Preserving dignity during the dying process requires reviewing the roles of those involved in the treatment, care methods and decision-making. This article examines the participation and responsibility assigned to nurses regarding decision-making in the final stages of life, as laid out in the Rights to and Guarantee of Dignity for the Individual During the Process of Death Act. This text has been analysed on the levels of socio-cultural practice and discourse practice, using the critical discourse analysis methodology. The lysine demethylase KDM5A collaborates with PARP1 and the histone variant macroH2A1.2 to modulate chromatin to promote DNA repair. Indeed, KDM5A engages poly(ADP‐ribose) (PAR) chains at damage sites through a previously uncharacterized coiled‐coil domain, a novel binding mode for PAR interactions. While KDM5A is a well‐known transcriptional regulator, its function in DNA repair is only now emerging. Here we review the molecular mechanisms that regulate this PARP1‐macroH2A1.2‐KDM5A axis in DNA damage and consider the potential involvement of this pathway in transcription (...) regulation and cancer. Using KDM5A as an example, we discuss how multifunctional chromatin proteins transition between several DNA‐based processes, which must be coordinated to protect the integrity of the genome and epigenome. The dysregulation of chromatin and loss of genome integrity that is prevalent in human diseases including cancer may be related and could provide opportunities to target multitasking proteins with these pathways as therapeutic strategies. El presente ensayo se propone examinar cómo los individuos en contextos de confinamiento carcelario - quienes han contribuido activamente en el desarrollo de esta investigación - pueden no solo experimentar la libertad de manera gradual, sino también producir libertad creadora a través de un proceso dialéctico en relación con su pasado, presente y futuro; y cómo este último –al que le daremos una mayor preponderancia– tiene como elemento inherente el potencial de transformar ontológicamente su existencia. Para ello, nos basamos en (...) tres tesis fundamentales: la idea de "libertad" en Jean-Paul Sartre, el "hombre histórico" en Friedrich Nietzsche y el concepto de "ser de lejanías" de Vicente Fatone. La imbricación de estas perspectivas permite comprender cómo una persona en un entorno de confinamiento puede desarrollar una libertad ontológica que trasciende las limitaciones ónticas y deterministas de su situación, modificando su ser y proyectándose hacia un futuro distinto. Does the board of directors influence cost of debt financing? This study of a sample of Spanish listed companies during the period 2004-2007 provides some evidence about the question. The results suggest that two board attributes - director ownership and board activity - appear to influence in the risk assessment of debtholders because of their ability to reduce agency cost and information asymmetry. We also find a non-linear relationship between board size and cost of debt, suggesting that from certain levels (...) the benefits of large boards may be outweighed by the cost of poorer communication and increased decision-making time. Este trabajo analiza las fórmulas predominantes para la formación de la propiedad inmobiliaria eclesiástica en Sevilla entre los siglos xiii y xv, a partir de los datos de instituciones, como la Catedral, la colegial del Salvador, conventos y hospitales. En la citada formación tuvieron un papel importante las donaciones, pero en algunos casos predominaron las compras o las transmisiones hereditarias. En el caso de las donaciones, se analiza la procedencia social de los donantes.

