Is contemporary continental philosophy making a break with Kant? The structures of knowledge, taken for granted since Kants Critique of Pure Reason, are now being called into question: the finitude of the subject, the phenomenal given, a priori synthesis. Relinquish the transcendental: such is the imperative of postcritical thinking in the 21st century. Questions that we no longer thought it possible to ask now reemerge with renewed vigor: can Kant really maintain the difference between a priori and innate? Can he (...) deduce, rather than impose, the categories, or justify the necessity of nature? Recent research into brain development aggravates these suspicions, which measure transcendental idealism against the thesis of a biological origin for cognitive processes. In her important new book Catherine Malabou lays out Kants response to his posterity. True to its subject, the book evolves as an epigenesis – the differentiated growth of the embryo – for, as those who know how to read critical philosophy affirm, this is the very life of the transcendental and contains the promise of its transformation. In many diagrams one seems to perceive necessity – one sees not only that something is so, but that it must be so. That conflicts with a certain empiricism largely taken for granted in contemporary philosophy, which believes perception is not capable of such feats. The reason for this belief is often thought well-summarized in Hume's maxim: ‘there are no necessary connections between distinct existences’. It is also thought that even if there were such necessities, perception is too passive or (...) localized a faculty to register them. We defend the perception of necessity against such Humeanism, drawing on examples from mathematics. (shrink)

The fallacies approach to argument evaluation can exacerbate problems it aims to address when it comes to social bias, perpetuating social injustice. A diagnosis that an argument commits a fallacy may flag the irrelevance of stereotypical characterizations to the line of reasoning without directly challenging the stereotypes. This becomes most apparent when personal bias is part of the subject matter under discussion, in ethotic argument, including ad hominem and ad verecundiam, which may be recognized as fallacious without addressing whether the (...) ethotic presumptions are true. Yap (2013; 2015) makes this case for ad hominem and the pragma-dialectical understanding of fallacies, expanded here to show related patterns in some other fallacies, and employing the argument schemes understanding of fallacies. Adding critical questions increases the ways reasoners can dismiss arguments as fallacious, and could include directly addressing bias, but if an argument fails on a different critical question, that may yet allow the bias to pass. The fallacies approach is a form of meta-debate and techniques of meta-debate need to address the ubiquity of social bias, not convey them as specialized problems. The view that the fallacies approach to argument evaluation can provide neutrality is dangerously false. Arguers thus should avoid using fallacies for argument evaluation where social stereotypes or schemas might be involved, especially when the subject matter relates closely to social justice. The discourse inside and outside of sport in Australia and abroad on the participation of transgender women in female sport focuses on the principles of fairness, equity and the safety of competitors. These concerns commonly materialise (with little evidence) labelling transgender women as ‘cheats’, dominating female sport, strategically being coached in collision sports to intentionally hurt opponents or fraudulently transitioning with the sole aim of competing in elite women’s sport. Our research examines the process by which the Australian Football League (...) (AFL) grappled with these competing narratives in developing a policy to permit the participation of transgender and gender diverse athletes in community and ‘elite’ competitions. It will be argued that the initial AFL process lacked consideration of the human rights of transgender women and did not provide the necessary resources required to ensure a safe and inclusive process for transgender women to engage with the AFLW competition. This article will also identify lessons which other sport governing organisations should heed in developing and implementing policies for the inclusion of transgender women in sport. (shrink)

ABSTRACT Understanding how extremist Salafists communicate, and not only what, is key to gaining insights into the ways they construct their social order and use psychological forces to radicalize potential sympathizers on social media. With a view to contributing to the existing body of research which mainly focuses on terrorist organizations, we analyzed accounts that advocate violent jihad without supporting any terrorist group and hence might be able to reach a large and not yet radicalized audience. We constructed a critical (...) multimodal and multidisciplinary framework of discourse patterns that may work as potential triggers to a selection of key cognitive biases and we applied it to a corpus of Facebook posts published by seven extremist Salafists. Results reveal how these posts are either based on an intense crisis construct or on simplistic solutions composed of taken-for-granted statements. Devoid of any grey zone, these posts do not seek to convince the reader; polarization is framed as a presuppositional established reality. These observations reveal that extremist Salafist communication is constructed in a way that may trigger specific cognitive biases, which are discussed in the paper. (shrink)

