When examining how emotions are evoked through music, the role of musical expectancy is often surprisingly under-credited. This mechanism, however, is most strongly tied to the actual structure of the music, and thus is important when considering how music elicits emotions. Pateman challenges the way contemporary society functions by questioning the standard interpretation of an idea that is deeply embedded in American and British political thought: that our rights and freedoms derive from the social contract explicated by Locke, Hobbes, and Rousseau and interpreted in the United States by the Founding Fathers. The author shows how we are told only half the story of the original contract that establishes modern patriarchy. The sexual contract is ignored and thus men's patriarchal right over (...) women is also glossed over. No attention is paid to the problems that arise when women are excluded from the original contract but incorporated into the new contractual order. One of the main targets of the book is those who try to turn contractarian theory to progressive use, and a major thesis of the book is that this is not possible. Thus those feminists who have looked to a more "proper" contract- one between genuinely equal partners, or one entered into without any coercion- are misleading themselves. In the author's words, "In contract theory universal freedom is always a hypothesis, a story, a political fiction. Contract always generates political right in the forms of domination and subordination." Thus the book is also aimed at mainstream political theorists, and socialist and other critics of contract theory. The author offers a sweeping challenge to conventional understandings- of both left and right- of actual contracts in everyday life: the marriage contract, the employment contract, the prostitution contract, and the new surrogate mother contract. By bringing a feminist perspective to bear on the contradictions and paradoxes surrounding women and contract, and the relation between the sexes, she is able to shed new light on fundamental political problems of freedom and subordination. After summarizing Kathleen Wallace’s cumulative network model of the self, this paper explores Wallace’s account of the whole self’s capacity for self‐reflection in some detail. Supposing that constituents of the self are capable of interpreting and communicating with one another, how is it possible for the whole self to interpret and communicate with itself and to act on the basis of its self‐understandings? The paper suggests that Wallace needs an account of the self’s ability to synthesize the information that interpretative (...) communication furnishes and manage it to reach all‐things‐considered judgments and decide what to do. The paper sketches such an account and concludes by considering some implications for selfhood of different types of traumatic experience. (shrink)

Research on bias in peer review examines scholarly communication and funding processes to assess the epistemic and social legitimacy of the mechanisms by which knowledge communities vet and self-regulate their work. Despite vocal concerns, a closer look at the empirical and methodological limitations of research on bias raises questions about the existence and extent of many hypothesized forms of bias. In addition, the notion of bias is predicated on an implicit ideal that, once articulated, raises questions about the normative implications (...) of research on bias in peer review. This review provides a brief description of the function, history, and scope of peer review; articulates and critiques the conception of bias unifying research on bias in peer review; characterizes and examines the empirical, methodological, and normative claims of bias in peer review research; and assesses possible alternatives to the status quo. We close by identifying ways to expand conceptions and studies of bias to countenance the complexity of social interactions among actors involved directly and indirectly in peer review. (shrink)

Victim's Stories and the Advancement of Human Rights takes on a set of questions suggested by the worldwide persistence of human rights abuse and the prevalence of victims' stories in human rights campaigns, truth commissions, and international criminal tribunals: What conceptions of victims are presumed in contemporary human rights discourse? How do conventional narrative templates fail victims of human rights abuse and resist raising novel human rights issues? What is empathy, and how can victims frame their stories to overcome empathetic (...) obstacles and promote commitment to human rights? How can victims' stories be used ethically in the service of human rights? The book addresses these concerns by analyzing the rhetorical resources for and constraints on victims' ability to articulate their stories and by clarifying how their stories can contribute to enlarged understandings of human rights protections and deepened commitments to realizing human rights. It theorizes the normative content that victims' stories can convey and the bearing of that normative content on human rights. Throughout the book, published victims' stories-including stories of torture, slavery, genocide, rape in wartime, and child soldiering-are analyzed in conjunction with philosophical arguments. How is women’s conception of self affected by the caregiving responsibilities traditionally assigned to them and by the personal vulnerabilities imposed on them? If institutions of male dominance profoundly influence women’s lives and minds, how can women form judgments about their own best interests and overcome oppression? Can feminist politics survive in face of the diversity of women’s experience, which is shaped by race, class, ethnicity, and sexual orientation, as well as by gender? Growing interest in workplace spirituality has led to the development of a new paradigm in organizational science. Theoretical assumptions abound as to how workplace spirituality might enhance organizational performance, most postulating a significant positive impact. Here, that body of research has been reviewed and analyzed, and a resultant values framework for workplace spirituality is introduced, providing the groundwork for empirical testing. A discussion of the factors and assumptions involved for future research are outlined.