Situados en un progresivo traspaso de responsabilidades en la ejecución de los servicios sociales desde el Estado hacia actores no gubernamentales, aparece una demanda hacia el mismo Estado, el cual en lugar de simplemente declinar su labor, debiera de hecho expandir su regulación de modo de asegurar que la oferta social sea eficiente en satisfacer al ciudadano usuario en aquellos servicios prometidos por las políticas y programas sociales. Así mismo, la institucionalidad pública debiera reconocer las demandas del mundo privado para (...) actuar articuladamente hacia fines comunes, que finalmente conduzcan a un horizonte de desarrollo de una sociedad más igualitaria. Este estudio da cuenta de las tensiones, reveladas por autoridades de servicios públicos que atienden personas vulnerables, en su relación de colaboración con OSFL (Organizaciones Sin Fines de Lucro), para alcanzar tal horizonte. La vigilancia tecnológica, que comienza como un mecanismo empresarial de captación y fidelización clientelar, ha conocido un desarrollo tecnológico tal que, junto a la obtención masiva de datos producidos de forma inconsciente y su tratamiento por la inteligencia artificial, ha permitido la anticipación de las tendencias y la supervisión constante de los deseos e intereses de los usuarios. La integración de vigilancia y consumo ha supuesto que esta lógica del mercado pueda ser entregada a la gubernamentalidad, transformando la racionalidad disciplinaria (...) estática en múltiples dinámicas de observación de una población móvil pero controlable en términos biopolíticos, de modo que el deseo y la libertad se convierten así en dimensiones activas de una economía política actual. Se ofrecen algunos ejemplos de este auténtico panoptismo digital, como puede comprobarse con el uso de navegadores, las aplicaciones financieras, la hipersegmentación de nichos de consumo o el internet de las cosas. Por último, se analiza el tránsito de esta vigilancia hacia una lógica de gobierno basada en la predeterminación de los intereses: es el paso del panoptismo a la gubernamentalidad. (shrink)

El impacto generado por Vigilar y castigar no ha dejado de crecer desde su aparición en 1975. En este artículo se abordan las estrategias de investigación que subyacen a su análisis de la prisión, la cual pasó en poco tiempo de ser un elemento marginal de la penalidad a constituir la forma privilegiada de castigo. La hipótesis de Foucault es que su rápida aceptación por parte del sistema jurídico se debe a la generalización previa de las disciplinas esparcidas por todo (...) el cuerpo social. El problema estriba en que una hipótesis como esta, pese a su evidente originalidad, alberga sin embargo un defecto constitutivo en el análisis propuesto, al no explicitar las precondiciones que hicieron posible dicho proceso. El propósito del artículo es identificarlas en el análisis de Marx en torno a la acumulación originaria. De esa manera, destacamos los elementos de agregación y complementación, así como las posibles disputas entre ambos autores, logrando postular cómo se enmarca la microfísica del poder en la generalización de la forma mercancía y el dominio del capital. This research presents an educational experience that was developed in a private university in Santiago of Chile. The problematic issues respond to the need of tense the role of the literature in the formal education and the transforming capacity through its creative potential. The general objective is to analyze the didactic process of the lecture connecting the artistic products that students created, in a dramatic writing project context, supported by The Literary Education as an emerging paradigm.

The peculiarity of the Nietschean notion of the will to power is his definition as an activity of continuous opposition of forces by which the living organizes itself in relations of dominance and obedience, trying not only to preserve itself but, above all, to overcome itself. This is the very politics of life that governs the processes of individuation, the conquest of freedom and cultural creativity that makes us advance and rise to higher forms of existence. This article tries to (...) clarify in what sense the originality of the Nietzschean Grosse Politik lies in the attempt to develop the way in which impulse psychophysiology allows to reformulate the transvaluation and elevation of the human type and culture. The inspiration in Plato of this project is analyzed, the counterpoint that the ethical-political approaches of Kant and Hegel represent for him, and the aporias of its practical implantation against the modern democratic systems with which Nietzsche debates. There is an increasing demand for ethical and Corporate Social Responsibility practices by companies. This competence has to be introduced in students’ training in business degree programs, and a check must then be done to determine if the students have come to appreciate the importance of CSR commitments. Using the framework of Stakeholders Theory, this work aims to examine students’ perceptions of ethical and CSR practices and commitment to different stakeholders, as well as the factors that lead students to act (...) in a socially responsible way. Furthermore, we hope to identify how the perception of CSR can be improved when Web 2.0 and social media tools that have proven effective in transmitting emotions and values are used in classrooms to teach these ideas. To this end, a survey was carried out in the year 2019 with 1,030 first-year students; it was administered at the beginning of the semester and also at the end of the semester after the training activities had been carried out. The main finding of the research is that students start with the belief that ethics and CSR are developed for reasons of image and legitimacy; however, after receiving training on these topics through tools that take into account emotions and values, they start to value the importance of the company as an agent of social change. The main practical and managerial implication is that methods based on Web 2.0 and social media tools are useful to teach ethics and CSR; the theoretical contribution is that students take into account the welfare of others. This finding contributes to Stakeholder Theory in a higher education context. (shrink)

