Context: In most jurisdictions where medical-aid-in-dying is available, this option is reserved for individuals suffering from incurable physical conditions. Currently, in Canada, people who have a mental illness are legally excluded from accessing MAiD. Methods: We developed a questionnaire for mental health care providers to better understand their perspectives related to ethical issues in relation to MAiD in the context of severe and persistent suffering caused by mental illness. We used a mixed-methods survey approach, using a concurrent embedded model with (...) both closed and open-ended questions. Findings: 477 healthcare providers from the province of Québec completed the questionnaire. One third of the sample were nurses, one quarter psychologists and one quarter psycho-educators. Nearly half of the respondents considered that people with a severe mental illness should be granted the right to opt for MAiD as a way to end their suffering. Respondents were more likely to feel comfortable listening to the person and participating in discussions related to MAiD for a mental illness than offering care or the means for the person to access MAiD. Most reported that they had not received adequate/sufficient training, education or preparation in order to address ethical questions surrounding MAiD. Conclusions: The findings highlight how extending MAiD to people with a mental illness would affect daily practices for mental healthcare providers who work directly with people who may request MAiD. The survey results also reinforce the need for adequate training and professional education in this complex area of care. (shrink)

Bis zum Ende leben. Überleben. Im Anderen. Dies ist das letzte große Thema, welches Ricœur beschäftigt hat. Die in dieser Ausgabe erstmals in deutscher Übersetzung vorgelegten Fragmente aus dem Nachlaß sind weniger eine Auseinandersetzung mit dem Tod als mit dem Leben und Überleben. Es ist das große Trauma des 20. Jahrhunderts, jener, die die Vernichtungslager überlebt haben und die Jorge Semprun in seinem Buch "Schreiben oder Leben", mit dem Ricœur sich auseinandersetzt, als Wiedergänger bezeichnet, weder tot noch lebend, jene, die (...) scheinbar ihren eigenen Tod überlebt, sich selbst überlebt haben. Aber es steht auch für ein ganz persönliches Trauma, nämlich den Tod seiner Frau Simone, dessen Etappen Catherine Goldenstein im Nachwort skizziert. Der Gedanke der Trauer oder Trauerarbeit wird inspiriert von dieser Verlusterfahrung, dem Verlust eines geliebten Menschen. Beide Traumata halten einander dabei die Waage. Gegen den anonymen Massentod, dem kein Sinn mehr abzuringen ist, für den es keine wirkliche Trauerarbeit gibt, stellt sich der Verlust eines geliebten, einem nahestehenden Menschen. Das Bindeglied zwischen beiden stellt die Vorstellungs- oder Einbildungskraft dar. Sie ermöglicht eine Antizipation, eine Vergegenwärtigung sowie eine Anstelle-von-Substitution. Es ist die Antizipation des eigenen Todes in der Vergegenwärtigung der anderen Toten, an deren Stelle wir uns projizieren. (shrink)

