Many business ethicists assume that if a type of conduct is illegal, then it is also unethical. This article scrutinizes that assumption, using the rideshare company Uber’s illegal operation in the city of Philadelphia as a case study. I argue that Uber’s unlawful conduct was permissible. I also argue that this position is not an extreme one: it is consistent with a variety of theoretical commitments in the analytic philosophical tradition regarding political obligation. I conclude by showing why business ethicists (...) would have a better rejoinder to the “dominant view” of business ethics associated with Milton Friedman if they dispensed with the assumption that illegal implies unethical. Some defenders of the view that there is a common morality have conceived such morality as being universal, in the sense of extending across all cultures and times. Those who deny the existence of such a common morality often argue that the universality claim is implausible. Defense of common morality must take account of the distinction between descriptive and normative claims that there is a common morality. This essay considers these claims separately and identifies the nature of the arguments for (...) each claim. It argues that the claim that there is a universal common morality in the descriptive sense has not been successfully defended to date. It maintains that the claim that there is a common morality in the normative sense need not be understood as universalist. This paper advocates the concept of group specific common morality, including country-specific versions. It suggests that both the descriptive and the normative claims that there are country-specific common moralities are plausible, and that a country-specific normative common morality could provide the basis for a country's bioethics. How should we distinguish between ethical and unethical ways of pursuing profit in a market? The market failures approach (MFA) to business ethics purports to provide an answer to this question. I argue that it fails to do so. The source of this failure is the MFA’s reliance on Pareto efficiency as a core ethical principle. Many ethically “preferred” tactics for seeking profit cannot be justified by appeal to Pareto efficiency. One important reason for this is that Pareto efficiency, as (...) understood by the theory of welfare economics upon which the MFA relies, assumes a static conception of efficiency. This is a problem because many ethically “preferred” tactics can only be justified by appeal to dynamic efficiency considerations. I argue that, instead of Pareto efficiency, we should look to the value of wealth creation to understand the ethical constraints on how market actors may pursue profit. (shrink)

Thomas Carson offers the most comprehensive and up-to-date investigation of moral and conceptual questions about lying and deception. Part I addresses conceptual questions and offers definitions of lying, deception, and related concepts such as withholding information, "keeping someone in the dark," and "half truths." Part II deals with questions in ethical theory. Carson argues that standard debates about lying and deception between act-utilitarians and their critics are inconclusive because they rest on appeals to disputed moral intuitions. He defends (...) a version of the golden rule and a theory of moral reasoning. His theory implies that there is a moral presumption against lying and deception that causes harm — a presumption at least as strong as that endorsed by act-utilitarianism. He uses this theory to justify his claims about the issues he addresses in Part III: deception and withholding information in sales, deception in advertising, bluffing in negotiations, the duties of professionals to inform clients, lying and deception by leaders as a pretext for fighting wars, and lying and deception about history, and cases of distorting the historical record by telling half-truths. It is not my claim that the ‘L¨ owenheim-Skolem paradox’ is an antinomy in formal logic; but I shall argue that it is an antinomy, or something close to it, in philosophy of language. Moreover, I shall argue that the resolution of the antinomy—the only resolution that I myself can see as making sense—has profound implications for the great metaphysical dispute about realism which has always been the central dispute in the philosophy of language.

In this paper, the author presents a lengthy class handout on moral relativism. The author treats in depth and disambiguates several senses of “moral relativism,” distinguishing between "cultural relativism," "situational relativism," "normative relativism," "metaethical relativism," "moral skepticism," and “irrationalism”. On the basis of the close attention given to these terminological differences, the author moves into a discussion of the question, “Is moral relativism true?” The author argues that while some forms of moral relativism (situational, cultural) are clearly true, others (normative) (...) are clearly false, and that the answer to the question cannot be simply “yes” or “no”. Special attention is given to metaethical relativism, which is framed as the most philosophically challenging and interesting version of moral relativism. (shrink)

This paper concerns Tarski’s use of the term “model” in his 1936 paper “On the Concept of Logical Consequence.” Against several of Tarski’s recent defenders, I argue that Tarski employed a non-standard conception of models in that paper. Against Tarski’s detractors, I argue that this non-standard conception is more philosophically plausible than it may appear. Finally, I make a few comments concerning the traditionally puzzling case of Tarski’s ω-rule example.

