Since the late 2000s trans pregnancy has received increasing public and academic attention, and stories of the ‘pregnant man’ have become a media staple. Existing research has critiqued such spectacularization and the supposed tension between maleness, masculinity, and pregnancy that underpins it. Extending that work, this article draws on interview data from an international study of trans reproductive practices and analyzes participants' experiences of being, and expecting themselves to be, perceived in public space not as spectacularly ‘pregnant men’, but as (...) fat men. As a starting point we take the experience of one participant whose heavily pregnant participation in a five-kilometer race prompted the question: ‘Why is the chubby guy running?’ Using Judith Butler's concept of the cultural intelligibility of gender, we ask why the question asked was not: ‘Why is the pregnant guy running?’ We further consider the degree to which pregnant trans people manage their unintelligibility within the matrix of pregnancy, fatness, and trans/gender and how this reveals the limits of gender intelligibility itself. In diesem Fazit & Ausblick werden nun die in der Einleitung formulierten Themenfelder, in denen wir auch die Anschlüsse an Arbeiten und Forschungsgebiete der Historischen Anthropologie gegeben sahen, wieder aufgegriffen. Dies geschieht entlang von Aspekten, die durch die responses aufgeworfen wurden, und die wir hinsichtlich unserer Forschung zu Arenen transkultureller Bildung weiterdenken. Ein wichtiger Schwerpunkt liegt dabei auf den Transmissionseffekten, die sich im Forschungsprozess, auch unter Einbezug der responses, zwischen den Forschungsfeldern – den Arenen Theater und Schule – ergeben haben. Daran anschließend formulieren wir die Implikationen, die sich daraus für die Weiterentwicklung unserer Methoden ergeben haben, sowie einen Ausblick, der sich den Möglichkeiten der Erweiterung der Forschung zu kultureller Bildung unter Einbezug postkolonialer und transkultueller Analyseperspektiven widmet. Objective: To analyze the empathic profile and the empathy scores of freshmen of the nursing course. Design and participants: Descriptive study involving 399 freshmen students of two modalities of nursing courses: Bachelor and Bachelor and Teaching Diploma, in the period from 2012 to 2015. A sociodemographic questionnaire and the Empathy Inventory were applied. Ethical considerations: The research received approval from the Research Ethics Committee of the University of São Paulo at Ribeirão Preto College of Nursing. The students registered their acceptance (...) to participate in the research by signing the Free and Informed Consent Form and anonymity was guaranteed. Findings: The mean age of the participants was 19 years, being 85.5% female. The students were grouped by course modality and all groups presented high empathy scores. A significant difference (p < 0.001) was found, which indicates that students of the Bachelor and Teaching Diploma program presented a higher degree of empathy for the General Score, Domain 2 (Interpersonal Flexibility), and Domain 3 (Altruism) in relation to students in the Bachelor program. Conclusion: Results show that nursing undergraduate freshmen are emphatic, with minimum differences between the two courses. This profile is relevant for the development of future professionals capable to demonstrate a balance between instrumental and expressive competences. (shrink)

The burdens of mental illnesses and substance use disorders do not lie merely with the individuals who suffer from these conditions but affect, and are affected by, their families, communities, cities and countries. The ethical and political challenges that arise in the treatment of mental illnesses and substance abuse disorders are, therefore, challenges that affect both individuals and communities.