From Hobbes to Weber, discussions of power increasingly made a modern concept of "will" their pivotal category. Although sometimes tinged with other concerns, this tendency continues today. Focusing through the lens of the "will" displays an image of power that reasserts untenable conceptions of the person and obscures the fact that power is a relation and not a property, a faculty, or a thing-in-itself. The dissertation tackles this fundamental problem. ;To begin, "dependence" is given the centering position. "Dependence," unlike "will," (...) is a necessarily relational concept. A distinction is introduced between dependence-from-things and dependence-from-persons. The interrelation between these is considered in terms of non-formal anthropological conceptions of reciprocity. This complex reciprocity is contrasted to reciprocity understood as "equality." ;Paradoxically, the theoretical move to contextually determined reciprocity forces reconsideration of the "will," for the background normative institutional patterns of reciprocity in liberal societies are delineated in terms of the "will." This is a virtuous, not a vicious, circle. Once the "will" has been forced from its central position in the theory of power, a critical perspective is gained by viewing "will" through "dependence." ;An analysis of the ways people rationalize or appropriate to their own advantage the unintended consequences of action illuminates the link between "will" and "dependence." The emergence of dependence itself provides a general example of an "unintended consequence of action." People seeking to gain advantage assert their independence from the unintended, even while appropriating the "unintended consequences of action." Cultural patterns for denying dependence play an important part in asserting advantage. ;Disruptions of practical relations of reciprocity cannot be determined a priori; rather, they follow from speech and action. These disruptions lead to contention. Two notoriously vague notions, public and private, have long been terms for playing out such contentions. Theorists often assume that public/private indicates two distinct "spheres" . By contrast, the present theory provides an approach to the analysis of the transformation of private into public. This is a necessary condition for the emergence and control of power. (shrink)

To arrive at their final evaluation of a manuscript or grant proposal, reviewers must convert a submission’s strengths and weaknesses for heterogeneous peer review criteria into a single metric of quality or merit. I identify this process of commensuration as the locus for a new kind of peer review bias. Commensuration bias illuminates how the systematic prioritization of some peer review criteria over others permits and facilitates problematic patterns of publication and funding in science. An empirically sensitive formulation of the norms of transformative criticism must recognize that even public and shared standards of evaluation can be implemented in ways that unintentionally perpetuate and reproduce forms of social bias that are epistemically detrimental. Helen Longino’s theory can explain and redress such social bias by treating peer evaluations as hypotheses based on data and by requiring a kind of perspectival diversity that bears, not on the content of the community’s knowledge claims, but on the beliefs and (...) norms of the culture of the knowledge community itself. To illustrate how socializing cognition can bias evaluations, we focus on peer-review practices, with some discussion of peer-review practices in philosophy. Data include responses to surveys by editors from general philosophy journals, as well as analyses of reviews and editorial decisions for the 2007 Cognitive Science Society Conference. (shrink)

Formulas designed to reduce the overweight body flourish in American culture, yet 98% of all weight loss efforts end in failure. Numerous experts note that women, more frequently than men, are overweight and have greater difficulty adhering to reducing diets. I analyze the discourse of weight loss by taking up Foucault's concepts of confession and surveillance. Specifically, I argue that reducing techniques weave the language of science, deviance, and theology to fuel the perpetuation of a wholly transparent female subject. The (...) weight conscious woman is divided within herself (mind versus body), and must, ironically, become and remain body conscious to alleviate body consciousness. Foucault's work, by describing the means by which bodies are inscribed in discursive practice, provides the diagnostic tools needed to assess the relation of dogma (reducing discourse) and individual (female body in need of alteration). A collection of some of my previously published papers with an introduction and a new chapter.