This paper examines the use of case studies in ethics education. While not dismissing their value for specific purposes, the paper shows the limits of their use. While agreeing that case studies are narratives, although rather thin stories, the paper argues that the claim that case studies could represent reality is difficult to sustain. Instead, the paper suggests a way of using stories in ethics teaching that could be more real for students, while also giving them a way of thinking (...) about their own professional practices. The paper shows how the method can be used to develop a more critical and reflective practice for students in the health care professions. Some immediate problems with the method are discussed. Several methods have been reported for extracting sperm from a man after he dies or enters a persistent vegetative state. Although such sperm retrieval could be performed for nonprocreative purposes, such as research, in this paper I focus on cases involving procreative intent. Since 1980, more than ninety cases have occurred in which family members requested sperm retrieval from patients who died or were irreversibly unconscious, with the intent that a wife, girlfriend, or other woman would be inseminated. Recently, the (...) first report of pregnancy and birth following postmortem sperm retrieval appeared in the media.In these cases, death or PVS typically is caused by anoxic injuries, trauma, or rapidly progressing infections. Business schools are frequently blamed for corporate ethical scandals by failing to develop integrity and critical ethical thinking skills in managers. What should business schools teach to address this? The paper proposes a framework for the development and evaluation of a business ethics curriculum, which is grounded on the AACSB learning goals of ethical understanding, reasoning abilities, managerial knowledge and ethical capacities. The framework is two building blocks in the form of tests, which together provide quality measures for business ethics (...) content and a definition of the scope and depth of knowledge an ethics curriculum should contain. Overall, the framework is a supplement to the AACSB guidelines and its purpose is to be a curriculum development tool. (shrink)

This article examines the most controversial of the activities of the India Meteorological Department (IMD): long-term seasonal forecasting for the South Asian subcontinent. Under the pressure of recurrent famines, in 1886 the imperial IMD commenced annual issue of monsoon predictions several months in advance, focused on one variable: rainfall. This state service was new to global late nineteenth-century meteorology, attempted first and most rigorously in India. Successive IMD leaders adapted the forecast in light of scientific and infrastructural developments, continuously revising (...) the underlying methods of its production. All methods failed to achieve accurate prevision. Nevertheless, the imperatives of economic administration, empire and public demand compelled IMD scientists to continue annual publication of this unreliable product. This article contends that the seasonal forecast is best understood as an enduring ritual of good governance in a monsoonal environment. Through analysis of newspaper controversies, it suggests that although the seasonal forecast was the most compelling justification for the IMD's imperial and global importance, its limitations undercut popular trust in modern meteorology. Finally, this case illustrates the centrality of ‘tropical meteorology’ to the historical development of modern atmospheric science. (shrink)