Purpose:Human navigation skills are essential for everyday life and rely on several cognitive abilities, among which visual-spatial competences that are impaired in subjects with cerebral palsy. In this work, we proposed navigation tasks in immersive virtual reality to 15 children with CP and 13 typically developing peers in order to assess the individual navigation strategies and their modifiability in a situation resembling real life.Methods:We developed and adapted to IVR an application based on a 5-way maze in a playground that was (...) to be navigated to find a reward. The learning process, navigation strategies, and adaptation to changes were compared between participants with CP and their TD peers and correlated with visual-spatial abilities and cognitive competences.Results:Most participants with CP needed more attempts than TD participants to become proficient in navigation. Furthermore, the learning phase was correlated to visual-spatial memory but not with cognitive competences. Interestingly, navigation skills were comparable between groups after stabilization. While TD participants mainly relied on allocentric strategies based on environmental cues, egocentric strategies based on body motion prevailed in participants with CP. Furthermore, participants with CP had more difficulties in modifying their navigation strategies, caused by difficulties in executive processes beyond the visual-perceptual impairment, with an inefficient shift between implicit and explicit competences.Conclusions:The navigation abilities in participants with CP seem to be different from their TD peers in terms of learning and adaptation to new conditions; this could deeply affect their everyday life and ultimately participation and inclusion. A regular assessing and focused rehabilitative plans could help to better navigate the environment and affect self-perception. (shrink)

Objective: To explore the strategies that can help individuals mourning a family member’s death from Covid-19 to cope with the loss. Method: We carried out a narrative review on the PubCovid-19 platform using the descriptors “death,” “mourning,” “Covid-19,” and “coping strategies.” Ten articles were included. Results: The strategies found are phone calls, audio recording, letters, and photos, classified as immediate and long-term. These strategies are focused on mental health, which can be adversely affected by depression and psychological disorders. Conclusions: Creating (...) counseling programs for the relatives of those who died from Covid-19 is urgent. They must offer comprehensive, humanized, and continuous mental health care. (shrink)

The extracellular‐signal regulated kinases 1/2 (ERK or ERKs) are involved in the regulation of important neuronal functions, including neuronal plasticity in normal and pathological conditions. We present findings that support the notion that the kinetics and localization of ERK are intrinsically linked, in that the duration of ERK activation dictates its subcellular compartmentalization and/or trafficking. The latter, in turn, dictates whether ERK‐expressing cells would enter a program of cell death, survival or differentiation. We summarize experimental data showing that chronic activation (...) of ERK plays a role in the mechanisms that trigger neurodegeneration. We also discuss how MKPs, members of the subclass of dual specificity phosphatases, might be the link between ERK kinetics and its subcellular localization. The intensification of farm animal welfare debate has led to an increasing number of certification schemes covering this issue; however, there are concerns about the contribution of these schemes in improving welfare. The aims of this study were to identify certification schemes for broiler chicken welfare at farm level in Brazil, to investigate the extent of nutritional, environmental, health and behavioral indicators within the schemes and to analyze the content of scheme and the capacity to promote continuous improvement on certified (...) farms. GLOBALG.A.P.® and Certified Humane® were the only schemes observed, corresponding to 2.1 % of broiler chicken farms in Brazil. Environmental and health indicators were in greater number, and the requirements classified as behavioral indicator were commonly related to the resolution of low levels of animal welfare. Both schemes were in accordance with the European Food Safety Authority recommendations for farmer training, birds and buildings inspection, temperature control, air and litter quality, stocking density and lighting. The selection of breeds and the use of animal-based indicators needs to be improved, as well the inclusion animal welfare objectives and management review as part of continuous improvement. Welfare certification is a potential market to be developed in Brazil. Overall, assessed schemes may potentially enhance animal welfare at farm level by including new concepts and practices. It is desirable to increase the number of certified farms in Brazil and that certification schemes be critically analyzed on a regular basis regarding their content to meet new demands and to include updates from scientific research. Individuals with Parkinson’s disease and temporal lobe epilepsy have hallucinations and mild cognitive dysfunction. The objective of this work was to study dreams in PD and TLE patients using a common functional model of dream production involving the limbic and paralimbic structures.Dreams were characterised in early-stage PD and TLE patients with dream diaries classified by the Hall van de Castle system and were compared with matched