of participatory parity, however it lacks a thorough analysis of the subjective constraints on which it also depends. Lastly, it aims to overcome those limits extending Fraser’s normative ideal with Dewey’s pragmatism. The main goal is to highlight aspects of justice hidden in Fraser’s proposal towards a democratic radicalization. (shrink)

One of the few points of agreement to be found in mainstream responses to the logical and semantic problems generated by vagueness is the view that if any modification of classical logic and semantics is required at all then it will only be such as to admit underdetermined reference and truth-value gaps. Logics of vagueness including many valued logics, fuzzy logics, and supervaluation logics all provide responses in accord with this view. The thought that an adequate response might require the (...) recognition of cases of overdetermination and truth value gluts has few supporters. This imbalance lacks justification. As it happens, Jaskowski's paraconsistent discussive logic-a logic which admits truth value gluts-can be defended by reflecting on similarities between it and the popular supervaluationist analysis of vagueness already in the philosophical literature. A simple dualisation of supervaluation semantics results in a paraconsistent logic of vagueness based on what has been termed subvaluational semantics. (shrink)

Paraconsistent responses to vagueness are often thought to represent a revision of logical theory that is too radical to be defensible. The paracomplete logic of supervaluationism, SpV, is not only taken to be more conservative but is also commonly said to 'preserve classical logic'. This chapter argues that this is wrong on both counts. The paraconsistent logic SbV, or subvaluationism, is no less conservative than SpV nor more so. In the end both logics offer equally compelling theoretical approaches to vagueness. (...) Each approach is also equally objectionable, with neither providing an adequate account of vagueness, but this criticism arises from a feature shared by each approach that is independent of their paracompleteness or paraconsistency per se. For all that has been said, a paraconsistent approach, and the associated recourse to truth-value gluts, remains a contender in accounting for vagueness. (shrink)

The sorites paradox is the name given to a class of paradoxical arguments, also known as little by little arguments, which arise as a result of the indeterminacy surrounding limits of application of the predicates involved. For example, the concept of a heap appears to lack sharp boundaries and, as a consequence of the subsequent indeterminacy surrounding the extension of the predicate ‘is a heap’, no one grain of wheat can be identified as making the difference between being a heap (...) and not being a heap. Given then that one grain of wheat does not make a heap, it would seem to follow that two do not, thus three do not, and so on. In the end it would appear that no amount of wheat can make a heap. We are faced with paradox since from apparently true premises by seemingly uncontroversial reasoning we arrive at an apparently false conclusion. (shrink)

Phillip Cary argues that Augustine invented or created the concept of self as an inner space--as space into which one can enter and in which one can find God. This concept of inwardness, says Cary, has worked its way deeply into the intellectual heritage of the West and many Western individuals have experienced themselves as inner selves. After surveying the idea of inwardness in Augustine's predecessors, Cary offers a re-examination of Augustine's own writings, making the controversial point that in his (...) early writings Augustine appears to hold that the human soul is quite literally divine. Cary goes on to contend that the crucial Book 7 of the Confessions is not a historical report of Augustine's "conversion" experience, but rather an explanation of his intellectual development over time. Difficulties in arriving at an adequate conception of vagueness have led many writers to describe a phenomenon that has come to be known as "higher-order vagueness". Almost as many have found it to be a problem that needs to be addressed. In what follows I shall argue that, whilst we must acknowledge its presence, it is a pseudo-problem. The crucial point is the vagueness of "vague", which shows the phenomenon to be unproblematic though real enough.

Bringing these two emergent areas of thought into direct conversation in Before the Law, Cary Wolfe fosters a new discussion about the status of nonhuman animals and the shared plight of humans and animals under biopolitics.

The idea that the phenomenon of vagueness might be modelled by a paraconsistent logic has been little discussed in contemporary work on vagueness, just as the idea that paraconsistent logics might be fruitfully applied to the phenomenon of vagueness has been little discussed in contemporary work on paraconsistency. This is prima facie surprising given that the earliest formalisations of paraconsistent logics presented in Jaśkowski(1948) and Halldén(1949) were presented as logics of vagueness. One possible explanation for this is that, despite initial (...) advocacy by pioneers of paraconsistency, the prospects for a paraconsistent account of vagueness are so poor as to warrant little further consideration. In this paper we look at the reasons that might be offered in defence of this negative claim. As we shall show, they are far from compelling. It is commonly suggested that vagueness is a purely semantic phenomenon having no metaphysical or ontological implications, requiring no new ontological category for its explanation. It does not entail any revision of the metaphysical view that the world is precise or determinate contra advocates of a vague or fuzzy ontology like Bertil Rolf and Michael Tye. The suggestion is often bolstered by arguments that purport to show that the world is completely describable in a precise language. The precision of the (...) world is then taken to follow from the availability of such a complete precise description thereof. In this sense vague language might be considered superficial. (shrink)