Christians look to Scripture to inform their ethical decision-making, believing that God speaks through it. However, disagreement as to what the Bible requires us to do can often lead to acrimonious splits within the church. So long as sharp divisions amongst Christians over ethical issues remain, injustices continue, and the reputation of the church is undermined. This article suggests that lessons may be learned from the story of the use of the Bible in the American Abolitionism debate which can help (...) the contemporary church to discuss and perhaps even resolve some enduring ethical questions which are dividing Christians today. Normative nonrealism denies, first, that some things are good or bad independently of facts about the attitudes of moral agents and, second, that attitude-independent moral facts determine what is rational. This implies that facts about what is rational are logically prior to what is moral. Nonrealism commonly assumes that moral realism is false or unjustifiable, that there is a conceptual connection between morality and rationality and that the particular theory of rationality is the correct account of rationality. Facing the threat (...) of relativism when abandoning it is argued that is at least dubious. Semantic considerations concerning the meaning of "rationality" are sketched and the full-information approach of decision making, intemalism and extemalism are discussed in the light of "Why care?"-questions with the resuh that these questions do serious damage to nonrealist approaches to rationality and reason-based morality. There is a long tradition, in the history and philosophy of science, of studying Kant’s philosophy of mathematics, but recently philosophers have begun to examine the way in which Kant’s reflections on mathematics play a role in his philosophy more generally, and in its development. For example, in the Critique of Pure Reason , Kant outlines the method of philosophy in general by contrasting it with the method of mathematics; in the Critique of Practical Reason , Kant compares the Formula (...) of Universal Law, central to his theory of moral judgement, to a mathematical postulate; in the Critique of Judgement , where he considers aesthetic judgment, Kant distinguishes the mathematical sublime from the dynamical sublime. This last point rests on the distinction that shapes the Transcendental Analytic of Concepts at the heart of Kant’s Critical philosophy, that between the mathematical and the dynamical categories. These examples make it clear that Kant's transcendental philosophy is strongly influenced by the importance and special status of mathematics. The contributions to this book explore this theme of the centrality of mathematics to Kant’s philosophy as a whole. For as long as humans have pondered philosophical issues, they have contemplated the good life. Yet most suggestions about how to live a good life rest on assumptions about what the good life actually is. Thomas Carson here confronts that question from a fresh perspective. Surveying the history of philosophy, he addresses first-order questions about what is good and bad as well as metaethical questions concerning value judgments. Carson considers a number of established viewpoints concerning the good life. (...) He offers a new critique of Mill's and Sidgwick's classic arguments for the hedonistic theory of value, employing thought experiments that invite us to clarify our preferences by choosing between different kinds of lives. He also assesses the desire- or preference-satisfaction theory of value in detail and takes a fresh look at both Nietzsche's Übermensch ideal and Aristotle's theory of the good life. In exploring foundational questions, Carson observes that many established theories rest on undefended assumptions about the truth of moral realism. Arguing against this stand, he defends the view that good means desirable and presents a divine-preference version of the desire-satisfaction theory. In this he contends that, if there exists a kind and omniscient God who created the universe, then what is good or bad is determined by His preferences; if such a God does not exist, what is good or bad depends on what we as rational humans desire. Value and the Good Life is the only book that defends a divine-preference theory of value as opposed to a divine-command theory of right and wrong. It offers a masterfully constructed argument to an age-old question and will stimulate all who seek to know what the good life truly is. (shrink)

Principlism has been advocated as an approach to resolving concrete cases and issues in bioethics, but critics have pointed out that a main problem for principlism is its lack of a method for assigning priorities to conflicting ethical principles. A version of principlism referred to as 'specified principlism' has been put forward in an attempt to overcome this problem. However, none of the advocates of specified principlism have attempted to demonstrate that the method actually works in resolving detailed clinical cases. (...) This paper shows that when one tries to use it, specified principlism fails to provide practical assistance in deciding how to resolve concrete cases. Proponents of specified principlism have attempted to defend it by arguing that it is superior to casuistry, but it can be shown that their arguments are faulty. Because of these reasons, specified principlism should not be considered a leading contender in the search for methods of making justifiable decisions in clinical cases. (shrink)

From the perspective of investigators conducting research involving pregnant women and fetuses, a woman's decision about whether to have an abortion can sometimes be relevant to the suitability of the woman and fetus as research subjects. However, prominent ethicists disagree over whether it is permissible for a woman's decision about abortion to be an inclusion or exclusion criterion for participation in research. A widely held view is that fetuses to be aborted and fetuses to be carried to term should be (...) treated equally as research subjects. Some hold that this principle implies that a woman's decision about whether to have an abortion should not be an inclusion or exclusion criterion. This paper identifies types of research in which investigators might want to have inclusion or exclusion criteria based on decisions about abortion. It examines the arguments for and against having the woman's decision about abortion included in such criteria. It is argued that there are types of research in which such criteria are ethically permissible. (shrink)