controls.In PD, there were significant differences between patients’ dreams and those of controls: animals, physical (...) aggression, and a befriender were more common in patients, and aggressor and bodily misfortunes were less common. The dreams of patients with frontal dysfunction showed more aggressive features.TLE patients had lower recall than PD patients and a higher proportion of dreams involving family and familiar settings, lower proportions involving success, and a higher incidence of frontal dysfunction.The dreams of PD and TLE patients share important features. In this book Frederic Schick develops his challenge to standard decision theory. He argues that talk of the beliefs and desires of an agent is not sufficient to explain choices. To account for a given choice we need to take into consideration how the agent understands the problem, how he sees in a selective way the options open to him. The author applies his new logic to a host of common human predicaments. Why do people in choice experiments act (...) so often against expectations? Why do people cooperate in situations where textbook logic predicts that they won't? What exactly is weakness of will? What are people reporting when they say their lives have no meaning for them? continent. 1.2 (2011): 141-144. This January, while preparing a new course, Robert Seydel was struck and killed by an unexpected heart attack. He was a critically under-appreciated artist and one of the most beloved and admired professors at Hampshire College. At the time of his passing, Seydel was on the brink of a major artistic and career milestone. His Book of Ruth was being prepared for publication by Siglio Press. His publisher describes the book as: “an alchemical assemblage that composes (...) the life of his alter ego, Ruth Greisman— spinster, Sunday painter, and friend to Joseph Cornell and Marcel Duchamp. Through collages, drawings, and journal entries from Ruth’s imagined life, Seydel invokes her interior world in novelistic rhythms.” This convergence of his professional triumph with the tragedy of his death makes now a particularly appropriate time to think about Robert Seydel and his work. This feature contains a selection of excerpts from Book of Ruth (courtesy of Siglio Press) alongside a pair of texts remembering him and giving critical and biographical insights into his art and his person. His office was a compendium of the ancient, mythic, potential and unworldy, where seemingly unrelated references were endlessly pulled, piled and fused in an ecstatic dance of hyper-annotation. The small room and all its contents overflowed with notes tucked in every margin and corner. Books coated the walls like a switchboard, anxious and humming, waiting for infinite links to be activated. William Blake's books of Job and Urizen summoned Greek mythology and the animal as metaphor, leading to 19th century cryptozoology and the cave paintings at Lascaux, Gaston Bachelard's description of the bird in his garden and Robert Rauschenberg's Canyon . Tracking archetypes and following tangential threads, new revelations and ancient narratives were compiled and ordered to form a new text, a bibliography as assemblage, portrait and poem. Robert's library—one of his many collections—is a portrait, an “artifact, collage of time, a token and remnant” (Seydel, 2007) He is humming with it still. The imagination of this room—of Robert—breathes through the pages of Book of Ruth, as every decision and detail unfolds to a cosmos. Allegory, invention, personal and art histories are entangled and leveled, rendering lived, perceived and absorbed experiences indistinguishable. Anonymous scraps discovered on the street or studio floor, careful clippings and drawn figures are chosen and animated through serendipitous destruction and whimsical, delicate positioning. A precise vocabulary of characters and terms erupts and collapses as personas and passers-by wave and whisper, “Every figure reveals aspects of the total form, which is open and green” (Seydel, 2007). The initials R.S. repeat, a nod to Robert's true family tree and further complicating identification. Robt, Robert's sometimes alter-ego, appears in myriad forms as a trickster “half-wit,” mercurial and skittish, or soft and worn thin. Saul is a solemn tinkerer, parsing the world and sometimes blind. Ruth, the speaker of the book, records and translates all, her voice wavering between poetic verse and a cryptic half-speech as complex as it is sparse. The rhythm of frayed edges sets time - the weight of the world and the lightness of paper. Robert wrote of his process, “Material is essential; scuffings carry history, which wanders throughout” (Seydel, 2007). Collectors, assemblers, sway between careful movements of selection and placement as they pull from the found world, mediating calculated and unconscious association to form a lexicon of gestures, symbols and allusion, the “artifacts of a life... the refuse and rejecta of days” (Seydel, 2007). These assembled fragments shift and chatter, at home in their homelessness, actors performing in their own lives, populating an invented world of similar orphans. Such accumulated, severed parts carry the injury of their cutting and retain the evidence of their source, binding loss to creation in a symbiosis of trauma and repair. Mourning and remembrance are deeply embedded in the histories and acts of such practices. Grievance, acceptance, and the fragility of life are conveyed in the 18th century allegorical arrangements of fetal specimens by Frederik Ruysch. A certain melancholy reverence