In der vorliegenden Arbeit widmet sich die Autorin dem in theodosianischer Zeit entstandenen Elfenbeinkästchen von Brescia („Lipsanothek von Brescia“), das wegen der Qualität seiner Reliefs und der Vielfalt seiner Darstellungen in keiner Darstellung frühchristlicher Kunst fehlt. Die oft großformatigen Abbildungen täuschen über die Maße von 0,22 × 0,24 × 0,32 m hinweg. Da das Kästchen sich seit unbestimmter Zeit im Besitz der 1798 aufgehobenen Kirche S. Giulia in Brescia befindet, nimmt man an, dass es auch in Norditalien hergestellt wurde (S. (...) 21f.). Als Funktion des Kästchens gilt in der Regel die eines Reliquiars (S. 18); das Elfenbeinkästchens von Brescia würde damit zusammen mit dem Silberkästchen von S. Nazaro in Mailand zu den ältesten erhaltenen Reliquiaren gehören. Allerdings kann auch eine profane Nutzung des Kästchens – etwa als Schmuckkästchen einer wohlhabenden Frau – nicht ausgeschlossen werden, da Alltagsgegenstände bekanntlich häufig mit christlichen Szenen geschmückt waren. Im einen wie im anderen Fall war die Öffentlichkeit der Bilder des Kästchens beschränkt: Sollte es Reliquien enthalten haben, muss das Kästchen nicht zuletzt wegen seines begehrten, diebstahlsgefährdeten Inhalts an einem sicheren Ort aufbewahrt worden und nur selten sichtbar gewesen sein; im Falle einer Verwendung als Schmuckkästchens hätte es sich in den Privatgemächern eines vornehmen Hauses befunden. Is contemporary continental philosophy making a break with Kant? The structures of knowledge, taken for granted since Kants Critique of Pure Reason, are now being called into question: the finitude of the subject, the phenomenal given, a priori synthesis. Relinquish the transcendental: such is the imperative of postcritical thinking in the 21st century. Questions that we no longer thought it possible to ask now reemerge with renewed vigor: can Kant really maintain the difference between a priori and innate? Can he (...) deduce, rather than impose, the categories, or justify the necessity of nature? Recent research into brain development aggravates these suspicions, which measure transcendental idealism against the thesis of a biological origin for cognitive processes. In her important new book Catherine Malabou lays out Kants response to his posterity. True to its subject, the book evolves as an epigenesis – the differentiated growth of the embryo – for, as those who know how to read critical philosophy affirm, this is the very life of the transcendental and contains the promise of its transformation. In the present paper, I analyze the complex relationship of tension between Critical Theory and phenomenology from a sociological-theoretical perspective. I start from two theses. The first one is that one of the primary reasons for the antagonism between these two paradigms lies in their ideal-typically opposed assessments of the role of ‘meaning-adequacy’ in social research. The second one is that in recent years, there has been a strong rapprochement of Critical Theory with (social) phenomenology. This shift, fundamentally embodied in (...) Hartmut Rosa’s work, can be understood as the culminating point of a progressive turn towards meaning-adequacy within the Frankfurt School. In order to unfold these two theses, I will proceed in three steps. First (1), I will present the main outlines of the relationship of tension between the two traditions from both a historico-intellectual and a systematic perspective. Second (2), I will focus on the contemporary readings of the Schutzian notion of ‘meaning-adequacy’ and discuss their value for better understanding the historical opposition between the two paradigms, as well as their recent rapprochement. Third (3), I will sketch the key features of Rosa’s sociology of world-relations, understood as a phenomenological Critical Theory that shows a strong commitment to a radicalized version of the meaning-adequacy postulate. In many diagrams one seems to perceive necessity – one sees not only that something is so, but that it must be so. That conflicts with a certain empiricism largely taken for granted in contemporary philosophy, which believes perception is not capable of such feats. The reason for this belief is often thought well-summarized in Hume's maxim: ‘there are no necessary connections between distinct existences’. It is also thought that even if there were such necessities, perception is too passive or (...) localized a faculty to register them. John Rawls is one of the most influential thinkers of the twentieth century. Contemporary political philosophy has been reshaped by his seminal ideas and most current work in the discipline is a response to them. This book introduces his central ideas and examines their contribution to contemporary political thought. In the first part of the book Catherine Audard focuses on Rawls' conception of political and social justice and its justification as presented in his groundbreaking A Theory of Justice. This (...) includes sustained examination of Rawls' moral philosophy and its core thesis, the primacy of justice, the complex relation between Rawls' views and utilitarianism, and his most famous concept, the Original Position Device. In the second half of the book, Audard explores Rawls' more practical concerns for stability and political consensus, citizenship and international justice, and shows the continuity between these concerns and his earlier work. Throughout, Audard contextualizes Rawls' ideas by giving a sense of their historical development, which underlines the intellectual cohesion of his thought. The move between ethics and politics so characteristic of Rawls' work, and which makes for the richness of his philosophy, is shown to also create for it significant problems. Explores the role and influence of walking in the lives of such thinkers as Kant, Rousseau, Nietzsche, Robert Louis Stevenson, Gandhi, and Jack Kerouac.