There is an increasing push by journals to ensure that data and products related to published papers are shared as part of a cultural move to promote transparency, reproducibility, and trust in the scientific literature. Yet few journals commit to evaluating their effectiveness in implementing reporting standards aimed at meeting those goals (1, 2). Similarly, though the vast majority of journals endorse peer review as an approach to ensure trust in the literature, few make their peer review data available to (...) evaluate effectiveness toward achieving concrete measures of quality, including consistency and completeness in meeting reporting standards. Remedying these apparent disconnects is critical for closing the gap between guidance recommendations and actual reporting behavior. We see this as a collective action problem requiring leadership and investment by publishers, who can be incentivized through mechanisms that allow them to manage reputational risk and through continued innovation in journal assessment. This volume brings together a wide-ranging collection of the papers written by Jeremy Waldron, one of the most internationally respected political theorists writing today. The main focus of the collection is on substantive issues in modern political philosophy. The first six chapters deal with freedom, toleration and neutrality and argue for a robust conception of liberty. Waldron defends the idea that people have a right to act in ways others disapprove of, and that the state should be neutral vis-á-vis religious (...) and ethical systems. The chapters that follow are concerned with socio-economic rights. Waldron argues that poverty and homelessness are not to be understood apart from the value of freedom. It is often said that human rights are the rights that people possess simply in virtue of being human – that is, in virtue of their intrinsic, dignity-defining common humanity. Yet, on closer inspection the human rights landscape doesn’t look so even. Once we bring perpetrators of human rights abuse and their victims into the picture, attributions of humanity to persons become unstable. In this essay, I trace the ways in which rights discourse ascribes variable humanity to certain categories of (...) people. I set the stage for my discussion of the human in relation to human rights by examining John Locke’s account of the justification for punishment. For Locke, in committing a crime one abrogates one’s humanity and forfeits one’s rights. Likewise, I argue, human rights discourse takes a scalar view of humanity. I consider victims of genocide who are dehumanized as helpless and passive, victims of state persecution who are super-humanized as righteously agentic, and perpetrators of genocide who are dehumanized as out-of-control beasts. In each case I use relevant testimony to argue that the scalar view of humanity is factually incorrect and morally deplorable. For genocide victims, I discuss testimony that Selma Leydesdorff gathered from women who survived the Srebrenica massacre. For a victim of persecution, I discuss Liao Yiwu’s memoire of his detention and imprisonment in China because of his artwork protesting the Tiananmen Square massacre. For perpetrators of genocide, I discuss testimony Jean Hatzfeld gathered from Hutu men who systematically murdered Tutsis in the Rwandan genocide. Finally, I apply my critique of dehumanized and super-humanized victims and dehumanized perpetrators to the problem of transnational trafficking in persons and argue that the view I advocate necessitates reforming immigration policy with respect to persons trafficked into forced labor. The value of autonomy - even personal autonomy - cannot be confined to the private sphere. Because autonomy bears a reciprocal relation to equal opportunity, it must be counted among the cardinal political values.

The aim of this chapter is to draw attention to an overlooked dimension of sex trafficking—namely, its abuse of women’s reproductive rights; to diagnose a tension between international anti-trafficking and refugee law and US anti-trafficking and immigration law; and to show that US anti-trafficking and immigration law is enforcing a misguided conception of victims that denies recognition to agentic victims of human rights abuse. Although women who have been trafficked into sex work should be prime candidates for legal protection, they (...) aren’t. Criminal and legal practices amount to a three-way struggle over women’s bodily integrity and autonomy. Because misconceptions about victimhood perpetuate this cyclical struggle, I argue for legal reforms based on a credible conception of victimhood. (shrink)

Feminist studies of female genital cutting (FGC) provide ample evidence that many women exercise effective agency with respect to this practice, both as accommodators and as resisters. The influence of culture on autonomy is ambiguous: women who resist cultural mandates for FGC do not necessarily enjoy greater autonomy than do those women who accommodate the practice, yet it is clear that some social contexts are more conducive to autonomy than others. In this paper, I explore the implications for autonomy theory (...) of these understandings of the relation between culture, FGC, and women’s agency. I review the range of worldwide FGC practices – including “corrective” surgery for “ambiguous genitalia” in Western cultures as well as the various initiation rites observed in some African and Asian cultures – and the diverse cultural rationales for different forms of FGC. I argue that neither latitudinarian, value‐neutral accounts of autonomy nor restrictive, value‐saturated accounts adequately explain women’s agentic position with respect to FGC. I then analyze a number of educational programs that have enhanced women's autonomy, especially by strengthening their introspection, empathy, and imagination. Such programs, which engage women's autonomy skills without exposing them to autonomy‐disabling cultural alienation, promote autonomy‐within‐culture. This understanding of autonomy as socially situated, however, entails neither endorsement of FGC nor resignation to its persistence. (shrink)

This paper argues for more randomised controlled trials in educational research. Educational researchers have largely abandoned the methodology they helped to pioneer. This gold-standard methodology should be more widely used as it is an appropriate and robust research technique. Without subjecting curriculum innovations to a RCT then potentially harmful educational initiatives could be visited upon the nation's children.

In his debates with Daniel Kahneman and Amos Tversky, Gerd Gigerenzer puts forward a stricter standard for the proper representation of judgment heuristics. I argue that Gigerenzer’s stricter standard contributes to naturalized epistemology in two ways. First, Gigerenzer’s standard can be used to winnow away cognitive processes that are inappropriately characterized and should not be used in the epistemic evaluation of belief. Second, Gigerenzer’s critique helps to recast the generality problem in naturalized epistemology and cognitive psychology as the methodological problem (...) of identifying criteria for the appropriate specification and characterization of cognitive processes in psychological explanations. I conclude that naturalized epistemologists seeking to address the generality problem should turn their focus to methodological questions about the proper characterization of cognitive processes for the purposes of psychological explanation.