colors Joseph Cornell's intimately tactile assemblages rendering the universe tangible in miniature, or made in devotion to unrequited loves. Preserved in stasis, these ghosts and idols are kept in a purgatory where fact and fiction, past and present are irrelevant distinctions. Catalogued and contained, the subject of loss is transferred to an artifact. Every thread, scrap and letter may be glued, gathered and placed in a museum, a tomb, a box, a page, ripe and open for possession. Holding on to grief and reveling in disrepair, we opt to be haunted. Forever unbalanced and in flux, the sublime of collage is its resolve to irresolution. For Robert, “Art, as creation and as sign of primary Imagination, is not objects but a state, a kind of fluid” (Seydel, 2007) Reflecting on his work, life, and death, I am drawn to my library and the myriad titles acquired through his inspiration. There is Daniel Spoerri's An Anecdoted Topography of Chance , Susan Stewart's On Longing , various Borges, Barthes, Perec, and especially Life: A User's Manual , which concludes that the perfect puzzle will have no solution. I think of the drawers of miscellaneous swallowed objects at the Mutter Museum, Ray Johnson coding the every day in riddles, Wallace Berman twisting tongues, and Susan Hiller laying every detail to bear. Collectors and makers working in endless cycles of observation, ingestion and display. Every gesture informs and is defined by others, every space is shaped by that which surrounds and fills it, the knot has an inner logic, the gigantic is not so different from the miniature, there is a world in every detail, and “All art is collage” (Seydel, 2011) These thoughts have molded my life, my art, and all the minutia that keep the two so profoundly intertwined; There is no difference between life and what we do with our time. “I write my life. I make me up.” What a gift to share this secret way of knowing the world, and to leave this knowledge for us to do with what we please. “Art begins in admiration” (Seydel, 2011) Lauren van Haaften-Schick is a curator, writer and artist based in New York. Sura Levine on Robert Seydel If early on in his time at Hampshire College I was officially his “mentor,” Robert Seydel quickly became one of my great teachers. Over the years we talked about everything, from art, music, collage, and poetry, to campus politics, this latter far too often. It was always a sublime pleasure, if all too rarely done, to enter his apartment to look at his work in progress, to peruse his bookshelves where, inevitably, there were always new treats to examine. And, while he was working on his Book of Ruth , I was given the opportunity over the course of many meals at the Korean and other restaurants, to talk with him about image and poem ordering. To see how he thought through each comma, each juxtaposition across the gutters of the Book, was to watch a brilliant curator at work. Each day, I walk past his wonderful collaged portrait of Ruth, purchased, after much haggling, as a birthday present, a couple of years ago. And each day, I think how lucky I am to have known Robert as he produced this magnum opus. One of my greatest pleasures in 24 years at the College was to teach “The Collector” with Robert. One of my greatest regrets is that the magic we created together in the classroom will not, and cannot, be duplicated. Its various incarnations, its utter intelligence and magic, were all so deeply Robert’s. His was a mind that put poetry, philosophy, history of science, and history together with art, and art together with music. His intellect and eye were unparalleled. He introduced us to so many artists. He shared his fascination with the cabinets of curiosity of Aldrovandi, of Seba, and Peter the Great’s collection of fetal anomalies, as well as the Museum of Jurassic Technology in Los Angeles. Robert knew them all and so many more. He was a walking encyclopedia, his home a great archive. Arcane knowledge, perhaps, but oh so important for another of Robert’s heroes, the mid-20th century Belgian artist Marcel Broodthaers, whose name he invariably mispronounced as “Broadthayers.” In speaking his name, Robert would always look in my direction in a panic, and then he go on and maul it. I absolutely loved his various mispronunciations of French names and terms! “The Collector” was always filled with talented young artists, art historians, philosophers and writers who all came to understand the wondrous obsessions of the figure of the collector. Students in this course created dazzling projects each term. He always moved while looking and speaking. He read deeply, and commented on everyone’s work with wonderful generosity. Robert always found something to praise even in the least developed of projects. Robert inspired and mentored all of his students into making work that far exceeded their expectations—and ours. For those of you who were lucky enough to have been touched by or to have had an evaluation written by Robert, savor it, keep it, reread it, and share it. He loved working with you all; it is somehow fitting that he died while prepping yet another new course. Robert, it’s almost impossible to speak of you in the past tense, even though you left us a month ago. No doubt, if you knew about our gatherings and celebrations of you, you would be embarrassed that we are making a fuss over you; you always placed the focus on others rather than on yourself. Ted Schick grapples with the New Age thinker Fritjof Capra. Is Capra right to suggest that the Eastern Mystics have been vindicated by the discoveries of modern science?