The present paper constitutes an attempt to articulate, systematize, and further develop the implicit traces of a phenomenological critical theory that, according to Michael Barber’s reading, are to be found in Schutz’s thought. It is my contention that a good way to achieve this aim is by reading Schutz against the background of novel, phenomenologically and hermeneutically informed accounts of Critical Theory in the tradition of the Frankfurt School, such as Hartmut Rosa’s. In order to achieve the stated objective, I (...) will proceed in four steps. First, I will briefly reconstruct the mostly negative reception of phenomenology, the interpretive social sciences, and Schutz by both the Frankfurt School and contemporary critical social theory. Second, I will present Barber’s alternative reading of Schutzian phenomenology as entailing an implicit ethics and a rudimentary critical theory based thereon. Third, I will sketch out Rosa’s formal model of Critical Theory as an heuristic means for articulating Schutz’s unspoken social-critical insights. Finally, establishing a dialogue between Barber’s reading of Schutz and Rosa’s account, I will provide a preliminary articulation of Schutz’s rudimentary critical theory. (shrink)

RESUMEN La reconstrucción realizada en el presente artículo parte de la hipótesis de que pueden diferenciarse dos tipos de objeciones schützianas al texto canónico de Husserl, a saber: inmanentes y fundamentales. Las primeras remarcan las dificultades subyacentes en los pasos tomados por Husserl para resolver el problema de la intersubjetividad trascendental, mientras que las segundas cuestionan la pertinencia filosófica del problema mismo. ABSTRACT The hypothesis underlying the reconstruction set forth in the article is that Schütz's objections to Husserl's canonical text (...) are of two types: immanent and fundamental. The former underline the difficulties inherent to Husserl's steps in trying to solve the problem of transcendental intersubjectivity, while the latter question the philosophical pertinence of the issue itself. Comparative study on eastern and western philosophy.

During public health crises including the COVID-19 pandemic, resource scarcity and contagion risks may require health systems to shift—to some degree—from a usual clinical ethic, focused on the well-being of individual patients, to a public health ethic, focused on population health. Many triage policies exist that fall under the legal protections afforded by “crisis standards of care,” but they have key differences. We critically appraise one of the most fundamental differences among policies, namely the use of criteria to categorically exclude (...) certain patients from eligibility for otherwise standard medical services. We examine these categorical exclusion criteria from ethical, legal, disability, and implementation perspectives. Focusing our analysis on the most common type of exclusion criteria, which are disease-specific, we conclude that optimal policies for critical care resource allocation and the use of cardiopulmonary resuscitation (CPR) should not use categorical exclusions. We argue that the avoidance of categorical exclusions is often practically feasible, consistent with public health norms, and mitigates discrimination against persons with disabilities. (shrink)

New 'states of violence' are changing how we think about war and peace, as terrorists attacks, insurgencies, precision missiles, and a belief that conflict can avoid casualties all demonstrate a shift of focus from the state to the individual.

In the last decade, the organization of pharmaceutical research on neglected tropical diseases has undergone transformative change. In a context of perceived “market failure,” the development of new medicines is increasingly handled by public-private partnerships. This shift toward hybrid organizational models depends on a particular form of exchange: the sharing of proprietary assets in general and of intellectual property rights in particular. This article explores the paradoxical role of private property in this new configuration of global health research and development. (...) Rather than a tool to block potential competitors, proprietary assets function as a lever to attract others into risky collaborative ventures; instead of demarcating public and private domains, the sharing of property rights is used to increase the porosity of that boundary. This reimagination of the value of property is connected to the peculiar timescape of global health drug development, a promissory orientation to the future that takes its clearest form in the centrality of “virtual” business models and the proliferation of strategies of deferral. Drawing on the anthropological literature on inalienable possessions, we reconsider property’s traditional exclusionary role and discuss the possibility that the new pharmaceutical “commons” proclaimed by contemporary global health partnerships might be the precursor of future enclosures. Drawing on the reinterpretations of Descartes' thought of the past twenty-five years, she shows how Descartes constructs a theory of the mind, the body, nature, and God from a premise of radical uncertainty. This article explores the link between liberalism and biopolitics in Foucault, through the analyses of the 1979 Lecture at the Collège de France The Birth of Biopolitics.

In this paper, I argue for an account of metaphorical content as what is said when a speaker utters a metaphor. First, I show that two other possibilities—the Gricean account of metaphor as implicature and the strictly semantic account developed by Josef Stern—face several serious problems. In their place, I propose an account that takes metaphorical content to cross-cut the semantic-pragmatic distinction. This requires re-thinking the notion of metaphorical content, as well as the relation between the metaphorical and the literal.