Human UDP‐glucuronosyltransferases (UDPGTs) are a family of enzymes which detoxify many hundreds of compounds by their conjugation to glucuronic acid, rendering them both harmless and more water soluble, hence, excretable. The level of expression of each UDPGT isoform in the body is the result of interplay between temporal, tissue‐specific and environmental regulators. This complexity contributes to the difficulty in predicting the metabolic fate of compounds.Genetic defects and polymorphisms affecting individual isoform activities have deleterious and potentially lethal effects, as exemplified by (...) the severe hyperbilirubinaemia observed in Crigler‐Najjar Syndrome. Such severe genetic defects in bilirubin glucuronidation are obvious candidates for antenatal screening and gene therapy. (shrink)

Cet article fournit les principaux résultats de la mission effectuée en mai 2011 dans le cadre du projet concernant la sculpture architecturale byzantine de la côte occidentale de la mer Noire. La première partie présente et décrit les ensembles architecturaux d’où proviennent les sculptures sur lesquelles ont été prélevés des échantillons de marbre. La seconde partie a trait aux caractéristiques spécifiques des marbres analysés : vingt échantillons de marbre prélevés sur des sculptures provenant surtout de Sozopol, mais aussi d’Obzor et (...) de Pomorie, ont été analysés afin de connaître leur provenance. Les différentes méthodes d’analyses ont montré que la majorité des échantillons étaient issus de l’île de Proconnèse. Néanmoins, quatre des vingt échantillons présentent une composition minéralogique et chimique différente de celle des marbres de Proconnèse : deux sont en marbre pentélique, un autre en marbre de Thasos et le dernier est très probablement en marbre local. It draws not only on feminist philosophers but criticizes, approves, or appropriates the work of the leading philosophers of all times.

La question de la cohérence de la théorie rawlsienne de la justice et de son tournant politique a été depuis longtemps une source de débats et de malentendus. Pour certains interprètes, l’abandon par le second Rawls d’un fondement kantien des principes de justice au profit d’un libéralisme purement politique serait un prix trop élevé à payer pour obtenir un large consensus sur des principes de justice dans des sociétés démocratiques traversées par des conflits de valeurs insurmontables. « La vérité dérangeante (...) ( inconvenient truth ) que Rawls découvre est qu’il est impossible, écrit Robert Taylor (2011), de parvenir à un consensus par recoupement sur une conception kantienne de la personne ou plus largement sur la justice comme équité », mais qu’en même temps, sans un tel fondement, la force morale de la théorie de la justice serait diluée. Dans cet article, je voudrais répondre à ces critiques et montrer que, bien loin de conduire au relativisme, l’exigence d’autonomie doctrinale et d’indépendance des principes de justice à l’égard de toute conception substantielle du Bien exprimée par Rawls ( Libéralisme politique, p. 133) exprime le sens qu’a pour lui l’idéal démocratique : le respect pour l’autonomie morale des personnes et le rejet de « la pratique séculaire de l’intolérance comme condition nécessaire à l’ordre et à la stabilité de la société » ( Libéralisme politique, p. 14). Mais un tel idéal n’est-il pas irréaliste? Faire ainsi confiance à l’autonomie des citoyens, à leur capacité à distinguer entre leurs doctrines morales personnelles et des principes publics de justice ( Libéralisme politique, p. 7) ne risque-t‑il pas d’affaiblir les démocraties au lieu de garantir leur stabilité, comme l’espère Rawls ( Libéralisme politique, p. 4)? Cette ambition d’autonomie doctrinale est-elle une force ou une faiblesse de la théorie rawlsienne? (shrink)

As men and women increasingly share access to state power, there has been a question of whether women’s rising descriptive representation leads to substantive change, and a sizable body of literature suggests it does. As a mechanism for this effect, I theorize legislatures as gendered organizations that build gender into their institutional operation, as enmeshed in legislative committee systems. Using case studies of Germany, Sweden, and the United States, I examine 40 years of data collected on legislative committees and memberships. (...) This study reveals some similarities, where all committee systems emphasize gender-typed roles, particularly female legislators’ greater segregation into social issue committees. Yet, gender is constructed differentially across these organizations, and the nations vary in the gender structure of their committee systems, degree of gender segregation and typing, and gendered relations of power and prestige. Implications for integrating theories of gender as an institution, gendered organizations, and feminist institutionalism are discussed. (shrink)