Constructivism in ethics is the view that insofar as there are normative truths, for example, truths about what we ought to do, they are in some sense determined by an idealized process of rational deliberation, choice, or agreement. As a “first-order moral account”--an account of which moral principles are correct-- constructivism is the view that the moral principles we ought to accept or follow are the ones that agents would agree to or endorse were they to engage in a hypothetical (...) or idealized process of rational deliberation. As a “metaethical account” – an account of whether there are any normative truths and, if so, what they are like – constructivism holds that there are normative truths. These truths are not fixed by facts that are independent of the practical standpoint, however characterized; rather, they are constituted by what agents would agree to under some specified conditions of choice. In working to provide a more precise definition of constructivism in metaethics, the focus of this entry, one faces two main difficulties. The first difficulty is that constructivism comes in several varieties, each of which claims a different niche within metaethics, and some claim no space at all. The second difficulty concerns where to place constructivism on the metaethical map in relation to realism and anti-realism. These are terms of art, and it is highly contested which views count as realist and which as antirealist. These two difficulties will be addressed in what follows by focusing on the distinctive questions that constructivist theories are designed to answer. Section §1 defines the scope of constructivism in ethics, in contrast to constructivism in political theory. Sections §§2-5 illustrate the main varieties of metaethical constructivism, which are designed to account for the nature of normative truths and practical reasons. Section §6 presents the main varieties of constructivist accounts of the justification of moral judgments of right and wrong. This book, first published in 1997, is an introductory overview of decision theory. It is completely non-technical, without a single formula in the book. Written in a crisp and clear style it succinctly covers the full range of philosophical issues of rationality and decision theory, including game theory, social choice theory, prisoner's dilemma and much else. The book aims to expand the scope and enrich the foundations of decision theory. By addressing such issues as ambivalence, inner conflict, and the constraints (...) imposed upon us by our attachments to others, Frederic Schick reveals that our thinking is often more subtle than standard theories of rationality allow. Only a theory that respects that subtlety can illumine what is otherwise puzzling. The book contains many examples drawn from history and literature dealing with subjects such as love, war, friendship, and crime. (shrink)

It is largely agreed that if constructivism contributes anything to meta-ethics it is by proposing that we understand ethical objectivity “in terms of a suitably constructed point of view that all can accept” (Rawls 1980/1999: 307). Constructivists defend this “practical” conception of objectivity in contrast to the realist or “ontological” conception of objectivity, understood as an accurate representation of an independent metaphysical order. Because of their objectivist but not realist commitments, Kantian constructivists place their theory “somewhere in the space between (...) realist and relativist accounts of ethics” (O’Neill 1988: 1). Furthermore, they argue that their practical conception of objectivity succeeds in making sense of certain features of morality, such as its categorical authority and its relation to rational agency, which escape rival theories (Korsgaard 1996b, Korsgaard 2003b). To this extent, constructivism claims a privileged place in meta-ethics. The legitimacy of this claim is widely challenged. Precisely because of its practical conception of objectivity, many – including some constructivists — regard constructivism as a first-order normative theory, rather than as a meta-ethical position, hence not on a par with realism. Some critics object that constructivism fails to offer a distinct meta-ethics because it is structurally incomplete and thus must be combined with a fully-fledged meta-ethics (Hussain and Shah 2006); others argue that it tacitly relies on realism (Timmons 2003; Shafer-Landau 2003; Larmore 2008). Thus far, the debate about the prospects of constructivism as a meta-ethical theory has been driven by the conviction that the case for or against constructivism depends on its ontological commitments. In this chapter, I propose a change in perspective. My aim is to defend constructivism as an objectivist account of practical knowledge. Its defining feature is the claim that practical knowledge is knowledge by principles. Its task is to establish a constitutive relation between knowledge of oneself as a practical subject and knowledge about what one ought to do. By focusing on the issue of practical knowledge I hope to show that the difficulty in situating Kantian constructivism firmly on the meta-ethical map, along with other meta-ethical theories, reflects ambiguities and oscillations about the practical significance of ethics. Even though the term is ambiguous, I retain the qualification “Kantian” for the constructivist