“Conciencia”, la sección inicial de la Fenomenología de Hegel, se ocupa de la comprensión del mundo físico que nos rodea. La sección siguiente, “Autoconciencia”, comienza a considerar nuestra comprensión de nosotros mismos y de los otros. Este orden de discusión no es ni arbitrario ni meramente conveniente. Por el contrario, una de las principales lecciones que hemos de aprender hacia el final del desarrollo de la “conciencia” es que nuestra mejor concepción del mundo que es el objeto de nuestras actividades (...) cognitivas es inteligible solo como una parte de un relato que además considera la naturaleza del sujeto que se dedica a tales actividades. La razón para esta transición expositiva es un aspecto importante en el idealismo de Hegel. En este capítulo ofrezco una reconstrucción racional de un argumento que veo como el soporte de esta transición y del tipo de idealismo que esta implica. (shrink)

El presente trabajo explora la postura bergsoniana en torno a la imagen, toda vez que es constituida, de fondo, por la pregunta ¿qué se puede conocer? A propósito del tema Bergson se ubica en un punto intermedio entre el idealismo y el realismo, considera que la imagen es aquello que es más que una representación pero menos que la cosa en sí que el realismo pretende mostrar como objeto de conocimiento. La comprensión de la imagen no sólo lleva a escenarios (...) epistemológicos, también posibilita observar que ahí donde hay una perspectiva ocurre un enfoque interesado de cierto tema. De tal forma que la relación objeto-sujeto se ve trastocada por la implementación de la imagen, como disposición afectiva del mundo que rodea al humano. Si sólo se conocen imágenes, la pertinencia de las distintas ramas científicas cambia según estas estudien imágenes interiores o exteriores. Para nada la actividad mental, puede ser el propiciador de las imágenes mentales, únicamente es una imagen más del conjunto de imágenes. En lo subsecuente, habrá un desarrollo del conocimiento de las imágenes, una propuesta teórica que ofrece una posibilidad distinta a la científica, pero que no es contradictoria. En este trabajo presento las líneas fundamentales de una fenomenología de la expresión tomando como punto de partida los desarrollos de Edith Stein sobre el tema. En efecto, el cuerpo vivo o propio (Leib) ocupa un lugar importante en sus primeras obras, en especial en su tesis doctoral Zum Problem der Einfhülung. El cuerpo está directamente ligado al problema de la empatía, mantiene un vínculo esencial con los fenómenos vitales, con los sentimientos en distintos niveles y todo ello aparece manifiesto (...) en el fenómeno de la expresión. El cuerpo expresa, pero ¿cómo es posible este fenómeno? ¿Qué elementos constitutivos de la persona están en juego en el fenómeno de la expresión? ¿Qué importancia tiene este fenómeno para un abordaje profundo de la intersubjetividad mediado o fundado en la experiencia de los otros? ¿Existe alguna relación entre el fenómeno de la expresión y la individualidad personal? RESUMEN: Este trabajo centra la atención en las características formales de la ley humana en el pensamiento de Juan de Mariana. En él se ofrece una presentación general de aquellas, acompañada de algunas circunstancias de la época. A continuación se trata de determinar la intención del autor en sus desarrollos y se analizan sus aportaciones, tanto desde la perspectiva del pensamiento ilustrado como desde el iusfilosófico de nuestro tiempo. Todo ello evidencia puntos de encuentro, pero también diferencias relevantes. El estudio (...) repara además en la aportación de los aspectos considerados en los ámbitos de la limitación al poder y la justicia. ABSTRACT: This article considers the formal characteristics of human law in the thought of Juan de Mariana. After a general introduction to those characteristics, accompanied by some contextual background, an attempt is made to ascertain the author’s intentions as his thought developed and to analyse his particular contribution to the matter through the double optic of enlightenment thought on the one hand, and contemporary jusphilosophy on the other. Some points of connection are found, but also various significant differences. At the same time, the article also gives some thought to the contribution made by the various aspects under consideration in the fields of justice and of the restriction of power. (shrink)