Manuscripts and notes by Michel Foucault on the visual arts recently deposited at the Bibliothèque Nationale reveal a reliance on canonical oil paintings by the ‘old masters’; a respect for the primary sources in the history of European art; an understanding of the necessity of research in both literary and visual sources, particularly self-portraits; and a sense of the value that a certain philosophical milieu – beginning with Sade and Nietzsche and expanding to his near contemporaries, Bataille, Blanchot, and Klossowski (...) – could offer to an understanding of paintings. The essay argues that Pierre Klossowski’s monumental drawing La Nef des fous (1990) provides an essential key for understanding the place of Hieronymus Bosch’s painting of the same title in History of Madness and the centrality of theories of similitude to Foucault’s thinking about visuality ca. 1960–74. The later significance of the figure of the artist for Foucault can be traced to these earlier writings on painting and madness. (shrink)

What is philosophically interesting about how soil is managed and categorized? This paper begins by investigating how different soil ontologies develop and change as they are used within different social communities. Analyzing empirical evidence from soil science, ethnopedology, sociology, and agricultural extension reveals that efforts to categorize soil are not limited to current scientific soil classifications but also include those based in social ontologies of soil. I examine three of these soil social ontologies: (1) local and Indigenous classifications farmers and (...) farming communities use to conceptualize their relationships with soil in their fields; (2) categorizations ascribed to farmers in virtue of their agricultural goals and economic priorities relied upon in sociological research; and (3) federal agency classifications of land capability employed by agricultural scientists. Studying the interplay of these social ontologies shows how assessing soil properties and capabilities are the result of previous agricultural strategies informed by culture, agroecological history, weather, soil biodiversity, crop rotation, and the goals held by decision-makers. The paper then identifies the soil relationships and interactions that constitute ontology-making activities. Building on recent work, I outline a novel interactive account of perspectival realism grounded in agricultural extension research and ethnopedological data that captures the haptic nature of farmers’ soil strategies. This interactive account explains how ontologies are chosen, why they are chosen, and how they interact and inform soil management decision-making. The paper concludes by examining the values laden in these ontologies and those which are causally implicated in the choice of soil management strategies. (shrink)

Cet article propose une analyse de la bifurcation à partir d’un corpus d’une soixantaine de récits de vie recueillis auprès de personnes en réorientation professionnelle. La reconversion professionnelle volontaire appréhendée comme une situation choisie par l’individu montre des cassures dans les trajectoires biographiques marquées par des changements d’univers professionnels, des ruptures familiales, un éclatement de la sphère relationnelle, et une perte de repères du soi. La thèse soumise ici est que le sens de l’événement n’est interprétable qu’à l’intérieur d’une biographie (...) particulière, elle-même inscrite dans un plan de sens à géométrie variable défini par des conditions objectives de contexte où les événements surviennent et déclenchent la réinterprétation du sens, imprimant une direction au devenir de la trajectoire. Le sens semble révisable à l’infini, il est contingent dans la bifurcation du regard porté par les autruis significatifs tour à tour déclencheurs ou soutiens de la reconversion professionnelle volontaire.This article examines the biographical change of direction based on a corpus of about sixty life stories of people undergoing professional reorientation. The professional retraining is regarded as a situation chosen by the individual and shows fissures in the biographical course marked by changes in the professional environments, divorce, a break in the relational sphere and a loss of oneself. The thesis supported in the present article is that the events can be interpreted only in the light of one particular biography, inscribed in the interpretation framework of the variable geometry defined by contextual objective conditions. The events occur and start the reinterpretation of the meaning in an already defined direction. The sense seems always revisable and contingent upon the evaluation of significant others, who support or even trigger off the voluntary professional retraining. (shrink)