theory I outline, and for two reasons. First, while the theory I outline differs from current agnostic or anti-realist variants, it is closer to its origins, since Kant treats practical reason as a cognitive capacity and takes moral judgments to be objective moral cognitions, which importantly differ from other sorts of rational cognitions because they bind us in the first person. Practical cognitions are common knowledge because they are such that all subjects endowed with rationality can arrive at them by reasoning and find them authoritative. Thus understood, Kantian constructivism carves a distinct logical space in the meta-ethical debate that other sorts of constructivism fail to identify. This is the second reason for keeping the qualification “Kantian”. On this formulation, constructivism is antagonistic to non-cognitivist theories denying that moral judgments have cognitive contents, because they deny that there is something to be known; but it is also a rival to cognitivist theories denying that knowledge can be practical in itself. How constructivism differs over the realist theories of practical reason is the least understood aspect of this debate. This essay aims to make the case that practical reason is both discursive and emotional. In contrast to foundational and anti-realist accounts of practical reasoning, it attempts to show that the moral feeling of respect plays a cognitive but non-evidential role in the account of the cognitive and practical powers of reason. The argument proceeds as follows. In section 1, I consider some prominent constructivist arguments against the model of applied knowledge and show that they are driven by non-cognitivist assumptions about the practicality of ethics and the legitimacy of epistemological claims. In section 2, I argue that these arguments do not succeed in disposing of the idea of practical knowledge as incoherent, because they trade on an ambiguity regarding the proper object of practical knowledge. To solve this ambiguity, I turn to Anscombe’s contrast between “practical” and “speculative” knowledge as models for understanding action. I thus suggest that Anscombe’s account of practical knowledge as knowledge of oneself as an agent is an important resource for Kantian constructivism. This finding prompts us to reset the current dispute about the ontological and epistemological commitments of Kantian constructivism, as illustrated in section 3. While constructivism does not postulate any moral ontology prior to reasoning, it attributes to reasoning the cognitive powers to establish a distinctive relation between the agent and her action. The task of sections 4-7 is to account for the distinctive features of Kantian constructivism understood as an objectivist account of practical knowledge. In section 4, I argue that in order for reasoning to accomplish its normative tasks, it should be conceived as a self-legislating activity. I respond to some objections to the idea of self-legislation as the form of rational willing by offering a dialogical view of practical reason. In section 5, I propose a non-standard interpretation of Kant’s argument of “the fact of reason” to show that the constructivist account of self-legislation does not build on realism about value, as its detractors claim. The “basis of construction” is the subjective experience of respect for the self-legislative capacity itself. This moral feeling conveys our awareness of rational agency and shows our responsiveness to the demands of practical reason. It is an emotional mode of practical knowledge of oneself as an agent (in the sense specified in section 2), but not as a mode of moral discernment. In section 6, I show how practical knowledge of oneself as an agent relates to practical knowledge about what one ought to do. I thus account for the relation between respect as emotional moral consciousness and respect as a deliberative constraint. Finally, in section 7, I reply to the objection of subjectivism. I explain how the complex sort of objectivity that Kantian constructivism affords is at the same time more ambitious and more modest than is generally assumed. (shrink)

Among legal scholars, P. J. A. Feuerbach is considered one of the most important German jurists of the 19th century: not only has he established Germany’s modern doctrine of penal law and the Bavarian penal code of 1813, but he is also the founder of the theory of psychological force, i.e. the idea of the threat of punishment (not punishment itself!) as deterrence. Whereas one cannot comprehend Feuerbach’s legal doctrines without their original philosophical justification, namely his concept of the legal (...) subject as a citizen of two worlds, most contemporary interpreters ignore this aspect of Feuerbach’s theory of punishment. Against this reductionist interpretation of Feuerbach, by reconstructing his philosophy of punishment, this article exposes both the theoretical potential and shortcomings of Feuerbach’s main philosophical concepts. This paper seeks to develop a theory of health that aligns with the shift in contemporary medical practice and research toward a temporally extended epidemiological view of health. The paper describes how such a theory is at the core of life course based approaches to health, and finds theoretical grounding in recent work in the philosophy of biology promulgating a process theory of life.