Miranda Fricker maintains that testimonial responsibility is the proper corrective to testimonial injustice. She proposes a perceptual-like “testimonial sensibility” to explain the transmission of knowledge through testimony. This sensibility is the means by which a hearer perceives an interlocutor's credibility level. When prejudice causes a hearer to inappropriately deflate the credibility attributed to a speaker, the sensibility may have functioned unreliably. Testimonial responsibility, she claims, will make the capacity reliable by reinflating credibility levels to their proper degree. I argue that (...) testimonial sensitivity may be or involve “mindreading,” the cognitive capacity by which we predict human behavior and explain it in terms of mental states. Further, I claim that, if testimonial sensibility is or involves mindreading, and mindreading is a function of brain processes, testimonial injustice cannot be corrected by testimonial responsibility. This is because 1) it appears to rely on conscious awareness of prejudice, whereas much bias occurs implicitly, and 2) it works at the individual level, whereas testimonial injustice occurs both individually and socially. I argue that the remedy for testimonial injustice is, instead, engaging in social efforts that work below the level of consciousness. (shrink)

Richard Sylvan (né Routley) was one of Australasia's most prolific and systematic philosophers. Though known for his innovative work in logic and metaphysics, the astonishing breadth of his philosophical endeavours included almost all reaches of philosophy. Taking the view that very basic assumptions of mainstream philosophy were fundamentally mistaken, he sought radical change across a wide range of theories. However, his view of the centrality of logic and recognition of the possibilities opened up by logical innovation in the fundamental areas (...) of metaphysics resulted in his working primarily in these two, closely connected fields. Modes of rationality in nursing documentation: biology, biography, and the ‘voice of nursing’ This article is based on a discourse analysis of the complete nursing records of 45 patients, and concerns the modes of rationality that mediated text‐based accounts relating to patient care that nurses recorded. The analysis draws on the work of the critical theorist, Jürgen Habermas, who conceptualised rationality in the context of modernity according to two types: purposive rationality based on an instrumental logic, and value rationality based (...) on ethical considerations and moral reasoning. Our analysis revealed that purposive rationality dominated the content of nursing documentation, as evidenced by a particularly bio‐centric and modernist construction of the workings of the body within the texts. There was little reference in the documentation to central themes of contemporary nursing discourses, such as notions of partnership, autonomy, and self‐determination, which are associated with value rationality. Drawing on Habermas, we argue that this nursing documentation depicted the colonisation of the sociocultural lifeworld by the bio‐technocratic system. Where nurses recorded disagreements that patients had with medical regimes, the central struggle inherent in the project of modernity became transparent — the tension between the rational and instrumental control of people through scientific regulation and the autonomy of the subject. The article concludes by problematising communicative action within the context of nursing practice. (shrink)

Human service managers are called on to make a variety of difficult decisions that often involve fundamental conflicts in values. Such conflicts constitute ethical dilemmas. This qualitative exploratory study examines how human service managers (N = 40), from the United States, identify and resolve ethical dilemmas. The dilemmas identified by the managers tended to result in the restriction of missions, programs, services and practice methods. The resolution of these ethical problems often rested on following the very rules that created the (...) dilemmas. Additional strategies included consultations and reliance on abstract principles, specifically those of one's spiritual faith. Missing, however, were systematic or evidence-based procedures for resolving challenges that often threatened the very goals of the human service agencies. The need for more careful training in the area of ethical problem solving that maintains the vision of human services is presented. (shrink)

Can identity be vague? More exactly, can there be objects x and y such that it is vague whether x = y, and the vagueness is due to the objects themselves as opposed to vagueness in language used to denote the objects? The question has been extensively discussed since Evans (1978) where it was claimed that an affirmative answer was a necessary condition for the thesis that there could be vague objects. A recent, ingenious argument in Pinillos (2003) seeks to (...) establish the negative and show that it cannot be de re vague whether x = y. The argument depends crucially on count claims concerning objects whose identity conditions are de re vague, and so we must learn how to count such objects — clouds, persons and much else besides. When that has been accomplished we can see a way out of Pinillos’s argument, and claim that de re vague identity remains coherent. (shrink)

The philosophical history of metaphysics of mind can be narrowed into two problems: Mind and body causation and issues of the self or persons. Due to the rise of the scientific revolution the nature of mental states and its possessors has been reduced to brain and cognitive functioning or eliminated instead of the ontological basic substance of a soul. The other criticism of soul identity or substance dualism is the problem of mental causation. In The Blackwell Companion to Substance Dualism (...) (2018), Jaegwon Kim argues against the intelligibility of Cartesian dualism and further extends that argument to any form of substance dualism by raising the question of mental causation or the traditional mind-body problem. His main attack comes from the essence of mind and the causal closure of the physical, together these provide an argument against the non-physical view of persons. The question, “can mental events cause physical events?” Is a problem for the dualist which he calls “the pairing problem.” Since causation requires a spatiotemporal relation between two bodies, and mind and body are distinct substances or properties, there’s no cause-and-effect pairing relation between minds and physical objects or bodies. Thus, according to Kim, the essence of an immaterial thinking substance, such as a soul, is unintelligible and should be rejected since it fails to answer the pairing problem. However, Kim has a misunderstanding of substance dualist views of the independent ontological status of a substantial self or soul. Further, Kim’s challenge does not take into account a causal powers ontology in which primitive is the free agentive causal subject. I’ll argue that a soul, though embodied, is a non-material primitive substance that has basic faculties to exemplify mental properties. One of the faculties of the soul is the instantiation of active agency. Further, the postulation of Gods existence, having a metaphysical internal structure and powers, is grounds for the existence of a soul with its own metaphysical, unified structure in which the dispositional properties of consciousness are located and exemplified. I conclude that mental causation is a coherent notion especially in light of the active powers of agent causation. Thus, Kim’s problem of mental causation becomes no problem at all. (shrink)