This project explored what constitutes “ethical practice of mathematics”. Thematic analysis of ethical practice standards from mathematics-adjacent disciplines (statistics and computing), were combined with two organizational codes of conduct and community input resulting in over 100 items. These analyses identified 29 of the 52 items in the 2018 American Statistical Association Ethical Guidelines for Statistical Practice, and 15 of the 24 additional (unique) items from the 2018 Association of Computing Machinery Code of Ethics for inclusion. Three of the 29 items (...) synthesized from the 2019 American Mathematical Society Code of Ethics, and zero of the Mathematical Association of America Code of Ethics, were identified as reflective of “ethical mathematical practice” beyond items already identified from the other two codes. The community contributed six unique items. Item stems were standardized to, “The ethical mathematics practitioner…”. Invitations to complete the 30-min online survey were shared nationally (US) via Mathematics organization listservs and other widespread emails and announcements. We received 142 individual responses to the national survey, 75% of whom endorsed 41/52 items, with 90–100% endorsing 20/52 items on the survey. Items from different sources were endorsed at both high and low rates. A final thematic analysis yielded 44 items, grouped into “General” (12 items), “Profession” (10 items) and “Scholarship” (11 items). Moreover, for the practitioner in a leader/mentor/supervisor/instructor role, there are an additional 11 items (4 General/7 Professional). These results suggest that the community perceives a much wider range of behaviors by mathematicians to be subject to ethical practice standards than had been previously included in professional organization codes. The results provide evidence against the argument that mathematics practitioners engaged in “pure” or “theoretical” work have minimal, small, or no ethical obligations. (shrink)

This article investigates Heidegger's views on technology, specifically focussing on whether it is possible to fit Heidegger's ideas into an ecologically minded framework. The author concludes that the question of what we should do in the wake of the technological crisis we face is inappropriate in terms of Heidegger's philosophy, since he proposes that we should first tackle the question “What should we think?”. At the core of the tort preemption cases before the U.S. Supreme Court is the extent to which state law can impose more stringent liability standards than federal law. The express preemption cases focus on whether the state law requirements are “different from, or in addition to” the federally imposed requirements. And the implied conflict preemption cases examine whether the state law standards are incompatible or at least at odds with the federal regulatory scheme. But the preemption cases in the (...) appellate pipeline - what I shall term the “second wave” of preemption cases - address a separate analytic question. Their focus is less on the substantive aspects of regulatory standards, and more on their enforcement. When can state tort law impose substantive duties or obligations that are “parallel” to federal requirements without thereby encroaching upon a federal agency’s discretionary enforcement prerogative? This is the new frontier in products liability preemption. My proposed model suggests that courts facing these new issues should solicit input from federal agencies before resolving them. The model thereby offers a hybrid private-public model for the regulation of health and safety. It advocates an extension of my “agency reference model” to the “enforcement preemption” context: courts should place more emphasis on FDA input when deciding whether tort requirements are “parallel” to federal dictates, and whether, even if they are, they nonetheless infringe on the federal agency’s discretionary enforcement prerogatives. Courts would thus seek guidance from federal agencies to determine whether a private right of action exists for the enforcement, via state law claims, of federal regulations. (shrink)

Previous studies (Salmon 1999; Salmon and Daly 1998) have found that sex and birth order are strong predictors of familial sentiments. Middleborns tend to be less family-oriented than firstborns or lastborns, while sex differences seem to focus on the utility of kin in certain domains. If this is a reflection of middleborns receiving a lesser degree of support from kin (particularly in terms of parental investment), are middleborns turning to reciprocal alliances outside the family, becoming friendship specialists? Are there comparable (...) birth order differences with respect to mating strategies? In this study, the impact of birth order on attitudes toward family, friends, and mating were examined. Two hundred and forty-five undergraduates completed a questionnaire relating to their attitudes toward friends and family as well as some aspects of mating behavior. Birth order did have a significant impact in several areas. Middleborns expressed more positive views toward friends and less positive opinions of family in general. They were less inclined to help family in need than firstborns or lastborns. Mating strategies also appeared to be influenced by birth order, most notably in the area of infidelity, with middleborns being the least likely birth order to cheat on a sexual partner. (shrink)