In this paper, I intend to show the relevance of Schutz’s account of interpersonal understanding within the context of the contemporary social cognition debate. Currently, the research on the nature of everyday interpersonal understanding is taking place almost exclusively within the field of interdisciplinary cognitive science. Generally speaking, since the mid-nineties the so-called social cognition debate is dominated by two opposed theoretical outlooks which diverge concerning the ultimate mechanisms responsible for our understanding of Others, namely the theory-theory of mind and (...) the simulation theory. Yet, in the last couple of years, there is a phenomenological turn taking place in this debate. Thinkers like Zahavi, Gallagher and Overgaard, among others, return to classical phenomenological accounts of empathy—like those of Husserl, Stein, Scheler and Merleau-Ponty—to propose an alternative theoretical outlook on intersubjective understanding, namely the direct perception theory. However, this recuperation of classical phenomenological approaches to intersubjective comprehension is, to some extent, incomplete. Indeed, DPT supporters tend to neglect the valuable contributions that Schutz made to the study of this problem. This is quite curious, not only because Schutz’s phenomenological theory of interpersonal understanding agrees, to some degree, with the main thesis of the direct perception theory, but also because it contains of insights that may be helpful to formulate a more solid and self-clarified version of it. Resumen En este artículo me propongo revisitar de manera sucinta y sistemática los li-neamientos centrales de la teoría de la subjetividad de Sigmund Freud, persiguiendo el objetivo de mostrar la vigencia filosófica y teórico-social de la misma. Para ello, procedo en tres pasos: en primer lugar expongo el modo en que el autor construye su concepción del "sujeto del Inconsciente" a través de un enfrentamiento con la noción de "sujeto cartesiano". Luego, examino la tensión entre natura y nurtura que puede (...) rastrearse en su tratamiento del problema de la "pulsión" [ Trieb]. Y, finalmente, reseño su descripción de la estructura tripartita del aparato psíquico, poniendo especial énfasis en su noción de la subjetividad escindida y en el análisis del origen intersubjetivo del "Superyó" [Über-Ich].In this paper, I intend to systematically revisit the main lines of Sigmund Freud's theory of subjectivity, with the aim of showing its current relevance within the fields of philosophy and social theory. In order to do so, I will proceed in three steps. First, I will scrutinize the way Freud elaborates his account of the "subject of unconsciousness" arguing against the conception of the "Cartesian subject". Then, I will examine the tension between nature and nurture, which can be found in his treatment of the problem of "drives" [Triebe]. Finally, I will sketch out his description of the three-fold structure of the psychical apparatus, putting special emphasis on his conception of the "split subjectivity" and on his analysis of the intersubjective origin of the Superego [Über-Ich]. In heart, the propagation of electrical activity is mediated by intercellular channels, referred to as junctional channels, aggregated into gap junctions and localised between myocytes. These channels consist of structurally related transmembrane proteins, the connexins, three of which (CX43, CX40 and CX45) have been shown to be associated with the myocytes of mammalian heart; a fourth, CX37, was detected exclusively in endothelial cells. In this paper, we review the recent data dealing with the topographical heterogeneity of expression of these connexins (...) in the different cardiac tissues and the unique conductance properties of the channels they form, and attempt to assess the role played by each connexin and the consequences of their multiplicity in the propagation of action potentials. Bayle, par sa maîtrise de l’écriture cryptée, va faire de ces textes, officiellement de justification et d’autocensure, un plaidoyer pour la liberté de philosopher.Dans ses premiers textes, comme les Pensées diverses sur la comète, il a pratiqué un art d’écrire d’autant plus efficace qu’il était presque revendiqué comme tel dans des « Avis aux lecteurs (...) ». Il appartient en effet à une génération d’écrivains qui tente de donner à un certain public quelques clefs de lecture permettant, en contournant la censure, de faire perdre à celle-ci une partie de sa nocivité et de sa raison d’être. Cette « pédagogie » se déploie dans les Nouvelles de la République des Lettres, dans son Dictionnaire. At Republic 370c–372d, Plato presents us with an early polis that is self-sufficient, peaceful, cooperative, and which provides a comfortable life for its inhabitants. While Glaucon derides this polis as a ‘city for pigs’, Socrates is quick to defend its virtues characterizing it as a city which is not only ‘complete’, but a ‘true’ and ‘healthy’ city. Is Plato sincere when he lauds the city of pigs? if so, why does the city of pigs degenerate so precipitously into the luxurious (...) city? Some commentators have been unable to find any place for the ‘city of pigs’ in the substantive argument of the Republic. Other commentators have supposed that the source of instability in the city of pigs is the nature of human desire. I argue that these interpretations miss what is most deeply interesting about the city of pigs. On my reading, the city of pigs is healthy and true in that it is a unified community. However, this unity depends on good fortune, is highly contingent, and thus unstable. (shrink)