Against the background of the criticism that the reflection theory of self-awareness has drawn from the Heidelberg School, a criticism first directed a Fichte, this article addresses the question of how Fichte’s reasoning in his Attempt of a New Presentation of the Wissenschaftslehre relates to the reflection theory of self-awareness. The question is motivated by the observation that Fichte seems to combine explicit criticism of this theory with affirmative adoption of some main features of the same. The article concludes that (...) Fichte succeeds in pointing out an immediate self-awareness, consisting in the self-awareness in thinking, which is, however, not suited for functioning as a first cause of consciousness, and, if forced to function in this way, falls prey to the vicious circle object to the reflection theory. Vor dem Hintergrund der von der Heidelberger Schule im Anschluss an Fichte vorgelegten Kritik des sogenannten Reflexionsmodells des Selbstbewusstseins geht der Beitrag der Frage nach, wie sich Fichtes Argumentation im Versuch einer neuen Darstellung der Wissenschaftslehre zur Reflexionstheorie des Selbstbewusstseins verhält. Das Motiv zu dieser Studie liefert die Beobachtung, dass sich hier neben expliziter Kritik auch affirmative Aufnahmen der Reflexionstheorie zu finden scheinen. Im Durchgang durch das erste Kapitel kommt der Beitrag zu dem Ergebnis, dass es Fichte gelingt, in Gestalt der Selbstgegenwart im Denken ein unmittelbares Selbstbewusstsein auszuweisen, das allerdings nicht geeignet ist, in die Rolle des Grundes allen Bewusstseins einzutreten und, in diese Rolle versetzt, in den Zirkel der Reflexionstheorie zurückführt. Der moderne Mensch hat ein ambivalentes Verhältnis zu seiner technischen Umwelt: Einerseits besitzt er technische Objekte, sie sind sein eigen und er strebt danach, sein technologisches Netzwerk ständig zu erweitern und zu erneuern. Andererseits bleiben die ihn umgebenden Objekte ihm immer ein Stück weit fremd, er kann sie ohne Spezialwissen nicht eigenhändig reparieren, versteht ihr Innenleben nicht oder fürchtet gar, dass sich das Machtverhältnis umkehrt und der Mensch nicht länger technische Objekte besitzt und handhabt, sondern von ihnen besessen und gesteuert (...) wird. Diese Vertrautheit und gleichzeitige Fremdheit der Technik scheint ein Kennzeichen der sozio-technischen Netzwerke zu sein, in denen wir uns bewegen. (shrink)

According to Eugenie Scott, methodological materialism---the view that science attempts to explain the world using material processes---does not imply philosophical materialism---the view that all that exists are material processes. Thus one can consistently be both a scientist and a theist. According to Phillip Johnson, however, methodological materialism presupposes philosophical materialism. Consequently, scientists are unable to see the cogency of supernatural explanations, like creationism. I argue that both Scott and Johnson are wrong: scientists are not limited to explaining tbe world using (...) material processes and science does not presuppose materialism. Thus scientists’ rejection of creationism is not irrational. (shrink)

The Doctrine of Right is one of Kant’s most disputed works: Defamed as an alleged sign of Kant’s emerging senility by Schopenhauer, it is now considered a classic of both philosophy of right and philosophy of the state. But to this day, even the reliability of the original edition of the Doctrine of Right is an object of learned and heated discussions. According to Martin Heuser’s recently published study Zur Positivität des Rechts in der kritischen Naturrechtslehre Immanuel Kants the whole (...) scholarly disputes on Kant’s Doctrine of Right originate from a complete misunderstanding of the Doctrine’s very methodology, the method of synthetic a priori knowledge. In a critical discussion of Heuser’s book, this paper hence re-reads Kant’s Doctrine of Right. It first takes into consideration some methodological issues with the Doctrine of Right and its interpretation. Afterwards, it investigates the metaphysical character of Kant’s philosophy of right. In a further step, it confronts Kant’s intrapersonal foundation of right with its interpersonal foundation by both Fichte and Hegel. Thereupon, it analyzes the status of private law, the state, and the relation of natural law and positive law in Kant’s Doctrine of Right. The paper ends with a critical examination of Kant’s matrimonial law and his rejection of any right of resistance. (shrink)