The nursing profession has a responsibility to ensure that nursing goals and perspectives as these have developed over time remain the focus of its work. Explored in this paper is the potential problem for the nursing profession of recognizing both the promises and pitfalls of informational technologies so as to use them wisely in behalf of ethical patient care. We make a normative claim that maintaining a critical stance toward the use of informational technologies in practice and in influencing the (...) thought patterns of the younger generations of nurses is a moral imperative of the discipline, because without this practice can become subverted from professional goals in various ways. We use a synthesized concept we call “intentional authenticity” derived from the writing of Heidegger and Feminist care ethics to provide a foundation for the development of nurses who understand the importance of the nurse‐patient relationship and how the unthoughtful use of informational and other technologies can militate against effective or good nursing care. There is a broad consensus that the study of social institutions is one of the fundamental concerns of the social sciences. The idea that phenomenology has ignored this topic is also widely accepted. As against this view, the present paper aims at demonstrating that especially Schutzian phenomenology—that is, the social-phenomenological tradition started by Alfred Schutz and continued by Thomas Luckmann and Peter Berger, among others—provides rich insights on the nature and workings of social institutions that could contribute to enriching the (...) current social-scientific debate on the issue. Approaches to this complicated directive frequently envision rhetoric as a mediating force among agentive subjects who act within well-defined political economic landscapes. Wedded to a political-communicative model wherein appropriate rhetorical choices persuade those with authority to distribute disputed political and economic rights, rhetorical theory becomes a sophisticated handbook for discovering topoi and executing decorous statements. This focus, according to Ronald Walter Greene, results in a "permanent anxiety over the meaning and potential of rhetorical agency" that positions rhetoricians as "moral entrepreneurs scolding, correcting, and encouraging the body politic" (2004, 188, 189). Committing themselves to endless debates about correct responses in situated spaces, rhetorical theories that underscore agency lose site of the world in flux and of our participation in that world's unpredictable unfoldings. Alternatively, Greene suggests rethinking rhetorical theory through a materialist-communicative model wherein the immaterial labor of communication produces value. Conceptualizing discursive practices as a form of labor rather than a form of political signification sidesteps anxiety about well-chosen language and emphasizes the life-affirming activity involved in deciphering issues, inventing paths through those issues, and communicating new ideas to others. In short, Greene's materialist model challenges critical rhetoricians to end their perennial search for a discursive key to the storehouse of political economic goods (a practice propelled by liberal democratic hopes) so that they can begin to invent analyses and modes of production better suited to the contours of contemporary neoliberalism.Unlike liberalism's clearly assigned spaces for public life and private life or work time and leisure time, neoliberal spaces bear few obvious markers. The neoliberal landscape consists of blurred boundaries that fold into one another: information flows almost instantaneously, commodities and people transgress national boundaries, time accelerates, space collapses, and distinctions between such classic demarcations as agent and subject or politics and economics erode. Facilitated by dramatic changes in our sociopolitical boundaries, economic neoliberalism, what James Arnt Aune calls "economic correctness" (2001), reigns throughout vast uneven terrains opened up from the imploded borders of our liberal world. While economics does indeed rule the neoliberal landscape, it does not do so according to uncompromising rationalism. Political and cultural practices flowing into the previously segregated spaces of economics enable market rule through logics that operate entirely outside the rational-irrational divide. Economic neoliberalism moves from situation to situation, disregarding spatial boundaries between the political, economic, [End Page 2] and cultural realms as well as their attendant modes of persuasion, wearing away at the rhetorical linkages between appropriate discursive choices and agentive power.Regardless of the particularities of neoliberalism's spaces, structures, and governing practices, many rhetoricians continue to mediate among different worldviews based on outmoded liberal gauges. Some rhetorical theorists, for instance, maintain that the problematics of neoliberalism result from an imbalance between reason and passion. Even though the most ardent supporters of neoliberal practices hold firmly to a belief in its scientific rationality, rhetorical theorists often argue that passion overpowers reason in neoliberal discourse. The rhetorical form that sustains this disequilibrium is, according to Bradford Vivian, neoliberal epideictic. Based on an impassioned identification, epideictic texts "unite an otherwise fractured citizenry in a dynamic affective experience" (Vivian 2006, 15).
